SUMMARY: U.S. Customs and Border Protection (CBP) is request-ing individuals who are interested in serving on the Advisory Com-mittee on Commercial Operations of U.S. Customs and Border Pro-tection (COAC) to apply for appointment. SUPPLEMENTARY INFORMATION: COAC is an advisorycommittee established in accordance with the provisions of theFederal Advisory Committee Act, 5 U.S.C. App. COAC providesadvice and makes recommendations to the Secretaries of theTreasury and Homeland Security (DHS) on all matters involvingthe commercial operations of CBP and related functions.
Balanced Membership Plans
The COAC consists of 20 members who are selected from represen-tatives of the trade or transportation community served by CBP orothers who are directly affected by CBP commercial operations andrelated functions. The members shall represent the interests of indi-viduals and firms affected by the commercial operations of CBP. Themembers will be appointed by the Secretaries of the Treasury andHomeland Security from candidates recommended by the Commis-sioner of CBP. In addition, members will represent major regions ofthe country, and, by statute, not more than ten (10) members may beaffiliated with the same political party.
It is expected that, during its upcoming fourteenth two-year term,COAC will consider issues relating to: Global supply chain securityand facilitation; CBP modernization and automation; air cargo secu-rity; customs broker regulations; trade enforcement; “One U.S. Gov-ernment” approach to exports and to trade and safety of imports;agricultural inspection; revenue collection; and protection of intellec-tual property rights.

Committee Meetings
The Committee meets at least once each quarter, although addi-tional meetings may be scheduled. Generally, every other meeting ofthe Committee may be held outside of Washington, DC, usually at aCBP port of entry. The members are not reimbursed for travel or perdiem.
Committee Membership
Membership on the Committee is personal to the appointee and amember may not send an alternate to represent him or her at aCommittee meeting. Appointees will serve a two-year term of officethat will be concurrent with the duration of the charter. Regularattendance is essential; a member who is absent for two consecutivemeetings, or does not participate in the committee’s work, may berecommended for replacement on the Committee.
No person who is required to register under the Foreign AgentsRegistration Act, 22 U.S.C. 611 et seq. as an agent or representative ofa foreign principal may serve on this advisory Committee. If you arefederally-registered lobbyist you will not be eligible to apply for ap-pointment.
Members who are currently serving on the Committee are eligibleto re-apply for membership provided that they are not in their secondconsecutive term and that they have met the attendance require-ments. A new application letter (see ADDRESSES above) is re-quired, but it may incorporate by reference materials previously filed(please attach courtesy copies). Members will not be considered Spe-cial Government Employees and will not be paid compensation by theFederal Government for their representative services with respect tothe COAC.

Background
I. The National Customs Automation Program
The National Customs Automation Program (NCAP) was estab-lished in Subtitle B of Title VI—Customs Modernization in the NorthAmerican Free Trade Agreement Implementation Act (Pub. L.103–182, 107 Stat. 2057, 2170, December 8, 1993) (Customs Modern-ization Act). See 19 U.S.C. 1411. Through NCAP, the initial thrust ofcustoms modernization was on trade compliance and the develop-ment of the Automated Commercial Environment (ACE), the plannedsuccessor to the Automated Commercial System (ACS). ACE is anautomated and electronic system for commercial trade processingwhich is intended to streamline business processes, facilitate growthin trade, ensure cargo security, and foster participation in globalcommerce, while ensuring compliance with U.S. laws and regulationsand reducing costs for U.S. Customs and Border Protection (CBP) andall of its communities of interest. The ability to meet these objectivesdepends on successfully modernizing CBP’s business functions andthe information technology that supports those functions.
CBP’s modernization efforts are accomplished through phased re-leases of ACE component functionality designed to replace a specificlegacy ACS function. Each release will begin with a test and, if thetest is successful, will end with implementation of the functionalitythrough the promulgation of regulations governing the new ACEfeature and the retirement of the legacy ACS function.
The ACE Cargo Release test was previously known as the Simpli-fied Entry Test because the test simplified the entry process by re-ducing the number of data elements required to obtain release forcargo transported by air. The original test notice required partici-pants to be a member of the Customs-Trade Partnership AgainstTerrorism (C–TPAT) program. Through phased releases of ACE com-ponent functionality this test has been expanded to allow all eligibleparticipants to join the test for an indefinite period regardless of theC– TPAT status of an importer self-filer or a customs broker.
For the convenience of the public, a chronological listing of FederalRegister publications detailing ACE test developments is set forth

