Supplemental Agreement

For the Period:August 1, 2013

through July 31, 2018

PreambleThe Teamsters United Parcel Service National NegotiatingCommittee on behalf of the following affiliated Locals: 17, 25, 70,71, 100, 107, 135, 162, 174, 222, 243, 294, 295, 317, 344, 385, 391,406, 407, 413, 480, 500, 509, 516, 519, 542, 560, 592, 600, 633,638, 657, 667, 671, 688, 710, 728, 745, 769, 776, 901, 957, 986 and988 (hereinafter collectively referred to as the “Union”) and UnitedParcel Service, Inc. (an Ohio Corporation) and its subsidiary UPSCartage Services, Inc. (“CSI”) (hereinafter collectively referred to,in this Supplement, as the “Employer”) agree that the followingprovisions shall constitute the UPS Cartage Services, Inc.,Supplement (hereinafter “CSI Supplement”) to the National MasterUnited Parcel Service Agreement (hereinafter “NMA”).

Section 1Any lesser conditions contained in any Rider or Addendum shall besuperseded by the conditions contained in this Agreement.However, except where specifically stated otherwise in thisAgreement, nothing in this Agreement shall deprive any employeeof any superior benefit contained in his/her Rider or Addendum.

Section 2It is the parties’ intent that this Agreement shall not be a basis forthe Union to expand its work by claiming that the work performedby affiliates of the Employer is covered by this Agreement.Likewise, the Employer agrees that it will not use this Agreement todiminish the work performed by bargaining unit employees underthe existing Addendum.

Section 3For the purpose of preserving work for the employees covered by thisCSI Supplement, the Employer agrees that it will continue to providethe guaranteed work hours set forth in the applicable Addenda. Thework to be performed by these employees shall be any combination ofdock work, driving or other freight-related duties, as described in theAddenda. However, no employee covered by this Supplement shallpick-up, deliver or otherwise progress parcels or packages, or performany other work described in Article 1, Section 1 of the NMA. In theevent a grievance is brought alleging that Article 1, Section 1 work isbeing, or has been, performed by employees covered by thisSupplement, the grievance shall immediately be referred to the nextscheduled meeting of the National Grievance Committee. In the eventthe grievance is dead locked, either party shall have the right to requestthe grievance be scheduled for expedited arbitration. The grievanceshall be scheduled for arbitration within thirty (30) days. The partiesshall jointly contact the arbitrators on the National Panel in alphabeti-cal order until they find an arbitrator who can offer a date within thethirty (30) day period. If no arbitrator is available from the NationalPanel, the parties shall jointly request the American ArbitrationAssociation to appoint an arbitrator to hear the case within the thirty(30) day period.

Article 1: RecognitionThe Employer will continue to recognize the Union as the sole andexclusive bargaining agent for all its Driver/Dockworkers andDockworkers employed at its North American facilities, and willalso continue to recognize employees it may have in other job clas-sifications, to the extent such employees are already represented bythe Union.

Article 2: Applicable NMA ArticlesThe parties agree that the elections each Local Union made pur-suant to Article 2 of the 2008-2013 CSI Supplement shall remain ineffect for the duration of this NMA.

With respect to its prior elections, a Local cannot elect to apply oneor more Sections from anArticle in its Addenda and also select por-tions of the NMAArticle covering the same subject. Further the par-ties agree that the following Articles within the NMA shall contin-ue to not be applicable to operations covered by this CSISupplement: Article 1 Section 4; 2; 3 Section 7; 6 Section 5; 10; 18;26; 32; 37 Section 1(b) and (c); 39; 40; 43; and 44. Articles 22, 34and 41 of the NMA will apply only to the extent they contain pro-visions specifically addressing CSI employees.

Article 3: Health & Welfare and Pensiona. In those Addenda which provide Teamster Health & Welfareand/or Pension Funds, the negotiated monetary increases set forth inArticle 34, Section 1(a) of the NMA shall be applicable. In addition,the terms of Article 34, Section 1(a) and (f) of the NMA shall beapplicable to determine any necessary allocations.

b. Employees covered by Addenda which have Employer spon-sored plans for pension shall continue to be covered by the existingUPS sponsored plans.

