A GRADE 12 learner (18) of the Ntabanku-lu Senior Secondary School was acciden-tally shot dead in a shoot-out described asa botched armed robbery at a shop in Nta-bankulu on September 1.

Xolisa Diko from the Bhakubha locationinNtabankuluwas shot deadwhile hewasbuying paraffin from the shop. Police be-lieve he was shot after being mistaken fora robber. He was found dead with the 5-li-tre paraffin container next to him.

It is alleged that five armedmen stormedthe shopwhileDikowas already inside theshop. The men were wielding shot gunsand were demanding money, forcing eve-rybody to lie down.

But the Pakistani owners of the shop,

didn’t surrender.An eyewitness said the owners came

from the other side of the shop and whenthe robbers realised this, they startedshooting at the owners and an exchange ofgunfire ensued between the robbers andowners.

Two robbers died on the scenewhile twoshop owners were rushed to hospitalwhere one of them died later.

Police spokesperson Captain MlungisiMatidane said three of the robbers had-managed to escape from the scene.

“A total of four people died in this inci-dent and we will work tirelessly to ensurethat we arrest those responsible,” he said.

Matidane confirmed that no money wastaken from the shop. He said they hadfound three 9mm pistols on the scene andsome ammunition.

TWO murder accused in a shooting at a tav-ern in Ngqeleni on August 2, appeared in theNgqeleni Magistrate Court last Tuesday andwere remanded in custody for their bail ap-plication.

Mkhulekeni Phakathi and Earnest Ngemawere arrested last month in connection withthe shooting in the Mdumazulu locationwhere six people were shot and one died.

The suspects were working at a construc-tion company that was doing work on theHluleka access road and scores of communitymembers protested outside Ngqeleni court tooppose their bail.

The man who died from the shooting isLindikhaya Sokhanyile (28) and is a son ofone of theMarikana victims, the late PumzileSokhanyile.

Tavern owner, Mlamli Mnakaniso (44),who was also shot in the arm during theshooting, said he was thankful to God that hesurvived the ordeal.

“I was shot in the arm while I was aboutto start the car on my way home as I wasabout to close the tavern,” said Mnakaniso.

He said when they heard gun shots, peoplefrom the tavern came out to look and the gun-men continued shooting at them, which gavehim a chance to roll-over and hide under hisvehicle.

“I heard several gunshots in the yard andinside the tavern. Two men came to the carto look for me but because I was under thevehicle, they did not see me and they left,”he said.

According to Nokwethisa Mlindwa (34),who was the cashier at the tavern on thatnight, one of the suspects came into the tav-ern before the shooting and bought a beerthat he drank.

“When it was time to close, my boss tookthe cash and went out and the suspect fol-lowed him to his car.”

She said when she heard the gun shots out-side, she turned off the lights.

“That did not help much because the sus-pect came and pointed at me with a gun de-manding money.

“I told him that there was no money andI begged him not to shoot me, then he startedto search me and found R40,” she said.

THE South African Human Rights Commis-sion (SAHRC) have found that the EasternCape departments of Education and Trans-port haveviolated learners’ right to basic edu-cation by failing to provide them with trans-port to school.

This was found after an investigation intothe problems with scholar transport in theEastern Cape was conducted.Isaac Mangena, Spokesperson for the SA-

HRC, said the departments have been orderedto provide urgent time-bound remedies todeal with this problem.“The Commission received a complaint in

May 2013 from former Democratic AllianceParliamentarian Lindiwe Mazibuko allegingthat learners from Zweledinga Senior Sec-ondary School in Queenstown had to walklong distances to school in order to access ed-ucation.“These learners were provided with schol-

ar transport in the previous year, and thescholar transport was suspended without no-tice being given to the school,” saidMangena.He added that owing to recognizing the sys-temic challenge of lack of transport of learn-ers to schools in the province, the Commis-sion elected to investigate more schools inthe province and visited schools such asLovemore Park FarmPrimary School in PortElizabeth, and Ntabankulu, Dalibaso,Luthubeli and Upper Mpako SecondarySchools inMqanduli area to gather more evi-dence relating to the scholar transport prob-lems. The investigation revealed that theavailability of transport to learners at theseschools was not adequate and in some in-stances, non-existent.The Commission found that the failure by

the Department of Education and the Depart-ment of Transport to provide transport, vio-lated learners’ right to education as en-shrined in Section 29 of the Constitution.“In addition, the departments’ failure to

provide subsidized transport amounts to aninfringement of its duty to consider the bestinterest of the learner as per section 28 of theConstitution.As a result, the Commission recommend-

ed that these departments should reviewtheir memorandum of agreement regardingthe provision of scholar transport to ensurethat it’s consistent and does not preventlearners from going to school, thus violatingtheir right to education.”The statement fromSAHRCstated that the

departments must provide the commissionwith monthly written reports on the

progress made towards the delivery of trans-port to the learners of the schools as listedabove.The Democratic Alliance Member of Parlia-

ment in the Eastern Cape, Edmund van Vu-uren, said his party would closely monitor thesituation until it is resolved.“The DAwill now request that this report be

tabled in the Eastern Cape Provincial Legisla-ture in order to ensure the recommendationsmade by the SAHRC are enforced immediate-ly,” said van Vuuren.He added that his colleague, the DA Shadow

