ANDHRA PRADESH STATE ROAD TRANSPORT CORPORATION

Tender Notice No. 08/CCE/2012-13, Dt.22.12.2012 APSRTC invites offers from reputed Valuing institutions/ Individuals towards

Valuation of its lands located across the State. The properties of the Corporation are categorised under Six Packages. The Bidders are required to quote their Consultancy Fee for each place in a Package and also as a Fixed sum for the entire Package. The Package wise list of places and the terms and conditions are provided in the Bid document. The brief terms & conditions are as follows; 1. The scope of work consists of (a) Physical verification of the lands and buildings, i.e., to survey the site using Total Station Survey instrument, furnishing of digital data such as site boundaries, buildings therein and extent of land (b) Submission of one soft copy and three hard copies of A3/A2 size, (c) Submission of land value as per the Sub-Registrar’s office with CARD, (d) Submission of market value of the land supported by copies of recent transactions/reports. 2. The time period for completion of the assignment is 60 days from the date of engagement. 3. The eligible Bidders (a) Should be Members of the Institution of Valuers, New Delhi and also should be registered with the Chief Commissioner of Income Tax for valuation of immovable properties (Other than agricultural lands, plantations, forests, mines, quarries). (b) Should be Empanelled members with Banks/Central/State Governments including Undertakings for the last three years. The Valuer should have undertaken a minimum of 100 valuations in above institutions in the year 2011-12. (c)Should have Service Tax registration, and shall be an IT assessee for the last three years. (Note: Documentary proof for the above items (a) to (c) shall be enclosed.) 4.The lands within a Package are considered as a single entity. However for convenience purpose, the Bidder is required to quote its Consultancy fee for each place within the Package and also a fixed sum for the entire Package. In case of discrepancy between the sum of individual place wise quotes and the total Package amount, the amount whichever is less will prevail and the individual quotes will be adjusted accordingly. 5.The Bidders are free to participate in any number of Packages. The Packages will be allotted based on competitive price. Irrespective of the number of Packages allotted, the time period allotted is 60 days only and the Bidder shall plan for simultaneous execution of the assignment. 6.The Bid documents can be had from the office of the Land Acquisition Officer, APSRTC, Bus Bhavan, Mushirabad, Hyderabad during 07.01.2013 to 10.01.2013 during office hours from 10.30 AM to 05.00 PM on submission of Demand Draft for Rs.5,725/- (Rs.Five thousand seven hundred and twenty five only). The DD shall be drawn on in favour of Financial Advisor, APSRTC on any Nationalised/Scheduled banks (Excluding Co-operative banks) and payable at Hyderabad.

7.The Bid documents can also be downloaded from http://www.apsrtc.gov.in, during 07.01.2013 to 10.01.2013 during office hours from 10.30 AM to 05.00 PM. However, the Bidders shall pay the cost of the document(Non-refundable), i.e., Rs. 5,725/- (Rs.Five thousand seven hundred and twenty five only) in the form of a Demand Draft. The DD shall be drawn on in favour of Financial Advisor, APSRTC on any Nationalised/Scheduled banks (Excluding Co-operative banks) and payable at Hyderabad. The DD shall be enclosed and submitted along with the filled in Bid document. 8.The intending Bidders shall pay an amount of Rs.50,000/- (Rs. Fifty thousands only) towards the EMD per each Package by way of Demand Draft drawn in favour of Financial Advisor, APSRTC on any Nationalised/Scheduled banks (Excluding Co-operative banks) and payable at Hyderabad, along with the filled in Bid document. 9.The filled in sealed Bid documents accompanied by EMDs ( Also cost of Bid document in case, the Bid document is downloaded) shall be submitted on 23.01.2013 in the Office of the Land Acquisition Officer, APSRTC, Bus Bhavan, Mushirabad, Hyderabad by 14.00Hrs. The Bids will be opened on the same day at 15.00 Hours in the presence of the Bidders/ Authorised representatives. 10.Further details can be had from the Land Acquisition Officer on 9959224528, (or)040-2763 6738 during office hours (10.30 AM to 05.00 PM). 11.APSRTC reserves the right to cancel/reject the proposal without assigning any reason whatsoever. No correspondance in this regard will be entertained. SECTION – II SCOPE OF WORK AND INSTRUCTIONS TO BIDDERS

1.0 Scope of the Work: The lands of the Corporation to be Valued and Surveyed are divided into Six Packages. The lands within a Package are considered as a single entity. The scope of work consists of A) Physical Verification: (i) Lands:

Physical verification of the lands include surveying the sites using Total Station Survey instrument and furnishing of digital data such as site Boundaries, Extent of the lands, Orientation, Physical features such as electrical lines, drains etc. The area of both covered and uncovered land also to be verified.

