Tenders duly filled in, along with EMD, will be received in the Board’s Office address mentioned above, on or before 13-08-2012 upto 4.00 PM and shall be opened on 14-08-2012 at 12.30 pm in the Board’s Office mentioned above, in the presence of the available tenderers.

KARNATAKA STATE UNORGANISED WORKERS SOCIAL SECURITY BOARD

PART-I

Preamble

1. Tenders under two cover system i.e. Technical Bid (Pre-Qualification Requirements) and Financial Bid, duly signed by the Authorised Signatory of the Man Power Supply Agency will be received by the Joint Secretary of the Board for the following:

2. Nature of Service: To carry out the awarded work at the Board Office, Bangalore, as

per Annexure-A

3. Period of Agreement: Twenty Four Months from the date of signing the agreement.

4. Tender shall accompany an Earnest Money Deposit (i.e. EMD) of Rs.85178/- (rounded off) in the form of a D.D. in favour of Joint Secretary, Karnataka State Unorganised Workers Social Security Board payable at Bangalore. Tenders without EMD will not be accepted. The EMD shall not carry any interest.

5. The Tenders shall be submitted to the Office of the Joint Secretary, Karnataka State Unorganised Workers Social Security Board, “ Karmika Bhavan ”, ITI Compound, Bannerughatta Road, Bangalore-560 029. before the time and date stipulated herein. The tenders shall be submitted in two separate sealed covers as under:

i) One cover meant for Technical Bid (Pre-qualification requirements) shall be duly superscribed as “Tender for carrying out the awarded work at the Board’s Office Bangalore- Technical Bid” and addressed to the Joint Secretary, Karnataka State Unorganised Workers Social Security Board, “ Karmika Bhavan ”, ITI Compound, Bannerughatta Road, Bangalore-560 029.

ii) Another cover meant for Financial Bid shall be duly superscribed as “Tender for carrying out the awarded work at the Board’s Office, Bangalore- Financial Bid” and addressed to the Joint Secretary, Karnataka State Unorganised Workers Social Security Board, “

iii) And that both these covers shall be put in a separate envelope and the envelope shall be addressed to the Joint Secretary, Karnataka State Unorganised Workers Social Security Board, “ Karmika Bhavan ”, Bannerughatta Road, Bangalore-560 029. and the said envelope shall be duly superscribed as “Tender for carrying out the awarded work at the Board’s Office, Bangalore.”

iv) The Tenders shall be signed by the authorised person duly affixing the office seal.

6. Tenders will be opened in the presence of available tenderers or the persons authorised by them in writing on the date and time specified herein.

7. The rates in the tender must be written in ink or typewritten both in words and figures.

Pre-Qualification Requirements (i.e. Technical Bid)

1. The tenderer shall have an experience of running the manpower supply agency for the past three years from the date of this tender notification. The relevant proof in Xerox form duly attested, shall be submitted along with the Technical Bid & the originals shall be produced at the time of opening of the Technical Bid.

2. The tenderer shall have experience of having provided similar service to at least three reputed organizations, preferably govt. organizations for a duration of at least one year. The relevant Xerox copies of work order shall be submitted along with the Technical Bid & the originals shall be produced at the time of opening of the Technical Bid.

3. The annual turn-over of the Agency shall not be less than Rs.1 Crore during any one year of the last two financial years (i.e. years 2010-11 and 2011-12). The relevant proof in this regard by way of audited Annual Accounts certified by a Chartered Accountant shall be submitted with the Technical Bid in Xerox format & the originals shall be produced at the time of opening of the Technical Bid. 4. The tenderer shall have already registered their firm with ESI, PF, PT, State Labour Department, Service Tax authorities and any other Government Departments as the Statutory requirements and shall also have PAN from I.T Dept. The Xerox copies of these registration documents along with the I.T returns for the last 2 years shall be submitted with the Technical Bid & the originals shall be produced at the time of opening of the Technical Bid.

