Mar3ue9 personally went to Iloilo $ity to loo! upon thematter. fter ma!ing several in3uiry she was able to confirm thereport of 0abylyn &olasco. he complainants are no longer reporting

for wor! since -ctober 1;, 2<. hey also failed to reimburse theircash advances from the respondent. #he also made an inventory inthe vault of all the licensed firearm turned over in the branch it wasfound out that the &orinco Kmm firearm with serial no. <11=1K) wasmissing and could no longer be found.

complainants stopped reporting for wor! on -ctober 1), 2<, they

abandoned their ob. hen complainants abandoned their wor! they

have shown that they have no more desire to wor! for the

respondent.

eneral Manager categorically informed the complainants that they

should start reporting for wor! and tal! about the missing licensed

firearm. #he even re3uested that they personally meet and try to

resolve the problem. 'owever, complainants categorically turned

down the offer of %elia . Mar3ue9.

rendered service for only forty five (45) days after which they have

abandoned their wor!. bandonment of a ob is a form of neglect of

duty.

account for the loss of the &orinco Kmm firearm with serial no.

<11=1K) which was turned over to him by the respondent despite

several re3uest for him to meet with %elia . Mar3ue9 to discuss the

matter and give him a chance to give his side but failed to do so is

clearly an indication that he was not in good faith to clear his name

for the loss. 'ence, complainant ntonio +. Meniel should be

accounted for the loss of the firearm and this constitute theft of

company property.

1<. he immediate filing of illegal dismissal complaint by the

complainants did not disprove abandonment of wor!. 'ere, the

evidence revealed that the complaint for illegal dismissal was

intended to gain leverage for the complainants to prevent respondent

from filing a criminal complaint for theft of company property against

complainant ntonio +. Meniel.

1K. $omplainants are not ordinary ran!andfile employee of

the respondent. s managerial employees, they are tas!ed to

perform !ey and sensitive functions, and thus Gbound by more

e"acting wor! ethics.H hey should have reali9ed that such sensitive

position re3uires the full trust and confidence of the respondent. hey

committed acts which reflected their unworthiness of the trust and

recover something he has not earned and could not have earnedH. ;

G0ac!wages (lucrum cessans in civil law* aregranted on grounds of e3uity to wor!ers for earnings lostdue to their illegal dismissal from wor!. hey are areparation for the illegal dismissal of an employee basedon earnings which the employee would have obtained,either by a lawful decree or order, as in the case of awage increase under a wage orderE or by rightfule"pectation, as in the case of one6s salary or wage. he

outstanding feature of bac!wages is thus the degree to anemployee that he would have had them as earnings hadhe not been illegally terminated from his employmentH.

Moral damages are recoverable only where the dismissals of

the employee was tainted by bad faith or fraud, or where it constituted

an act oppressive to labor, and done in a manner contrary to morals,

good customs, or public policy. hile, Gexemplary damages may be

awarded only if the dismissal was done in a wanton, oppressive, or

malevolent mannerH.K &one of these can be reasonably attributed to

espondent under the circumstances.

Ghile no proof of pecuniary loss is necessary in order that

moral damages may be awarded, the amount of indemnity being left

to the discretion of the $ourtH,1 it is, nevertheless, essential that

claimant Gsatisfactorily prove the e"istence of the factual basis of the

damageH 11 and its causal relation to defendant6s acts. Ghis is so

because moral damages, though incapable of pecuniary estimation,

are in the category of an award designed to compensate the claimant

for actual inury suffered and not to impose a penalty on the

wrongdoerH.12