For those full-time or part-time employees who have re-ceived health and welfare benefits from the Company Health &Welfare Plan, benefits on and after January 1, 2014 will be provid-ed by the Central States Health & Welfare Fund (CSH&W Fund),under the terms set forth in Article 34 of the National MasterAgreement. The Company will continue to provide health & wel-fare benefit coverage under the existing plan through December 31,2013.

c. Part-time and full-time employees covered by a Teamster Healthand Welfare Fund will continue to be covered by those funds.

d. Any eligible employee covered by this Section who retires effec-tive January 1, 2014 or thereafter shall be provided retiree medicalbenefits through the CSH&W Fund.

e. Current retirees who are receiving benefits through a UPS spon-sored plan shall receive coverage on and after January 1, 2014under the terms of the Memorandum Concerning UPS SponsoredPlans, attached to the National Master Agreement

f. Contributions to pension funds will be made in accordance withArticle 34 of the National Master Agreement.

g. Full-Time employees of UPS Cartage Services Inc. (CSI) whowere participants in the Central States Southeast and SouthwestAreas Pension Fund (CS Plan) as of December 26, 2007, and allfuture full-time employees who would have been covered by the CSPlan absent this agreement, shall be covered by the UPS/IBT Full-Time Pension Fund as set forth in Article 34, Section 1(l) of theNational Master Agreement (effective upon ratification) and therelated Plan Documents and Trust Agreement. Any provision in anyAddenda to the CSI Supplement specifying participation in the CSPlan shall be null and void.

Article 4: Joint National UPS CSI/TeamstersCommittee

The Joint National UPS CSI/Teamsters Committee shall continue tomeet as necessary to oversee the integration of the local contractsinto the NMA and resolve any unforeseen problems that may arise.

Article 5: Rates of Pay

Section 1Full-time CSI employees shall be eligible to receive the GWI as setforth in Article 41 Section 1 of the NMA.

All Addenda shall modify their top wage rates to incorporate theGWI as well as the effective dates of wage increases, in accordancewith Article 41 Section 1 of the NMA.

Section 2The progression in NMA Article 41 Section 2(c) shall apply to full-time employees at UPS CSI, hired after July 31, 2013. The LocalAddenda progression shall remain in effect for all employees in thatprogression as of July 31, 2013.

The top rate referenced in Article 41 Section 2(c) shall be the ratein effect on July 31, 2013 for those employees who have complet-ed the progression, plus all subsequent General Wage Increases,including COLA, if applicable. This shall not affect any Addendathat have a higher “Top Rate”.

Section 3Part-time CSI employees entitled to a General Wage Increase(“GWI”) under the terms of their Addenda shall be eligible toreceive the GWI as set forth in Article 22 of the NMA on the datesspecified.

Article 6: Grievance ProcedureThe provisions of this Article shall be substituted for the grievanceprocedure set forth in any Addenda.

Should any dispute arise between the Employer and the employees,or the Employer and the Union concerning the application or inter-pretation of any provision of this Agreement, or concerning anyterm or condition of employment set forth in thisAgreement, it shallbe handled in the following manner:

Step 1 - The complaint shall be discussed with the aggrievedemployee, the immediate supervisor, and the Shop Steward, withinfive (5) working days of the known occurrence giving rise to the com-plaint.

Step 2 - If the complaint is not resolved in Step one (1), then theemployee, Shop Steward or Local Union representative shall sub-mit a grievance in writing to the designated Company representa-tive on the designated grievance form within ten (10) working daysafter the known occurrence giving rise to the grievance.

Step 3 - If an agreement cannot be reached in the second step, thematter shall then be referred to the Local Union Business Agent with-in ten (10) working days after receipt of the response of the CompanyRepresentative. The Company Representative shall meet promptlywith the Local Union BusinessAgent, the Shop Steward and the griev-ant within ten (10) working days in order to reach an adjustment to thegrievance. The Company Representative shall respond in writing tothis third step meeting within three (3) working days of the meeting.

Step 4 - Any grievance not resolved in Step three (3) shall proceed tothe established local area Cartage Services or regional CartageServices Grievance Panel. Cases deadlocked will be forwarded as fol-lows: UPSNationalMasterAgreement (NMA) language will be dock-eted to the next National Grievance Committee; Cartage ServicesSupplemental language will be docketed to the next Joint NationalCartage Services Grievance Committee; Discipline andAddenda/Rider language will be submitted to arbitration.

