General Terms & Conditions of the Tender for the Design, Development and Implementation and Maintenance of Dynamic Website and Mobile Enabled Website of Urdu Academy, Delhi, Govt. of Delhi in two Language Urdu and English. 1 The period of Completion of above Contract mentioned in the Tender as per

Scope of work is 120 days from the award of the Contract. No time extension will be given under normal circumstances. Time line for the stages of completion of each milestone/derivables of Project will be settled with the Lowest -1 bidder and the same will be incorporated in the Service Level Agreement.

2 The contractor will maintain and update the Website for one year from the date of hosting of the Website free of cost.

3 The Dynamic Website is in Urdu and English Language, it is expected with the bidder that he has sufficient manpower having expert/specialize knowledge of Urdu Language.

4 The Design and Development of Dynamic Website should be user friendly and have maximum features/functions.

5 During the period of Warranty and free maintenance contractor shall provide manpower/technical support on site as and when required at the shortest notice for the smooth and without interrupted service.

6 The contractor should have all statutory licenses/registration for carrying out work of Tender and shall adhere to all Web Application Audit /Compliance and approval/Security features.

7 All deliverables created or developed by the Contractor specifically for User Department (Urdu Academy) , together with any associated copyright and other intellectual property rights, shall be the sole and exclusive property of Urdu Academy, Delhi.

8 Mere submission of tender forms by the contractor(s)/tenderer(s) or the firm/agency/company does not qualify for award of contract. The L-1 will be decided by the Tender Committee, whose decision in the matter will be final and binding on all the concerned parties. No correspondence in this respect will be entertained at all.

9 The bidder shall quote the lumpsum amount ( inclusive of all) for the Tender , However,

Govt. levies will be paid extra as per applicable rates.

10 The “Bid Security Declaration” is required to be signed by each bidder accepting that if they

withdraw or modify their bids during period of validity of the bid , they may be suspended for a period of one year from bidding in Delhi Govt, Tenders.

11 Tenderers have to submit an affidavit on a stamp paper of Rs.50/- duly notarized by a Notary

Public, affirming that neither any case is pending against the firm/agency/tenderer nor is blacklisted by any Govt./Semi Govt./PSU.

12 Any tenderer whether individual or firm, whose relative or near relative is working in the Department of ACL, Academies or Sahitya Kala Parishad , Delhi shall not be eligible for this tender.

13 Persons working in Govt./Semi Govt. offices and autonomous bodies shall not be eligible to enter into contracts.

14 The tenderer should have at least three years post registration (Service Tax/GST) experience in the field for which the tender is being submitted.

15 Secretary (UA) has the right to accept or reject any tender without assigning any reason. The

decision of the Department in this regard will be final and no correspondence whatsoever will be entertained in this regard.

16 The tenderer has to furnish proof of depositing Service Tax/DVAT/GST with the Government within the prescribed time, if he charges it on the bill.

17 The payment will be made as soon as possible , hence if the contractor(s) refuse to carry out the work orders due to non-payment of earlier bills, then their contract(s) shall be terminated.

18 Tenderer must have a valid PAN number/GST number. Income tax/GST shall be deducted at source from the bills as per the rules of the Income Tax Act and GST Act. .

19 All the documents as specified in the Technical Bid should be serially numbered and signed by the tenderer with the seal of the firm/agency. The scanned (PDF format) copy of these documents should be uploaded along with the Technical Bid. Certificates from the existing/previous clients/organizations to whom services were provided/supplies made during the last three years, should also be uploaded.

20 Financial bids of the technically qualified bidders will only be opened. The bidder shall quote the lumpsum price in figures and words for Tender. Cutting, overwriting and alterations will not be acceptable.

21 The bid validity period is ninety days from the closing date of the Tender. 22 The office of the tenderer will be subject to inspection by any agency or any expertise ,at the

discretion of Secretary (Urdu Academy) in order to judge the standard , suitability and capacity of the bidder and his decision in this regard will be final and binding on the bidders.

23 The tenderer should have to pay TDS and TDS(GST) and all other taxes as per applicable Act

as per policy of Government at the time of payment. The Contractee shall not be responsible for any lapse on his part in any way.

24 Contract will be awarded to the successful evaluated Lowest -1 bidder whose bid has

been found to be responsive and who is eligible and qualified to perform the contract satisfactorily as per the terms and conditions/scope of work incorporated in the bidding document.

