^ Memorandum of Understanding v lT >v of th^Meeting v|f^>'* between the delegation of the Republic of Cyprus and the delegation of the Federal Republic of Yugoslavia Delegations representing the Government of the Republic of Cyprus and the Federal Government of the Federal Republic of Yugoslavia, the members of which appear in the attached Appendix I, met in Nicosia on 17 th and 18 th , June 2002 in order to discuss a mutually acceptable text for an Air Services Agreement between the respective countries to replace the Agreement between the two countries in force since 1976. The discussions were held in a friendly and constractive spirit. In the course of negotiations, the following understandings have been reached: (a) Air Services Agreement Both Delegations agreed on a mutually acceptable text of the Air Services Agreement which was initialled and is attached as Appendix II. The Delegation of the Federal Republic of Yugoslavia proposed that each Contracting Party shall have the right to designate more than one airline for the purpose of operating the agreed services. The Cypriot delegation stated that its policy is to designate only one carrier, and is willing to reconsider the matter if its policy changes.. (b) Capacity and Frequencies The Yugoslav delegation insisted on the increase of number of frequencies on the route LCA-BEG V.V. Therefore, Yugoslav designated airline JAT, is strongly opposing any kind of limitation of number of JU or any tentative partner flights. Yugoslav delegation strongly supports a creation of an offer equal to real demand of traffic movements. In order to achieve this, airlines operating that route ought to have open hands in satisfying market demand. Therefore, the introduction of four flights per week for Yugoslav airlines was proposed, as it was regular number of frequencies in the previous period. This would be considered as a first step in obtaining daily traffic on aforesaid route. Yugoslav delegation considers as not good practices of Cypriot Administration towards JAT-Yugoslavia Lines (A Scheduled Airlines) regarding issuance of approval for flight to Cyprus, on temporary basis, limiting it on 15days period

  • The C^prioi"'delegation prop îseci' *that the desigo îfei'-airline ofContracting Party shall be entitled to operate up to three weekly frequencies4for the Summer 2002 and up to two for Winter 2002 - 2003 seasons for eachcarrier and suggested that the two Aeronautical Authorities meet again beforethe end of the winter season of 2003 for re-evaluation of the situationaccording to the traffic results and performance of the two designated carries.In the meantime the Cypriot side will be ready to examine ad-hoc applicationsfor extra to schedule flights if traffic conditions justify it. The Cypriotdelegation explained that approvals were granted to JAT on a temporarybasis only because of the delays experienced by the Cypriot carrier inobtaining the necessary approvals from the Yugoslav Authorities and did notaccept the remarks of the Yugoslav delegation.

    (c) Signing of the Agreement

    Both delegations agreed to proceed with the fulfillment of the conditionsprescribed by their national legislation for signing of the Agreement at an earlydate.