Step 5 - If the parties fail to reach a decision or agree upon a settle-ment of any grievance in Step four (4), the grievance may be submit-ted to arbitration. If the parties cannot agree upon an impartial arbitra-tor within ten (10) working days from the date arbitration is invoked,then the parties shall jointly request theAAAor FMCS, in accordancewith area practices, to supply both parties with a list of seven (7)impartial arbitrators. Each party shall alternately strike one (1) namefrom the list and the name of the person last remaining on the list shallbe designated as the arbitrator and his appointment shall be binding onboth parties. The arbitrator shall deal only with the matter which occa-sioned his appointment and his decision shall be final and bindingupon both parties. In no case, however, may the arbitrator make a deci-sion which will in any way add to, subtract from, or alter the terms ofthis agreement. The fee of the arbitrator will be shared equally by theCompany and the Union. Notwithstanding the above, any grievanceinvolving language in the NMA will be resolved in accordance withArticle 8 of the NMA.

Article 7: Maintenance of StandardsThe Employer agrees that all the conditions of employment relatingto wages, hours of work, overtime differentials and general working

conditions shall be maintained at no less than the highest standardsin effect at the time of the signing of this Agreement, and the con-ditions of employment shall be changed whenever specific provi-sions for change are made elsewhere in the Agreement. It is agreedthat the provision of this section shall not apply to inadvertent orbona fide errors made by the Employer or the Union in applying theterms and conditions of this Agreement. Such bona fide errors maybe corrected at any time.

Any disagreement between the Local Union and the Employer withrespect to this matter shall be subject to the Grievance Procedure.This provision does not give the Employer the right to impose orcontinue wages, hours, and working conditions less than those con-tained in this Agreement.

Article 8: Safety and Health, Equipment,Accidents and Reports

PreambleThe Employer and the Union agree that the safety of the employeesand the general public is of utmost importance. This Article is beingnegotiated and included in this Supplement with the intent that it isa substitute for Article 18 of the National Master Agreement andthat the latter Article will have no applicability to the employees orvehicles in CSI’s operations.

The Employer and the Union have developed the followingSections and Subsections of this Agreement to respond to thatmutual concern for safety. The contract language responds to a vari-ety of areas related to safety, health, ergonomics, and climatic con-ditions as well as federal, state and local laws dedicated to provid-ing a safe and healthy workplace.

To address safety and health issues, the Employer and the Unionhave developed local area joint labor/management committeescomprised of bargaining unit members and management, to addressjob related safety and health concerns through the ComprehensiveHealth and Safety Process (CHSP).

Notwithstanding the employee’s right to contact federal, state orlocal agencies, it is the recommendation of the committees thatissues and concerns, regarding this Agreement, should first bebrought before the National Safety and Health Committee.

Section 1 – Employees’ Rights – Equipment,Vehicles and ConditionsThe Employer shall not require employees to take out on the streetsor highways any vehicle, or use any type of equipment, that is notin a safe operating condition or equipped with the safety appliancesprescribed by law. First line trailers will be swept on a daily basis.All CSI tractors and delivery vehicles will be maintained in a cleanand sanitary condition including mirrors and windows.

Under no circumstances will an employee be required or assignedto engage in any activity involving dangerous conditions of work ordanger to a person or property or in violation of a government reg-ulation relating to safety of person or equipment. The term “dan-gerous conditions of work” does not relate to the type of cargowhich is to be hauled or handled.

It shall not be a violation of this Agreement, or cause for disciplinaryaction, where employees refuse to operate equipment or a vehicle whensuch operation constitutes a violation of any state or federal rules, reg-ulations, standards or orders applicable to commercial motor vehiclesafety or health, or because of the employee’s reasonable apprehensionof serious injury to himself/herself or the public due to the unsafe con-ditions as set out in any state or federal rules, regulations, standards ororders applicable to commercial motor vehicle safety or health toinclude Part 392.14 of the Federal Motor Carrier Regulations.

Section 2 – Out of Service Equipment and VehicleReportsAll equipment which is refused, or has been written up for repair,because not mechanically sound or properly equipped, shall beappropriately tagged, and placed out of service, so that it cannot beused by other drivers, or employees until the Automotive/Maintenance Department has adjusted the complaint.

