Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

That the following sums are appropriated, out of any 3

money in the Treasury not otherwise appropriated, for the 4

Department of the Interior, environment, and related 5

agencies for the fiscal year ending September 30, 2020, 6

and for other purposes, namely: 7

TITLE I 8

DEPARTMENT OF THE INTERIOR 9

BUREAU OF LAND MANAGEMENT 10

MANAGEMENT OF LANDS AND RESOURCES 11

(INCLUDING RESCISSION OF FUNDS) 12

For necessary expenses for protection, use, improve-13

ment, development, disposal, cadastral surveying, classi-14

fication, acquisition of easements and other interests in 15

lands, and performance of other functions, including main-16

tenance of facilities, as authorized by law, in the manage-17

ment of lands and their resources under the jurisdiction 18

of the Bureau of Land Management, including the general 19

administration of the Bureau, and assessment of mineral 20

potential of public lands pursuant to section 1010(a) of 21

Public Law 96–487 (16 U.S.C. 3150(a)), $1,265,097,000, 22

to remain available until September 30, 2021; of which 23

$125,653,000 for annual and deferred maintenance shall 24

remain available until expended, and of which $6,000,000 25

is for a pilot program to complement activities authorized 1

by Public Law 92–195: Provided, That amounts in the 2

fee account of the Bureau of Land Management permit 3

process improvement fund may be used for bureau-related 4

expenses directly associated with the processing of oil and 5

gas applications for permits to drill and related use of au-6

thorizations. 7

In addition, $39,696,000 is for Mining Law Adminis-8

tration program operations, including the cost of admin-9

istering the mining claim fee program, to remain available 10

until expended, to be reduced by amounts collected by the 11

Bureau and credited to this appropriation from mining 12

claim maintenance fees and location fees that are hereby 13

authorized for fiscal year 2020, so as to result in a final 14

appropriation estimated at not more than $1,265,097,000, 15

and $2,000,000, to remain available until expended, from 16

communication site rental fees established by the Bureau 17

for the cost of administering communication site activities. 18

Of the unobligated balances from amounts made 19

available under this heading in fiscal year 2016 or before, 20

$14,000,000 is permanently rescinded: Provided, That no 21

amounts may be rescinded from amounts that were des-22

ignated by the Congress as an emergency requirement 23

pursuant to the Concurrent Resolution on the Budget or 24

the Balanced Budget and Emergency Deficit Control Act 1

of 1985. 2

CONSTRUCTION 3



available under this heading $5,000,000 is permanently 6

rescinded: Provided, That no amounts may be rescinded 7

from amounts that were designated by the Congress as 8

an emergency requirement pursuant to the Concurrent 9

Resolution on the Budget or the Balanced Budget and 10

Emergency Deficit Control Act of 1985. 11

LAND ACQUISITION 12

For expenses necessary to carry out sections 205, 13

206, and 318(d) of Public Law 94–579, including admin-14

istrative expenses and acquisition of lands or waters, or 15

interests therein, $33,800,000, to be derived from the 16

Land and Water Conservation Fund and to remain avail-17

able until expended. 18

OREGON AND CALIFORNIA GRANT LANDS 19

For expenses necessary for management, protection, 20

and development of resources and for construction, oper-21

ation, and maintenance of access roads, reforestation, and 22

other improvements on the revested Oregon and California 23

Railroad grant lands, on other Federal lands in the Or-24

egon and California land-grant counties of Oregon, and 25

on adjacent rights-of-way; and acquisition of lands or in-1

terests therein, including existing connecting roads on or 2

adjacent to such grant lands; $117,195,000, to remain 3

available until expended: Provided, That 25 percent of the 4

aggregate of all receipts during the current fiscal year 5

from the revested Oregon and California Railroad grant 6

lands is hereby made a charge against the Oregon and 7

California land-grant fund and shall be transferred to the 8

General Fund in the Treasury in accordance with the sec-9

ond paragraph of subsection (b) of title II of the Act of 10

August 28, 1937 (43 U.S.C. 2605). 11

RANGE IMPROVEMENTS 12

For rehabilitation, protection, and acquisition of 13

lands and interests therein, and improvement of Federal 14

rangelands pursuant to section 401 of the Federal Land 15

Policy and Management Act of 1976 (43 U.S.C. 1751), 16

notwithstanding any other Act, sums equal to 50 percent 17

of all moneys received during the prior fiscal year under 18

sections 3 and 15 of the Taylor Grazing Act (43 U.S.C. 19

315b, 315m) and the amount designated for range im-20

provements from grazing fees and mineral leasing receipts 21

from Bankhead-Jones lands transferred to the Depart-22

ment of the Interior pursuant to law, but not less than 23

$10,000,000, to remain available until expended: Pro-24

vided, That not to exceed $600,000 shall be available for 1

administrative expenses. 2

SERVICE CHARGES, DEPOSITS, AND FORFEITURES 3

For administrative expenses and other costs related 4

to processing application documents and other authoriza-5

tions for use and disposal of public lands and resources, 6

for costs of providing copies of official public land docu-7

ments, for monitoring construction, operation, and termi-8

nation of facilities in conjunction with use authorizations, 9

and for rehabilitation of damaged property, such amounts 10

as may be collected under Public Law 94–579 (43 U.S.C. 11

1701 et seq.), and under section 28 of the Mineral Leasing 12

Act (30 U.S.C. 185), to remain available until expended: 13

Provided, That notwithstanding any provision to the con-14

trary of section 305(a) of Public Law 94–579 (43 U.S.C. 15

1735(a)), any moneys that have been or will be received 16

pursuant to that section, whether as a result of forfeiture, 17

compromise, or settlement, if not appropriate for refund 18

pursuant to section 305(c) of that Act (43 U.S.C. 19

1735(c)), shall be available and may be expended under 20

the authority of this Act by the Secretary to improve, pro-21

tect, or rehabilitate any public lands administered through 22

the Bureau of Land Management which have been dam-23

aged by the action of a resource developer, purchaser, per-24

mittee, or any unauthorized person, without regard to 25

whether all moneys collected from each such action are 1

used on the exact lands damaged which led to the action: 2

Provided further, That any such moneys that are in excess 3

of amounts needed to repair damage to the exact land for 4

which funds were collected may be used to repair other 5

damaged public lands. 6

MISCELLANEOUS TRUST FUNDS 7

In addition to amounts authorized to be expended 8

under existing laws, there is hereby appropriated such 9

amounts as may be contributed under section 307 of Pub-10

lic Law 94–579 (43 U.S.C. 1737), and such amounts as 11

may be advanced for administrative costs, surveys, ap-12

praisals, and costs of making conveyances of omitted lands 13

under section 211(b) of that Act (43 U.S.C. 1721(b)), to 14

remain available until expended. 15

ADMINISTRATIVE PROVISIONS 16

The Bureau of Land Management may carry out the 17

operations funded under this Act by direct expenditure, 18

contracts, grants, cooperative agreements and reimburs-19

able agreements with public and private entities, including 20

with States. Appropriations for the Bureau shall be avail-21

able for purchase, erection, and dismantlement of tem-22

porary structures, and alteration and maintenance of nec-23

essary buildings and appurtenant facilities to which the 24

United States has title; up to $100,000 for payments, at 25

the discretion of the Secretary, for information or evidence 1

concerning violations of laws administered by the Bureau; 2

miscellaneous and emergency expenses of enforcement ac-3

tivities authorized or approved by the Secretary and to be 4

accounted for solely on the Secretary’s certificate, not to 5

exceed $10,000: Provided, That notwithstanding Public 6

Law 90–620 (44 U.S.C. 501), the Bureau may, under co-7

operative cost-sharing and partnership arrangements au-8

thorized by law, procure printing services from cooperators 9

in connection with jointly produced publications for which 10

the cooperators share the cost of printing either in cash 11

or in services, and the Bureau determines the cooperator 12

is capable of meeting accepted quality standards: Provided 13

further, That projects to be funded pursuant to a written 14

commitment by a State government to provide an identi-15

fied amount of money in support of the project may be 16

carried out by the Bureau on a reimbursable basis. Appro-17

priations herein made shall not be available for the de-18

struction of healthy, unadopted, wild horses and burros 19

in the care of the Bureau or its contractors or for the 20

sale of wild horses and burros that results in their destruc-21

tion for processing into commercial products. 22

UNITED STATES FISH AND WILDLIFE SERVICE 1

RESOURCE MANAGEMENT 2


For necessary expenses of the United States Fish and 4

Wildlife Service, as authorized by law, and for scientific 5

and economic studies, general administration, and for the 6

performance of other authorized functions related to such 7

resources, $1,364,760,000, to remain available until Sep-8

tember 30, 2021: Provided, That not to exceed 9

$23,442,000 shall be used for implementing subsections 10

(a), (b), (c), and (e) of section 4 of the Endangered Spe-11

cies Act of 1973 (16 U.S.C. 1533) (except for processing 12

petitions, developing and issuing proposed and final regu-13

lations, and taking any other steps to implement actions 14

described in subsection (c)(2)(A), (c)(2)(B)(i), or 15

(c)(2)(B)(ii)). 16

explanatory statement accompanying the Consolidated Ap-19

propriations Act, 2019, for central office operations in fis-20

cal year 2019, $4,000,000 is permanently rescinded: Pro-21

vided, That no amounts may be rescinded from amounts 22

that were designated by the Congress as an emergency re-23

quirement pursuant to the Concurrent Resolution on the 24

Budget or the Balanced Budget and Emergency Deficit 1

CONSTRUCTION 3

For construction, improvement, acquisition, or re-4

moval of buildings and other facilities required in the con-5

servation, management, investigation, protection, and uti-6

lization of fish and wildlife resources, and the acquisition 7

of lands and interests therein; $15,693,000, to remain 8

available until expended. 9

LAND ACQUISITION 10

For expenses necessary to carry out chapter 2003 of 11

title 54, United States Code, including administrative ex-12

penses, and for acquisition of land or waters, or interest 13

therein, in accordance with statutory authority applicable 14

to the United States Fish and Wildlife Service, 15

$67,750,000, to be derived from the Land and Water Con-16

servation Fund and to remain available until expended, 17

of which, notwithstanding section 200306 of title 54, 18

United States Code, not more than $10,000,000 shall be 19

for land conservation partnerships authorized by the 20

Highlands Conservation Act of 2004, including not to ex-21

ceed $320,000 for administrative expenses: Provided, That 22

none of the funds appropriated for specific land acquisi-23

tion projects may be used to pay for any administrative 24

overhead, planning or other management costs. 25

COOPERATIVE ENDANGERED SPECIES CONSERVATION 1

FUND 2


For expenses necessary to carry out section 6 of the 4

Endangered Species Act of 1973 (16 U.S.C. 1535), 5

$63,702,000, to remain available until expended, of which 6

$23,702,000 is to be derived from the Cooperative Endan-7

gered Species Conservation Fund; and of which 8

$40,000,000 is to be derived from the Land and Water 9

Conservation Fund. 10

Of the unobligated balances made available from the 11

Cooperative Endangered Species Conservation Fund, 12

$5,000,000 is permanently rescinded: Provided, That no 13

amounts may be rescinded from amounts that were des-14

ignated by the Congress as an emergency requirement 15

pursuant to the Concurrent Resolution on the Budget or 16

the Balanced Budget and Emergency Deficit Control Act 17

of 1985. 18

NATIONAL WILDLIFE REFUGE FUND 19

For expenses necessary to implement the Act of Octo-20

ber 17, 1978 (16 U.S.C. 715s), $13,228,000. 21

NORTH AMERICAN WETLANDS CONSERVATION FUND 22

For expenses necessary to carry out the provisions 23

of the North American Wetlands Conservation Act (16 24

U.S.C. 4401 et seq.), $50,000,000, to remain available 1

until expended. 2

NEOTROPICAL MIGRATORY BIRD CONSERVATION 3

For expenses necessary to carry out the Neotropical 4

Migratory Bird Conservation Act (16 U.S.C. 6101 et 5

seq.), $4,910,000, to remain available until expended. 6

MULTINATIONAL SPECIES CONSERVATION FUND 7

For expenses necessary to carry out the African Ele-8

phant Conservation Act (16 U.S.C. 4201 et seq.), the 9

Asian Elephant Conservation Act of 1997 (16 U.S.C. 10

4261 et seq.), the Rhinoceros and Tiger Conservation Act 11

of 1994 (16 U.S.C. 5301 et seq.), the Great Ape Con-12

servation Act of 2000 (16 U.S.C. 6301 et seq.), and the 13

Marine Turtle Conservation Act of 2004 (16 U.S.C. 6601 14

et seq.), $15,000,000, to remain available until expended. 15

STATE AND TRIBAL WILDLIFE GRANTS 16

For wildlife conservation grants to States and to the 17

District of Columbia, Puerto Rico, Guam, the United 18

States Virgin Islands, the Northern Mariana Islands, 19

American Samoa, and Indian tribes under the provisions 20

of the Fish and Wildlife Act of 1956 and the Fish and 21

Wildlife Coordination Act, for the development and imple-22