Minister of Basic Education, Annette Love-

more,will also have the report brought beforethe Portfolio Committee on Basic Education,so that the national policy can be improved.Department of Education Spokesperson in

the Eastern Cape, Loyiso Pulumani, said theDepartment had received the report from theSAHRC and that they are currently in theprocess of studying it.“All the recommendationswill be fully con-

sidered. The SAHRC is an important Chapter9 institution in our country’s constitutionallandscape and the department will treat it assuch, with the full deference they deserve,”said Pulumani.

PhathisizweNgwaqawas sentenced on Septem-ber 1 following themurder of Mninawa Gewu (48)with a hammer in his home inMbodleni location,Mount Frere on November 02, 2011.According to court papers Ngwaqa kicked the

door open and attacked Gewu who was alone inthe house.He allegedly hit him with the hammer on his

head until he died before taking the deceased’smoney, vehicle and cell phone.Following a thorough investigation led byWar-

rant Officer Thandile Vezi the “hammer-man,” ashe became known after this incident, was arrest-ed.

. In a separate incident Elliotdale police arrest-ed aman (31) and awoman (22) in connectionwiththe murder of a man (50) in the Thafalehashe Ad-ministrativeAuthority inElliotdale onAugust 28.It is alleged that threemen armedwith firearms

entered the shop and demanded money from thedeceased and then shot him to death.Police spokesperson Major Zamukulungisa Jo-

zana said they then took aR2 000, airtime amount-ing to R300, cigarettes amounting to R300 and hisfirearm before fleeing from the scene.He said the man and a woman were arrested in

Thafalehashe and could appear in the ElliotdaleMagistrate Court on charges of business robberyand murder.

Tough sentence for hammermurdererand two men arrested. According tothe police spokesperson, CaptainMlungisi Matidana, the cattle werestolen in Flagstaff, Harding and Koks-tad.Matidana said that meant there was

across-the-border theft which couldmake it difficult to recover the stockif it is stolen.“It might happen that they take the

stock from Bizana and exchange it inKwaZulu-Natal towns like Hardingand Kokstad which is why we’ve re-covered stolen stock there,” said Mati-dana. Some of the stock had alreadybeen identified by the rightful ownersbut those that have not yet been identi-fied are at a compound.He urged people to come forward if

they had lost their livestock.

ed trees andHenever asked anyone to cut them

down. If we continue creating veld fires andcutting trees, we will suffer from climatechange that will only hurt us and our nextgeneration,” said Mdingi.“One tree gives oxygen to a maximum of

fourpeople,whichmeansbycuttingone treefour people will inhale dirt and therefore re-ducing their life span,” said OR Tambo Dis-trict Municipality Environmental affairs of-

EASTERN Cape MEC for Heath, Dr PumzaDyantyi and Umzimvubu Local MunicipalityMayor Councillor, Khulukazi Phangwa,blessed the commencement of the construc-tion of a new health facility to the value ofR5 million in Ward 21 of the Mpindweni loca-tion.

The sod-turning ceremony, which tookplace on September 5, was held at the sitewhere the clinic would be constructed.

Residents of Ward 21 were present to wit-ness the proceedings.Western Chrome Mines (WCM), which is

a business unit of Samancor Chrome Limit-ed, had donated the amount for the construc-tion of the clinic, as part of its corporate so-cial investment programme and as requiredby the mining charter.WCM had identified the Mpindweni Com-

munity as one of the beneficiaries of its com-munity upliftment projects.After a series of consultations and engage-

ments with the Umzimvubu Local Munici-

pality, the Mpindweni community and the De-partment of Health (District Office); the pro-posal by WCM was welcomed with greatappreciation.The Department of Health received a propos-

al from WCM, scrutinised it and saw it fit andviable for a clinic to be built here.Mpindweni, Bislane, Qunubeni, Qoqa, Tole-

ni, Mhlanganisweni, Dangwana, Mvuzi, Mbi-zeni, Cwalinkungu and Mabhobho are amongthe villages that would benefit from this healthfacility. Currently the nearest clinic to thesevillages is 18km away.

People spend around R60 to travel to thenearest clinic, while it costs around R600 tohire a vehicle to get to hospital in an emergen-cy. The chrome mining company, situated inthe North-West Province and Limpopo, cameto the decision of ploughing back into thiscommunity, because some of its workforce isfrom here. According to the Department ofHealth’s regulations, for a clinic to be ap-proved, aminimum of 10 000 people should beresidents of the area that it would service.The facility is scheduled for completion in

April 2015.