(ii) Buildings: Physical verification of the buildings include surveying the buildings with Total

Station Survey instrument and furnishing of digital data such as outline of the structures.

B) Valuation: To undertake the market value study duly enquiring the recent transactions in the vicinity and to arrive at a rational market value of the lands. In the process, the Bidder has to take into consideration the shape of the site, frontage and depth of the site, orientation of the site, width of access roads etc. The Bidder shall adopt suitable valuation techniques such as Belting method for arriving at a true market value of the land. The Bidder shall also furnish the land value as per the “CARD” statement obtained from the Registrar’s/Sub-Registrar’s office. The above land values arrived shall be supported by copies of recent transactions/reports, “CARD” statements etc. C) Documentation: The Bidder shall submit all the drawings in one soft copy and three hard copies of A2 size. All the reports, extracts, workings and statements shall also be submitted in one soft and three hard copies. 2.0 Details of Lands: The lands and buildings to be surveyed are divided into Six Packages. The list of Packages and the number of places within a Package are furnished at SECTION- III.

3.0 Contact Persons: The Executive Engineers of the Corporation will be acting as Nodal Officers. The Bidders may contact the Executive Engineers concerned for inspection of the site and for any clarifications pertaining to the properties. The list of the Executive Engineers and their contact numbers (Mobile) are furnished at Section-III. 4.0 Price Bid: The Bidders are free to participate in any number of Packages. The lands within a Package are considered as a single entity. However for convenience purpose, the Bidder is required to quote its consultancy fee for “Each place and also for the entire Package” in the proforma furnished at Section- V. The extent of lands provided are for information purpose only and variation in extent shall not have any bearing on the Price Bid. In case of discrepancy between the sum of individual place wise quotes and the total Package amount, the amount whichever is less will prevail and the individual quotes will be adjusted accordingly. The Packages will be allotted based on competitive price. However, in case the same rate is quoted by more than one Bidder, the Corporation reserves the right to allot the Packages to more than one Bidder in view of time constraint. The Corporation also reserves the right to allot to more than one Bidder, if felt necessary, in view of the time constraint. Note: The quoted rates shall be inclusive of all expenses like surveying, valuation,

travel, cost of obtaining CARD, Xerox copies, lodging, boarding etc., in all and also all applicable Taxes except Service Tax. The Service Tax will be reimbursed upon submission of Service tax Registration No., and invoice as prescribed under Service tax act.

5.0 Terms and Conditions: 1. The Bidder should thoroughly read all the clauses before submitting their tender. The original copy of the Tender Document shall be signed by the Bidder on each and every page and stamped with company’s seal towards acceptance of all the terms & conditions provided in the Tender Document. 2. The intending Bidders shall be reputed Valuing Institutions/Individuals and must be working with in the scope as enumerated above for not less than the past 3 years. 6.0 Earnest Money Deposit(EMD): 6.1 As defined in the scope of work, there are Six Packages for participation by the Bidders. The Bidders are free to participate in any number of Packages. The Bidders shall pay an amount of Rs. 50,000/- (Rupees Fifty thousands only) towards the EMD per each Package. The EMD shall be paid by way of Demand Draft drawn in favour of “Financial Adviser, APSRTC” obtained from any Nationalized/Scheduled bank, other than Co-operative banks, payable at Hyderabad and shall be submitted along with the Tenders.

6.2 The EMD shall not carry any interest. 6.3 Proposals not accompanying EMD/ accompanying part EMD shall be summarily

rejected. 6.4 The EMD will be refunded to the unsuccessful Bidders on deciding upon the

acceptance, or otherwise of the proposal, or on expiry of Four Months from the date of opening of the Tenders, whichever is earlier. In the case of successful Bidder, it will be adjusted towards the Performance Security.

