COMMERCIAL BAIL BOND SURETY OVERSIGHT BOARD Title 31A, Chapter 35, Part 1 - 7, Bail Bond Act
The Board is composed of seven voting members appointed by the commissioner for a four-
year term. Four members represent four bail bond surety companies, two represent the general
public, and one is an attorney. There is also one nonvoting staff member from the Insurance
Department. As of December 31, 2016 Bail Bond Board members included:

Duties of the Board are described in 31A-35-202, and include:
making recommendations for rules;
making recommendations regarding action against surety company licenses; and
conducting investigations of allegations of unprofessional conduct on part of bail bond licensees, and reporting results to the commissioner.
Meetings were held quarterly, on January 13, 2016, April 13, 2016, July 13, 2016 and November
2, 2016, from 12:00 Noon – 1:30pm, which is generally the second Wednesday of the month.
There was a supplementary meeting on March 23, 2016. Minutes of these meetings can be found

TITLE AND ESCROW COMMISSION Title 31A, Chapter 2, Part 4, Title and Escrow Commission Act
The Commission "shall administer and enforce the provisions in Title 31A related to:
(a) title insurance; and
(b) escrow conducted by a title licensee or title insurer."
The Commission is composed of five members appointed by the governor for a four-year term
with the consent of the Senate. Four members must have or have had a title license and a search
and escrow license for at least five years, with each member from a different Utah county. One
member must represent the general public from any county. As of December 31, 2015 Title and
Escrow Commission members included:

Duties of the Commission are described in 31A-2-404. They include:
make rules;
concur with issuance and renewal of licenses;
establish title license fees;
determine title assessment;
conduct administrative hearings not delegated to administrative law judge;
approve assets to be included in reserve fund;
approve continuing education programs;
impose penalties;
advise commissioner of title administrative and enforcement matters;
advise commissioner of title insurance matters dealing with department's budget; and
perform other duties as provided in Title 31A.
Meetings were held on the second Monday of the month except when a holiday fell on that date.

UTAH DEFINED CONTRIBUTION RISK ADJUSTER BOARD Title 31A, Chapter 42, Defined Contribution Risk Adjuster Act
The Board was created in 2009. The Utah Defined Contribution Risk Adjuster is a nonprofit
entity within the department. The Risk Adjuster Board is under the direction of a board of
directors composed of up to nine members. They are appointed for a four-year term by the
governor with the consent of the Senate. A board member may not serve more than two
consecutive terms. As of December 31, 2015, Risk Adjuster Board members were as follows:

Duties of the Board:
shall submit a plan of operation for the risk adjuster to the commissioner;
establish methodology for implementing the defined contribution arrangement market, and the participation of small employer groups defined contribution arrangement health
benefit plans;
establish regular times and places for board meetings;
management and reporting of financial transactions;
determine provisions necessary and proper for the execution of the powers and duties of the risk adjuster; and
establish procedures for incurred administrative expenses.

premium is due to charges added to cover industry losses from insurance fraud.
o 41 states have created Insurance Fraud Investigation units to combat insurance fraud

o Most referrals come from the insurance industry through Special Investigative Units (SIU’s)
o Other sources include: law enforcement, the public, and discovery by IFD investigators during other
investigations
o The IFD receives nearly 800 referrals annually

Rehabilitations/Liquidations
The Insurance Department regulates the business of insurance. It monitors the financial
condition of insurance companies incorporated in Utah. When an insurance company
becomes impaired, insolvent or engages in activity hazardous to the company, the
Insurance Commissioner is authorized to petition a Utah court to place the company into
formal rehabilitation or liquidation proceedings. Such proceedings are court-supervised
receiverships in which, as mandated by statute, the Insurance Commissioner is appointed
by the court to act in the capacity of a rehabilitator or a liquidator.
Once a court issues an order of rehabilitation or liquidation, the policyholders, creditors,
and other potential claimants are notified that the company has been placed into a formal
delinquency proceeding. If the company has been placed into liquidation, the Liquidator
receives and processes the claims of the company's policyholders, creditors, and other
potential claimants. The Liquidator also proceeds to marshal all assets of the company for
the benefit of policyholders, creditors, and other claimants.
Once the claims against the company are known and classified, and the assets available to
satisfy those claims are known, the claims are presented to and approved by the court.
Court approved claims are thereafter paid to the extent the assets will allow.
During 2016, the Utah Insurance Commissioner, acting as Liquidator, administered the
liquidation of the following Utah insurance companies:
National Annuity Company
Western Insurance Company
Wasatch Crest Mutual Insurance
Wasatch Crest Insurance Company
Arches Mutual Insurance Company
American Protectors Insurance Company o (liquidation re-opened in 2015)
During 2016, the Utah Insurance Commissioner, acting as Liquidator, continued with the
rehabilitation of:
Liberty First Risk Retention Group
During 2016, the Utah Insurance Commissioner, acting as Liquidator, closed the
liquidation proceeding for the estate of:
