Pursuant to Local Rule 31 .2(a)(1 )(D), this letter is sllbmjtted in furtherance of Defendant-Appellant Martin Shkreli' s request for an extended date in which to file his Brief and Appendix, beyond the 91 day deadline provided in subd. (a)(I)(A).
The reason for this request is that, far in excess of the almost six thousand (6,000) page trial transcript, thi rather high profile criminal prosecution presents an unusually voluminous record encompass ing numerous issues of law which constituted the proceedings ilL the district court. At tili . juncture, however, it is impossible for appellate counsel to foresee which issues will be selected for presentation to the court for review and which issues -- only following dutiful analysis ofthe record in its entirety -will not be submitted for the Court's consideration.
Barring any presently unforeseen items which may have escaped counsel's attention, the following is a list of the various transcripts, submissions, exhibits and materials, along with the corresponding amount of pages, which constitutes the record of the district court resulting from the 35 page Indictment:

Notably, it is Defendant-Appellant's intention to participate fully in the determination and drafting of the issues to be presented. Thus, given his incarceration, significant periods of time will be consumed in simply exchanging drafts, followed -- if time allows -- by face to face discussion between counsel and client in whatever Bureau of Prisons facility to which he will ultimately be assigned.

In light of the sheer volume of the record on appeal-- and given other existing filing deadlines with which, as appellate counsel to this firm, I must comply -- it is respectfully requested that Appellant be allowed an additional sixty-two (62) days in which to file his brief and appendix. Specifically, it is requested that he be granted until on or before September 4, 2018 (i.e., the day after Labor Day) to perfect this appeal.