6.5 The EMD shall be forfeited a) If the Bidder withdraws his proposal during the period of Tender validity. b) If the Bidder does not accept the correction of his financial proposal. c) If the Bidder withdraws or modifies his offer within the tender validity period. d) In case, the successful Bidder fails to adhere to the terms and conditions of the

“Letter Of Engagement(LOE)”. (e) In case, the successful Bidder fails to sign the Agreement within Fifteen days after

acceptance of his offer, or fails to commence the work within Fifteen days of signing the Agreement.

After the forfeiture of EMD, the “LOE”, and/or “Agreement” shall be deemed as nullified.

7.0 Tender Validity: 7.1 Proposals shall remain valid for a period of 4 (Four) months from the date of opening of Tenders. 7.2 In exceptional circumstances, the validity period shall be extended on mutual consent. For the extended period, the Bidder shall extend the validity of his Earnest Money and in compliance with Clause 6.5 in all respects. 8.0 Eligibility Criteria: a) Memberships/Registrations:

The Bidder (As on 22.12.2012) (a) Should be Members of the Institution of Valuers, New Delhi (b) Should be registered with the Chief Commissioner of Income Tax for valuation of immovable properties (Other than agricultural lands, plantations, forests, mines, quarries).

b) Experience:

The Bidder should have completed a minimum of 100 valuations in above institutions in the year 2011-12.

The Bidder shall submit the details of the Memberships, Registrations, Experience as per the Formats provided in Section-IV and shall be supported by copies of last 3 years IT returns, PAN Card, Service Tax registration No, memberships, registrations, work orders, experience certificates etc. All the Xerox copies shall be got attested by a Gazetted Officer.

Note: (i) Mere issuance of Tender document does not guarantee that the bidder is meeting the eligibility criteria

(ii) Bids submitted without correct supporting documents will not be considered. 9.0 Establishment:

The Bidder shall submit the details of its office establishments, Branches in A.P, Employee strength as per the formats specified in Section – IV.

10.0 Submission of Tender:

The filled in Bid Documents must be dropped in the tender box kept in the Office of the Land Acquisition Officer, APSRTC, Mushirabad, Hyderabad –500 020, by 14.00 Hrs (I.S.T) on 23.01.2013, or any amendments issued thereon.

The Bidder shall submit the proposals in Two separate envelopes as detailed

hereunder: i) The Envelope No.1, marked on top as `QUALIFICATION PROPOSAL' and

the name of Bidder with Telephone No. written on the left hand bottom side shall contain

(a) Tender Document duly signed by the Bidder on each page as a token of acceptance of all the terms & conditions.

(b) Documents as per Clause Nos.8 & 9 above and (c) Bidders who have downloaded the bid document from http://www.apsrtc.gov.in

should submit DD for Rs.5,725/- (Non-refundable) (Rs.Five thousand seven hundred and twenty five only) drawn on any Nationalised /Scheduled bank in favour of “Financial Adviser, APSRTC” and payable at Hyderabad, towards cost of bid document .

Note: The D.D towards bid document cost as mentioned at 10(i)(c) above shall be

attached outward to the Envelope No.1 in a separate Small Envelope superscribing the words “D.D towards Cost of Bid Document”.

ii) The Envelope No.2 consists of "PRICE BID FOR PACKAGE ____’ and the name of Bidder with Telephone No.written on the left hand bottom side shall contain the Form of Price Bid and Letter as indicated at Section V.

(iii) DD for Rs.50,000/- (Rs.Fifty thousands only) per each Package drawn on any Nationalised /Scheduled bank in favour of “Financial Adviser, APSRTC” and payable at Hyderabad, towards EMD. Note: 1.The D.D towards EMD as mentioned at 10(iii) above shall be attached

outward to the Envelope No.2 in a separate Small Envelope super scribing the words “D.D towards EMD”.

