  • Better Attendance 'Must'For Trade Conventions

    Although the sixth Annual ARMADA Convention got off to arather sparse start at the Eden Roc Hotel in Miami Beach June25, attendance and enthusiasm gained momentum as the hoursand meetings sped by.

    It was generally conceded that whatever air of immediate dis-satisfaction permeated the convention was caused in the mainby the fact that Federal Trade Commissioner John R. Reilly,speaking on Saturday, June 27, did not put forth the FTC TradePractice Rules as had been a strong possibility. They are nowexpected to be divulged before the end of July, and this iswhat everybody is really waiting for.

    Highlights of the convention, of course, were the dynamicspeeches by Reilly on "Industry and the Federal Trade Commis-sion Responsibilities Under The Trade Practice Rules"; ARMADAGeneral Counsel Earl Kintner; William P. Gallagher, Columbia'sVice President of Marketing, on "A Sound Future in a SoundIndustry"; Congressman James Roosevelt on "Doom or NewLife For The Independent Distributors," with emphasis on trans-shipping and functional discounts.

    Especially impressive, too, was the expert, polished and pro-fessional Colpix Records Distributors Meeting, Sunday, June 28,with the unveiling of its new product by label execs. (One wagsuggested Colpix rent an off-Broadway house and give the pre-sentation a run, it was that good.)

    Ackerman Awarded

    Gratifying to all conventioneers, too, was the presentationSaturday night, June 27, of a plaque -certificate to veteran musicreporter Paul Ackerman for his service and devotion to theindustry over the years and especially for his contributions toARMADA as Executive Secretary during 1962 and 1963. Acker-man was visibly moved by the presentation which proved oneof the most popular events at the convention.

    One thing is clear, however, from the entire convention pic-ture. Regardless of what the Trade Practice Rules bring, theindustry can never attain full health unless organized attemptsto iron out things-in this case, the ARMADA Convention-re-ceive better backing from the parties, associations, businesses,etc., involved. More distributors, along with other factions con-cerned, should have attended this convention. There is no mistak-ing that.

    Let's hope that the Trade Practice Rules, when they finallyarrive, are given better backing by those concerned. Otherwise,the oft -used industry word "chaotic" will be too mild a wordfor the results.

    4th Streisand LPNEW YORK - Barbra Strei-

    sand's next album for Colum-bia will probably be taggedafter her current hit Colsingle, "People," from herBroadway show, "Funny Girl"(which Capitol has on wax).

    According to word afield, thealbum, like Miss Streisand'sother solo LP efforts, will con-tain selections of her ownchoosing and is being recordedright now. Permission, how-ever, to tag the package afterher single will probably have

    Monteux Dies; 89Pierre Monteux, the French -

    born conductor, known here forhis work with the San FranciscoSymphony, died last week. Hewas 89.

    Monteux, who recorded forRCA and Westminster, had beenill for a long time.

    His career started in 1910when he led the Ballet Russeorchestra in France. His firstpost with an American companycame in 1916 when he conductedthe French repertory of theMetropolitan Opera. He tookover the San Francisco Sym-phony in 1934.

    In his new position, Loetzwill be responsible to WilliamP. Gallagher, Vice President,Marketing, for directing theactivities of Columbia RecordDistributors.

    Since joining Columbia in1955, Loetz has made significantcontributions to Columbia's mar-keting efforts. Prior to his newappointment, he was GeneralManager, Columbia Record Dis-tributors.

    Disney's MetzDies in MiamiMIAMI BEACH-{Herb Metz,

    33, Assistant Sales Managerfor Disneyland Records in NewYork, died suddenly Sundaymorning, June 28, in his hotelroom at the Eden Roc duringthe ARMADA Convention.Heart failure was the causegiven-Metz had had a historyof heart disease.

    Metz was being groomed totake over the Sales Managerspot in New York headed byBob Larsen, who was planningto return to West Coast activ-ities on behalf of DisneylandRecords. A resident of Bergen-field, N.J., Metz previouslyworked for Riverside Recordsand is survived by a wife andthree children.

    ABC AnnouncementNEW YORK-To avoid any

    misunderstanding due to recentpersonnel additions at ABC -Paramount, Sam Clark, Presi-dent, announced last week thatthere are no changes plannedwhich would involve any of theexecutive personnel presentlywith the company.

    Beatles album, "A Hard Day'sNight," the soundtrack set ofthe group's initial starring film,has proved to be "the fastest sell-ing album in the history of therecord industry," UA reports.

    Introduced at the label's dis-tributor meeting at the EdenRoc Hotel in Miami Beach, overone million copies have been soldand delivered as of Wednesday,July 1, with additional orderscontinuing to pour into UnitedArtists headquarters.