mentation of programs for the benefit of wildlife and their 23

habitat, including species that are not hunted or fished, 24

vided, That of the amount provided herein, $5,209,000 is 1

for a competitive grant program for Indian tribes not sub-2

ject to the remaining provisions of this appropriation: Pro-3

vided further, That $7,362,000 is for a competitive grant 4

program to implement approved plans for States, terri-5

tories, and other jurisdictions and at the discretion of af-6

fected States, the regional Associations of fish and wildlife 7

agencies, not subject to the remaining provisions of this 8

appropriation: Provided further, That the Secretary shall, 9

after deducting $12,571,000 and administrative expenses, 10

apportion the amount provided herein in the following 11

manner: (1) to the District of Columbia and to the Com-12

monwealth of Puerto Rico, each a sum equal to not more 13

than one-half of 1 percent thereof; and (2) to Guam, 14

American Samoa, the United States Virgin Islands, and 15

the Commonwealth of the Northern Mariana Islands, each 16

a sum equal to not more than one-fourth of 1 percent 17

thereof: Provided further, That the Secretary shall appor-18

tion the remaining amount in the following manner: (1) 19

one-third of which is based on the ratio to which the land 20

area of such State bears to the total land area of all such 21

States; and (2) two-thirds of which is based on the ratio 22

to which the population of such State bears to the total 23

population of all such States: Provided further, That the 24

amounts apportioned under this paragraph shall be ad-25

justed equitably so that no State shall be apportioned a 1

sum which is less than 1 percent of the amount available 2

for apportionment under this paragraph for any fiscal year 3

or more than 5 percent of such amount: Provided further, 4

That the Federal share of planning grants shall not exceed 5

75 percent of the total costs of such projects and the Fed-6

eral share of implementation grants shall not exceed 65 7

percent of the total costs of such projects: Provided fur-8

ther, That the non-Federal share of such projects may not 9

be derived from Federal grant programs: Provided further, 10

That any amount apportioned in 2020 to any State, terri-11

tory, or other jurisdiction that remains unobligated as of 12

September 30, 2021, shall be reapportioned, together with 13

funds appropriated in 2022, in the manner provided here-14

in. 15


The United States Fish and Wildlife Service may 17

carry out the operations of Service programs by direct ex-18

penditure, contracts, grants, cooperative agreements and 19

reimbursable agreements with public and private entities. 20

Appropriations and funds available to the United States 21

Fish and Wildlife Service shall be available for repair of 22

damage to public roads within and adjacent to reservation 23

areas caused by operations of the Service; options for the 24

purchase of land at not to exceed $1 for each option; facili-25

ties incident to such public recreational uses on conserva-1

tion areas as are consistent with their primary purpose; 2

and the maintenance and improvement of aquaria, build-3

ings, and other facilities under the jurisdiction of the Serv-4

ice and to which the United States has title, and which 5

are used pursuant to law in connection with management, 6

and investigation of fish and wildlife resources: Provided, 7

That notwithstanding 44 U.S.C. 501, the Service may, 8

under cooperative cost sharing and partnership arrange-9

ments authorized by law, procure printing services from 10

cooperators in connection with jointly produced publica-11

tions for which the cooperators share at least one-half the 12

cost of printing either in cash or services and the Service 13

determines the cooperator is capable of meeting accepted 14

quality standards: Provided further, That the Service may 15

accept donated aircraft as replacements for existing air-16

craft: Provided further, That notwithstanding 31 U.S.C. 17

3302, all fees collected for non-toxic shot review and ap-18

proval shall be deposited under the heading ‘‘United 19

States Fish and Wildlife Service—Resource Management’’ 20

and shall be available to the Secretary, without further 21

appropriation, to be used for expenses of processing of 22

such non-toxic shot type or coating applications and revis-23

ing regulations as necessary, and shall remain available 24

until expended. 25

NATIONAL PARK SERVICE 1

OPERATION OF THE NATIONAL PARK SYSTEM 2

For expenses necessary for the management, oper-3

ation, and maintenance of areas and facilities adminis-4

tered by the National Park Service and for the general 5

administration of the National Park Service, 6

$2,646,979,000, of which $10,282,000 for planning and 7

interagency coordination in support of Everglades restora-8

tion and $150,980,000 for maintenance, repair, or reha-9

bilitation projects for constructed assets and 10

$166,575,000 for cyclic maintenance projects for con-11

structed assets and cultural resources and $5,000,000 12

shall be for uses authorized by section 101122 of title 54, 13

United States Code shall remain available until September 14

30, 2021: Provided, That funds appropriated under this 15

heading in this Act are available for the purposes of sec-16

tion 5 of Public Law 95–348: Provided further, That not-17

withstanding section 9(a) of the United States 18

Semiquincentennial Commission Act of 2016 (Public Law 19

114–196; 130 Stat. 691), $500,000 of the funds made 20

available under this heading shall be provided to the orga-21

nization selected under section 9(b) of that Act for ex-22

penditure by the United States Semiquincentennial Com-23

mission in accordance with that Act. Provided further, 24

That notwithstanding section 9 of the 400 Years of Afri-25

can-American History Commission Act (Public Law 115– 1

102; 131 Stat. 2248), $500,000 of the funds made avail-2

able under this heading shall be provided to the 400 Years 3

of African-American History Commission for expenditure 4

in accordance with that Act. 5

NATIONAL RECREATION AND PRESERVATION 6

For expenses necessary to carry out recreation pro-7

grams, natural programs, cultural programs, heritage 8

partnership programs, environmental compliance and re-9

view, international park affairs, and grant administration, 10

not otherwise provided for, $73,508,000. 11

HISTORIC PRESERVATION FUND 12

For expenses necessary in carrying out the National 13

Historic Preservation Act (division A of subtitle III of title 14

54, United States Code), $121,660,000, to be derived 15

from the Historic Preservation Fund and to remain avail-16

able until September 30, 2021, of which $16,000,000 shall 17

be for Save America’s Treasures grants for preservation 18

of national significant sites, structures and artifacts as au-19

thorized by section 7303 of the Omnibus Public Land 20

Management Act of 2009 (54 U.S.C. 3089): Provided, 21

That an individual Save America’s Treasures grant shall 22

be matched by non-Federal funds: Provided further, That 23

individual projects shall only be eligible for one grant: Pro-24

vided further, That all projects to be funded shall be ap-25

proved by the Secretary of the Interior in consultation 1

with the House and Senate Committees on Appropria-2

tions: Provided further, That of the funds provided for the 3

Historic Preservation Fund, $750,000 is for competitive 4

grants for the survey and nomination of properties to the 5

National Register of Historic Places and as National His-6

toric Landmarks associated with communities currently 7

under-represented, as determined by the Secretary, 8

$22,500,000 is for competitive grants to preserve the sites 9

and stories of the Civil Rights movement, $10,000,000 is 10

for grants to Historically Black Colleges and Universities, 11

and $5,000,000 is for competitive grants for the restora-12

tion of historic properties of national, State and local sig-13

nificance listed on or eligible for inclusion on the National 14

Register of Historic Places, to be made without imposing 15

the usage or direct grant restrictions of section 101(e)(3) 16

(54 U.S.C. 302904) of the National Historical Preserva-17

tion Act: Provided further, That such competitive grants 18

shall be made without imposing the matching require-19

ments in section 302902(b)(3) of title 54, United States 20

Code, to States and Indian tribes as defined in chapter 21

3003 of such title, Native Hawaiian organizations, local 22

governments, including Certified Local Governments, and 23

non-profit organizations. 24

CONSTRUCTION 1

For construction, improvements, repair, or replace-2

ment of physical facilities, and compliance and planning 3

for programs and areas administered by the National 4

Park Service, $319,704,000, to remain available until ex-5

pended: Provided, That notwithstanding any other provi-6

sion of law, for any project initially funded in fiscal year 7

2021 with a future phase indicated in the National Park 8

Service 5-Year Line Item Construction Plan, a single pro-9

curement may be issued which includes the full scope of 10

the project: Provided further, That the solicitation and 11

contract shall contain the clause availability of funds 12

found at 48 CFR 52.232–18: Provided further, That Na-13

tional Park Service Donations, Park Concessions Fran-14

chise Fees, and Recreation Fees may be made available 15

for the cost of adjustments and changes within the origi-16

nal scope of effort for projects funded by the National 17

Park Service Construction appropriation: Provided further, 18

That the Secretary of the Interior shall consult with the 19

Committees on Appropriations, in accordance with current 20

reprogramming thresholds, prior to making any charges 21

authorized by this section. 22

LAND AND WATER CONSERVATION FUND 1

(RESCISSION) 2

The contract authority provided for fiscal year 2020 3

by section 200308 of title 54, United States Code, is re-4

scinded. 5

LAND ACQUISITION AND STATE ASSISTANCE 6

For expenses necessary to carry out chapter 2003 of 7

title 54, United States Code, including administrative ex-8

penses, and for acquisition of lands or waters, or interest 9

therein, in accordance with the statutory authority appli-10

cable to the National Park Service, $208,400,000, to be 11

derived from the Land and Water Conservation Fund and 12

to remain available until expended, of which $140,000,000 13

is for the State assistance program and of which 14

$15,000,000 shall be for the American Battlefield Protec-15

tion Program grants as authorized by chapter 3081 of title 16

54, United States Code. 17

CENTENNIAL CHALLENGE 18


of section 101701 of title 54, United States Code, relating 20

to challenge cost share agreements, $20,000,000, to re-21

main available until expended, for Centennial Challenge 22

projects and programs: Provided, That not less than 50 23

percent of the total cost of each project or program shall 24

be derived from non-Federal sources in the form of do-25

nated cash, assets, or a pledge of donation guaranteed by 1

an irrevocable letter of credit. 2

In addition to other uses set forth in section 5

101917(c)(2) of title 54, United States Code, franchise 6

fees credited to a sub-account shall be available for ex-7

penditure by the Secretary, without further appropriation, 8

for use at any unit within the National Park System to 9

extinguish or reduce liability for Possessory Interest or 10

leasehold surrender interest. Such funds may only be used 11

for this purpose to the extent that the benefitting unit an-12

ticipated franchise fee receipts over the term of the con-13

tract at that unit exceed the amount of funds used to ex-14

tinguish or reduce liability. Franchise fees at the benefit-15

ting unit shall be credited to the sub-account of the origi-16

nating unit over a period not to exceed the term of a single 17

contract at the benefitting unit, in the amount of funds 18

so expended to extinguish or reduce liability. 19

For the costs of administration of the Land and 20

Water Conservation Fund grants authorized by section 21

105(a)(2)(B) of the Gulf of Mexico Energy Security Act 22

of 2006 (Public Law 109–432), the National Park Service 23

may retain up to 3 percent of the amounts which are au-24

thorized to be disbursed under such section, such retained 1

amounts to remain available until expended. 2

National Park Service funds may be transferred to 3

the Federal Highway Administration (FHWA), Depart-4

ment of Transportation, for purposes authorized under 23 5

U.S.C. 204. Transfers may include a reasonable amount 6

for FHWA administrative support costs. 7

UNITED STATES GEOLOGICAL SURVEY 8

SURVEYS, INVESTIGATIONS, AND RESEARCH 9

For expenses necessary for the United States Geo-10

logical Survey to perform surveys, investigations, and re-11

search covering topography, geology, hydrology, biology, 12

and the mineral and water resources of the United States, 13

its territories and possessions, and other areas as author-14

ized by 43 U.S.C. 31, 1332, and 1340; classify lands as 15

to their mineral and water resources; give engineering su-16

pervision to power permittees and Federal Energy Regu-17

latory Commission licensees; administer the minerals ex-18

ploration program (30 U.S.C. 641); conduct inquiries into 19

the economic conditions affecting mining and materials 20

processing industries (30 U.S.C. 3, 21a, and 1603; 50 21

U.S.C. 98g(1)) and related purposes as authorized by law; 22

and to publish and disseminate data relative to the fore-23

going activities; $1,236,398,000, to remain available until 24

September 30, 2021; of which $84,337,000 shall remain 25

available until expended for satellite operations; and of 1

which $20,164,000 shall be available until expended for 2

deferred maintenance and capital improvement projects 3

