JUDICIAL REVIEW OF ITC MATERIAL INJURY DETERMINATIONS1

The accompanying listing of U.S. Court of International Trade decisions reviewing material injury determinations by the U.S.International Trade Commission (“ITC”) in antidumping and countervailing duty proceedings (both original investigations and five-year sunset reviews) identifies the Judge making the decision as well as certain information about the ITC’s determination itself. Forexample, in the columns to the right of the case caption and citation, date of the decision and identity of the Judge, is informationspecifying whether the ITC determination was affirmative or negative with respect to the existence of material injury/threat ofmaterial injury, the number of Commissioners in the majority as well as the number of dissenters, if any. The last two columns in thecase listings then specify whether the ITC’s determination was affirmed by the reviewing Judge or remanded. The cases are set forthin a chronological listing and also grouped by the Judges deciding the appeals, listed in alphabetical order by Judge. The listingscontain all decisions of the Court rendered between 1980 and July 2008. Only those decisions of the Court reviewing a final agencyaction are contained in the listings. Omitted are Court opinions relating to all other matters, including issues such as access toconfidential information, procedural rulings, and statutory provisions other than those relating to final agency actions in antidumpingand countervailing duty determinations.

These case listings and the accompanying charts and graphs, which immediately follow afterwards, were prepared to begin anassessment of whether this data would reveal anything about the frequency of remands and whether the remands that occur are relatedin any meaningful way to either the nature of the Commission determination, i.e., whether a negative or affirmative determination orby the presence or absence of either unanimity, or near unanimity, among the Commissioners in the determinations subject to review. The data also has been examined to consider whether particular Judges are more likely to issue remand orders more frequently thanthe average rate for the Judges collectively.

During this twenty-nine year time period, the Court issued a total of 226 decisions as defined above. Eighty-five of thosedecisions or 38 percent resulted in remands to the ITC. Sometimes there were multiple remands in the course of an appeal from theagency determination(s) subject to the particular court proceeding.

The first graph reveals that when the twenty-nine year period is divided into three distinct ten year periods (nine years in thelast instance), there is noticeable variation in the remands rates. During the first ten years (1980-1989), the remand rate was the

highest with approximately 46 percent of the opinions issued by the Court including remands. The rate declined between 1990-1999to 26 percent and then rebounded to approximately 40 percent for the most recent nine year period.

The second graph depicts the percentage of total decisions remanded by each Judge who has rendered a decision in a caseinvolving the ITC between 1980-2008. As would be expected there is considerable variation among the Judges. The degree ofvariation would appear to be attributable to a number of factors. For one, the fewer the number of ITC determinations reviewed by aJudge means that the circumstances of individual cases will have a disproportionate effect on the percentage of remand/affirmancesoverall for that Judge. Thus, both the highest percentage of remands as well as the lowest percentage of remands are attributable tothose Judges who have decided the fewest cases involving the ITC. Those Judges who have issued fifteen or more opinions involvingthe ITC (only 7 of the 18 Judges issuing decisions reviewing ITC determinations during this period), have issued remands with afrequency that falls within the middle range for the Court as a whole—25 to 40 percent. When multiple remands are issued by asingle Judge in the course of a single appeal, the overall percentage of remand opinions issued by that Judge will be affected upwardsaccordingly. Conversely, if the number of remands for any one Judge were to be adjusted for multiple remands, the percentage ofoverall decisions remanded by that Judge would decline. In this connection, those Judges who have more frequently issued multipleremands tend to have a higher proportion of remands as a percentage of total decisions issued.

The penultimate graph examines whether there is any obvious correlation between whether the ITC decision subject to judicialreview is a negative or affirmative material injury determination and a Court ordered remand. The statistics for this period indicatethat there are a nearly identical percentage of remand decisions issued in both instances; again approximately 37-39 percent.

Finally, the last graph examines whether on a purely statistical basis a remand is more likely when the Commission’sdetermination is not unanimous and whether an evenly divided Commission vote is more likely to result in a remand. The datareveals that a remand is almost twice as likely when the Commission is evenly divided (a 3-3, or 2-2 vote) as when the Commissionissues a unanimous decision.