Employees shall immediately, or at the end of their shifts, report all known defects of equipment on a suitable form furnished by theEmployer. The Employer shall not ask or require any employee toutilize equipment that has been reported by any other employee asbeing in an unsafe condition. Such equipment will be red tagged,as necessary, by automotive/maintenance personnel. The tag mustnot be removed until the Automotive/Maintenance Departmenthas determined that the vehicle/equipment is in a safe operatingcondition or, where no Automotive/Maintenance Departmentexists, qualified management will make the deciding determination.Management not qualified to make such a determination, willconsult with qualified automotive/maintenance personnel beforeremoving a red tag. The person making the decision will sign offthe car condition report or other form required by law. Anyautomotive/maintenance person consulted will be noted on thisreport.

When the occasion arises where an employee gives a written reporton forms in use by the Employer of a vehicle/equipment being inunsafe working or operating condition and receives no considera-tion from the Employer, the employee shall take the matter up withan officer of the Union, who will take the matter up with theEmployer. But in no event shall an employee be required to operatea vehicle/equipment that is unsafe or in violation of any federal,state or local, rules, regulations, standards or orders applicable toequipment or commercial motor vehicles.

Copies of the car-condition reports or Driver Vehicle InspectionReports (DVIR) will be available in centers for review by drivers.Upon notification, drivers may make copies of said reports in facil-ities that have copy equipment. In facilities with no copy equip-ment, the employee will be provided a copy as soon as practical,when requested. In no case will the copy of the DVIR remain validafter the DOT retention requirement (ninety (90) days) or the orig-inal DVIR expires. The current DVIR will be maintained in eachvehicle between completion of Preventative MaintenanceInspections (PMI). Other copies will be made available for reviewby drivers as required by the Federal Motor Carrier Safety Act(FMCS), 48 CFR 396, as applicable to the Employer.

Section 3 – Accidents and ReportsAny employee involved in any accident shall immediately notifythe Employer. When required by the Employer, the employee,before the end of the employee’s shift, shall complete a report of theaccident including all available names and addresses of witnesses tothe accident. The reference number will be given to the employee,and when requested, a copy of the accident report will be furnishedto the employee within two (2) working days of such request. Acopy of the accident report will also be furnished to the Local Unionif requested by a Local Union official. In cases of equipment acci-dents where a Driver’s Report of Accident form is completed, theemployee will be given a copy of the form the same day, whenrequested. In facilities with no copy equipment the employee willbe provided a copy as soon as practicable.

In the event of a vehicle accident, the Employer shall have twenty(20) days to complete its investigation, if warranted, and ten (10)days to take disciplinary action, if any, unless otherwise mutuallyagreed. Except for serious accidents, where the driver may be pre-sumed to be at fault, a driver will not be removed from the payrollduring an investigation of the accident.

A serious accident is defined as one in which:

1. There is a fatality, or;

2. A citation is issued and there is bodily injury to a person who, asa result of the injury, receives immediate medical treatment awayfrom the scene of the accident, or:

3. A citation is issued and one or more motor vehicles incur dis-abling damage as a result of the accident requiring a vehicle to betransported away from the scene by a tow truck or other vehicle, or;

4. Any vehicular contact with an aircraft which results in damagethat grounds such aircraft, or;

5. There is an accident involving a motor vehicle on Companyproperty, outside of any building, that results in a fatality or bodily

injury to a person, who as a result of the injury receives medicaltreatment away from the scene of the accident.

The driver will be entitled to non-driving work where available dur-ing this period at his/her normal rate of pay.

The Employer and the Union mutually agree that the employee’srights to Union representation will be protected pursuant to Article4 of the National Master UPS Agreement.

Section 4 – SeatsThe Employer will provide air-ride seats in all new CSI tractors andstraight trucks. In addition, where such seats exist, they shall bemaintained in a proper and reasonable condition.

Section 5 – Sun VisorsEmployer agrees to maintain sun visors in proper and reasonablecondition on all CSI equipment.

Section 6 – TiresOnly first-line tires will be used on the steering axle of CSI tractortrailer and straight truck equipment. In case of breakdown, a tem-porary replacement, other than a first line tire may be used to returnto the home terminal. The Employer agrees to not mix radial andbias ply tires on the same unit.

Section 7 – ShocksWhere the manufacturer recommends and provides shock absorbersas standard equipment, properly maintained shocks on suchequipment shall be considered as a necessary and integral part of thatassembly.