    "A Hard Day's Night" isslated for saturation bookingsand multiple city openings inearly August. UA brass are con-fident that at least three millioncopies will be sold prior to thefilm opening, after which, withthe movie's play dates and coastto coast personal appearances of

  • Too -Early English Wax on USMkt. a Problem: Epic's Levy

    NEW YORK - Len Levy,General Manager of Epic Rec-ords, returned from the AR-MADA Convention last weekwith an increased awareness ofa problem which he feels isgrowing in the record industry,and was vehement when he toldRecord World all about it.

    "I understand this problemexists not only with Epic," heexplained, "but with severalother American companies whohave English product. Ofcourse, I can only speak formyself in specifics. Briefly, it'sthis: When a label has, for in-stance, a hit group like Eng-land's Dave Clark Five overhere on wax and selling, some-one in England decides to bringout a new record by the artistwithout consulting the Amer-ican company. The new recordgets to the stations, andtrouble starts."

    It's Happened AgainThis kind of thing had just

    happened again in Miami withThe Five's tune, "Because,"which, Levy said he had been

    told, was being aired as "thenew Dave Clark release" and"an exclusive." The group'scurrent single click on Epic is"Can't You See That She'sMine," which under ordinarycircumstances would havequite a few weeks of life left butwhich now may lose ground.

    According to Levy, all thishappened previously with theboys' "Glad All Over." "Thatwas doing great here, thensomeone sneaked 'Bits andPieces' on the market severalweeks before we were ready torelease it."

    "We're not in a position toproperly promote the recordswhen they arrive out of theblue like this," Levy went on."And this kind of spurious re-lease to stations creates prob-lems for other stations, too.They go to distributors andwant to know why they gavecertain stations exclusives onthe new Epic Dave Clark re-lease."

    Levy said there is a networkextending from England doingthis kind of thing. "It was anespecially propitious time atARMADA," he opined. "I've

    been getting calls here fromdistributors from all over thecountry about it. Whoever didthis in England feels they canforce our hand over here intodoing things.

    A Job For FTC?"I think this all might even

    be something the FTC shouldlook into. As I see it, radio sta-tions are perpetuating a fraudby making the public believethese disks are new Americanproduct and can be obtained inthe States at that moment. Thepublic is getting a raw deal,and the manufacturer, too. TheBeatles' United Aritists sound-track LP was released simi-larly, creating a demand for itbefore it was ready."

    Levy believes these prema-ture English factions are hurt-ing themselves and their salesbecause they don't really un-derstand the American market.Eventually, he added, they'llhurt themselves to the extentthat nothing will sell.

    "Something must be doneabout all this," Levy stated."It's unfair."

Roosevelt, Chair-man, Subcommittee on Distri-bution for House Select Com-mittee on Small Business, spokeat a Monday, June 29, AR-MADA meeting at the EdenRoc Hotel, making it known hewas delighted to work withthe association and had op-timistic hopes-and sugges-tions-for the problems facingit.

    Said Roosevelt: "None of usobjects to problems of growthor change. Meeting and solv-ing them is the main businessof living. It is only when a situ-ation is misused or when un-fair advantage is taken thatthe small businessman findshimself compelled to seekCongressional or other outsideintervention or assistance.

    "This has been the patternmy Subcommittee has foundconcerning dual distribution.Almost without exception,where serious injury is result-ing to the small business com-munity from dual distribution,it is not caused by the mereexistence of the practice. The

    injury stems rather from theuse of unfair tactics or an at-tempt to take what would seemto be an unfair advantage of aparticular situation.

    MIAMI BEACH - Speakingat the ARMADA Banquet Sat-urday, June 27, at the Eden Roc,Columbia's Vice President ofMarketing, William P. Gal-lagher, predicted that, industry -wise, the best is yet to come.The speech was appropriatelytitled, "A Sound Future in aSound Industry."

    "Every change in the patternof distribution which we havewitnessed in the past fifteenyears has not been a sudden up-heaval, but the result of deep-seated social, technological andeconomic courses," Gallagherbegan.

    "Let's take a minute to definethe role of marketing in thisindustry. Marketing is theorientation of a business to itsmarkets, rather than to itsplants or warehouses. Market-ing is the art of selling throughto the customer not just to thenext step in the distributionchange. Too few of us in thisindustry today understand themarketing concept, too few ofus are willing to accept thechanges and responsibilitiesnecessary to guarantee a soundfuture in a sound industry."