that exceed $100,000 in cost: Provided, That none of the 4

funds provided for the ecosystem research activity shall 5

be used to conduct new surveys on private property, unless 6

specifically authorized in writing by the property owner: 7

Provided further, That no part of this appropriation shall 8

be used to pay more than one-half the cost of topographic 9

mapping or water resources data collection and investiga-10

tions carried on in cooperation with States and municipali-11

ties. 12


From within the amount appropriated for activities 14

of the United States Geological Survey such sums as are 15

necessary shall be available for contracting for the fur-16

nishing of topographic maps and for the making of geo-17

physical or other specialized surveys when it is administra-18

tively determined that such procedures are in the public 19

interest; construction and maintenance of necessary build-20

ings and appurtenant facilities; acquisition of lands for 21

gauging stations, observation wells, and seismic equip-22

ment; expenses of the United States National Committee 23

for Geological Sciences; and payment of compensation and 24

expenses of persons employed by the Survey duly ap-25

pointed to represent the United States in the negotiation 1

and administration of interstate compacts: Provided, That 2

activities funded by appropriations herein made may be 3

accomplished through the use of contracts, grants, or co-4

operative agreements as defined in section 6302 of title 5

States Geological Survey may enter into contracts or coop-7

erative agreements directly with individuals or indirectly 8

with institutions or nonprofit organizations, without re-9

gard to 41 U.S.C. 6101, for the temporary or intermittent 10

services of students or recent graduates, who shall be con-11

sidered employees for the purpose of chapters 57 and 81 12

of title 5, United States Code, relating to compensation 13

for travel and work injuries, and chapter 171 of title 28, 14

ABANDONED MINE RECLAMATION FUND 3

For necessary expenses to carry out title IV of the 4

Surface Mining Control and Reclamation Act of 1977, 5

ceipts of the Abandoned Mine Reclamation Fund and to 7

remain available until expended: Provided, That pursuant 8

to Public Law 97–365, the Department of the Interior is 9

authorized to use up to 20 percent from the recovery of 10

the delinquent debt owed to the United States Government 11

to pay for contracts to collect these debts: Provided fur-12

ther, That funds made available under title IV of Public 13

Law 95–87 may be used for any required non-Federal 14

share of the cost of projects funded by the Federal Gov-15

ernment for the purpose of environmental restoration re-16

lated to treatment or abatement of acid mine drainage 17

from abandoned mines: Provided further, That such 18

projects must be consistent with the purposes and prior-19

ities of the Surface Mining Control and Reclamation Act: 20

Provided further, That amounts provided under this head-21

ing may be used for the travel and per diem expenses of 22

State and tribal personnel attending Office of Surface 23

Mining Reclamation and Enforcement sponsored training. 24

In addition, $115,000,000, to remain available until 1

expended, for grants to States and federally recognized In-2

dian Tribes for reclamation of abandoned mine lands and 3

other related activities in accordance with the terms and 4

conditions in the report accompanying this Act: Provided, 5

That such additional amount shall be used for economic 6

and community development in conjunction with the prior-7

ities in section 403(a) of the Surface Mining Control and 8

Reclamation Act of 1977 (30 U.S.C. 1233(a)): Provided 9

further, That of such additional amount, $75,000,000 10

shall be distributed in equal amounts to the 3 Appalachian 11

States with the greatest amount of unfunded needs to 12

meet the priorities described in paragraphs (1) and (2) 13

of such section, $30,000,000 shall be distributed in equal 14

amounts to the 3 Appalachian States with the subsequent 15

greatest amount of unfunded needs to meet such prior-16

ities, and $10,000,000 shall be for grants to federally rec-17

ognized Indian Tribes without regard to their status as 18

certified or uncertified under the Surface Mining Control 19

and Reclamation Act of 1977 (30 U.S.C. 1233(a)), for 20

reclamation of abandoned mine lands and other related 21

activities in accordance with the terms and conditions in 22

the report accompanying this Act and shall be used for 23

economic and community development in conjunction with 24

the priorities in section 403(a) of the Surface Mining Con-25

trol and Reclamation Act of 1977: Provided further, That 1

such additional amount shall be allocated to States and 2

Indian Tribes within 60 days after the date of enactment 3

of this Act. 4

OPERATION OF INDIAN PROGRAMS 6


For expenses necessary for the operation of Indian 8

programs, as authorized by law, including the Snyder Act 9

of November 2, 1921 (25 U.S.C. 13), the Indian Self-De-10

termination and Education Assistance Act of 1975 (25 11

U.S.C. 5301 et seq.), $1,650,504,000 to remain available 12

until September 30, 2021, except as otherwise provided 13

herein; of which not to exceed $8,500 may be for official 14

reception and representation expenses; of which not to ex-15

ceed $77,734,000 shall be for welfare assistance pay-16

ments: Provided, That in cases of designated Federal dis-17

asters, the Secretary may exceed such cap, from the 18

amounts provided herein, to provide for disaster relief to 19

Indian communities affected by the disaster: Provided fur-20

ther, That federally recognized Indian tribes and tribal or-21

ganizations of federally recognized Indian tribes may use 22

their tribal priority allocations for unmet welfare assist-23

ance costs: Provided further, That not to exceed 24

$73,164,000 shall remain available until expended for 25

housing improvement, road maintenance, attorney fees, 1

litigation support, land records improvement, and the 2

Navajo-Hopi Settlement Program: Provided further, That 3

any forestry funds allocated to a federally recognized tribe 4

be transferred during fiscal year 2022 to an Indian forest 6

land assistance account established for the benefit of the 7

holder of the funds within the holder’s trust fund account: 8

Provided further, That any such unobligated balances not 9

so transferred shall expire on September 30, 2022: Pro-10

vided further, That in order to enhance the safety of Bu-11

reau field employees, the Bureau may use funds to pur-12

chase uniforms or other identifying articles of clothing for 13

personnel: Provided further, That the Bureau of Indian 14

Affairs may accept transfers of funds from U.S. Customs 15

and Border Protection to supplement any other funding 16

available for reconstruction or repair of roads owned by 17

the Bureau of Indian Affairs as identified on the National 18

Tribal Transportation Facility Inventory, 23 U.S.C. 19

202(b)(1). 20

CONTRACT SUPPORT COSTS 21

For payments to tribes and tribal organizations for 22

contract support costs associated with Indian Self-Deter-23

mination and Education Assistance Act agreements with 24

CONSTRUCTION 7


For construction, repair, improvement, and mainte-9

nance of irrigation and power systems, buildings, utilities, 10

and other facilities, including architectural and engineer-11

ing services by contract; acquisition of lands, and interests 12

in lands; and preparation of lands for farming, and for 13

construction of the Navajo Indian Irrigation Project pur-14

suant to Public Law 87–483; $146,014,000, to remain 15

available until expended: Provided, That such amounts as 16

may be available for the construction of the Navajo Indian 17

Irrigation Project may be transferred to the Bureau of 18

Reclamation: Provided further, That not to exceed 6 per-19

cent of contract authority available to the Bureau of In-20

dian Affairs from the Federal Highway Trust Fund may 21

be used to cover the road program management costs of 22

the Bureau: Provided further, That any funds provided for 23

the Safety of Dams program pursuant to the Act of No-24

vember 2, 1921 (25 U.S.C. 13), shall be made available 25

on a nonreimbursable basis: Provided further, That this 1

appropriation may be reimbursed from the Office of the 2

Special Trustee for American Indians appropriation for 3

available under this heading, $10,000,000 shall be derived 7

from the Indian Irrigation Fund established by section 8

3211 of the WIIN Act (Public Law 114–322; 130 Stat. 9

INDIAN LAND AND WATER CLAIM SETTLEMENTS AND 11

MISCELLANEOUS PAYMENTS TO INDIANS 12

For payments and necessary administrative expenses 13

for implementation of Indian land and water claim settle-14

ments pursuant to Public Laws 99–264, 100–580, 101– 15

618, 111–11, 111–291, and 114–322, and for implemen-16

tation of other land and water rights settlements, 17

$45,644,000, to remain available until expended. 18

INDIAN GUARANTEED LOAN PROGRAM ACCOUNT 19

For the cost of guaranteed loans and insured loans, 20

$12,784,000, of which $1,725,000 is for administrative 21

expenses, as authorized by the Indian Financing Act of 22

1974: Provided, That such costs, including the cost of 23

modifying such loans, shall be as defined in section 502 24

of the Congressional Budget Act of 1974: Provided fur-25

ther, That these funds are available to subsidize total loan 1

principal, any part of which is to be guaranteed or insured, 2

The Bureau of Indian Affairs may carry out the oper-5

ation of Indian programs by direct expenditure, contracts, 6

cooperative agreements, compacts, and grants, either di-7

rectly or in cooperation with States and other organiza-8

tions. 9

Notwithstanding Public Law 87–279 (25 U.S.C. 15), 10

the Bureau of Indian Affairs may contract for services in 11

support of the management, operation, and maintenance 12

of the Power Division of the San Carlos Irrigation Project. 13

Notwithstanding any other provision of law, no funds 14

available to the Bureau of Indian Affairs for central office 15

oversight and Executive Direction and Administrative 16

Services (except executive direction and administrative 17

services funding for Tribal Priority Allocations, regional 18

offices, and facilities operations and maintenance) shall be 19

available for contracts, grants, compacts, or cooperative 20

agreements with the Bureau of Indian Affairs under the 21

provisions of the Indian Self-Determination Act or the 22

Tribal Self-Governance Act of 1994 (Public Law 103– 23

413). 24

In the event any tribe returns appropriations made 1

available by this Act to the Bureau of Indian Affairs, this 2

action shall not diminish the Federal Government’s trust 3

responsibility to that tribe, or the government-to-govern-4

ment relationship between the United States and that 5

tribe, or that tribe’s ability to access future appropria-6

tions. 7

Notwithstanding any other provision of law, including 8

section 113 of title I of appendix C of Public Law 106– 9

113, if in fiscal year 2003 or 2004 a grantee received indi-10

rect and administrative costs pursuant to a distribution 11

formula based on section 5(f) of Public Law 101–301, the 12

Secretary shall continue to distribute indirect and admin-13

istrative cost funds to such grantee using the section 5(f) 14

distribution formula. 15

BUREAU OF INDIAN EDUCATION 16

For expenses necessary for the operation of Indian 18

Education programs, as authorized by law, including the 19

ments of 1978 (25 U.S.C. 2001-2019), and the Tribally 23

federally recognized Indian tribes and tribal organizations 2

school operation costs of Bureau-funded schools and other 6

education programs shall become available on July 1, 7

2020, and shall remain available until September 30, 8

2021: Provided further, That notwithstanding any other 9

provision of law, including but not limited to the Indian 10

Self-Determination Act of 1975 (25 U.S.C. 5301 et seq.) 11

and section 1128 of the Education Amendments of 1978 12

(25 U.S.C. 2008), not to exceed $81,508,000 within and 13

only from such amounts made available for school oper-14

ations shall be available for administrative cost grants as-15

sociated with grants approved prior to July 1, 2020: Pro-16

vided further, That in order to enhance the safety of Bu-17

reau field employees, the Bureau may use funds to pur-18

chase uniforms or other identifying articles of clothing for 19

personnel. 20

EDUCATION CONSTRUCTION 21

For construction, repair, improvement, and mainte-22

nance of buildings, utilities, and other facilities necessary 23

for the operation of Indian Education programs, including 24

architectural and engineering services by contract; acquisi-25

tion of lands, and interests in lands; $387,252,000 to re-1

main available until expended; Provided, That for fiscal 2

year 2020, in implementing new construction, replacement 3

facilities construction, or facilities improvement and repair 4

project grants in excess of $100,000 that are provided to 5

grant schools under Public Law 100–297, the Secretary 6

of the Interior shall use the Administrative and Audit Re-7

quirements and Cost Principles for Assistance Programs 8

contained in part 12 of title 43, Code of Federal Regula-9

tions, as the regulatory requirements: Provided further, 10

That such grants shall not be subject to section 12.61 of 11

title 43, Code of Federal Regulations; the Secretary and 12

the grantee shall negotiate and determine a schedule of 13

payments for the work to be performed: Provided further, 14

That in considering grant applications, the Secretary shall 15

consider whether such grantee would be deficient in assur-16

ing that the construction projects conform to applicable 17

building standards and codes and Federal, tribal, or State 18

health and safety standards as required by section 19