NTABANKULU Local Municipality, in linewith the provincial communication strategy,held a communication strategy workshopwith the aim of making sure that whateverthe municipality does is communicated withall stakeholders, including the community.

During the workshop, the Alfred Nzo Dis-trict Municipality, under which Ntabankulufalls, shared information with Ntabankulucouncillors, invited stakeholders and theme-dia on communication channels inside andoutside the municipality, up to provinciallevel.The Ntabankulu Municipality communi-

cations department also shared the challeng-es they had experienced due to poor relationsbetween the municipality and the media,poor co-ordination of communication withinthe municipality and their limited budget.“The communications department, as the

face of the municipality, needs to be well fi-nanced. As the Ntabankulu LocalMunicipal-ity communications office it is hard to deliv-er, due to the limited funds we have,” said

Municipal Relations Manager Xolile Petela.He added that itwas difficult for themunic-

ipality to communicate a clear message,since interpretation of documents into differ-ent languages remained a problem. This iswhy theyhad agreed onhaving theworkshopas a means of solving their problems.Petela presented a proposed action plan to

solve all the problems the municipality wasfacing. The action plan suggests they createa good working relationship with rate pay-ers, engage with the media as well as otherstakeholders and use Imbizo’s to communi-cate with the communities they serve.The plan further stated that they needed to

improve people’s lives and build a strong re-lationship between the municipality andFaith Based Organizations. “Regarding allthe challenges we have, it remains every-one’s duty to make a change. Changing theimage of ourmunicipality depends onus all,”said Mayor Vusi Mgoduka.TheMayor said they needed to redefine the

way they had been doing things in the pastand had to look into improving the waythings were being communicated internallyand externally.

HILLCREST TOWNSHIPGETS NEW FACELIFT

Report by Zibele Limani & Amanda NgquzuIn a bid to improve the lives of our communities, KSD municipality has splashedR15 millions to upgrade seven (7) streets of Hillcrest which are Yellow wood, MtatiStreet, Rose wood, Stink wood, Msintsi Street, Mbongisa and a parallel streetknown as West Street. 30 locals got employment in the refurbishment and oneEngineering Student got a training opportunity.The refurbishment of the above-mentioned streets started on May 2013 and it wascompleted on April 2014. Three (3) sub-contractors got a piece of slice in thedevelopment. But the Municipality is not done yet with the development ofHillcrest, right now, it is in the process of tenderising the revamping of GeraldHawks andMsimbiti streets.KSD Municipality's Human settlements department started the project with theimplementing agent known as Stedone and it spent R6 million revamping theabove-mentioned streets of Hillcrest and KSD's department of Technical servicestook over and run the project to completion.One of the residents of Hillcrest, the 18 year old Devin Fleshman had this to sayabout the Hillcrest development: “We are pleasedwith this revamping of our streetsbecause we use to have gravel road but now we can walk freely on a tar road. WethankKSDMunicipality for coming to our rescue”.The Municipality urges Hillcrest residents not to wash cars in the middle of theroad as this will lead to the erosion of the road and the blockage of storm waterdrainage.KSD Executive Mayor, Councillor Nonkoliso Nngqongwa had this to say about thisproject: “Ever since the inception of KSD Presidential Intervention, the lives of KSDresidents were changed drastically. Yes, we are not done yet with the developmentof our streets and we are planning to roll out phase two (2) of street revamping atIkwezi township. The following streets of Ikwezi Township will be refurbished:Dikweni, Gobodo,Mpako and Finiza Street”.However, the Municipality has established four teams dealing with potholepatching programme in the Mthatha Central Business District, Mthatha North,MthathaEast,Mthatha South andMthathaWest respectively.

THE Thembu Royals were crowned the 2014Mthatha champs at the Rotary stadium inMthatha this past Sunday, following theirhard-earned victory over Mthatha Bucs.

Bucs’ defence that took no prisoners at theback almost cost them in the early minutesof the game.Bucs gave away a free kick too close to the

box as they couldn’t handle the Thembu’sgoal-hungry strikers. And a few minutes af-ter that they again conceded an early goalwhich was ruled out as being offside by thematch official.The game ended in a goalless draw and

since it was the final, a decider was neededand they went on penalties.Confident Bucs’ were the first that took

the first penalty but their confidence wascalmed down after they missed.Thembu’s goalkeeper slaughtered in the

first goal for his team and saved three moreand consequently put his side ahead. Mt-hatha Bucs’ nerves grew as they missedmore.Royals’ captain sealed his team’s win by

a marvellous strike that left the Bucs’ goal-keeper shocked and the arena roaring withjoy. Bucs’ didn’t go home empty handed, asthey were consoled with Build It sportingbags, balls, soccer kit and miniature tro-phies.Build It representative, Walter Chakufu-