    The album contains eight vocalselections by The Beatles plusfour instrumental themes fromthe picture all composed byBeatles John Lennon and PaulMcCartney. The vocal selectionsare the title song, "A HardDay's Night," "Tell Me Why,""I Cry Instead," "I'm HappyJust To Dance With You," "IShould Have Known Better,""If I Fell," "And I Love Her"and "Can't Buy Me Love." Theinstrumental themes from thesoundtrack are "I Should HaveKnown Better," "And I LoveHer," "Ringo's Theme (ThisBoy)," and "A Hard Day'sNight," all played by GeorgeMartin, the Beatles' musical di-rector.

    UA Records has just releaseda single of "Ringo's Theme(This Boy)" and "And I LoveHer" due to "unprecedented re-quests" from radio stations anddealers.

    Years ago someone made the statement about records, "It'sgot to be in the grooves." Since that time, most of us have ac-cepted the fact that it is the over-all sound of the record thatsells it rather than one particular feature. True, a record mayhave an outstanding story, vocal, beat, gimmick or novelty ideathat immediately makes it more saleable, but unless it is properlyproduced to the complete satisfaction of the public it will berejected. We all recognize that merchandising and promotionplay an important part in the ultimate success of any hit, butno amount of promotion has ever made a good record out of abad one.

    Recently, many radio stations have asked me how to properlyprogram jingles. They have queried if it is necessary to buyexpensive jingles; how long should they be; should they bescheduled on the log, and, if so, where? Other stations havewondered about the frequency of play for new records and howmany of these should be added per week.

    Many questions have arisen about the length of play lists. Ihave been asked about contests and the frequency of play foroldies. All of these questions are important, and the correcthandling of each will most assuredly relate to a station's ratings;but the most important question of them all is almost alwaysomitted. No one has asked what kind of a sound his stationshould have to make and keep it number one in its market!

    Just as it is with records, it is the total sound of a radio stationthat is accepted by the public rather than an individual soundor idea. In other words, "It's got to be in the grooves !"

    The jets got quite a work-out from people in the record busi-ness last week. David Rose flew here from England for one shortweek, during which time he wrote and scored MGM's "QuickBefore It Melts." The ink wasn't even dry before he was backon the plane headed for his family who stayed behind.

    At about the same time The Rip Chords hopped on a jet out ofN. Y. which also was aimed for Los Angeles. They stayed herejust long enough to put in three hours at the recording studioand do one-half of their new single for Columbia which is duefor immediate release. Sides are titles "Wah Wahini" and "OnePiece Topless Bathing Suit." The big label is also very excitedabout another West Coast group The Dave Brubeck Quartet andtheir latest release "Toki's Theme," which was written for thenew Craig Stevens TV series, Mr. Broadway."

    Bill Finnegan (of Sauter -Finnegan) is going to do the arrange-ments on the new Sam Fletcher album called "I Believe In You."Lee Magid, Sam's manager, got RCA Victor to agree to let VeeJay use the original "I Believe In You" which Sam recorded forthem in 1962 and which was a big hit single.

    Connie Francis is scheduled to appear at the Hollywood Bowlon July 24. It will be her first appearance at The Bowl, and tomake the evening even more exciting, Peter Nero will also bestarring . . . Jerry Wallace is packing his bags in preparationfor a two-week whirlwind trip which will take him into Minne-apolis, Pittsburgh, Cleveland, Detroit, Cincinnati, Chicago, Se-attle and San Francisco. He'll be plugging hard for his record"It's A Cotton Candy World" just out on Mercury . . . My spiesalso inform me that James Brown was in town a couple of daysago to record an instrumental album for Smash.

Thefirst of these is transshipping.This disruptive practice isreally little more than 'dump-ing.' I cannot urge too stronglythat the Commission squarelyface this problem and write arule controlling the use oftransshipping.

    "The second question of im-portance to all segments of theindustry is that of functionaldiscounts. I do not believe thatany of us are opposed to thosefunctional discounts that arelegitimately earned by theperformance of the variousfunctions required in the dis-tributional process. It is clear,however, that a rule is neededto insure that the only func-tional discounts given will bethose which have actuallybeen earned. A discount whichis functional in name only isreally nothing more than aprice discrimination-and, ifa rose by any other namesmells just as sweet, I say toyou that price discriminationby any other name is just asdestructive."

    A third rule which he feltis imperative is one concerningsales below cost. "The absenceof such a rule would consti-tute a serious deficiency inyour industry rules," he said.

    "I agree with your distin-guished counsel, Earl Kintner,that existing law cannot copewith all practices which aretoday harming small business-men in the distributive sectorof our economy. The structureof our antitrust laws is notwholly relevant to the problemsposed by vertical integration.There is mounting convictionin many quarters that the nextorder of business must be asearching re-examination andre-evaluation of our antitrustlaws, particularly with respectto marketing practice.