1125(b) of title XI of Public Law 95–561 (25 U.S.C. 20

2005(b)), with respect to organizational and financial 21

management capabilities: Provided further, That if the 22

Secretary declines a grant application, the Secretary shall 23

follow the requirements contained in section 5206(f) of 24

Public Law 100–297 (25 U.S.C. 2504(f)): Provided fur-25

ther, That any disputes between the Secretary and any 1

grantee concerning a grant shall be subject to the disputes 2

provision in section 5208(e) of Public Law 107–110 (25 3

U.S.C. 2507(e)): Provided further, That in order to ensure 4

timely completion of construction projects, the Secretary 5

may assume control of a project and all funds related to 6

the project, if, not later than 18 months after the date 7

of the enactment of this Act, any grantee receiving funds 8

appropriated in this Act or in any prior Act, has not com-9

pleted the planning and design phase of the project and 10

commenced construction. 11

of the Bureau of Indian Education, or more than one 1

grade to expand the elementary grade structure for Bu-2

reau-funded schools with a K-2 grade structure on Octo-3

ber 1, 1996. Appropriations made available in this or any 4

prior Act for schools funded by the Bureau shall be avail-5

able, in accordance with the Bureau’s funding formula, 6

only to the schools in the Bureau school system as of Sep-7

tember 1, 1996, and to any school or school program that 8

was reinstated in fiscal year 2012. Funds made available 9

under this Act may not be used to establish a charter 10

school at a Bureau-funded school (as that term is defined 11

in section 1141 of the Education Amendments of 1978 12

(25 U.S.C. 2021)), except that a charter school that is 13

in existence on the date of the enactment of this Act and 14

that has operated at a Bureau-funded school before Sep-15

tember 1, 1999, may continue to operate during that pe-16

riod, but only if the charter school pays to the Bureau 17

a pro rata share of funds to reimburse the Bureau for 18

the use of the real and personal property (including buses 19

and vans), the funds of the charter school are kept sepa-20

rate and apart from Bureau funds, and the Bureau does 21

not assume any obligation for charter school programs of 22

the State in which the school is located if the charter 23

school loses such funding. Employees of Bureau-funded 24

schools sharing a campus with a charter school and per-25

forming functions related to the charter school’s operation 1

and employees of a charter school shall not be treated as 2

Federal employees for purposes of chapter 171 of title 28, 3

United States Code. 4

Notwithstanding any other provision of law, including 5

section 113 of title I of appendix C of Public Law 106– 6

113, if in fiscal year 2003 or 2004 a grantee received indi-7

rect and administrative costs pursuant to a distribution 8

formula based on section 5(f) of Public Law 101–301, the 9

Secretary shall continue to distribute indirect and admin-10

istrative cost funds to such grantee using the section 5(f) 11

distribution formula. 12

Funds available under this Act may not be used to 13

establish satellite locations of schools in the Bureau school 14

system as of September 1, 1996, except that the Secretary 15

may waive this prohibition in order for an Indian tribe 16

to provide language and cultural immersion educational 17

programs for non-public schools located within the juris-18

dictional area of the tribal government which exclusively 19

serve tribal members, do not include grades beyond those 20

currently served at the existing Bureau-funded school, 21

provide an educational environment with educator pres-22

ence and academic facilities comparable to the Bureau- 23

funded school, comply with all applicable Tribal, Federal, 24

or State health and safety standards, and the Americans 25

with Disabilities Act, and demonstrate the benefits of es-1

tablishing operations at a satellite location in lieu of incur-2

ring extraordinary costs, such as for transportation or 3

other impacts to students such as those caused by busing 4

students extended distances: Provided, That no funds 5

available under this Act may be used to fund operations, 6

maintenance, rehabilitation, construction or other facili-7

ties-related costs for such assets that are not owned by 8

the Bureau: Provided further, That the term ‘‘satellite 9

school’’ means a school location physically separated from 10

the existing Bureau school by more than 50 miles but that 11

forms part of the existing school in all other respects. 12

That in implementing this section, the Secretary shall de-23

velop written guidance to field units to ensure account-24

ability and consistent application of the authorities pro-25

States Fish and Wildlife Service and the National Marine 3

required by section 7 of such Act, in connection with 7

That the Secretary of the Interior may use wildland fire 9

struct capitalized improvements for fire facilities on such 12

leased properties, including but not limited to fire guard 13

stations, retardant stations, and other initial attack and 14

fire support facilities, and to make advance payments for 15

any such lease or for construction activity associated with 16

the lease: Provided further, That the Secretary of the Inte-17

rior and the Secretary of Agriculture may authorize the 18

transfer of funds appropriated for wildland fire manage-19

ment, in an aggregate amount not to exceed $50,000,000, 20

between the Departments when such transfers would fa-21

cilitate and expedite wildland fire management programs 22

and projects: Provided further, That funds provided for 23

wildfire suppression shall be available for support of Fed-24

eral emergency response actions: Provided further, That 25

funds appropriated under this heading shall be available 1

for assistance to or through the Department of State in 2

connection with forest and rangeland research, technical 3

States and its territories and possessions, including tech-8

nical assistance, education and training, and cooperation 9

251(b)(2)(F)(ii)(I) of the Balanced Budget and Emer-13

gency Deficit Control Act of 1985, as amended. 14

In addition to the amounts provided under this head-15

ing for wildfire suppression operations, $300,000,000, to 16

remain available until expended, is additional new budget 17

authority as specified for purposes of section 251(b)(2)(F) 18

of the Balanced Budget and Emergency Deficit Control 19

Act of 1985, as amended: Provided, That the Secretary 20

of the Interior may transfer such amounts to the Depart-21

ment of Agriculture for wildfire suppression operations. 22

ties, equipment, or services in the vicinity of the National 22

Indian Program Training Center: Provided further, That 23

all funds received pursuant to the two preceding provisos 24

shall be credited to this account, shall be available until 25

ADMINISTRATIVE PROVISION 8

There is hereby authorized for acquisition from avail-9

able resources within the Working Capital Fund, aircraft 10

which may be obtained by donation, purchase or through 11

available excess surplus property: Provided, That existing 12

aircraft being replaced may be sold, with proceeds derived 13

or trade-in value used to offset the purchase price for the 14

replacement aircraft. 15

For necessary expenses for management of the collec-17

tion and disbursement of royalties, fees, and other mineral 18

revenue proceeds, and for grants and cooperative agree-19

shall remain available until expended for the purpose of 22

mineral revenue management activities: Provided, That 23

notwithstanding any other provision of law, $15,000 shall 24

GENERAL PROVISIONS, DEPARTMENT OF THE INTERIOR 5


EMERGENCY TRANSFER AUTHORITY—INTRA-BUREAU 7

SEC. 101. Appropriations made in this title shall be 8

available for expenditure or transfer (within each bureau 9

or office), with the approval of the Secretary, for the emer-10

gency reconstruction, replacement, or repair of aircraft, 11

buildings, utilities, or other facilities or equipment dam-12

aged or destroyed by fire, flood, storm, or other unavoid-13

able causes: Provided, That no funds shall be made avail-14

able under this authority until funds specifically made 15

available to the Department of the Interior for emer-16

gencies shall have been exhausted: Provided further, That 17

all funds used pursuant to this section must be replenished 18

by a supplemental appropriation, which must be requested 19

as promptly as possible. 20

EMERGENCY TRANSFER AUTHORITY—DEPARTMENT-WIDE 21

SEC. 102. The Secretary may authorize the expendi-22

ture or transfer of any no year appropriation in this title, 23

in addition to the amounts included in the budget pro-24

grams of the several agencies, for emergency actions re-25

lated to potential or actual earthquakes, floods, volcanoes, 1

storms, or other unavoidable causes; for contingency plan-2

ning subsequent to actual oil spills; for response and nat-3

ural resource damage assessment activities related to ac-4

tual oil spills or releases of hazardous substances into the 5

environment; for the prevention, suppression, and control 6

of actual or potential grasshopper and Mormon cricket 7

outbreaks on lands under the jurisdiction of the Secretary, 8

pursuant to the authority in section 417(b) of Public Law 9

106–224 (7 U.S.C. 7717(b)); for emergency reclamation 10

projects under section 410 of Public Law 95–87; and shall 11

transfer, from any no year funds available to the Office 12

of Surface Mining Reclamation and Enforcement, such 13

funds as may be necessary to permit assumption of regu-14

latory authority in the event a primacy State is not car-15

rying out the regulatory provisions of the Surface Mining 16

Act: Provided, That appropriations made in this title for 17

wildland fire operations shall be available for the payment 18

of obligations incurred during the preceding fiscal year, 19

and for reimbursement to other Federal agencies for de-20

struction of vehicles, aircraft, or other equipment in con-21

nection with their use for wildland fire operations, with 22

such reimbursement to be credited to appropriations cur-23

rently available at the time of receipt thereof: Provided 24

further, That all funds used pursuant to this section must 25

be replenished by a supplemental appropriation, which 1

must be requested as promptly as possible: Provided fur-2

ther, That such replenishment funds shall be used to reim-3

burse, on a pro rata basis, accounts from which emergency 4

funds were transferred. 5

AUTHORIZED USE OF FUNDS 6

SEC. 103. Appropriations made to the Department 7

of the Interior in this title shall be available for services 8

as authorized by section 3109 of title 5, United States 9

Code, when authorized by the Secretary, in total amount 10

not to exceed $500,000; purchase and replacement of 11

motor vehicles, including specially equipped law enforce-12

ment vehicles; hire, maintenance, and operation of air-13

craft; hire of passenger motor vehicles; purchase of re-14

prints; payment for telephone service in private residences 15

in the field, when authorized under regulations approved 16

by the Secretary; and the payment of dues, when author-17

ized by the Secretary, for library membership in societies 18

or associations which issue publications to members only 19

or at a price to members lower than to subscribers who 20

are not members. 21

AUTHORIZED USE OF FUNDS, INDIAN TRUST 22

MANAGEMENT 23

SEC. 104. Appropriations made in this Act under the 24

headings Bureau of Indian Affairs and Bureau of Indian 25

Education, and Office of the Special Trustee for American 1

Indians and any unobligated balances from prior appro-2

priations Acts made under the same headings shall be 3

available for expenditure or transfer for Indian trust man-4

agement and reform activities. Total funding for historical 5

accounting activities shall not exceed amounts specifically 6

designated in this Act for such purpose. The Secretary 7

shall notify the House and Senate Committees on Appro-8

priations within 60 days of the expenditure or transfer of 9

any funds under this section, including the amount ex-10

pended or transferred and how the funds will be used. 11

REDISTRIBUTION OF FUNDS, BUREAU OF INDIAN 12

AFFAIRS 13

SEC. 105. Notwithstanding any other provision of 14

law, the Secretary of the Interior is authorized to redis-15

tribute any Tribal Priority Allocation funds, including 16

tribal base funds, to alleviate tribal funding inequities by 17

transferring funds to address identified, unmet needs, 18

dual enrollment, overlapping service areas or inaccurate 19

distribution methodologies. No tribe shall receive a reduc-20

tion in Tribal Priority Allocation funds of more than 10 21

percent in fiscal year 2020. Under circumstances of dual 22

enrollment, overlapping service areas or inaccurate dis-23

tribution methodologies, the 10 percent limitation does not 24

apply. 25

law, the Secretary of the Interior is authorized to acquire 3

lands, waters, or interests therein including the use of all 4

or part of any pier, dock, or landing within the State of 5

New York and the State of New Jersey, for the purpose 6

of operating and maintaining facilities in the support of 7

transportation and accommodation of visitors to Ellis, 8

Governors, and Liberty Islands, and of other program and 9

administrative activities, by donation or with appropriated 10

funds, including franchise fees (and other monetary con-11

sideration), or by exchange; and the Secretary is author-12

ized to negotiate and enter into leases, subleases, conces-13

sion contracts or other agreements for the use of such fa-14

cilities on such terms and conditions as the Secretary may 15

determine reasonable. 16

OUTER CONTINENTAL SHELF INSPECTION FEES 17