Section 8 – MirrorsAll vehicles purchased after the ratification of this Agreement shallbe equipped with regular mirrors and a convex mirror.

New tractor trailer and straight truck equipment shall be equippedwith heated mirrors. Any tractor trailer and straight truck equipment

with a model year 1994 or later shall be equipped with heated mir-rors when the mirrors require replacement.

Section 9 – Exhaust SystemsAll new diesel tractors added to the CSI fleet after ratification ofthis agreement shall be equipped with vertical exhaust stack.

Section 10 – Heaters and DefrostersThe Employer shall install and maintain heaters and defrosters onall trucks and all safety equipment required by law. Complaintsregarding heaters or defrosters not being in proper working ordershall be addressed pursuant to the red-tagging procedures underSection 2 of this Article.

Section 11 – Noise AbatementAll new CSI delivery fleet, will be ordered to comply with FederalMotor Carrier Safety Regulations (FMCSR), regarding in cab noiselevels.

Section 12 – Vehicle IntegrityThe Employer agrees to maintain all door and engine compartmentseals in order to eliminate, as much as possible, fumes, dust andmoisture in the delivery vehicle.

Section 13 – Qualification on EquipmentIf the Employer or a government agency requests a regular employ-ee to qualify on equipment requiring a classified or special license,or in the event an employee is required to qualify (recognizing sen-iority) on such equipment in order to obtain a better job opportuni-ty with his/her Employer, the Employer shall allow such regularemployee the use of the equipment so required in order to take theexamination.

Section 14 – Safety and Health CommitteesThere shall be Safety and Health Committees to cover all full-time andpart-time employees. There shall be one (1) committee per operatingfacility unless the number of employees and/or job classifications

within a facility dictates the establishment of more than one (1) com-mittee. The respective committees will be comprised of a mutuallyagreed to number of bargaining unit representatives and up to an equalnumber of management representatives.

Bargaining unit members who seek to serve on the Safety andHealth Committee may volunteer to do so, with approval of theLocal Union. The Union co-chair of the committee(s) shall beselected by the bargaining unit members of the committee.

Each committee shall meet at least once a month at a mutuallyagreeable time and place. The Employer shall provide committeemembers with adequate time to perform committee functions, asdescribed in paragraphs 1 through 7 below.

Each committee shall perform functions including, but not limited to:

1. Creating sub-committees, on an as needed basis, to investigatespecific issues of safety and health concern. These committees shallreport to the full committee.

2. Developing and maintaining minutes for all meetings, withcopies to all committee members and posted on designated safetybulletin boards.

3. Conducting periodic inspections of the facility to ensure thatthere is a safe, healthful and sanitary working environment in eachcenter.

4. Accompanying governmental, union, and/or Company healthand safety professionals on facility inspection tours. The Employermay limit the number of bargaining unit members of the committeeaccompanying such an inspection tour.

5. Receiving information pertaining to lost workday injury/ acci-dent causes and review results of the investigation of suchinjuries/accidents.

6. Receiving copies of the center’s OSHA Illness and Injury logsand the facility’s man-hours.

7. Receiving the Company sponsored training to enable committeemembers to effectively perform their respective functions as safetyand health committee members.

Any information provided to a CHSP committee will not be sharedoutside the committee without Employer’s consent.

If the committee is unable to resolve a safety and health concern and allsteps of the Comprehensive Health and Safety Process (CHSP) havebeen exhausted, the issue will be subject to the grievance procedure.

Section 15 – Hazardous Materials Handling ProgramThe Employer will maintain its HazardousMaterial Handling Program.

Section 16 – Union LiabilityNothing in the Agreement or its Supplements relating to health,safety or training rules or regulations shall create or be construed tocreate any liability or responsibility on behalf of the Union for anyinjury or accident to any employee or any other person; nor does theUnion assume any such liability or responsibility.

The Employer will not commence legal action against the Union, ona subrogation theory, contribution theory or otherwise, as a result ofthe Union’s negotiation of safety standards contained in thisAgreement or failure to properly investigate or follow up Employercompliance with those safety standards.