2. Envelope No.2 along with EMD as at 10(iii) should be submitted separately for

each package. (* For example, if a Bidder is participating in three Packages, they are required to submit three individual sets of envelopes (Price Bids: 3, EMD: 3) as at Cl.10.(ii) & (iii).) iii) The Two ORIGINAL envelopes marked as “QUALIIFICATION

PROPOSAL” and “PRICE BID” shall be enclosed in an outer envelope super -scribed as “Tender for Valuation & Physical Verification of Lands of APSRTC”, duly furnishing the name of the Bidder alongwith Telephone No. on the left hand bottom side.

The tender shall be typed or written in indelible ink and shall be signed by the Bidder or a person or persons duly authorised to sign on behalf of the Bidder. All pages of the tender document containing the entries and all corrections or amendments made there in shall be initialed by the person or persons signing the tender. The Bidders should ensure that their offer is submitted on the due date and time. Offers received after due date and time, shall not be accepted. The Bidder shall bear all costs associated with the preparation and submission of tender and the department shall in no case be liable for these costs.

Incomplete tenders or tenders not fulfilling any of the conditions specified above are liable to be rejected without assigning any reason. Substantially responsive bids shall be evaluated in accordance with the clause-8 of Tender document.

11.0 Opening and Evaluation of Proposals: The following procedures will be adopted for opening of the proposals. i) The Outer Envelope will be opened first and verified for (a)Envelope No.1,

(b)Small outer envelope containing Bid document Cost and attached to Envelope-1 (For Dowloaded Documents) (c) Envelope-2 for Each Package (d) Small outer envelope containing EMD and attached to Envelope-2. First, the

small cover containing Bid Document Cost will be opened. If the DD is in order, then only the Document will be taken into consideration. Then, small cover containing EMD will be opened for each submitted Package . If the EMD is in order, then only the Package will be taken into consideration. Envelope-1 will be opened to verify its contents to check the responsiveness of the Bidder to comply with the TENDER submissions in the prescribed formats and the supporting documents. If various documents contained in this envelope are incomplete or not in the prescribed formats or substantially insufficient to evaluate the qualification criteria a note will be recorded accordingly and evaluate for eligibility creteria for shortlisting the Bidder on the basis of the information contained in it. Necessary supporting documents/clarifications for compliance with conditions in the Tender documents may be demanded by APSRTC from the Bidders, if found necessary after the scrutiny. Refusal for compliance or giving clarification may render the proposal invalid and Envelope No. 2 of each Package in that case will not be opened, but recorded with a suitable note. After evaluation, the applicants will be intimated on their qualification or disqualification. If the applicant does not qualify, the Envelope No.2 of each Package, will not be opened and EMD will be refunded. The applicant may collect the same from APSRTC with due acknowledgement.

ii) Non-submission of requisite DD towards Bid document Cost (For Dopwnloaded

documents), EMD for each Package and Envelope No.l will not be opened. iii) Envelope No. 2, only of those Bidders who have fulfilled the requirements

stipulated in Envelope No. 1, will be opened. The date of opening of ‘Price Bid” will be intimated in due course and shall be opened in the presence of qualified Bidders. The “Price Bids” of the Bidders shall be read out to all the Bidders, or their representatives present at the time of opening the same.

Note: Even though the bidders meet the above qualifying criteria, they are subject to be

disqualified if they have made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements, and / or record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures etc.

12.0 Period of Completion:

The time allowed for completion of the assignment is 60 (Sixty)days from the date of entering engagement (Agreement). Irrespective of the number of Packages allotted, the time period allotted is 60 days only and the Bidder shall plan for simultaneous execution of the assignment in case of securing more than one Package.

On acceptance of the tender, the Bidder shall either himself remain available at site of work, or arrange the availability of an accredited representative, fully authorised in writing at the site of work to receive instructions of the Land

Acquisition Officer, Executive Engineer concerned, or any representative of the Corporation and to ensure prompt compliance thereof. The certificate of completion will be as issued by the concerned Executive Engineer/APSRTC and shall be the conclusive proof of completion of work.