SEC. 107. (a) In fiscal year 2020, the Secretary shall 18

collect a nonrefundable inspection fee, which shall be de-19

posited in the ‘‘Offshore Safety and Environmental En-20

forcement’’ account, from the designated operator for fa-21

cilities subject to inspection under 43 U.S.C. 1348(c). 22

(b) Annual fees shall be collected for facilities that 23

are above the waterline, excluding drilling rigs, and are 24

in place at the start of the fiscal year. Fees for fiscal year 1

2020 shall be: 2

(1) $11,500 for facilities with no wells, but with 3

processing equipment or gathering lines; 4

(2) $18,500 for facilities with 1 to 10 wells, 5

with any combination of active or inactive wells; and 6

(3) $34,500 for facilities with more than 10 7

wells, with any combination of active or inactive 8

wells. 9

(c) Fees for drilling rigs shall be assessed for all in-10

spections completed in fiscal year 2020. Fees for fiscal 11

year 2020 shall be: 12

(1) $33,500 per inspection for rigs operating in 13

water depths of 500 feet or more; and 14

(2) $18,500 per inspection for rigs operating in 15

water depths of less than 500 feet. 16

(d) Fees for inspection of well operations conducted 17

via non-rig units as outlined in title 30 CFR 250 subparts 18

D, E, F, and Q shall be assessed for all inspections com-19

pleted in fiscal year 2020. Fees for fiscal year 2020 shall 20

be: 21

(1) $13,260 per inspection for non-rig units op-22

erating in water depths of 2,500 feet or more; 23

erating in water depths between 500 and 2,499 feet; 2

and 3


erating in water depths of less than 500 feet. 5

(e) The Secretary shall bill designated operators 6

under subsection (b) quarterly, with payment required 7

within 30 days of billing. The Secretary shall bill des-8

ignated operators under subsections (c) and (d) within 30 9

days of the end of the month in which the inspection oc-10

curred, with payment required within 30 days of billing. 11

DISCLOSURE OF WAIVERS 12

SEC. 108. (a) Subject to subsection (b), in any case 13

in which the Bureau of Safety and Environmental En-14

forcement or the Bureau of Ocean Energy Management 15

issues any waiver, departure, variance, or any other alter-16

native compliance authorization from any law, rule, regu-17

lation, or other directive, the head of such bureau shall 18

post a copy of such waiver, departure, variance, or other 19

alternative compliance authorization on such bureau’s 20

publically available website not more than 3 business days 21

after such issuance. 22

(b) The head of each bureau may redact confidential 23

business information. 24

this Act, the Secretary of the Interior may enter into 4

multiyear cooperative agreements with nonprofit organiza-5

tions and other appropriate entities, and may enter into 6

multiyear contracts in accordance with the provisions of 7

section 3903 of title 41, United States Code (except that 8

the 5-year term restriction in subsection (a) shall not 9

apply), for the long-term care and maintenance of excess 10

wild free roaming horses and burros by such organizations 11

or entities on private land. Such cooperative agreements 12

and contracts may not exceed 10 years, subject to renewal 13

at the discretion of the Secretary. 14

MASS MARKING OF SALMONIDS 15

SEC. 110. The United States Fish and Wildlife Serv-16

ice shall, in carrying out its responsibilities to protect 17

threatened and endangered species of salmon, implement 18

a system of mass marking of salmonid stocks, intended 19

for harvest, that are released from federally operated or 20

federally financed hatcheries including but not limited to 21

fish releases of coho, chinook, and steelhead species. 22

Marked fish must have a visible mark that can be readily 23

identified by commercial and recreational fishers. 24

law, during fiscal year 2020, in carrying out work involv-3

ing cooperation with State, local, and tribal governments 4

or any political subdivision thereof, Indian Affairs may 5

record obligations against accounts receivable from any 6

such entities, except that total obligations at the end of 7

the fiscal year shall not exceed total budgetary resources 8

available at the end of the fiscal year. 9

HUMANE TRANSFER OF EXCESS ANIMALS 10


law, the Secretary of the Interior may transfer excess wild 12

horses or burros that have been removed from the public 13

lands to other Federal, State, and local government agen-14

cies for use as work animals: Provided, That the Secretary 15

may make any such transfer immediately upon request of 16

such Federal, State, or local government agency: Provided 17

further, That any excess animal transferred under this 18

provision shall lose its status as a wild free-roaming horse 19

or burro as defined in the Wild Free-Roaming Horses and 20

Burros Act: Provided further, That any Federal, State, or 21

local government agency receiving excess wild horses or 22

burros as authorized in this section shall not: destroy the 23

horses or burros in a way that results in their destruction 24

into commercial products; sell or otherwise transfer the 25

horses or burros in a way that results in their destruction 1

for processing into commercial products; or euthanize the 2

horses or burros except upon the recommendation of a li-3

censed veterinarian, in cases of severe injury, illness, or 4

advanced age. 5

DEPARTMENT OF THE INTERIOR EXPERIENCED SERVICES 6

PROGRAM 7

SEC. 113. (a) Notwithstanding any other provision 8

of law relating to Federal grants and cooperative agree-9

ments, the Secretary of the Interior is authorized to make 10

grants to, or enter into cooperative agreements with, pri-11

vate nonprofit organizations designated by the Secretary 12

of Labor under title V of the Older Americans Act of 1965 13

to utilize the talents of older Americans in programs au-14

thorized by other provisions of law administered by the 15

Secretary and consistent with such provisions of law. 16

(b) Prior to awarding any grant or agreement under 17

subsection (a), the Secretary shall ensure that the agree-18

ment would not— 19

(1) result in the displacement of individuals 20

currently employed by the Department, including 21

partial displacement through reduction of non-over-22

time hours, wages, or employment benefits; 23

(2) result in the use of an individual under the 24

Department of the Interior Experienced Services 25

Program for a job or function in a case in which a 1

Federal employee is in a layoff status from the same 2

or substantially equivalent job within the Depart-3

ment; or 4

SEC. 114. Section 6906 of title 31, United States 7

Code, is amended by striking ‘‘fiscal year 2019’’ and in-8

serting ‘‘fiscal year 2020’’. 9

REPUBLIC OF THE MARSHALL ISLANDS 10

SEC. 115. As authorized in section 111(d) of the 11

Compact of Free Association Act of 1985 (Public Law 99– 12

239; 99 Stat. 1799; 48 U.S.C. 1911) and section 108(b) 13

of the Compact of Free Association Amendments Act of 14

nental Shelf Oil and Gas Leasing Program, or any plan 8

used to conduct offshore oil and gas pre-leasing, leasing 12

and related activities for any lease sale proposed in the 13

Draft Proposed Program described in the ‘‘Notice of 14

Availability of the 2019-2024 Draft Proposed Outer Con-15

tinental Shelf Oil and Gas Leasing Program and Notice 16

of Intent to Prepare a Programmatic Environmental Im-17

pact Statement’’ published in the Federal Register on 18

January 8, 2018 (83 Fed. Reg. 829), unless such sale was 19

also contained in the 2017-2022 Outer Continental Shelf 20

Oil and Gas Proposed Final Program described in the 21

Service Fee Fund’’ as discretionary offsetting receipts in 12

STATE AND TRIBAL ASSISTANCE GRANTS 10

For environmental programs and infrastructure as-11

sistance, including capitalization grants for State revolv-12

ing funds and performance partnership grants, 13

$4,641,992,000, to remain available until expended, of 14

which— 15

(1) $1,810,000,000 shall be for making capital-16

ization grants for the Clean Water State Revolving 17

Funds under title VI of the Federal Water Pollution 18

Control Act; and of which $1,300,000,000 shall be 19

for making capitalization grants for the Drinking 20

Water State Revolving Funds under section 1452 of 21

the Safe Drinking Water Act: Provided, That for fis-22

cal year 2020, to the extent there are sufficient eligi-23

ble project applications and projects are consistent 24

with State Intended Use Plans, not less than 10 per-25

cent of the funds made available under this title to 1

each State for Clean Water State Revolving Fund 2

capitalization grants shall be used by the State for 3

projects to address green infrastructure, water or 4

for fiscal year 2020, funds made available under this 7

title to each State for Drinking Water State Revolv-8

ing Fund capitalization grants may, at the discretion 9

of each State, be used for projects to address green 10

infrastructure, water or energy efficiency improve-11

ments, or other environmentally innovative activities: 12

Provided further, That notwithstanding section 13

603(d)(7) of the Federal Water Pollution Control 14

Act, the limitation on the amounts in a State water 15

pollution control revolving fund that may be used by 16

a State to administer the fund shall not apply to 17

amounts included as principal in loans made by such 18

fund in fiscal year 2020 and prior years where such 19

amounts represent costs of administering the fund 20

to the extent that such amounts are or were deemed 21

reasonable by the Administrator, accounted for sepa-22

rately from other assets in the fund, and used for 23

eligible purposes of the fund, including administra-24

tion: Provided further, That for fiscal year 2020, 25

notwithstanding the provisions of subsections (g)(1), 1

(h), and (l) of section 201 of the Federal Water Pol-2

lution Control Act, grants made under title II of 3

such Act for American Samoa, Guam, the common-4

Virgin Islands, and the District of Columbia may 6

also be made for the purpose of providing assistance: 7

(1) solely for facility plans, design activities, or 8

plans, specifications, and estimates for any proposed 9

project for the construction of treatment works; and 10

(2) for the construction, repair, or replacement of 11

privately owned treatment works serving one or 12

more principal residences or small commercial estab-13

lishments: Provided further, That for fiscal year 14

2020, notwithstanding the provisions of such sub-15

sections (g)(1), (h), and (l) of section 201 and sec-16

shall be so used by the State only where such funds 7

are provided as initial financing for an eligible re-8

cipient or to buy, refinance, or restructure the debt 9

obligations of eligible recipients only where such debt 10

was incurred on or after the date of enactment of 11

this Act, or where such debt was incurred prior to 12

the date of enactment of this Act if the State, with 13

concurrence from the Administrator, determines that 14

such funds could be used to help address a threat 15

to public health from heightened exposure to lead in 16

drinking water or if a Federal or State emergency 17

declaration has been issued due to a threat to public 18

health from heightened exposure to lead in a munic-19

ipal drinking water supply before the date of enact-20

ment of this Act: Provided further, That in a State 21

in which such an emergency declaration has been 22

issued, the State may use more than 14 percent of 23

the funds made available under this title to the 24

State for Drinking Water State Revolving Fund cap-25

italization grants to provide additional subsidy to eli-1

gible recipients; 2

(2) $30,000,000 shall be for architectural, engi-3

neering, planning, design, construction and related 4

activities in connection with the construction of high 5

priority water and wastewater facilities in the area 6

of the United States-Mexico Border, after consulta-7

tion with the appropriate border commission: Pro-8

vided, That no funds provided by this appropriations 9

Act to address the water, wastewater and other crit-10

ical infrastructure needs of the colonias in the 11

United States along the United States-Mexico bor-12

der shall be made available to a county or municipal 13

government unless that government has established 14

an enforceable local ordinance, or other zoning rule, 15

which prevents in that jurisdiction the development 16

or construction of any additional colonia areas, or 17

the development within an existing colonia the con-18

struction of any new home, business, or other struc-19

ture which lacks water, wastewater, or other nec-20

essary infrastructure; 21

(3) $20,000,000 shall be for grants to the State 22

of Alaska to address drinking water and wastewater 23

infrastructure needs of rural and Alaska Native Vil-24

lages: Provided, That of these funds: (A) the State 25

of Alaska shall provide a match of 25 percent; (B) 1

no more than 5 percent of the funds may be used 2

for administrative and overhead expenses; and (C) 3

the State of Alaska shall make awards consistent 4

with the Statewide priority list established in con-5

junction with the Agency and the U.S. Department 6

of Agriculture for all water, sewer, waste disposal, 7

and similar projects carried out by the State of Alas-8

ka that are funded under section 221 of the Federal 9

Water Pollution Control Act (33 U.S.C. 1301) or 10

the Consolidated Farm and Rural Development Act 11

(7 U.S.C. 1921 et seq.) which shall allocate not less 12

than 25 percent of the funds provided for projects 13

in regional hub communities; 14

(4) $105,000,000 shall be to carry out section 15

104(k) of the Comprehensive Environmental Re-16

sponse, Compensation, and Liability Act of 1980 17

(CERCLA), including grants, interagency agree-18

ments, and associated program support costs: Pro-19

vided, That not more than 25 percent of the amount 20

