    These records are to be used by EAPpersonnel in the execution of thecounseling and rehabilitation function.They document the nature and effects ofemployee problems and counseling bythe EAP and referral to, and progressand participation in, outside treatmentand counseling programs and therehabilitation process. These recordsmay also be used to track compliancewith agreements made to mitigatediscipline based upon treatment(abeyance agreements).ROUTINE USES OF RECORDS MAINTAINED INTHE SYSTEM, INCLUDING CATEGORIES OFUSERS AND PURPOSES OF SUCH USES:

    In addition to those disclosurespermitted by the Privacy Act itself,' 5U.S.C. 552a(b), perm issive disclosures,without individual consent, are asfollows:To report, under State law, incidentsof suspected child abuse or neglect toappropriate State or local authorities.CONTESTING RECORDS PROCEDURES:

    Direct all requests to contest oramend information to the systemmanager identified above. The requestshould follow the record accessprocedure, listed above, and shouldstate clearly and concisely theinformation being contested, the reasonfor contesting it, and the proposedamendment thereof. In the case ofdrug abuse c ounseling, records may alsobe generated by the staff of the Drug-Free Workplace Program and theMedical Review Officer.POLICIES AND PRACTICES FOR STORING,RETRIEVING, ACCESSING, RETAINING, ANDDISPOSING OF RECORDS IN THE SYSTEM:STORAGE:

    All records are stored in paper foldersin locked file cabinets in accordancewith 42 CFR 2.16.RETRIEVABILITY:

    Records are indexed and retrieved byidentifying number or symbol, cross-indexed to employee names.SAFEGUARDS:

    Records are kept in a secure room inlocked file cabinets. Only the EAPAdministrator or a d esignated staffmember will access or disclose therecords.RETENTION AND DISPOSAL

    Records are retained for three yearsafter the individual ceases contact withthe counselor unless a longer retentionperiod is necessary because of pendingadministrative or judicial proceedings.In such cases, the records are retainedfor six months after the case is closed.Records are destroyed by shredding orburning.SYSTEM MANAGER AND ADDRESS:

    In response to petitions from mem bersof the public to make certaindeterminations concerning theadministration of the cable compulsorylicense, 17 U.S.C. 111, the CopyrightOffice published a notice of inquiry withrespect to possible changes in the list ofspecialty broadcast stations originallydeveloped by the FederalCommunications Commission ("FCC").On Septembe r 18, 1989, a policy decision(54 FR 38461) and a request forinformation (54 FR 38486) were issuedinviting all interested televisionbroadcast stations claiming to qualify asspecialty stations under the FCC'sformer distant signal carriage rules tosubmit to the Office sworn affidavitsstating that in the preceding calendaryear the programming of their stationssatisfied the FC C's former requirementsfor specialty station status.On April 4, 1990, the Office publisheda list of the stations that filed affidavits(55 FR 12575), and solicited from