5. The tenderer shall supply the manpower specified in this tender , as and when indented by the tendering authority, so that he/she shall be in a position to carry out the awarded work without any loss

of time immediately after finalisation of agreement. The list of Manpower required as per this tender document mentioning therein their qualifications, addresses and the date of their registrations with the tenderer’s firm/establishment shall be necessarily produced at the time of opening of the Technical Bid.

6. The age group of the outsourced staff to be deployed by the Agency shall range from 21 years and 40 years and applicable to specific roles as mentioned in Annexure-A.

7. The agencies which do not meet the above pre-qualifying requirements will be automatically disqualified from participating in the second round of the bid i.e. the Financial Bid.

General Information 1. The “Board” means “Karnataka State Unorganised Workers’

Social Security Board, Karmika Bhavan, ITI Compound, Bannerughatta Road, Bangalore-560029” represented by the Joint Secretary of the Board.

2. Secretary means Secretary to Government, Department of Labour and Member Secretary, Karnataka State Unorganised Workers’ Social Security Board.

3. The “Joint Secretary” means the “Joint Secretary of the Board.”

4. The word “Agreement” means “a written agreement on a non-judicial stamp paper of Rs.200/- between the Board and the successful tenderer stipulating the terms and conditions governing the tender.”

5. The word “Work Order” means “the order issued by the Board to the successful tenderer to carry out the awarded work for the prescribed period.

Other Terms & Conditions

1. Tenders shall be valid for ninety days from the date of opening of the Financial Bid.

2. Alternative tender/s will not be considered.

3. Tender document is non-transferable.

4. Conditional tenders are liable for rejection.

5. The successful tenderer shall enter into a contract agreement on a non-judicial stamp paper of Rs.200/- only (Rupees Two hundred only) for due performance of the contract.

6. The right to reject any or all tenders without assigning any reason is reserved with the Joint Secretary. No correspondence in this regard shall be entertained.

i] The tenderer shall quote monthly rate in the Annexure-A which shall include all costs for the services to be rendered and no other payment shall be permissible.

ii] The bid of the Agency which is below the prescribed rate i.e. wages fixed including payment of ESI, PF, Service Tax, Bonus, shall be liable to be rejected. The break-up of the prescribed rate is as per the Annexure – A of the Tender Document.

iii] No escalation in rates by the successful tenderers on any account in any form, shall be entertained by the Board during the agreement period, for whatsoever reason.

7. The Agency shall be responsible to comply all statutory obligations such as remittances of Service Tax. ESI/PF etc, in respect of the outsourced staff deployed by it.

8. The outsourced staff deployed by the Agency shall be the employees of the Agency only.

9. The Board shall not be responsible for any un-authorised acts and omissions of the outsourced staff.

10. The Board shall not be responsible for any damage/injury sustained by outsourced staff of the Agency during the course and arising out of their work/duty in and around the office premises.

11. i] The Agency shall make the payment of wages/salaries and other statutory benefits to the outsourced staff through A/c payee crossed cheque only/or remit it in their bank accounts.

ii] The Agency shall arrange to pay all statutory deductions like ESI/PF, Service Tax to the designated authorities at the notified rates along with the Agency’s contribution as per law, wherever applicable. The Agency shall also produce the copies of remittance challans for having paid above such contributions of the outsourced employees along with Agency’s contribution to the authorities concerned from time to time.

iii] The PF/ESI numbers of each outsourced staff, deployed by

the Agency, shall be intimated to the Board.

12. The successful Agency shall have obtained licence as required under the Contract Labour (Regulation and Abolition) Act, 1970 and Karnataka Rules, 1974.

13. i] The said Agency shall maintain relevant registers and records under the applicable enactments.

ii] The records/registers/licences shall be produced by the Agency for verification/inspection as and when required by the Board.

14. i] The Agency shall ensure that the service provided is in accordance with the conditions stipulated in the agreement.

ii] If any outsourced staff employed by the Agency deployed to

carry out the Board’s work, is considered undesirable by the Board, it shall be the responsibility of the Agency to withdraw the said staff from the Board’s work and substitute the position/s with suitable manpower immediately. Such withdrawn staff shall not be re-deployed by the Board for any other work in the Board.

15. If the Agency assigns or sub-lets the obligations under the agreement, the work order awarded shall automatically stand cancelled.

16. In case the Agency fails to seek clarification, if any, in writing from the Board regarding any doubts or ambiguities with regard to any clause in the agreement, the decision of the Joint Secretary of the Board on such issues shall be final.

17. The scope of agreement shall be liable for alteration by way of deletions or additions at the discretion of the Joint Secretary of the Board.

18. The Agency shall ensure that one of its representative /supervisor is available at the pre-notified address with contact number/s, so that they can be contacted in case of need, at any time i.e. 24X7 on all 365 days.

19. The duration of the agreement is for a period of 24 months from the date of signing the agreement which may be extended for further period upto 12 months or any other period rests at the discretion of the Member Secretary of the Board. However, the agreement can be terminated by either party by giving three months advance notice.

20. In the event of agreement being extended, the Agency shall continue to provide outsourced staff on the same terms and conditions of the agreement.

1. i] i] The successful tenderer shall deposit an amount equivalent to five percent of the tender amount as security deposit or provide an irrevocable bank guarantee for the duration of the agreement at the time of entering into agreement or it may opt for recovery of the same i.e. the security deposit from monthly bills

proportionately in six monthly bills, starting from the first month of the billing.

ii] The EMD can be adjusted towards security deposit for the successful tenderer/s. For the remaining amount of the security deposit, the successful tenderer shall submit a demand draft or irrevocable bank guarantee, in favour of the Joint Secretary, Karnataka State Unorganised Workers Social Security Board payable at Bangalore.

iii] The security deposit shall be refunded after 30 (thirty) days of the expiry of the period of the agreement or one month after the final bill is paid whichever is later by adjusting any dues to the Board..

21. To prevent disputes and litigations, it shall be accepted as an inseparable part of the agreement, that in matters with regard to interpretation of agreement, mode of procedure and carrying out the work, the decision of the Joint Secretary shall be final and binding on the Agency.

22. If any loss or damage is caused to the Board due to non-compliance of the obligations under the agreement by the Agency, the Agency shall make good, such losses and the Board shall be entitled to recover the same from the Agency.

23. Any disputes arising out of the agreement is subject to the jurisdictional courts of Bangalore.

24. The outsourced staff deployed to the Board, shall be under the direct control and supervision of the Agency. The employees shall not have any claim whatsoever against the Board.

25. The Agency shall provide leave facilities as per the Karnataka Shops and Commercial Establishments Act, 1961 and Rules, 1963 to the staff deployed and also the list of gazetted holidays with pay, declared by the Government.

26. In case of any dispute or proceedings in any court/ authority on a matter arising out of the agreement, the Security Deposit shall not be refunded until the proceedings are disposed off, even in the event of the agreement coming to an end.

JOB DESCRIPTION

1. JUNIOR RESEARCH ASSISTANTS :-The incumbent has to be well versed in the field of Research and analysis of data collected, generation of reports and statistics, and other such related works. Should possess atleast minimum one year of experience in such field.

2. STENOGRAPHER :-

The incumbent will be deployed as a Personal Assistant to Senior Officers of the Board. He/She is expected to take dictation in shorthand in Kannada and English, transcribe in appropriate MS-Office software, preparation of letters, schedules and statements in Kannada and English, managing engagements and visitors, maintaining files, attending phone calls, organising meetings, drawing proceedings and such other connected jobs entrusted by the Officers of the Board from time to time.

3. CLERKThe incumbent should be a graduate and must possess

atleast 1 year of work experience in the same discipline. He/she should be able to manage office work entrusted by the Officers of the Board from time to time

4. DATA ENTRY OPERATOR:-The incumbent has to be well versed in keying in data,

formatting, generating reports, preparing statements and schedules, preparing daily reports, statistics, preparing pay rolls, typing letters and so on. Knowledge of Kannada software “Nudi” is essential