appropriated to carry out section 104(k) of 21

CERCLA shall be used for site characterization, as-22

sessment, and remediation of facilities described in 23

section 101(39)(D)(ii)(II) of CERCLA: Provided 24

further, That at least 10 percent shall be allocated 25

the direct and guaranteed loan programs, notwithstanding 13

section 5033 of the Water Infrastructure Finance and In-14

novation Act of 2014, $5,000,000, to remain available 15

ADMINISTRATIVE PROVISIONS—ENVIRONMENTAL 17

PROTECTION AGENCY 18


For fiscal year 2020, notwithstanding 31 U.S.C. 20

6303(1) and 6305(1), the Administrator of the Environ-21

mental Protection Agency, in carrying out the Agency’s 22

function to implement directly Federal environmental pro-23

grams required or authorized by law in the absence of an 24

acceptable tribal program, may award cooperative agree-25

ments to federally recognized Indian tribes or Intertribal 1

consortia, if authorized by their member tribes, to assist 2

the Administrator in implementing Federal environmental 3

programs for Indian tribes required or authorized by law, 4

agreements. 7

The Administrator of the Environmental Protection 8

Agency is authorized to collect and obligate pesticide reg-9

istration service fees in accordance with section 33 of the 10

Federal Insecticide, Fungicide, and Rodenticide Act, as 11

amended by Public Law 116–8, the Pesticide Registration 12

Improvement Extension Act of 2018. 13

Notwithstanding section 33(d)(2) of the Federal In-14

secticide, Fungicide, and Rodenticide Act (FIFRA) (7 15

U.S.C. 136w–8(d)(2)), the Administrator of the Environ-16

mental Protection Agency may assess fees under section 17

33 of FIFRA (7 U.S.C. 136w–8) for fiscal year 2020. 18

The Administrator is authorized to transfer up to 19

$305,000,000 of the funds appropriated for the Great 20

Lakes Restoration Initiative under the heading ‘‘Environ-21

mental Programs and Management’’ to the head of any 22

Federal department or agency, with the concurrence of 23

such head, to carry out activities that would support the 24

Great Lakes Restoration Initiative and Great Lakes 25

to enter into an interagency agreement with the head of 2

For fiscal year 2020, and notwithstanding section 16

518(f) of the Federal Water Pollution Control Act (33 17

U.S.C. 1377(f)), the Administrator is authorized to use 18

the amounts appropriated for any fiscal year under section 19

319 of the Act to make grants to Indian tribes pursuant 20

to sections 319(h) and 518(e) of that Act. 21

The Administrator is authorized to use the amounts 22

appropriated under the heading ‘‘Environmental Pro-23

grams and Management’’ for fiscal year 2020 to provide 24

Appropriations to the Forest Service for the current 5

fiscal year shall be available for: (1) purchase of passenger 6

motor vehicles; acquisition of passenger motor vehicles 7

from excess sources, and hire of such vehicles; purchase, 8

lease, operation, maintenance, and acquisition of aircraft 9

to maintain the operable fleet for use in Forest Service 10

wildland fire programs and other Forest Service programs; 11

notwithstanding other provisions of law, existing aircraft 12

being replaced may be sold, with proceeds derived or 13

trade-in value used to offset the purchase price for the 14

replacement aircraft; (2) services pursuant to 7 U.S.C. 15

2225, and not to exceed $100,000 for employment under 16

5 U.S.C. 3109; (3) purchase, erection, and alteration of 17

buildings and other public improvements (7 U.S.C. 2250); 18

(4) acquisition of land, waters, and interests therein pur-19

suant to 7 U.S.C. 428a; (5) for expenses pursuant to the 20

Volunteers in the National Forest Act of 1972 (16 U.S.C. 21

558a, 558d, and 558a note); (6) the cost of uniforms as 22

authorized by 5 U.S.C. 5901–5902; and (7) for debt col-23

lection contracts in accordance with 31 U.S.C. 3718(c). 24

Not more than $50,000,000 of funds appropriated to 1

the Forest Service shall be available for expenditure or 2

transfer to the Department of the Interior for wildland 3

fire management, hazardous fuels management, and State 4

fire assistance when such transfers would facilitate and 5

expedite wildland fire management programs and projects. 6

Funds appropriated to the Forest Service shall be 7

available for assistance to or through the Agency for Inter-8

national Development in connection with forest and range-9

land research, technical information, and assistance in for-10

eign countries, and shall be available to support forestry 11

and related natural resource activities outside the United 12

States and its territories and possessions, including tech-13

nical assistance, education and training, and cooperation 14

with U.S., private, and international organizations. The 15

Forest Service, acting for the International Program, may 16

sign direct funding agreements with foreign governments 17

and institutions as well as other domestic agencies (includ-18

ing the U.S. Agency for International Development, the 19

Department of State, and the Millennium Challenge Cor-20

poration), U.S. private sector firms, institutions and orga-21

nizations to provide technical assistance and training pro-22

grams overseas on forestry and rangeland management. 23

preparation, and adoption of excess wild horses and burros 2

ice in this Act or any other Act with respect to any fiscal 7

year shall be subject to transfer under the provisions of 8

section 702(b) of the Department of Agriculture Organic 9

Act of 1944 (7 U.S.C. 2257), section 442 of Public Law 10

106–224 (7 U.S.C. 7772), or section 10417(b) of Public 11

Law 107–171 (7 U.S.C. 8316(b)). 12

Not more than $82,000,000 of funds available to the 13

Forest Service shall be transferred to the Working Capital 14

Fund of the Department of Agriculture and not more than 15

$14,500,000 of funds available to the Forest Service shall 16

be transferred to the Department of Agriculture for De-17

partment Reimbursable Programs, commonly referred to 18

as Greenbook charges. Nothing in this paragraph shall 19

prohibit or limit the use of reimbursable agreements re-20

quested by the Forest Service in order to obtain services 21

from the Department of Agriculture’s National Informa-22

tion Technology Center and the Department of Agri-23

culture’s International Technology Service. 24

Of the funds available to the Forest Service, up to 1

$5,000,000 shall be available for priority projects within 2

the scope of the approved budget, which shall be carried 3

out by the Youth Conservation Corps and shall be carried 4

out under the authority of the Public Lands Corps Act 5

of 1993 (16 U.S.C. 1721 et seq.). 6

Of the funds available to the Forest Service, $4,000 7

is available to the Chief of the Forest Service for official 8

reception and representation expenses. 9

Pursuant to sections 405(b) and 410(b) of Public 10

Law 101–593, of the funds available to the Forest Service, 11

up to $3,000,000 may be advanced in a lump sum to the 12

National Forest Foundation to aid conservation partner-13

ship projects in support of the Forest Service mission, 14

without regard to when the Foundation incurs expenses, 15

for projects on or benefitting National Forest System 16

lands or related to Forest Service programs: Provided, 17

That of the Federal funds made available to the Founda-18

tion, no more than $300,000 shall be available for admin-19

istrative expenses: Provided further, That the Foundation 20

shall obtain, by the end of the period of Federal financial 21

assistance, private contributions to match funds made 22

available by the Forest Service on at least a one-for-one 23

basis: Provided further, That the Foundation may transfer 24

Federal funds to a Federal or a non-Federal recipient for 25

Pursuant to section 2(b)(2) of Public Law 98–244, 3

shall be matched on at least a one-for-one basis by the 10

Foundation or its sub-recipients: Provided further, That 11

the Foundation may transfer Federal funds to a Federal 12

or non-Federal recipient for a project at the same rate 13

that the recipient has obtained the non-Federal matching 14

pose of performing fire, administrative, and other facilities 6

maintenance and decommissioning. 7

Funds appropriated to the Forest Service shall not 8

be available for the destruction of healthy, unadopted, wild 9

horses and burros in the care of the Forest Service or its 10

contractors or for the sale of wild horses and burros that 11

results in their destruction for processing into commercial 12

Notwithstanding any other provision of law, of any 14

appropriations or funds available to the Forest Service, 15

not to exceed $500,000 may be used to reimburse the Of-16

fice of the General Counsel (OGC), Department of Agri-17

culture, for travel and related expenses incurred as a re-18

sult of OGC assistance or participation requested by the 19

Forest Service at meetings, training sessions, management 20

reviews, land purchase negotiations and similar matters 21

unrelated to civil litigation. Future budget justifications 22

for both the Forest Service and the Department of Agri-23

culture should clearly display the sums previously trans-24

ferred and the sums requested for transfer. 25

An eligible individual who is employed in any project 1

funded under title V of the Older Americans Act of 1965 2

(42 U.S.C. 3056 et seq.) and administered by the Forest 3

Service shall be considered to be a Federal employee for 4

purposes of chapter 171 of title 28, United States Code. 5

Notwithstanding any other provision of this Act, 6

through the Office of Budget and Program Analysis, the 7

Forest Service shall report no later than 30 business days 8

following the close of each fiscal quarter all current and 9

prior year unobligated balances, by fiscal year, budget line 10

this Act may be used for annual contracts and grants that 12

fall within 2 fiscal years, provided the total obligation is 13

recorded in the year the funds are appropriated: Provided 14

further, That the amounts collected by the Secretary of 15

Health and Human Services under the authority of title 16

IV of the Indian Health Care Improvement Act (25 U.S.C. 17

1613) shall remain available until expended for the pur-18

pose of achieving compliance with the applicable condi-19

tions and requirements of titles XVIII and XIX of the So-20

cial Security Act, except for those related to the planning, 21

design, or construction of new facilities: Provided further, 22

That funding contained herein for scholarship programs 23

under the Indian Health Care Improvement Act (25 24

U.S.C. 1613) shall remain available until expended: Pro-25

For payments to tribes and tribal organizations for 2

other provision of law, no amounts made available under 7

this heading shall be available for transfer to another 8

carry out such Acts and titles II and III of the Public 21

tion, renovation or expansion of health facilities for the 2

equipment from the Department of Defense for distribu-7

vehicles and aircraft; purchase of medical equipment; pur-20

chase of reprints; purchase, renovation and erection of 21

modular buildings and renovation of existing facilities; 22

payments for telephone service in private residences in the 23

field, when authorized under regulations approved by the 24

Secretary of Health and Human Services; uniforms or al-25

and for expenses of attendance at meetings that relate to 2

the functions or activities of the Indian Health Service: 3

may be extended health care at all tribally administered 6

or Indian Health Service facilities, subject to charges, and 7

the proceeds along with funds recovered under the Federal 8

Medical Care Recovery Act (42 U.S.C. 2651–2653) shall 9

be credited to the account of the facility providing the 10

service and shall be available without fiscal year limitation: 11

Provided further, That notwithstanding any other law or 12

regulation, funds transferred from the Department of 13

Housing and Urban Development to the Indian Health 14

Service shall be administered under Public Law 86–121, 15

the Indian Sanitation Facilities Act and Public Law 93– 16

638: Provided further, That funds appropriated to the In-17

dian Health Service in this Act, except those used for ad-18

ministrative and program direction purposes, shall not be 19

subject to limitations directed at curtailing Federal travel 20

and transportation: Provided further, That none of the 21

funds made available to the Indian Health Service in this 22

Act shall be used for any assessments or charges by the 23

Department of Health and Human Services unless identi-24

fied in the budget justification and provided in this Act, 25

propriations through the reprogramming process: Pro-2

vided further, That notwithstanding any other provision 3

of law, funds previously or herein made available to a tribe 4

or tribal organization through a contract, grant, or agree-5

Determination and Education Assistance Act of 1975 (25 7

U.S.C. 450 et seq.), may be deobligated and reobligated 8

to a self-determination contract under title I, or a self- 9

governance agreement under title V of such Act and there-10

tion without fiscal year limitation: Provided further, That 12

none of the funds made available to the Indian Health 13

Service in this Act shall be used to implement the final 14

rule published in the Federal Register on September 16, 15

1987, by the Department of Health and Human Services, 16

relating to the eligibility for the health care services of 17

the Indian Health Service until the Indian Health Service 18

has submitted a budget request reflecting the increased 19

costs associated with the proposed final rule, and such re-20

quest has been included in an appropriations Act and en-21

acted into law: Provided further, That with respect to func-22

tions transferred by the Indian Health Service to tribes 23

