    Taxes - people just love to pay them. Not! Many home owners think they pay too much in property taxes, and the reality is that many do! Their property values may have dropped and the taxing authorities may not have adjusted for these drops, or its possible the home was over-assessed to start with. What to do?! The first thing to do is to check your as-sessment. Its possible your property is still as-sessed at its peak value from 3-4 years ago. If you believe your property is over-assessed, its time to seek help. Unless you are 100% cer-tain of your property value, call your favor-ite Realtor or seek one out. Explain that you need a CMA (Comparative Market Analy-sis). While some Realtors will gladly do this for free (especially if you are a regular client) be prepared to pay a nominal sum for their time and effort - unless you expect others to work for you for free. If it looks like your property is over-assessed you have options! Once you are armed with the information of whether your property is over assessed, you need to decide to challenge the assessment yourself or to hire someone to do it for you. At this point, I must disclose that my signifi-cant other, Rick, specializes in property tax reductions. Because of this, I get to see (and participate in) the work involved, up close and personal. It is time consuming and re-quires hours spent, visiting and photograph-ing properties, finding and pouring over comparables, all the while planning strategy for successfully getting that reduction. We go through too many ink cartridges to count and by the time tax season is over, the relief is palpable. Researching this article, I have come across articles in respectable magazines urging home owners to do the work themselves un-der the premise that tax boards are irritated if a professional is hired and less sympathetic to the home owner as a result. If anything, I see the opposite, at least in the Greater Rochester region. Many of the tax boards that review cases include real estate professionals who know their taxation region like the back of their hand. Unless you are as well versed as someone who works with property value ev-ery day, you usually will come out with the short end of the stick. I see this when our of-fice gets a call from people who decided to go it alone and either did not win or got a nominal token drop in value to make them go away. They then come to Rick to see what he can do. At that point there is little to do until next year, or if there is a possibility of helping, Rick is now faced with a much more difficult situation to overcome and often the reduction total is less than if he had taken the

    case from the very beginning. Talking with assessors who deal yearly with citizens seeking a drop their values, the common complaint is use of incorrect com-parables and demands based on emotions in-stead of fact. Often home owners are belliger-ent and demanding, which does little to gain sympathy. No matter what, assessments are based on facts and unless you are intimately familiar with the facts and can use them to challenge the assessor, you come to the table with a reduced capability to achieve maxi-mum results. I liken this to going to battle with one hand tied behind your back. If you decide to hire someone, how do you do this? Some people use their attorney, which can be ex-pensive. Often fees are paid up front whether you win or not. Many times they are a high por-tion of the realized savings, such as 30-50% of each years savings. Al-ternately, you can find Real Estate professionals who specialize in assess-ment reductions. For some reason, in this area there are only a few who specialize in this, so your search will be harder than if you lived down-state where there are companies solely devoted to this field. Find these specialists on-line or ask your Real-tor, CPA, Appraiser or Attorney for a referral. Rick regularly gets referrals from other Realtors, Attorneys and Appraisers who are aware of his skill in this area. Those that specialize in this service usually have a success rate between 90-95%. Of course, you need to understand that they evaluate the case. If they decide that there is no merit, they will not take it on because most specialists work on a commission ba-sis. This is actually very advantageous to the home owner, since if they take the case, the professional believes they have a good chance at reducing the taxes, and if they ultimately are unsuccessful, there are no costs to the home owner. Fees are usually 50% of the first years savings - the rest is free money.

    In other words, without the services of this professional, you would have to pay the full tax amount instead of saving the portion re-sulting from the reduction. I would be wary of services demanding money up front, since you cannot be sure that there is really a viable case, the company can just pocket your cash and shrug their shoulders when you dont get a reduction. These services are often scams. If you go it alone, your first stop should be the internet, in particular check out MonroeCounty.gov. Under Real Property you will find town and city assessment dates, equalization rates, tax tables, contact infor-mation, forms and publications. This will start you on your way. The deadline to file

    varies, depend-ing on where you live. For the city of Rochester, the deadline for the fiscal year of 2014 is March 19th. The suburban area deadlines are later, but its best to call your towns tax as-sessors office to get their deadline date directly. Get to know the laws per-taining to how your assessments are de-vised. Do you fall into into any spe-cial categories such as senior citizen exemptions? Call your city or town assessors office to ask if their data base is available to citizens, allowing you to search for comparables. Or,