13.0 Payments:

APSRTC shall make the payment Package wise in the following manner:

A bill shall be submitted by the Bidder alongwith the necessary documents at each stage for groups of places (preferably multiples of 20). The Executive Engineer in charge shall get the bill verified within 15 days from its presentation and the Bidder shall be required to sign the corrections made if any, in token of its acceptance, before releasing or adjusting the payment amount. If the Bidder does not submit the bill or delays its submission or acceptance of correction after verification, the entire responsibility for non-payment rests with the Bidder and shall not claim any relaxation for extension of period of completion, or interest whatsoever.

14.0 Performance Security:

The Bidder is required to make a payment of 5% of the value of the work as per its Price Bid, (or) Rs.50,000/- whichever is higher towards the “Performance Security” as a pre-condition to sign the Agreement. However, the EMD paid by the Bidder at the time of Tender will be adjusted to the Performance Security. The Performance security has to be provided Package wise. This Performance Security will be released on completion of 30 days from the date of completion of the assignment. The Performance Security shall not carry any interest

15.0 One Proposal Per Bidder:

Each Bidder is free to participate in any number of Packages, but shall submit only one Bid per Package. In case, a Bidder participates in more than one Bid for a single Package, the proposal which is beneficial to the Corporation will be considered and other disqualified.

16.0 Statutory Obligations:

The Bidder shall comply with all the provisions of the statutory acts concerning his scope of work including but not limited to Apprentices Act 1961, minimum wages Act 1948, Workmen’s compensation Act 1923, Contract labour (Regulation and Abolition Act 1970), Payment of wages Act 1936, Corporation’s liability Act 1938, Maternity Benefits Act 1961 and the Industrial disputes Act 1947, various Import laws etc., as applicable and the rules and regulations issued there under from time to time. Failure to do so shall amount to breach of the contract and the Corporation may at its discretion terminate the contract. The Bidder shall also be liable for any pecuniary liability arising on account of violation by him of the provisions of the Act.

17.0 Currency for Price Bid: The Price Bid shall be quoted by the Bidder entirely in Indian Rupees. 18.0 Contents of the Tender Document:

To provide prospective Bidders reasonable time, to take an addendum into

22.0 Language: For all the correspondence, the medium is English/Telugu. 23.0 Confidentiality :

All information relating to the examination, clarification, evaluation and comparison of proposals and recommendations for the award of a project shall not be disclosed to Bidders or any other persons not officially concerned with such process until the award to the successful Bidder has been announced. Any effort by any Bidder to influence APSRTC's processing of proposals or award decisions may result in the rejection of that Bidder's proposal.

24.0 Extension Of Dead Line:

APSRTC may, at its discretion, extend the dead line for submission of proposals as specified at Clause -10 by issuing an addendum/amendment in accordance with Clause- 21. ( in which case all rights and obligations of APSRTC and the Bidders previously subject to the original deadline will thereafter be subject to the deadline as extended). 25.0 Withdrawl Of Tenders Withdrawal of a Tender during the interval between the last date for submission

of Tender and the expiration of the period of Tender validity specified in Clause-7 shall result in the forfeiture of the EMD pursuant to Clause- 6.

26.0 Cost Of Tendering:

The Bidder shall bear all the costs associated with the preparation and submission of his proposal and APSRTC shall in no case be responsible or liable for those costs, regardless of the conduct or outcome of the Tendering process.

27.0 Correction Of Errors Proposals determined to be substantially responsive will be checked by APSRTC, for any errors. Errors will be corrected by APSRTC as follows: "Where there is a discrepancy between the amounts in figures and in words, the amount whichever is beneficial to the Corporation will govern".

The amount stated in the Form of Price Bid will be adjusted by APSRTC in accordance with the above procedure for the correction of errors of the proposal, shall be considered as binding upon the Bidder. If the Bidder does not accept the

same, his proposal will be rejected, and the EMD shall be forfeited in accordance with Clause -6.

28.0 Award Of Project:

APSRTC will award the project to the Bidder whose proposal has been determined to be substantially responsive to the TENDER documents and whose Price Bid is the Lowest, through a ‘Letter Of Engagement(LOE).

