NOTICE OF INTENTION TO MAKE MEETING PROCEDURE LOCAL LAW 2020Notice is given, pursuant to section 119(3) of the Local Government Act 1989 (Act), that the

Northern Grampians Shire Council (Council) intends to make Meeting Procedure Local Law 2020 and invites submissions.

The purpose of the local law is to:1.1 provide a mechanism to facilitate the good government of the Council through its formal

meeting procedure to ensure effective and efficient Council decisions are made in a manner which acknowledges the role of local government within the Australian system of government;

1.3 regulate and control the election of Mayor and the Chairperson of any Special Committee; 1.4 regulate and control the procedures governing the conduct of meetings;1.5 provide for the administration of the Council’s powers and functions;1.6 provide generally for the peace, order and good government of the municipal district; and1.7 regulate the use of the common seal.

The draft Meeting Procedure Local Law 2020 and Local Law Community Impact Statement can be viewed on Council’s website at www.ngshire.vic.gov.au or alternatively, copies are available at Council offices in Stawell and St Arnaud or by contacting Council’s Customer Service Centres on (03) 5358 8700.

Any submissions received must be considered by the Council and any person making a submission is entitled to state in the submission that he or she wishes to appear in person, or to be represented by a person specified in the submission, at a meeting to be heard in support of the submission.

PROPOSED LOCAL LAW NO. 2 – COMMUNITY AMENITY AND MUNICIPAL PLACESPursuant to section 119 of the Local Government Act 1989, notice is hereby given that the

Hepburn Shire Council proposes to make a new Local Law No. 2 of 2019 – Community Amenity and Municipal Places.

The purpose of this Local Law is to provide for the peace, order and good government of the municipal district by:(a) managing, regulating and controlling activities on and uses of land which may be dangerous,

cause a nuisance or be detrimental to the amenity of the area or the environment;(b) promoting a healthy and safe environment in which residents and visitors to the municipal

district can enjoy;(c) regulating and controlling behaviour which causes detriment to the amenity and environment of

the municipality or could compromise public safety on Council land and assets; and(d) providing uniform and fair administration of this Local Law.Documents available for inspection

The Amendment proposes to implement the findings of the Cardinia Planning Scheme Review 2018.

The Amendment proposes to update the Local Planning Policy Framework by introducing a new Municipal Strategic State (MSS) at Clause 21 of the Cardinia Planning Scheme.

Plant Biosecurity Act 2010ORDER PROHIBITING OR RESTRICTING THE ENTRY OR IMPORTATION

OF MATERIALS WHICH ARE HOSTS OF SPIRALLING WHITEFLYI, Rosa Crnov, as delegate of the Minister for Agriculture, being of the reasonable suspicion that

the exotic pest spiralling whitefly exists within Australia but outside Victoria, make the following Order.1 Objective

The objective of this Order is to prohibit, restrict or impose conditions upon the entry or importation into Victoria of materials which are hosts of spiralling whitefly.

2 Authorising provisionThis Order is made under section 36(1) of the Plant Biosecurity Act 2010 (the Act).

3 CommencementThis Order comes into force on the day of making.

4 RevocationThe Order entitled Order prohibiting or restricting the entry or importation into Victoria of materials which are hosts of spiralling whitefly made under section 36(1) of the Plant Biosecurity Act 2010, prohibiting or restricting the entry or importation of spiralling whitefly host materials into Victoria, and published in Victoria Government Gazette G49 on 6 December 2018 at pages 2724–2725 is revoked.

5 DefinitionsIn this Order –‘spirallingwhitefly’ means the exotic pest Aleurodicus dispersus (Russell);‘host material’ means any plant or plant product intended for propagation in a glasshouse, hothouse or indoor area.

6 Prohibitions, restrictions and conditionsThe following prohibitions, restrictions and conditions are specified in relation to the entry or importation of host material. (a) The entry or importation into Victoria of any host material is prohibited.(b) Subclause (a) does not apply if the host material –

(i) originates from an area for which there is currently in force an area freedom certificate, being a certificate issued by an officer responsible for agriculture in the State or Territory from which the host material originated, certifying that the area from which the host material originated is known to be free of spiralling whitefly; or

(ii) is accompanied by a plant health certificate, assurance certificate or plant health declaration, certifying or declaring that the host material has been treated in a manner described in the Schedule to this Order; or

(iii) enters Victoria under and in accordance with a permit issued by an inspector and there is compliance with any conditions or requirements set out in the permit.

7 VerificationofconsignmentsWhere requested by an authorised inspector, host material imported into Victoria, which is required by clause 6(b)(ii) to be accompanied by a certificate or declaration, must be presented to an authorised inspector for inspection.

8 ExpiryThis Order remains in force for a period of 12 months after the date of making.

ScheduleHost material must be –

(1) grown on a property located more than 10 km from a detection of spiralling whitefly; or(2) grown on property known to be free from spiralling whitefly; or(3) inspected and found free of spiralling whitefly; or(4) treated by –

(a) cover spraying, to the point of run off, with a mixture of a commercial wetting agent at the rate specified on the registered label of the product, and –(i) 0.75 ml of a concentrate containing 400 g/l dimethoate per litre of water; or(ii) 0.5 ml of a concentrate containing 80 g/l bifenthrin per litre of water; or(iii) 0.4 ml of a concentrate containing 100 g/l bifenthrin per litre of water; or

(b) full immersion in a mixture containing 0.75 ml of concentrate containing 400 g/l dimethoate per litre of water for a minimum of 10 seconds; and

(5) packed so as to prevent infestation by spiralling whitefly.Notes: Section 38 of the Act provides that it is an offence for a person to cause, permit or assist any plant, plant product, plant vector, used equipment, used package, earth material or beehive to enter, or be imported into, Victoria in contravention of an importation order under section 36. The maximum penalty of 60 penalty units applies in the case of a natural person, and 300 penalty units in the case of a body corporate.Terms in this Order that are defined in the Act have that meaning.

I, John Bradley, Secretary to the Department of Environment, Land, Water and Planning (DELWP), give notice that I have reviewed and amended the DELWP Road Management Plan in accordance with Regulation 9(3) of the Road Management (General) Regulations 2016. The amended plan provides appropriate standards and priorities for the inspection, maintenance and repair of public State non-arterial roads managed by the Secretary.

Following this review I have decided, pursuant to Regulation 11(3) of the Road Management (General) Regulations 2016, to amend the Road Management Plan in a manner that does not require a notice of proposed amendment under Regulation 10, as the amendments only deal with administrative procedures or the responsibilities of a road authority, or are of a fundamentally declaratory or machinery nature.