    hire an appraiser to do an appraisal of your home. Explain to them what you are doing. Most appraisers understand and will look for comparables that will help you in your case. Be aware that in New York State, appraisers are prohibited from representing you in the hearing, but can supply you with the infor-mation needed to bolster your case. Check the information your assessor has on your home. Is it correct? If not, that could be part of your challenge. Check if the square footage, lot size, number of baths or bedrooms is correct. Are special features at-tributed to your home that are not there? Did you remove a shed, deck or pool? Is the house in the condition stated on the report? If the

    assessor claims your house is pristine but in actuality is a fixer upper, that can be chal-lenged. Take photographs of the property, especially anything that would bring value down. Be prepared to have the assessor want to tour your property to verify your claims. Accompany them when they go through and make sure they see the problems, or they will seek out the good points which they might be able to justify their assessment with, pos-sibly missing the issues with the property that could lead to reduction. Be aware, that you should be certain be-yond a doubt, that you are over accessed since once you start this process, this is a red flag to the assessor to check your property out. If you refuse to let them in, in many towns, the policy is to assess at the highest value possible. So if you have done property im-provements, make sure you have the permits in place for them or your quest for a reduc-tion could result in the opposite! When you get your tax bill you have the opportunity for an informal hearing, where you simply call your assessor and either talk on the phone or agree to meet to review the reasons why you believe the assessment is in-correct. If this is unsuccessful you have the right to present your case to the board of re-view. Ask how many will be on the panel and be sure to provide each with a copy of the data you will be working from. If you just bought your home, bring your sales data, and be prepared to prove the sale was an arms length deal. In NY State, grounds for refus-ing to reduce the assessment based on sales price is that the deal was not an arms length sale. Arms length sales are not; foreclosure or short sales, estate sales, sales between relatives or institution to institution sales. Be profes-sional in your presentation, and do not try to make an emotional appeal such as I lost my job and cant pay these taxes. If you are not satisfied with the result you can appeal to the Small Claims Supreme Court. To do so you would be advised at this point, to bring a professional in to help you with the matter even though you can represent yourself. They can help you with the presentation making sure you have the proper materials and tools to prove your argument. All property owners should review their as-sessments each tax season, to ensure that they are not improperly assessed. Because New York State has the highest property taxes of the nation, you cant afford not to!

As always, when considering repair or replacement of windows with failed seals, obtain several quotations from qualified contractors before entering into any contract. We hope that this provides you with valu-able information about the impact of fogged windows on the heating cost for homes. As always, please do not hesitate to contact our office if we can be of assistance in this regard, or in other issues related to home inspections.

    Obviously, fogged and drippy windows are not pleasant to look through, but what about when there is only slight fogging? Does this destroy the insulating qualities of the window and necessitate glass replace-ment? The table below offers a quantitative comparison of six (6) windows that are ap-proximately 30 inches wide by 48 inches tall. The windows are the same except for the type and quality of glass in them. In the chart, the last number under each type of glass gives an estimate for the an-nual heating cost to make up for the heat loss through the window. Although the table shows that the annual heating cost associated with each window is quite different, one needs to look at specific

    comparisons. For example, if taking a win-dow that has a failed seal and replacing the glass with medium quality glass, the annual heating cost goes from $14 per year to ap-proximately $4.42 per year. This is less than a $10 per year savings. What is the cost of performing this glass replacement? Well, the cost can vary from perhaps $100 to more than $200. This makes the simple pay-back somewhere between 10 and 20 years. If simply taking a window with a failed seal and repairing the window to remove the fog, the savings is closer to $5 per year for a procedure that costs less, but still presents a relatively long payback of about 15 years. Of course, the payback will vary based on many factors, but this gives at least one way to make a quantitative comparison.