II. Authorization for the Test
The Customs Modernization Act provides the Commissioner of CBPwith authority to conduct limited test programs or procedures de-signed to evaluate planned components of the NCAP. The test de-scribed in this notice is authorized pursuant to § 101.9(b) of title 19 ofthe Code of Federal Regulations (19 CFR 101.9(b)), which provides forthe testing of NCAP programs or procedures. See Treasury Decision(T.D.) 95–21.
III. Expansion of ACE Cargo Release Test to Truck Mode ofTransportation
This document is announcing CBP’s plan to expand the ACE CargoRelease test which allows for the filing capabilities by importers andcustoms brokers for cargo transported by air, ocean or rail to includefiling capabilities by importers and customs brokers for cargo trans-ported by truck.
Eligibility Requirements
To be eligible to apply for this test, the applicant must: (1) Be aself-filing importer who has the ability to file ACE Entry Summariescertified for cargo release or a broker who has the ability to file ACEEntry Summaries certified for cargo release; or (2) have stated itsintent to file entry summaries in ACE in its request to participate inthe test.
Parties seeking to participate in this test must use a softwarepackage that has completed Automated Broker Interface (ABI) certi-fication testing for ACE and offers the simplified entry message setprior to transmitting data under the test. See the General Notice ofAugust 26, 2008 (73 FR 50337) for a complete discussion on proce-dures for obtaining an ACE Portal Account. Importers not self-filingmust be sure their broker has the capability to file entry summariesin ACE.
Document Image System (DIS)
Parties who file entry summaries in ACE are allowed to submitspecified CBP and Partner Government Agency (PGA) documents viaa CBP-approved Electronic Data Interchange (EDI). A current listingof those documents may be found on the following Web site:

DIS provides for the storage of all submitted documents in a securecentralized location for the maintenance of associations with ACEentry summary transactions.

Test Participation Selection Criteria
The ACE Cargo Release test is open to all importers and customsbrokers filing ACE Entry Summaries for cargo transported in thetruck mode. Please note that participants must meet the eligibilityrequirements mentioned above and set forth in 76 FR 69755 (Novem-ber 9, 2011).
CBP will endeavor to accept all new eligible applicants on a firstcome, first served basis; however, if the volume of eligible applicantsexceeds CBP’s administrative capabilities, CBP will reserve the rightto select eligible participants in order to achieve a diverse pool inaccordance with the selection standards set forth in 76 FR 69755.
Any party seeking to participate in this test must provide CBP, inits request to participate, its filer code and the port(s) at which it isinterested in filing ACE Cargo Release transaction data. At this time,ACE Cargo Release data may be submitted only for entries filed atcertain ports. A current listing of those ports may be found on thefollowing Web site: www.cbp.gov/document/guidance/ace-cargo-release-pilot-ports. CBP may expand to additional ports in the future.Any changes and/or additions to the ports that are part of the ACECargo Release test will be posted to this Web site.
Filing Capabilities
The filing capabilities for the ACE Cargo Release test set forth in 78FR 66039 (November 4, 2013) and 79 FR 6210 (February 3, 2014)continue to apply and are now expanded to include importers andcustoms brokers filing ACE Entry Summaries for cargo transportedin the truck mode. The expansion of ACE Cargo Release filing capa-bilities for the truck mode of transportation will also allow for auto-mated corrections and cancellations and entry for a full manifestedbill quantity. However, this phase of the test will not include splitshipments, partial shipments, entry on cargo which has been movedby in-bond from the first U.S. port of unlading, and entries requiringPartner Government Agency (PGA) information. These new capabilities include functionality specific to the filingand processing of type “01” (consumption) and type “11” (informal)commercial entries for the truck mode of transportation. The ACECargo Release filing capabilities serve to assist the importer incompletion of entry as required by the provisions of 19 U.S.C.1484(a)(1)(B).
Data Elements To Be Filed
In lieu of filing CBP Form 3461 data, the importer or broker actingon behalf of the importer must file the 12 data elements (known asthe ACE Cargo Release Data set) with CBP required in the originalCargo Release pilot for basic air shipments as well as data elementssubsequently added to accommodate more complex shipments andother modes of transportation. See 76 FR 69755 (November 9, 2011)and 78 FR 66039 (November 4, 2013). The ACE Cargo Release Dataelements are:
(1) Importer of Record Number.(2) Buyer name and address.(3) Buyer Employer Identification Number (consignee number).(4) Seller name and address.(5) Manufacturer/supplier name and address.(6) HTS 10-digit number.(7) Country of origin.(8) Bill of lading/house air waybill number.(9) Bill of lading issuer code.(10) Entry number.(11) Entry type.(12) Estimated shipment value.(13) Bill Quantity (The quantity of shipping units shown in the bill
of lading. If bill of lading quantity is specified in the entry, it becomesthe entered and released quantity for that bill. If the bill quantity isnot specified, full bill quantity will be entered and released for thatbill).
Data element (1) and data elements (6) through (12) are defined inthe same manner as when they are used for entry filing on the CBPForm 3461. Data elements (2) through (5) are defined in accordancewith the provisions of 19 CFR 149.3.
The ACE Cargo Release Data set may be filed at any time prior toarrival of the cargo in the United States port of arrival with the intentto unlade. This data fulfills merchandise entry requirements andallows for earlier release decisions and more certainty for the im-porter in determining the logistics of cargo delivery.

