Two issues are at the top of our agenda for 2006: *First: Eliminate the maximum $50,000 sales tax burden on the purchase of machinery and equipment by manufacturers. Elimination of the tax will be a major benefit to smaller manufacturers. Current law requires purchase of over $830,000 of capital equipment each year to reach the $50,000 hurdle rate. Over 95% of Florida manufacturers are small- to mid-sized. This imposes an additional burden making these companies less competitive not only globally, but with their competitors next door in Georgia, Alabama, and other Southeastern states. The projected fiscal impact of $28 million will be returned many times by the increase in capital expenditures as Florida manufacturers invest to be competitive and efficient. Elimination of the sales tax is included in Governor Bush’s budget and we have strong support in the House. The problem is the Senate. We hope President Lee will support us and allow a vote on the issue this year. Passage would complete a long process of eliminating sales tax detrimental to Florida manufacturers that began in 1995. *Second: Repeal Joint and Several Liability. Florida must have meaningful Torn Reform if business is to be competitive. The current system encourages abuse by free-wheeling trial attorneys and free-loading clients. Both have made our legal system a lottery. Repeal of Joint and Several Liability will be a major step to restore order in an increasingly dysfunctional legal process. We do not wish to avoid liability for mistakes we cause. Neither do we wish to pay beyond the extent of our liability. In particular, we do not want to be the fall guy for plaintiffs wanting to get rich quick. The Governor and the House are solidly behind repeal. Again, the Senate is the roadblock. The vote will be close and we must lobby hard for passage. How can you help? Easy! Contact members of the Duval Delegation and ask that each support our two bills. Pass Sales Tax Exemption and Joint and Several Liability