or tribal organizations, the Indian Health Service is au-24

thorized to provide goods and services to those entities on 25

a reimbursable basis, including payments in advance with 1

subsequent adjustment, and the reimbursements received 2

therefrom, along with the funds received from those enti-3

such amounts to remain available until expended: Provided 7

further, That reimbursements for training, technical as-8

personnel serving in hospitals operated by the Indian 14

appropriation structure for the Indian Health Service may 19

not be altered without advance notification to the House 20

to evict any single Navajo or Navajo family who, as of 14

November 30, 1985, was physically domiciled on the lands 15

partitioned to the Hopi Tribe unless a new or replacement 16

home is provided for such household: Provided further, 17

That no relocatee will be provided with more than one new 18

or replacement home: Provided further, That the Office 19

shall relocate any certified eligible relocatees who have se-20

lected and received an approved homesite on the Navajo 21

reservation or selected a replacement residence off the 22

Navajo reservation or on the land acquired pursuant to 23

section 11 of Public Law 93–531 (88 Stat. 1716). 24

TITLE IV 1

GENERAL PROVISIONS 2

RESTRICTION ON USE OF FUNDS 3

SEC. 401. No part of any appropriation contained in 4

this Act shall be available for any activity or the publica-5

tion or distribution of literature that in any way tends to 6

promote public support or opposition to any legislative 7

proposal on which Congressional action is not complete 8

other than to communicate to Members of Congress as 9

described in 18 U.S.C. 1913. 10

OBLIGATION OF APPROPRIATIONS 11

SEC. 402. No part of any appropriation contained in 12

this Act shall remain available for obligation beyond the 13

current fiscal year unless expressly so provided herein. 14

DISCLOSURE OF ADMINISTRATIVE EXPENSES 15

SEC. 403. The amount and basis of estimated over-16

head charges, deductions, reserves or holdbacks, including 17

working capital fund and cost pool charges, from pro-18

grams, projects, activities and subactivities to support gov-19

ernment-wide, departmental, agency, or bureau adminis-20

trative functions or headquarters, regional, or central op-21

erations shall be presented in annual budget justifications 22

and subject to approval by the Committees on Appropria-23

tions of the House of Representatives and the Senate. 24

Changes to such estimates shall be presented to the Com-1

mittees on Appropriations for approval. 2

MINING APPLICATIONS 3

SEC. 404. (a) LIMITATION OF FUNDS.—None of the 4

funds appropriated or otherwise made available pursuant 5

to this Act shall be obligated or expended to accept or 6

process applications for a patent for any mining or mill 7

site claim located under the general mining laws. 8

(b) EXCEPTIONS.—Subsection (a) shall not apply if 9

the Secretary of the Interior determines that, for the claim 10

concerned (1) a patent application was filed with the Sec-11

retary on or before September 30, 1994; and (2) all re-12

quirements established under sections 2325 and 2326 of 13

the Revised Statutes (30 U.S.C. 29 and 30) for vein or 14

lode claims, sections 2329, 2330, 2331, and 2333 of the 15

Revised Statutes (30 U.S.C. 35, 36, and 37) for placer 16

claims, and section 2337 of the Revised Statutes (30 17

U.S.C. 42) for mill site claims, as the case may be, were 18

fully complied with by the applicant by that date. 19

(c) REPORT.—On September 30, 2021, the Secretary 20

of the Interior shall file with the House and Senate Com-21

mittees on Appropriations and the Committee on Natural 22

Resources of the House and the Committee on Energy and 23

Natural Resources of the Senate a report on actions taken 24

by the Department under the plan submitted pursuant to 25

section 314(c) of the Department of the Interior and Re-1

lated Agencies Appropriations Act, 1997 (Public Law 2

104–208). 3

(d) MINERAL EXAMINATIONS.—In order to process 4

patent applications in a timely and responsible manner, 5

upon the request of a patent applicant, the Secretary of 6

the Interior shall allow the applicant to fund a qualified 7

third-party contractor to be selected by the Director of the 8

Bureau of Land Management to conduct a mineral exam-9

ination of the mining claims or mill sites contained in a 10

patent application as set forth in subsection (b). The Bu-11

reau of Land Management shall have the sole responsi-12

bility to choose and pay the third-party contractor in ac-13

cordance with the standard procedures employed by the 14

Bureau of Land Management in the retention of third- 15

party contractors. 16

CONTRACT SUPPORT COSTS, PRIOR YEAR LIMITATION 17

SEC. 405. Sections 405 and 406 of division F of the 18

Consolidated and Further Continuing Appropriations Act, 19

2015 (Public Law 113–235) shall continue in effect in fis-20

cal year 2020. 21

CONTRACT SUPPORT COSTS, FISCAL YEAR 2020 22

LIMITATION 23

SEC. 406. Amounts provided by this Act for fiscal 24

year 2020 under the headings ‘‘Department of Health and 25

Human Services, Indian Health Service, Contract Support 1

Costs’’ and ‘‘Department of the Interior, Bureau of Indian 2

Affairs and Bureau of Indian Education, Contract Sup-3

port Costs’’ are the only amounts available for contract 4

support costs arising out of self-determination or self-gov-5

ernance contracts, grants, compacts, or annual funding 6

agreements for fiscal year 2020 with the Bureau of Indian 7

Affairs, Bureau of Indian Education, and the Indian 8

Health Service: Provided, That such amounts provided by 9

this Act are not available for payment of claims for con-10

tract support costs for prior years, or for repayments of 11

payments for settlements or judgments awarding contract 12

support costs for prior years. 13

FOREST MANAGEMENT PLANS 14

SEC. 407. The Secretary of Agriculture shall not be 15

considered to be in violation of subparagraph 6(f)(5)(A) 16

of the Forest and Rangeland Renewable Resources Plan-17

ning Act of 1974 (16 U.S.C. 1604(f)(5)(A)) solely because 18

more than 15 years have passed without revision of the 19

plan for a unit of the National Forest System. Nothing 20

in this section exempts the Secretary from any other re-21

quirement of the Forest and Rangeland Renewable Re-22

sources Planning Act (16 U.S.C. 1600 et seq.) or any 23

other law: Provided, That if the Secretary is not acting 24

expeditiously and in good faith, within the funding avail-25

able, to revise a plan for a unit of the National Forest 1

System, this section shall be void with respect to such plan 2

and a court of proper jurisdiction may order completion 3

of the plan on an accelerated basis. 4

PROHIBITION WITHIN NATIONAL MONUMENTS 5

SEC. 408. No funds provided in this Act may be ex-6

pended to conduct preleasing, leasing and related activities 7

under either the Mineral Leasing Act (30 U.S.C. 181 et 8

seq.) or the Outer Continental Shelf Lands Act (43 U.S.C. 9

1331 et seq.) within the boundaries of a National Monu-10

ment established pursuant to the Act of June 8, 1906 (16 11

U.S.C. 431 et seq.) as such boundary existed on January 12

20, 2001, except where such activities are allowed under 13

the Presidential proclamation establishing such monu-14

ment. 15

LIMITATION ON TAKINGS 16

SEC. 409. Unless otherwise provided herein, no funds 17

appropriated in this Act for the acquisition of lands or 18

interests in lands may be expended for the filing of dec-19

larations of taking or complaints in condemnation without 20

the approval of the House and Senate Committees on Ap-21

propriations: Provided, That this provision shall not apply 22

to funds appropriated to implement the Everglades Na-23

tional Park Protection and Expansion Act of 1989, or to 24

funds appropriated for Federal assistance to the State of 25

Florida to acquire lands for Everglades restoration pur-1

poses. 2

PROHIBITION ON NO-BID CONTRACTS 3

SEC. 410. None of the funds appropriated or other-4

wise made available by this Act to executive branch agen-5

cies may be used to enter into any Federal contract unless 6

such contract is entered into in accordance with the re-7

quirements of Chapter 33 of title 41, United States Code, 8

or Chapter 137 of title 10, United States Code, and the 9

Federal Acquisition Regulation, unless— 10

(1) Federal law specifically authorizes a con-11

tract to be entered into without regard for these re-12

quirements, including formula grants for States, or 13

federally recognized Indian tribes; 14

(2) such contract is authorized by the Indian 15

Self-Determination and Education Assistance Act 16

(Public Law 93–638, 25 U.S.C. 450 et seq.) or by 17

any other Federal laws that specifically authorize a 18

contract within an Indian tribe as defined in section 19

4(e) of that Act (25 U.S.C. 450b(e)); or 20

(3) such contract was awarded prior to the date 21

of enactment of this Act. 22

POSTING OF REPORTS 23

SEC. 411. (a) Any agency receiving funds made avail-24

able in this Act, shall, subject to subsections (b) and (c), 25

post on the public website of that agency any report re-1

quired to be submitted by the Congress in this or any 2

other Act, upon the determination by the head of the agen-3

cy that it shall serve the national interest. 4

(b) Subsection (a) shall not apply to a report if— 5

(1) the public posting of the report com-6

promises national security; or 7

(2) the report contains proprietary information. 8

(c) The head of the agency posting such report shall 9

do so only after such report has been made available to 10

the requesting Committee or Committees of Congress for 11

no less than 45 days. 12

NATIONAL ENDOWMENT FOR THE ARTS GRANT 13

GUIDELINES 14

SEC. 412. Of the funds provided to the National En-15

dowment for the Arts— 16

(1) The Chairperson shall only award a grant 17

to an individual if such grant is awarded to such in-18

dividual for a literature fellowship, National Herit-19

age Fellowship, or American Jazz Masters Fellow-20

ship. 21

(2) The Chairperson shall establish procedures 22

to ensure that no funding provided through a grant, 23

except a grant made to a State or local arts agency, 24

or regional group, may be used to make a grant to 25

any other organization or individual to conduct ac-1

tivity independent of the direct grant recipient. 2

Nothing in this subsection shall prohibit payments 3

made in exchange for goods and services. 4

(3) No grant shall be used for seasonal support 5

to a group, unless the application is specific to the 6

contents of the season, including identified programs 7

or projects. 8

NATIONAL ENDOWMENT FOR THE ARTS PROGRAM 9

PRIORITIES 10

SEC. 413. (a) In providing services or awarding fi-11

nancial assistance under the National Foundation on the 12

Arts and the Humanities Act of 1965 from funds appro-13

priated under this Act, the Chairperson of the National 14

Endowment for the Arts shall ensure that priority is given 15

to providing services or awarding financial assistance for 16

projects, productions, workshops, or programs that serve 17

underserved populations. 18

(b) In this section: 19

(1) The term ‘‘underserved population’’ means 20

a population of individuals, including urban minori-21

ties, who have historically been outside the purview 22

of arts and humanities programs due to factors such 23

as a high incidence of income below the poverty line 24

or to geographic isolation. 25

(2) The term ‘‘poverty line’’ means the poverty 1

line (as defined by the Office of Management and 2

Budget, and revised annually in accordance with sec-3

tion 673(2) of the Community Services Block Grant 4

Act (42 U.S.C. 9902(2))) applicable to a family of 5

the size involved. 6

(c) In providing services and awarding financial as-7

sistance under the National Foundation on the Arts and 8

Humanities Act of 1965 with funds appropriated by this 9

Act, the Chairperson of the National Endowment for the 10

Arts shall ensure that priority is given to providing serv-11

ices or awarding financial assistance for projects, produc-12

tions, workshops, or programs that will encourage public 13

knowledge, education, understanding, and appreciation of 14

the arts. 15

(d) With funds appropriated by this Act to carry out 16

section 5 of the National Foundation on the Arts and Hu-17

manities Act of 1965— 18

(1) the Chairperson shall establish a grant cat-19

egory for projects, productions, workshops, or pro-20

grams that are of national impact or availability or 21

are able to tour several States; 22

(2) the Chairperson shall not make grants ex-23

ceeding 15 percent, in the aggregate, of such funds 24

to any single State, excluding grants made under the 1

authority of paragraph (1); 2

(3) the Chairperson shall report to the Con-3

gress annually and by State, on grants awarded by 4

the Chairperson in each grant category under sec-5

tion 5 of such Act; and 6

(4) the Chairperson shall encourage the use of 7

grants to improve and support community-based 8

music performance and education. 9

STATUS OF BALANCES OF APPROPRIATIONS 10

SEC. 414. The Department of the Interior, the Envi-11

ronmental Protection Agency, the Forest Service, and the 12

Indian Health Service shall provide the Committees on 13

Appropriations of the House of Representatives and Sen-14

ate quarterly reports on the status of balances of appro-15

priations including all uncommitted, committed, and unob-16

ligated funds in each program and activity. 17

CONTRACTING AUTHORITIES 18

SEC. 415. Section 412 of Division E of Public Law 19

112–74 is amended by striking ‘‘fiscal year 2020’’ and in-20

serting ‘‘fiscal year 2021’’. 21

EXTENSION OF GRAZING PERMITS 22

SEC. 416. The terms and conditions of section 325 23

of Public Law 108–108 (117 Stat. 1307), regarding graz-24