29.0 Acceptance: The successful Bidder shall acknowledge the receipt of the LOE and consent the LOE accepting the terms and conditions contained therein within 7 days and execute the necessary agreements within 15 days from the date of LOE. 30.0 Rejection and return of Earnest Money Deposit: APSRTC will notify the other Bidders that their proposals have been unsuccessful and their EMD will be returned as per clause-6. 31.0 Right To Accept Or Reject Any Proposal 31.1 APSRTC reserves the Right to accept or reject any Proposal and to annul the

Tendering process and reject all proposals, at any time prior to award of project, without thereby incurring any liability to the affected Bidders or any obligation to inform the affected Bidder or Bidders of the ground for rejection of any Proposal.

31.2 APSRTC also reserves the Right to reject any Proposal if: a) at any time, a material misrepresentation is made or uncovered, (or) b) the Bidder does not respond promptly and thoroughly to request for supplemental information required for the evaluation of the Proposal. This would lead to the disqualification of the Bidder. If such disqualification/ rejection occurs after the Financial Proposals have been opened and the Lowest Bidder gets disqualified/rejected, then APSRTC reserves the right to: i) Either invite the next Lowest Bidder to match the Lowest offer, (or) ii) Take any such measure as may be deemed fit at the sole discretion of APSRTC,

including annulment of the Tendering process / inviting fresh Tenders whatsoever, and the decision of APSRTC in this regard shall be final and binding.

32.0 Signing Of Agreement The agreements shall be signed with in 15 days from the date of issue of LOE, on a date predetermined by APSRTC. 33.0 Bidder’s(Successful Bidder) Default: a) If the Bidder is not executing the Works in accordance with the Contract

or is neglecting to perform his obligations there under, as seriously, to affect the Program for carrying out of the Works, the Corporation may give notice to the Bidder requiring him to make good such failure or neglect.

b) If the Bidder:

i. Has failed to comply within a reasonable time. ii. Fails to rectify, replace any defective work or continues the execution of

work in an inefficient, improper, unworkman-like manner or not in accordance with sound Engineering practices or without complying with the directions and requirements.

iii. Assigns the Contract or Sub-Contracts the whole/part of the works without the written approval of the Corporation, or becomes bankrupt or insolvent, has a receiving order made against him or compounds with his creditors, or carries on business under a receiver, trustee or manager for the benefit of his creditors or goes into liquidation.

The Corporation may, after giving 15 days notice to the Bidder, terminate the Award/Agreement duly forfeiting the Performance security deposit. Any such termination shall be without prejudice to any other rights or powers of the Corporation. The Corporation may upon such termination complete the Work by itself or through any other Bidder.

c) The Corporation shall, as soon as possible after such termination, certify the

value of the Works and all sum then due to Bidder as on the date of termination. d) The Corporation shall be entitled to recover from the Bidder the extra costs, if

any, of completing the Works after allowing for any sum due to the Bidder. 34.0 Settlement of Disputes: a) Any dispute(s) or difference(s) arising out of or in connection with the

Contract shall, to the extent possible, settled amicably between the parties. b) If any dispute or difference of any kind whatsoever shall arise between the

Corporation and the Bidder, arising out of the Contract for the performance of the works whether during the progress for the works or after its completion or whether before or after the termination, abandonment or

breach of the Contract, it shall, in the first place, be referred to and settled

by the Empowered officer to be appointed by the Corporation, who within a period of thirty (30) days after being requested by either party to do so, shall give written notice of his decision to the Corporation and the Bidder.

c) Unless as hereinafter provided, such decision in respect of any matter so referred

shall be final and binding upon the parties until the completion of the Works and shall forthwith be given effect to by the Bidder who shall proceed with the Works with all due diligence, whether he or the Corporation required to file a Civil suit.

d) If after the Empowered Officer has given written notice of his decision to the

parties, and no claim to Civil suit has been communicated to him by either party within thirty (30) days from the receipt of such notice, the said decision shall become final and binding on the parties.

e) In the event of the Empowered Officer failing to notify his decision as

aforesaid within thirty (30) days after being requested aforesaid, or in the event of either the Corporation or the Bidder being dissatisfied with any such decision, or within thirty (30) days after the expiry of the first mentioned period of thirty (30) days, as the case may be, either party may require that the matters in dispute be referred to Civil suit as hereinafter provided.