    Fogged insulated glass should be repaired or replaced when the fogging destroys the pleasing appearance of the window. How-ever, when the failed seal is barely discern-able, it is difficult to justify repairing or replacing the glass from an energy cost sav-ings standpoint. The failed seal is basically a cosmetic deficiency rather than a significant deficiency in terms of the insulating value of the window. When addressing a failed seal, some win-dow companies can basically wash out the window to restore a clear appearance. Other companies will propose replacing the glass unit and maintaining the existing sash and frame. Still others will propose complete re-placement of the window. The right decision depends on the severity of the fogging, the

    Youre planning a home improvement and hopefully got three estimates from contractors that you checked out with the Better Contractors Bureau. You have decided on one as your contractor and call him to let him know he has the job. A date is set for him to come over to sign the contract and discuss the specifications: approximate start and completion dates and most impor-tant to him, the payment schedule. You check the contract over to make sure it contains the contractors com-pany name, address (not P.O. Box number), phone number, correct price, specifications, and the payment sched-ule. You find that hes asking for a large down payment and three prog-ress draw payments that are tied to various phases of the projects progres-sion phases. This is where you have the upper hand and hold all the so-called cards! (money) Never give a large down pay-ment! Its suggested that you give a good faith deposit of no more than $500. Where specialty items have to be ordered such as custom cabinetry,

    custom windows or doors or any other items that will only be able to be in-stalled in your home he will usually ask for more but its advisable to tell the contractor when he produces proof of the actual placed order you will then give him a draw for the item. The regular payment schedule in this area is usually a small good faith down payment and then three progress draws. Always make sure the payment coincides with the work thats done. For example in the case of an addition if the contract states one third when the mason starts the foundation dont pay it until you see the materials are on the site and the mason is actually working. The same for a framing draw or other similar work done. Any remodeling contractor worth his salt should have enough credit to buy materials and pay subcontractors to get the work started. However some suppliers want payment up front on specialty items and wont except credit so in this case the contractor is within his right to ask for payment before or-dering.

    Most jobs will entail changes so be sure that you get the specifica-tions and cost in writing and signed by both parties! Again dont pay for a change upfront and only when the change is started. No matter what the draw schedule is that you agree on al-ways protect yourself and keep a large enough balance to insure that the job is to your satisfaction. A walk through final inspection should be mandatory and usually pro-duces a punch list. If the job is com-pleted and the punch list only has a few minor items on it such as some missing caulking or a molding that needs re-placing and the balance is large then you should work out a payment for the balance holding enough to insure the contractor returns to finish the punch list items. Do not add to the punch list after the initial one so be sure you have listed all your concerns. When the job is finished hopefully it was an enjoyable experience and you can recommend the contractor to friends and relatives. Good Luck with your project.

    This month is all about pillows. The fluffing, the stuffing, the washing, the drying. Pillows can range in price from $4.00 to $200.00. It is true that you get what you pay for, but unless you are a relative of the princess and the pea, a good $20.00 to $40.00 pillow will be fine and give you many nights of comfortable sleep. Basically, pillows have one of four types of fillings: feather, Dacron, foam, or cotton. Different fillings require different care, but all pillows should be cleaned regularly, about every six to eight months. Pillows can contain all sorts of debris and varmints - gross, but true! Mildew,

    fungus, skin, and dust mites may be lurking in your pillows, so here are a few hints on how to clean your pil-lows and have a worry free sleep. Foam pillows must be hand washed in a mild detergent. Use the bath tub, and pick a nice warm day to do this job. Fill the tub with warm water and detergent, just capful is needed. Soak the pillows, then rinse. Fill the tub again and add cup of white vinegar. Squeeze out all the water. Be gentle, foam can break down - then hang or lay outside to dry. They will have a fresh clean scent from the out-door air. Feather and down pillows require different care - either hand washing

    Pillow talkmore than a fluff piece

    or dry cleaning. Washing in the ma-chine is also possible, but always use a gentle cycle, and very small amounts of detergent. When hand washing, re-member that it is a lot of hand work, the feathers repel water and the pil-lows take more time to get wet. They then can be air dried or toss them in the dryer on low with a couple of ten-nis balls. They will plump right up. Dacron pillows can be washed by hand or machine, but if they are inex-pensive, the $4.00 version, they will get lumpy and who wants a lumpy pillow? Cotton pillows can be hand or ma-chine washed also, using cold water and a mild detergent. Use the gentle