Functionality
Upon receipt of the ACE Cargo Release data, CBP will process thesubmission and will subsequently transmit its cargo release decisionto the filer. A filer may electronically submit a correction or a requestfor cancellation of the entry at any time prior to the cargo arrivingand being released. If a submission is transmitted to CBP requestingcorrection or cancellation of the entry prior to arrival or release,CBP’s decision regarding the original submission is no longer control-ling.
The merchandise will then be considered to be entered upon itsarrival in the port with the intent to unlade, as provided by current19 CFR 141.68(e).
Test Duration
The ACE Cargo Release test modifications set forth in this docu-ment are effective no earlier than April 6, 2014. The test will run untilapproximately November 1, 2015, and is open to type ‘‘01’’ (consump-tion) and type ‘‘11’’ (informal) commercial entries for the truck modeof transportation at specified ports.
IV. Misconduct Under the Test
The terms for misconduct under the ACE Cargo Release Test setforth in 78 FR 66039 (November 4, 2013) continue to apply and arenow expanded to include importers and customs brokers filing ACEEntry Summaries for cargo transported in the truck mode.
V. Previous Notices
All requirements and aspects of the ACE test discussed in previousnotices are hereby incorporated by reference into this notice andcontinue to be applicable, unless changed by this notice.
VI. Paperwork Reduction Act
The collection of information contained in this ACE Cargo Releasetest have been approved by the Office of Management and Budget(OMB) in accordance with the requirements of the Paperwork Reduc-tion Act (44 U.S.C. 3507) and assigned OMB number 1651–0024.
An agency may not conduct or sponsor, and a person is not requiredto respond to, a collection of information unless it displays a validcontrol number assigned by OMB.

Title: Automated Clearinghouse.OMB Number: 1651–0078.Form Number: CBP Form 400.Abstract: The Automated Clearinghouse (ACH) allowsparticipants in the Automated Broker Interface (ABI) to transmitdaily statements, deferred tax, and bill payments electronicallythrough a financial institution directly to a CBP account. ACHdebit allows the payer to exercise more control over the paymentprocess. In order to participate in ACH debit, companies mustcomplete CBP Form 400, ACH Application. Participants also usethis form to notify CBP of changes to bank information or contactinformation. The ACH procedure is authorized by 19 U.S.C. 1202,and provided for by 19 CFR 24.25. Title: Declaration of Owner and Declaration of Consignee whenEntry is made by an Agent.OMB Number: 1651–0093.Form Number: CBP Forms 3347 and 3347A.Abstract: CBP Form 3347, Declaration of Owner, is adeclaration from the owner of imported merchandise stating thathe/she agrees to pay additional or increased duties, thereforereleasing the importer of record from paying such duties. Thisform must be filed within 90 days from the date of entry. CBPForm 3347 is provided for by 19 CFR 24.11 and 141.20.When entry is made in a consignee’s name by an agent who has
knowledge of the facts and who is authorized under a proper power ofattorney by that consignee, a declaration from the consignee on CBPForm 3347A, Declaration of Consignee when Entry is made by anAgent, shall be filed with the entry summary. If this declaration isfiled, then no bond to produce a declaration of the consignee is re-quired. CBP Form 3347 is provided for by 19 CFR 141.19(b)(2).