35.0 Civil Suit: All matters, question, disputes, differences and/or claims arising out of and/or concerning and/or in connection and/or in consequences or relating to this Contract whether or not obligations of either of both parties under this Contract be subsisting at the time of such dispute and whether or not this Contract has been terminated or purported to be terminated or completed, shall be referred to Civil Suit The Award of the Court shall be final and binding on the parties to this Contract. 36.0 Jurisdiction:

All questions, disputes or differences arising under out of or in connection with the Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender / Acceptance of tender issued is situated i.e. Hyderabad.

37.0 Variation in the Scope of work: The quantum of work, i.e., the number of places in each Package, may be increased or decreased as the case may be during the execution, or otherwise if warranted by the Corporation. The Bidder will be paid as per the actual number places for which services are rendered.

38.0 Extension of Time Period:

It will be responsibility of the Bidder to ensure that the work is completed within the stipulated Period(Clause-12). However, if on account of reasons beyond ones control APSRTC may consider extension of time period. However, extension will be considered only upon submission of documentary evidence for the reasons of delay. 39.0 Programme of Work:

The time allowed for carrying out the work shall be the essence of the contract and shall be strictly observed. The Bidder shall ensure all due diligence to achieve progress of work not less than indicated below:-

(i) On lapse of 25% contractural time : 20% (ii) On lapse of 50% contractural time : 50% (iii) On lapse of 75% contractural time : 80% (iv) On lapse of full contractural time : 100%

40.0 Penalty:

In case of default, the Bidder shall not withstanding issuance of a prior notice in this regard pay a penalty upto 1% of the amount of contract value or such lesser amount that the Corporation may levy, for every week that the work remains uncommenced after 15 days of the Agreement, or the work remains unfinished within 15 days of the full contract period.

41.0 Prohibition against collusion with other prospective bidders. Each bidder warrants by the bid that the contents of the bid and the bid amount have been arrived at independently. Any bid that is found to have been arrived at through consultation or collusion or any sort of understanding with any other prospective bidder for the purpose of restricting competition shall be deemed to be invalid and the bidder shall lose his security deposit/earnest money deposit. 42.0 Inducement: Any effort by a bidder to influence processing of bids or award of bid by the Department or any officer/agent/advisor thereof may result in the rejection of such bidder’s bid. In such a situation involving the rejection of bid the bidder shall lose the Earnest money deposit.

43.0 Precision: The Bidder shall take every possible scientific precaution to ensure that the land values are realistic. The Bidder shall take into consideration the shape, orientation, aspect ratio, width of abutting land, developments in the vicinity of the site, recent market transactions etc. also while doing the valuation. The Bidder shall also adopt best practices of valuation such as “Belting Method” etc. The Bidder shall ensure that the land boundaries are properly located and measurements are taken with utmost care. It shall be the responsibility of the Bidders to co-relate the site measurements with the digital data acquired through the Total station whenever the concerned Executive Engineers demand the same as a check. The Executive Engineers concerned will ensure the accuracy of the measurements and valuation before releasing payments to the Bidder. 44.0 Indemnity: The bidder shall agree to defend, indemnify and hold harmless APSRTC, its officers, and employees from and against any and all claims, liabilities, actions, demands, judgments, losses, costs, expenses, suits, actions and damages arising by reason of bodily injury, death or damages to property sustained either by APSRTC or third parties that are caused by an act of negligence or the willful misconduct of the bidder, or his agents/Bidders/ employees etc.

Note:

1) It is understood that in case of discrepancy between the sum of individual place wise quotes and the total Package amount, the amount whichever is less will prevail and the individual quotes will be adjusted accordingly. 2) We abide by the above offer/quote and terms condition of the Tender Document,

if APSRTC selects us as the Successful Bidder.

3) The quoted rates are inclusive of all expenses like surveying, valuation, travel, cost of obtaining CARD, Xerox copies, lodging, boarding etc., in all and also all applicable Taxes except Service Tax. The Service Tax will be reimbursed upon production of paid receipts.

4) APSRTC reserves the right to omit some of the places, or replace, or increase the number as warranted as per site conditions and its requirement.

5) The extent of lands provided in the Bid document are for information purpose only and variation in extent shall not have any bearing on the Price Bid.