    Studies On"It is my understanding that

    the Senate Antitrust Subcom-mittee will soon commence anew series of studies of ecoc-nomic concentration. I believethat this is a most useful un-dertaking, and would like tocommend Senator Hart and hiscapable staff on their decisionto embark upon this neededproject. Their investigation, to-gether with the study which Iam proposing here today,could be invaluable to theentire Congress in its work con-cerning the vital areas of traderegulation and antitrust."

    turers today, the distributorrepresents a landing field. I dis-agree with this philosophy. Tomy way of thinking the dis-tributor represents the point oftake -off. The successful distribu-tor, next to the A&R man, isthe most creative step in thechain of events that leads to theultimate sale. The distributor'srole, as I see-and those of youhere who have been associatedwith me know I practice whatI preach-the distributor's roleis to motivate the ear and theeye of every consumer he canreach in his area of primaryresponsibility. His next andmost vital role is to supply thedemand he creates.

    "A word about today's re-tailer, the link in the distribu-tion chain that has been chal-lenged with the responsibilityof coping with the demands ofthe consumer on one end andthe prejudiced interests of thedistributor on the other. Thesuccessful record retailer today

    is the man who learned a longtime ago that he could not re-sist change. He recognized hisrole and dedicated his effortstoward satisfying the needs ofthe consumer. He learned, too,to take his wares to the peopleinstead of sitting idly by, won-dering where the people went."

    Gallagher finished by saying,"in the era of enlightenment, youmust rededicate yourselves tothe continued growth of this in-dustry, in a climate of mutualconsideration. You must respectthe role of the manufacturer,the distributor, the rack jobber,the one -stop. I have no quarrelwith those who choose to per-form more than one role in thedistribution system of this in-dustry. cMy only quarrel is withthose who do not accept the fullresponsibility for the roles theychoose to perform.

    "We can all be assured of asound future in a sound indus-try if, under a code of under-standable trade practices, wededicate our roles in the mar-keting of phonograph recordswith personal integrity, in afair and sensible manner, withequity for all."

    Command Issues6 Varied LPs

    MIAMI BEACH - Commandannounced the release of threepopular and three classical al-bums at its June 28 meeting. Inpresenting the new disks, Com-mand National Sales ManagerLoren Becker stressed "the im-portance to both distributors andCommand to sell 'Command'rather than individual hit al-bums."

    He pointed out that "thestrength of the label was in itscatalogue sale" and that "thehit albums and singles were the'frosting' on the cake."

    Becker also mentioned thatthe label had just completed thesecond biggest quarter in itshistory.

    Command General ManagerEnoch Light stressed the pointthat it was "most important toknow what goes into each indi-vidual album and which selec-tions are most effective in dem-onstrating the release" in makingsales.

    ABC prexy Sam Clark con-gratulated the Command headsand sales organization for a"phenomenal sales record" in itsfive-year history and hoped thatthe next five years would be assuccessful.

    Little LP Topic Of Weiss SpeechMIAMI BEACH - At the

    ROSA Meeting Saturday, June27, Gene Weiss, Columbia Gen-eral Manager, Sales, told of thelabel's plans to follow up itsinitial batch of six stereo singlesand six little LPs for musicoperators with six more of eachfor August marketing.

    "We are streamlining ourHall of Fame series," Weisssaid, "with a browser unit avail-able in September for one stopsso they can have a completeadult department. There's onebig danger, however. The stereosingles and little LPs for jukebox programming must not getinto the hands of dealers forsale to consumers. At $1.50 eachthese little LPs could destroythe regular LP sales. Columbia

    will stop producing little LPs ifdealers start doing this kind ofthing."

    According to Weiss, unlessthe one -stop aggressively facesthis new program, they will befaced with the total loss of adultprogramming. "One stops mustattend the MOA," Weiss wenton, "because 90% of records arebought by ops."

    Questions were asked regard-ing additional title strips needed,but Weiss said that Columbiawould not commit itself on thisadded expense until it was seenjust how things were workingout.

    Atlantic and Atco executivesreturned from the ARMADAConvention in Miami Beachbeaming over the success oftheir annual distributors' meet-ings.

    Nesuhi Ertegun, Vice -Presi-dent of Atlantic said, "Ordersfor over a half million dollarswere written at the meetings on20 new albums introduced to thedistributors. This puts us wellon the way towards the milliondollars in album sales antici-pated during the period of thesales program. On the basis ofthe enthusiastic reception of ourdistributors to the new product,the million dollar figure is al-together too conservative."