25 The Deptt. Will communicate the successful bidder confirmation by letter transmitted by

regd. Post/E-mail that his bid has been accepted. 26 The successful bidder will be required to execute a contract agreement within a period of

15 days from the date of issue of letter of offer. 27 The successful bidder shall be required to furnish a Performance Security within 15 days

of receipt of Letter of Offer for an amount of 3 % of the value of contract in Fixed Deposit Receipt from a commercial bank, or Bank Guarantee from a commercial bank in favour of Secretary, Urdu Academy, Delhi. The performance Security shall remain valid for a period 18 months from the date of award of the contract.

28 Failure of the successful bidder to comply with the requirements of above clauses

shall constitute sufficient grounds of the annulment of the award and forfeiture of Bid Security.

29 Penalty Clause: If it is found that there is a delay in completion of task as per mile stone specified in the terms and conditions of the bid document and scope of work penalty of 0.5 % of the milestone payment block/value for delay of each week will be levied. In case cumulative penalty touches 10 % of milestone payment value, cancellation of the contract may be done and entire performance Security may be forfeited.

30 Rescind Clause: In case of any material breach or default in the performance of any obligation under the contract , the contractee may terminate the contract by giving notice in writing to the contractor. 31 Force Majeure: Neither party will be liable in respect of failure to fulfil its obligations, if the said failure is entirely due to Acts of God, Governmental restrictions or instructions, natural calamities or catastrophe, epidemics or disturbances in the country. The party affected by an event of Force Majeure will immediately notify the other party of such an event and will also notify the unaffected party cessation of disability resulting from the Force Majeure Act. 32 Secretary (UA) reserves the right to accept or reject any tender in whole or in part without assigning any reason in public / govt. interest. 33 Secretary(UA) reserves the right to relax any of the terms and conditions in govt. interest. 34 Any dispute will be under the jurisdiction of courts of Delhi / New Delhi.

Eligibility Criteria /Who can apply ? 1 The bidder which shall provide evidence that it is a current legal entity in India with

impeccable repute in managing equally large and data oriented sites with at least three years’ experience in managing similar websites may apply.

2 Minimum 15-20 well qualified Technical Resources including expert in Urdu Language

should be associated with the bidder. 3 The bidder must warrant that no legal action has been taken or being undertaken against

it for any cause in any legal jurisdiction. If such an action exists and the service provider considers that it does not affect its ability to deliver the RFP requirements, it shall provide details of the action(s).

4 The bidder should have proven experience in designing a new site or migration an old

site as per WCAG2.0 guidelines for Levels A, AA and AAA. The service provider needs to submit list of previous assignments/projects where these guidelines are implemented.

5 The bidder should have a service Centre in Delhi. 6 The bidding company should have a robust in-house designing team and should be well

versed with designing tools including Adobe Photoshop, Adobe In Design. 7 The average annual turnover for the last three financial years i.e. 2017-18, 2018-19,2019-20

should not be less than 15 lakhs.

Scope of Work Tender For System Study, Design, Development , Implementation and Maintenance of Website , Web Enabled Application and Mobile enabled Website of Urdu Academy in two languages Urdu and English.

1. The work that will be performed

2. Latest News: All the latest happenings will be in this section. It will be published by the admin through the control panel and the admin can post news articles with pictures and videos.

3. Event Calendar: An event calendar will be on our website having the information of all upcoming events throughout the year. Any Event can be added / edited from the control panel.

4. Press Release A specific plugin will be added in our website for the press release. The admin shall be able to add a PDF file to the press release section that will be listed and published on the site. It will be printer friendly and more options will be added to the specific pages like anybody can share this release to any specific email and to any social media platform.

5. Blogging A full featured blog publishing module should be included where the admin can post new blogs/stories on Urdu adab, culture, history, and other Urdu literature related content.

6. Galleries

Photos Galleries will be added in which all the latest photo albums can be updated.

Videos: The main uploading platform will be Academy’s YouTube channel. All the videos from YouTube can be embedded on our website. The admin should be able to adjust, copy & paste the sharing code from YouTube and it will be published on our website.

7. Magazine and Books Uploading & Archives The admin should be able to upload the PDF versions of Umang &Aiwan-e-Urdu magazines and it will be displayed like an e-book. It will be easy for the users to browse the pages and read the desired articles. The users can also download the current and earlier versions of magazines to their devices to read them offline as well.

8. Contact & Feedback Forms All the contact & other forms will be linked from an instant notification email service where the admin can get a notification whenever anyone fills up the forms from our website.

9. Analytics & User Data Tracking Our website should be trackable and should give us the analytical reports and the admin should be able to see the details of all the visitors. The system should show us the IP address, location country, time stamps, and the sources of visiting sites.