Section 17 – Compensation ClaimsNotwithstanding Article 2 of the Supplement, the parties agree thatArticle 14.2 of the National Master Agreement shall supersede anyprovision on compensation claims in any Addendum. The Companymay continue to maintain a modified work program at all Locals on anon-discriminatory basis. This program is designed to provide tem-porary work opportunities to those employees who are unable to per-form their normal work assignments due to an on-the-job injury.Notwithstanding any provision in any Addenda, the Company shallpay employees on TAW 100% of their regular rate of pay. To beassigned, temporary work must be available and within the employ-ee’s medical restrictions.

Article 9: Supervisors WorkingThis Article is being negotiated and included in this Supplementwith the intent that it is a substitute for Article 3 Section 7 of theNational Master Agreement and that the latter Article will have noapplicability to the employees in CSI’s operations. Furthermore, itis understood that existing supervisors working language in anyAddenda or Rider shall be applicable and any lesser conditions con-tained in any Rider or Addendum shall be superseded by the condi-tions contained in this Article.

The Employer agrees that the function of supervisors is the super-vision of employees and not the performance of work of theemployees they supervise. Accordingly, the Employer agrees thatsupervisors or other employees of the Employer who are not mem-bers of the bargaining unit shall not perform any bargaining unitwork, except while training, in instances of Acts of God, or to meetimmediate customer requirements in a timely manner whenemployees in the unit are not available. In performing such work,supervisory personnel will not cause bargaining unit employees tobe laid off. In addition, the Employer shall make every reasonableeffort to maintain a sufficient workforce to staff its operations withbargaining unit employees and to have the work performed by bar-gaining unit employees in accordance with current accepted localpractices.

If it is determined at any step of the grievance and/or arbitrationprocedure that this Section, or a “supervisor working” provision inan Addendum or Rider has been violated, the aggrieved employeewill be paid for the actual hours worked by the supervisor, at theappropriate rate of pay. If no aggrieved employee can be identified,the payment will be made to the grievant.

Article 10: SubcontractingSection 1The Employer may contract first flight; other unscheduled or emer-gency pick-up or deliveries and excess volume that cannot be han-dled by the normal pick-up and delivery pattern or equipment.

However, the Employer will make every reasonable effort to utilizebargaining unit employees before contracting out such work.

Section 2Notwithstanding any language to the contrary in any Rider orAddenda, the following provisions shall apply:

a) The Employer may utilize subcontractors at its discretion for outlying geographic areas when shipments and revenues are notsufficient to justify the cost of operating the Employer’s vehicles.Upon ratification of this agreement and, at least once every six (6)months thereafter the Employer shall meet with the Union toreview cost and volume data related to existing subcontracts. Thework will be assigned to the bargaining unit if it can be performedat equal or lesser cost by the bargaining unit. The Employer shallhave the right to remove any work assigned to the bargaining unitas a result of the subcontracting review meeting. Nothing withinthis section shall allow the Employer to remove work assigned tothe bargaining unit prior to the next scheduled review meeting.Furthermore nothing within this Section shall allow the Employerto remove work being performed by the bargaining unit as ofDecember 19, 2007.

b) The Employer shall notify the Union of any subcontracting.

Article 11: Short HaulNotwithstanding any language to the contrary in any Rider orAddenda, the following provision shall apply:

Bargaining unit members shall have the right to perform shorthaul work (i.e. runs to and from CSI facilities and/or hubs) whichcan be completed within a shift if it can be performed at an equalor lesser cost than the available vendors. The Employer shall havethe right to remove any work assigned pursuant to this paragraphfrom the bargaining unit if it becomes more expensive to use bar-gaining unit members than available vendors. However, the workwill not be removed within one year from the implementation of therun and unless costs exceed the vendor by more than five percent(5%).

The Employer shall continue to meet with the Union every six (6)months, to review the economic competitiveness of short haul workassigned to the bargaining unit pursuant to this paragraph. Nothingwithin this Section shall allow the Employer to remove short haulwork from the bargaining unit prior to one (1) year from the imple-mentation of the run. Furthermore, nothing within this Section shallallow the Employer to remove short haul work being performed asof December 19, 2007. In addition, short haul work shall not be per-formed by part-time employees, unless already permitted under theterms of the existing Addenda.

Article 12: Loss or DamageEmployees shall not be disciplined for loss or damage, unless theCompany so demonstrates by a preponderance of the evidence thatthe employee was negligent, reckless, or committed intentional actsresulting in loss, damage, or theft of freight or property.