    A full attendance of Atlanticand Atco distributors were onhand for the meeting in Miami.Commenting on the reaction ofdistributors, Len Sachs, Directorof Albums Sales and Merchan-dising said, "Our strong newproducts and the various facetsof the sales programs fulfill theneeds of our distributors andtheir salesmen in selling Atlanticand Atco in today's competitiveand selective buyer's market.We are looking forward to oneof the most successful albumsales programs in our history."

    The Atlantic and Atco salesprogram calls for a 121/2% dis-count on all new album releasesas well as all the LP catalogues.

    Crusader Credo:What Price Artist?

    dom for an artist!" might havebeen Richard III's cry had helusted after a record companyinstead of a throne; for, accord-ing to Harry iMaselow, GeneralManager of Crusader Recordshere, the artist is the most im-portant element in the successof any diskery.

    And Harry should know. Aveteran of many years' ex-perience in several phases ofshow business, he also beganCrusader in January, 1964, andstarted swinging the followingmonth with the acquisition ofthe Terry Stafford master,"Suspicion." That song was asmash, of course, and was fol-lowed by the "Suspicion" albumand young Terry's most recentsingle, "I'll Touch a Star," bothof which did-and are still do-ing-well.

    "You're only as big as yourartists," Harry told RecordWorld last week. "It's vital todevelop new artists if you wantto stick around. I don't deludemyself into thinking that TerryStafford's going to be my breadand butter for life. I've got tobe on the look -out for talentconstantly. Right now, though,we at Crusader are concentrat-ing all our efforts on Terry,helping him to become the all-around performer he can be,which you have to be to survivetoday. The famous choreog-rapher Charles O'Curran (alsoPatti Page's husband) is stag-ing Terry's new night club act;and Terry has just cut his nextalbum, with a single to bepulled from the LP."

    But it's not all artist, farfrom it, Harry asserts. "There'sno such thing as an armchairhit," he went on. "To break`Suspicion' nationally, there wasplenty of hard work Old-timers

    like myself know this; it's nosecret. You have to set up thedistributors, the contacts withpromotion men-the phone billscan break you, you know. Andthere's the element of time, themonth. (Instrumentals, by theway, don't seem to me to havesuch a hot chance to make it insummer. I was just talkingabout this with a friend. Dur-ing the summer kids have lovein their hearts and they wantto hear ballads.) And last,there's the luck involved."

    Harry said he was mightyfortunate to have John Fisheras A&R chief and Les Worden-"a man of diversified inter-ests who is fascinated by therecord business and has helped

    One of the problems facinga new label like Crusader isscaring up good masters. Ac-cording to Harry, people withgood masters go to the majorsfirst. "We have to go out andhustle the masters. That's whythe majors get so many of thetop masters."

    Wherever you turn in the rec-ord business, it costs money, hesighed. You can't just press acouple of hundred records; youmust get out a minimum of athousand, get them shipped andpromoted.     are the valid economic functionsin terms of the record indus-try?" asked ARMADA CounselEarl Kintner at the conventionMonday, June 29. He then wenton to say of his question, "Thisis probably the most controver-sial question in the industry andthe fact that it is unresolved isclearly an important key to theindustry's difficulties."

    In his candid speech aboutillegal pricing practices in theindustry, he gated that "nosegment of the industry-andindeed relatively few membersof the industry-has been ableto avoid falling into the patternof illegality."     And all areas are importantin the recording field, Harrystressed, pointing out, too, thatmany record reps neglect tocourt the djs who hold positions"just outside of the big towns.They try to get with the topdisk jockeys only, forgettingthat djs move around a lot-and frequently go up. Even anewsman can be important tothe success of a record."

    Thinking young is anotherMaselow credo: "When youmanufacture for the young, youhave to give the kids what theywant. Still, you have to workon something you have con-fidence in. Even if it doesn't al-ways sell big. Look at JerryVale, for instance. I buy all hisrecords. He's one of the bestsingers around, but although hegets quite a lot of air play forsome strange reason he can'tsell records.

    ords' summer sales plan, "TheRed Carpet Is Out," was un-veiled to Colpix distributors atthe company's sales meeting atthe Eden Roc June 28. In addi-tion to portions of 13 new al-bums and two repackaged LPs,several new singles were alsoplayed.

    Attending the conference wereColpix' sales, promotion, adver-tising and a&r staffs and repre-sentatives from Columbia Pic-tures. Reporters from severalmusic trade papers were alsopresent.

    Topics discussed included theimportance of a close workingrelationship between Colpix dis-tributors and Columbia Picturesfield men and several im