ing permits issued by the Forest Service on any lands not 25

subject to administration under section 402 of the Federal 1

Lands Policy and Management Act (43 U.S.C. 1752), 2

shall remain in effect for fiscal year 2020. 3

FUNDING PROHIBITION 4

SEC. 417. (a) None of the funds made available in 5

this Act may be used to maintain or establish a computer 6

network unless such network is designed to block access 7

to pornography websites. 8

(b) Nothing in subsection (a) shall limit the use of 9

funds necessary for any Federal, State, tribal, or local law 10

enforcement agency or any other entity carrying out crimi-11

nal investigations, prosecution, or adjudication activities. 12

FOREST SERVICE FACILITY REALIGNMENT AND 13

ENHANCEMENT ACT 14

SEC. 418. Section 503(f) of the Forest Service Facil-15

ity Realignment and Enhancement Act of 2005 (16 U.S.C. 16

580d note; Public Law 109–54) is amended by striking 17

‘‘2019’’ and inserting ‘‘2020’’. 18

USE OF AMERICAN IRON AND STEEL 19

SEC. 419. (a)(1) None of the funds made available 20

by a State water pollution control revolving fund as au-21

thorized by section 1452 of the Safe Drinking Water Act 22

(42 U.S.C. 300j–12) shall be used for a project for the 23

construction, alteration, maintenance, or repair of a public 24

water system or treatment works unless all of the iron and 25

steel products used in the project are produced in the 1

United States. 2

(2) In this section, the term ‘‘iron and steel’’ products 3

means the following products made primarily of iron or 4

steel: lined or unlined pipes and fittings, manhole covers 5

and other municipal castings, hydrants, tanks, flanges, 6

pipe clamps and restraints, valves, structural steel, rein-7

forced precast concrete, and construction materials. 8

(b) Subsection (a) shall not apply in any case or cat-9

egory of cases in which the Administrator of the Environ-10

mental Protection Agency (in this section referred to as 11

the ‘‘Administrator’’) finds that— 12

(1) applying subsection (a) would be incon-13

sistent with the public interest; 14

(2) iron and steel products are not produced in 15

the United States in sufficient and reasonably avail-16

able quantities and of a satisfactory quality; or 17

(3) inclusion of iron and steel products pro-18

duced in the United States will increase the cost of 19

the overall project by more than 25 percent. 20

(c) If the Administrator receives a request for a waiv-21

er under this section, the Administrator shall make avail-22

able to the public on an informal basis a copy of the re-23

quest and information available to the Administrator con-24

cerning the request, and shall allow for informal public 25

input on the request for at least 15 days prior to making 1

a finding based on the request. The Administrator shall 2

make the request and accompanying information available 3

by electronic means, including on the official public Inter-4

net Web site of the Environmental Protection Agency. 5

(d) This section shall be applied in a manner con-6

sistent with United States obligations under international 7

agreements. 8

(e) The Administrator may retain up to 0.25 percent 9

of the funds appropriated in this Act for the Clean and 10

Drinking Water State Revolving Funds for carrying out 11

the provisions described in subsection (a)(1) for manage-12

ment and oversight of the requirements of this section. 13

JOHN F. KENNEDY CENTER REAUTHORIZATION 14

SEC. 420. Section 13 of the John F. Kennedy Center 15

Act (20 U.S.C. 76r) is amended by striking subsections 16

(a) and (b) and inserting the following: 17

‘‘(a) MAINTENANCE, REPAIR, AND SECURITY.— 18

There is authorized to be appropriated to the Board to 19

carry out section 4(a)(1)(H), $25,690,000 for fiscal year 20

2020. 21

‘‘(b) CAPITAL PROJECTS.—There is authorized to be 22

appropriated to the Board to carry out subparagraphs (F) 23

and (G) of section 4(a)(1), $17,800,000 for fiscal year 24

2020.’’. 25

SEC. 421. The Secretary of the Interior is authorized 4

to enter into grants and cooperative agreements with vol-5

unteer fire departments, rural fire departments, rangeland 6

fire protection associations, and similar organizations to 7

provide for wildland fire training and equipment, including 8

supplies and communication devices. Notwithstanding 9

121(c) of title 40, United States Code, or section 521 of 10

title 40, United States Code, the Secretary is further au-11

thorized to transfer title to excess Department of the Inte-12

rior firefighting equipment no longer needed to carry out 13

the functions of the Department’s wildland fire manage-14

ment program to such organizations. 15

RECREATION FEES 16

SEC. 422. Section 810 of the Federal Lands Recre-17

ation Enhancement Act (16 U.S.C. 6809) is amended by 18

striking ‘‘September 30, 2019’’ and inserting ‘‘September 19

30, 2021’’. 20

REPROGRAMMING PROCEDURES, DISCLOSURE OF 21

ADMINISTRATIVE EXPENSES, AND OPERATING PLANS 22

SEC. 423. (a) DEFINITIONS.—For the purposes of 23

this section: 24

(1) ‘‘Reprogramming’’ includes: 25

(A) The reallocation of funds from one 1

program, project, or activity, to another within 2

any appropriation funded in this Act. 3

(B) For construction, land acquisition, and 4

forest legacy accounts, the reallocation of funds, 5

including unobligated balances, from one con-6

struction, land acquisition, or forest legacy 7

project to another such project. 8

(C) An operating plan or any later modi-9

fication thereof submitted under subsection (i) 10

of this section. 11

(D) Proposed reorganizations even without 12

a change in funding, including any change to 13

the organization table presented in the budget 14

justification. 15

(2) ‘‘Program’’, ‘‘project’’, and ‘‘activity’’ con-16

stitute the delineation below the appropriation ac-17

count level of any agency funded by this Act, as 18

shown in any table of the report accompanying this 19

Act. 20

(3) ‘‘Funds’’ includes funds provided in this Act 21

or previous appropriations Acts that are available 22

for obligation in the current fiscal year and any 23

amounts available for obligation in the current fiscal 24

year derived from collections, fees or charges. 25

(4) ‘‘Assessment’’ is any overhead charge, de-1

duction, reserve or holdback, including working cap-2

ital fund and cost pool charges, from any program, 3

project, and activity to support government-wide, de-4

partmental, agency, or bureau administrative func-5

tions or headquarters, regional, or central operations 6

or to provide for contingencies. 7

(b) GENERAL GUIDELINES FOR REPROGRAMMING.— 8

(1) A reprogramming should be made only 9

when an unforeseen situation arises, and then only 10

if postponement of the project or the activity until 11

the next appropriation year would result in actual 12

loss or damage. 13

(2) Any project or activity, which may be de-14

ferred through reprogramming, shall not later be ac-15

complished by means of further reprogramming, but 16

instead, funds should again be sought for the de-17

ferred project or activity through the regular appro-18

priations process. 19

(3) Except under the most urgent situations, 20

reprogramming should not be employed to initiate 21

new programs or increase allocations specifically de-22

nied or limited by the Congress, or to decrease allo-23

cations specifically increased by the Congress. 24

(4) New programs requested in the budget 1

should not be initiated before enactment of the bill 2

without notification to, and the approval of, the 3

Committees on Appropriations of the House of Rep-4

resentatives and the Senate (hereinafter ‘‘the Com-5

mittees’’). This restriction applies to all such actions 6

regardless of whether a formal reprogramming of 7

funds is required to begin the program. 8

(c) CRITERIA.— 9

(1) A reprogramming shall be submitted to the 10

Committees in writing 30 days prior to implementa-11

tion if— 12

(A) it exceeds $1,000,000 individually or 13

cumulatively or results in a cumulative increase 14

or decrease of more than 10 percent of funds 15

annually in any affected program, project, or 16

activity; 17

(B) it is a reorganization; or 18

(C) it is an operating plan or any later 19

modification thereof as submitted under sub-20

section (i) of this section: Provided, That such 21

plan or modification thereof also meets any of 22

the other criteria under subsection (c)(1) of this 23

section. 24

(2) No funds shall be available for obligation or 1

expenditure through a reprogramming until 30 days 2

after the receipt by the Committees of a notice of 3

proposed reprogramming. 4

(3) A reprogramming shall be considered ap-5

proved 30 days after receipt if the Committees have 6

posed no objection. However, agencies shall not im-7

plement the reprogramming and shall extend the no-8

tification period if specifically requested by either 9

Committee. 10

(d) EXCEPTIONS.— 11

(1) With regard to the tribal priority allocations 12

of the Bureau of Indian Affairs, there is no restric-13

tion on reprogrammings among these programs. 14

However, the Bureau shall report on all 15

reprogrammings made during a given fiscal year no 16

later than 60 days after the end of the fiscal year. 17

(2) With regard to the Environmental Protec-18

tion Agency, State and Tribal Assistance Grants ac-19

count, the Committees do not require reprogram-20

ming requests associated with States and Tribal 21

Partnership Grants. 22

(3) With regard to funding for Park Manage-23

ment subactivities within the National Park Service 24

Operations of the National Park System account, re-25

programming guidelines apply at the activity level, 1

not the more detailed level as shown in the Com-2

mittee report. The National Park Service shall re-3

port on actual spending at the more detailed level no 4

later than 60 days after the end of the fiscal year 5

and show its impact on the succeeding year budget 6

at the more detailed level in the budget justification 7

submitted to the Congress in the subsequent fiscal 8

year for the purpose of updating the Committee sup-9

port table. 10

(e) ASSESSMENTS.— 11

(1) No assessment shall be levied or collected 12

unless such assessment and the basis therefor are 13

presented to the Committees in the budget justifica-14

tions and are subsequently approved by the Commit-15

tees. The explanation for any assessment in the 16

budget justification shall show the amount of the as-17

sessment, the activities assessed, and the purpose of 18

the funds. 19

(2) Proposed changes to estimated assessments, 20

as such estimates were presented in annual budget 21

justifications, shall be submitted through the re-22

programming process set out in this section and 23

shall be subject to the same dollar and reporting cri-24

teria as any other reprogramming. 25

(3) Each department, agency or bureau that 1

utilizes assessments shall submit an annual report to 2

the Committees which provides details on the use of 3

all funds assessed from any other program, project, 4

or activity. 5

(4) In no case shall contingency funds or as-6

sessments be used to finance agency actions dis-7

approved or limited by the Congress. 8

(f) LAND ACQUISITIONS, EASEMENTS, AND FOREST 9

LEGACY.—Lands shall not be acquired for more than the 10

approved appraised value (as addressed in section 301(3) 11

of Public Law 91–646), unless such acquisitions are sub-12

mitted to the Committees for approval in compliance with 13

these procedures. 14

(g) LAND EXCHANGES.—Land exchanges, wherein 15

the estimated value of the Federal lands to be exchanged 16

is greater than $1,000,000, shall not be consummated 17

until the Committees have had a 30-day period in which 18

to examine the proposed exchange. In addition, the Com-19

mittees shall be provided advance notification of exchanges 20

valued between $500,000 and $1,000,000. 21

(h) BUDGET STRUCTURE.—The program, project, 22

and activity structure for any agency appropriation ac-23

count shall not be altered without advance approval of the 24

Committees. 25

(i) OPERATING PLANS.—Not later than 60 days after 1

the date of enactment of this Act, each department or 2

agency funded by this Act shall submit an operating plan 3

to the Committees to establish the baseline for application 4

of reprogramming for the current fiscal year. The oper-5

ating plan shall include— 6

(1) a table for each appropriation with a sepa-7

rate column to display the President’s budget re-8

quest, adjustments made by the Congress, enacted 9

rescissions, if appropriate, and the fiscal year en-10

acted level; 11

(2) a delineation in the table for each appro-12

priation by program, project, and activity for the re-13

spective appropriation; and 14

(3) an identification of items of special congres-15

sional interest. 16

PROJECT INFORMATION 17

SEC. 424. (a) Not later than April 1, 2020, and each 18

April 1 thereafter, the Secretary of the Interior and the 19

Secretary of Agriculture shall submit to the Committees 20

on Appropriations of the House of Representatives and the 21

Senate prioritized and detailed lists of federal land acqui-22

sition projects, and Forest Legacy projects, which could 23

be executed within the three fiscal years beginning with 24

the fiscal year after the date upon which the lists are sub-1

mitted. 2

(b) The federal land acquisition project lists required 3

by subsection (a) shall include projects for the National 4

Park Service, the U.S. Fish and Wildlife Service, the Bu-5

reau of Land Management, and the U.S. Forest Service, 6

including recreational public access projects as required 7

by 54 U.S.C. 200306, and shall total for each agency no 8

less than 150 percent of the amount enacted for that agen-9

cy for the previous fiscal year. 10

This Act may be cited as the ‘‘Department of the In-11

terior, Environment, and Related Agencies Appropriations 12

Act, 2020’’. 13