Article 13: Employee TrainingThe Employer will provide employees who wish to become traineddrivers reasonable access to equipment so as to become familiarwith the equipment, while being trained by experienced Unionmembers. Employees shall have reasonable opportunity to utilizesuch equipment in the areas designated by the Employer to practiceoperation of the vehicles. In addition, the Employer shall providethe equipment and permit a bargaining unit employee to transportthe employee to the site where the employee will take the drivingportion of the license test. All training, practice and testing will beconducted on the employees’ own time, unless otherwise providedin the applicable Rider, Addendum, or established local practice.

Article 14: Uniforms

Section 1a) The Employer agrees that when employees are required to wearany kind of uniform as a condition of employment, they shall fur-nish, repair and replace the uniforms free of charge. The Employerwill furnish a minimum of six (6) uniforms (shirts, pants, shorts). Inaddition, the Employer will furnish a hat, jacket or coat and a belt.

b) Employer-issued uniforms must be worn while engaged in thework of the Employer and may be worn in travel to and from work,and between split shifts, but not otherwise. Employer-issued uni-forms shall not be worn for any purpose other than in the perform-ance of the employee’s normal job functions. The responsibility forcleaning of the Employer-issued uniforms will be determined bycurrent area practice.

The Employer has the right to establish and maintain reasonableappearance standards for all employees. The appearance standardswill be posted in each center.

Section 2Each employee is required to be in full dress uniform prior to andthrough the duration of his/her route. Only Employer providedclothing, on route, will be acceptable.

Employees performing sort functions or any other required dockwork will be allowed to wear tee-shirts.

Section 3Any Employee wearing a beard as of the effective date of thisAgreement is required to keep it neatly trimmed in accordance withEmployer’s appearance Guidelines. All employees not wearingbeards as of the effective date of this Agreement are required to beclean shaven. Any employee that has a beard as of the effective dateof this agreement and shaves it off will be expected to remain cleanshaven. Employees may wear neatly trimmed mustaches.

Article 15: Company RulesThe Company may establish and post such rules as deemed neces-sary and reasonable, provided such rules are not in conflict with theterms and provisions of this Agreement. All new rules posted shallbe provided to the job stewards and be sent to the Union by certi-fied mail five (5) days prior to posting. All such rules shall be post-ed for a period of ten (10) working days. If no protest in the form ofa written grievance is filed during the ten (10) working days period,the rules thereafter shall not be subject to a grievance.

Article 16: Military LeaveNotwithstanding Article 2 of this Supplement, the parties agree that the vacation language of Article 5 of the National MasterAgreement shall apply to any employees covered by this Supple-ment and supersede any provision on military leave vacation accrual in any Addendum.

Article 17: DurationThis Supplemental Agreement and all attached Addenda shall be ineffect in accordance with Article 45 of the NMA.

Letter of Agreement

Notwithstanding Article 2 of the UPS CSI Supplement, UPS CSIand the Teamsters UPS National Negotiating Committee agree thatTeamsters Local 901 may select National Master Agreement(NMA) Articles to supersede provisions in its Addendum.Teamsters Local 901 is being given this opportunity because it didnot participate in this process in the last contract. Effective August1, 2013 Teamsters Local 901 selects the following NMA Articles toapply in its Addendum:

(a) Article 3, Sections 1 through 5;(b) Article 16, Section 1;(c) Article 7;(d) Article 8; and (e) Article 17.

Discipline and SuspensionsThe Employer shall not discharge nor suspend any employee with-out just cause. No employee shall be suspended or discharged with-out first being given one (1) warning letter of complaint. The warn-ing letter, as herein provided, shall be given to the employee with acopy of said letter to the Union within ten (10) days of knowledgeof said complaint and shall not remain in effect for a period of morethan nine (9) months from date of said warning. Employees shallhave the right to protest any discharge or suspension pursuant to thegrievance procedure. No employee who is discharged or suspendedshall suffer any loss of pay or benefits until the grievance procedurehas been fully completed. The Employer liability will stop if thedischarge is sustained by the UPS Joint Area Committee. Dischargeor suspension must be by proper written notice to the employee andthe Union. The Employer agrees that when conducting an interviewwith an employee for the purpose of discipline, it will be done in thepresence of a steward.