10. Tenders Submission Admin should be able to upload the tender file i.e. PDF, JPG, or other formats and it will show all the latest and previous tenders on our site. We should be able to manage the files as per our requirements.

11. Auditorium Booking Module It will show a calendar on our website with available and booked options, if any user wants to book on a specific date, users should be able to book through the given form on our website. We should get an instant email notification for booking. If we approve that booking we can block that specific date as a booked one.

12. Unlimited Pages We should be able create as many pages as we require. So there should be no limitation on the number of pages.

13. Web Hosting Server Linux based web server will be used with unmetered web space (soft limit of server is 40 GB, which is sufficient for 100+books or 1000+ pages) with 99.9% uptime with high bandwidth limits which can host upto 1 lac users monthly.

The scope of work may Typically consists of : Study, Requirement gathering and Analysis, Design, Development Testing, Implementation, Training and Maintenance of new/ existing Websites, Web Applications, SSL which comply with the 'Guidelines for Indian Government Websites' (GIGW Version 2) http://guidelines.gov.in/ and are audited for security by a CERT-IN Empanelled agency.

Additional activities under above scope of work include the following:

Training & User Manual: Conducting training programs as per the requirement for successful execution of project along with preparation of User Manual.

Maintenance of Websites, Web-portals, Web Applications .

Design and development of the Electronic form application in Secure & Usable format.

Monitoring and managing the various applications, printing of submitted application forms,

Workflow architecture & software development may also be part of the requirement.

Submission of report on developed website and Sign off by user department.

Operation and Maintenance support

Identify and execute training requirements for successful execution of project.

Creation of necessary documents and User Manuals and Technical Manual for training.

Support on Training/ Demo on need basis.

Warranty Maintenance / Annual Maintenance of Websites, Web Portals, Applications (Web based & Mobile).

Handover of Websites, Web Portals, Applications (Web based & Mobile) to user department along with technology transfer, and source code.

The agency shall also provide support as and when required by the User Department during the O&M period.

In addition to the phases as defined above, wherever applicable the selected agency will perform the following as per the requirement of user:

Design and Development of Websites, , Applications (Web based ) Devices having capability to connect directly to Service Provider's central system through laptops, handheld devices, mobile etc. used for financial inclusion at grassroots level.

Designing interface/ mechanism for Mobile Enabled Website along with other interfaces as defined through the Scope of Work of the bid document .

Adherence to all Web Application Audit/ Compliance and Approval / Security Features.

4. Roles and responsibilities

Except as expressly otherwise provided, the Buyer shall, at its own expense, provide in timely timely all the necessaries facilities so that Service Provider’s employees can perform and deliver project objective as per agreed Terms and Conditions .

The Buyer shall notify the Service Provider of any dishonest, wrongful or negligent acts or omissions of the Service Provider’s employees or agents in connection with the Services as soon as possible after the Buyer becomes aware of them.

The Buyer shall not be under any obligation for providing empanelment to any of the personnel of the Service Provider after the expiry of the contract. The Buyer does not recognise any employee employer’s relationship with any of the workers of the Service Provider.

Service Provider’s Obligations

Hired agency shall be responsible for handling all technical issues related to hosting of Websites, Web Portals, Applications (Web based & Mobile), etc. in coordination with concerned user department . Hired agencies shall also be responsible for handling the issues related to management of Database and applications during the project duration.

Indicative Deliverables :The following is a list of indicative deliverables proposed through this tender. However actual deliverables will depend upon project specific requirements and will be finalized in consultation with user department.

Preparation of Websites in compliance with GIGW- version 2 to obtain website quality certificate.

Translation Services for new/existing Websites / Portals.

Proof reading / validation and correction of the translated and entered data and submission of error free sentences in softcopy, by agency.

Validation certificate of the translation done by the Agency shall be given by the User Department.

Submission of print-outs of the translated sets (12 pt size print) for verification to the User Department by agency.

Data Entry of translated sentence in Unicode font of respective language by the agency.

PAYMENT PROCESS

(1) Payment shall be made by buyer as per following Time Line and Corresponding Mile Stone Based Deliverable and as per details given below:

(2) 75% payment shall be made after project completion certificate issued by user department and submission of security certificate (by CERT IN empanelled agency) whereas rest 25% payment shall be made post submission of GIGW Version 2 Compliance certificate issued by STQC. For projects where GIGW Version 2 compliance certificate is not required as per the scope of work, 100% payment shall be released upon submission of project completion certificate and security certificate.
