2. Please indicate whether SDG&E has provided any monies in support of a San Diego County Valley Rainbow Alliance that was formally announced on June 21, 2001. If SDG&E has provided monies in support of this alliance, please indicate:

a. How much has been provided; b. To what account this cost has been allocated; c. The basis for SDG&E expending ratepayer monies in this effort.

SDG&E Response:

a) SDG&E objects to this question on the grounds, among others, that it exceeds the scope of this proceeding and is irrelevant because SDG&E does not seek to recover any costs associated with the Valley-Rainbow project in A.02-12-027/A.02-12-028. SDG&E is seeking to recover its costs associated with the Valley-Rainbow project in Federal Energy Regulatory Commission Docket ER03-601-000, SDG&E’s electric transmission rate case, filed March 6, 2003. Without waiving any objections to UCAN’s request, however, SDG&E responds as follows. SDG&E is unaware of a group called the San Diego County Valley Rainbow Alliance. However, another group, called Southern Californians for Valley Rainbow, was formally announced on June 21, 2001. SDG&E responds to questions regarding Southern Californians for Valley Rainbow in the following question.

SDG&E RESPONSE 3. Please indicate whether SDG&E has provided any monies in support of an “Southern Californians For

Valley Rainbow” (found at http://www.supportvri.com/) in which SDG&E is listed as a supporter. If SDG&E has provided monies in support of this alliance, please indicate:

a. How much has been provided in total; b. An accounting of in-kind or staff commitments in support of the group’s activities; c. To what accounts these costs has been allocated; d. The basis for SDG&E expending ratepayer monies in this effort.

SDG&E Response: SDG&E objects to this question on the grounds, among others, that it exceeds the scope of this proceeding and is irrelevant because SDG&E does not seek to recover any costs associated with the Valley-Rainbow project in A.02-12-027/A.02-12-028. SDG&E is seeking to recover its costs associated with the Valley-Rainbow project in Federal Energy Regulatory Commission Docket ER03-601-000, SDG&E’s electric transmission rate case, filed March 6, 2003. Without waiving any objections to UCAN’s request, however, SDG&E responds as follows.

a. Approximately $129,000 has been provided for support work by third party consultant(s), but no payments to the organization were made. Southern Californians for Valley Rainbow is a group of supporters formed by the San Diego Regional Chamber of Commerce, San Diego Regional Economic Development Corporation and San Diego-Imperial Counties Labor Council to raise project awareness and educate business and community leaders. SDG&E was a member of this group. Other members of the group included 13 Mayors from the San Diego region, other elected officials, trade groups, economic development organizations, chambers of commerce, labor unions, businesses and individual customers.

b. Public Affairs used its personnel to communicate the benefits of the project to government officials, community organizations, customers and support groups, including Southern Californians for Valley Rainbow Interconnect. Public Affairs total labor charges allocated to the Transmission Project Capital Account for the Southern California for Valley Rainbow totaled $16,950.

c. Costs associated with Public Affairs activities related to the Valley Rainbow project were charged to the Transmission Project Capital Account and are not a part of the Cost of Service proceeding or under CPUC jurisdiction.

d. The Valley Rainbow Interconnect was proposed to meet reliability criteria as defined by the California Independent System Operator’s (CAISO) statewide grid planning standards. The CAISO Board on May 25, 2000 directed SDG&E to proceed with the design and licensing of the Valley Rainbow project. SDG&E is obligated to meet CAISO’s standards and pursue approval and licensing through the CPUC process. Public Affairs activities were conducted as part of the regular course of business and consistent with providing energy related information to its customers and affected stakeholders.

• Chula Vista Resurfacing The City of Chula Vista has proposed a resurfacing standard that will increase the cost of resurfacing by an estimated 150% and put upward pressure on rates. RPA has been working closely with City staff to identify new technology and alternate solutions that will accomplish the City’s goals and spare ratepayers.

• Otay Ranch Substations SDG&E will need to build two substations in the Otay Ranch. RPA has been working to get these substations included in the City’s General Plan Update and guide planners in finding a location that is conducive to the planned land use.

• REPAC's Regional Energy Strategy RPA has been participating in the REPAC process as an advisory member.

• National City Resurfacing The City of National City has proposed a street cut moratorium that would require more stringent resurfacing requirements on newly resurfaced streets. • Uptown Substation RPA is currently closing in on gaining the local Planning Group's acceptance of the team's #1 site for this City of San Diego project. In an area of few alternatives, RPA along with our Right-of-Way representative has gained significant support from property owners willing to sell.

• Highland Avenue 20A project At the request of Mayor Nick Inzunza, RPA is working with the City of National City to identify funding sources to underground the transmission lines on Highland Avenue.

• Tree Clearance Issues on the Silver Strand There are over 50 palm trees on the Silver Strand that regularly fall out of compliance with CPUC clearance regulations. Vegetation Management would like to remove the trees. RPA is working with the community to identify a solution that addresses both SDG&E’s safety concerns and the community’s environmental concerns.

• Reconfiguration of the Transmissions Lines from South Bay to Main Street SDG&E needs to increase transmission capacity from South Bay to the Main Street substation. RPA is working to determine how the community will be impacted.

• Otay Lakes Rd in Chula Visa 20A project The City of Chula Vista shut down this 20A project in mid-construction. RPA worked with City staff to find a solution that would get the project back on track.

• Possible Relocation of Facilities at Marina Parkway, Chula Vista The City of Chula Vista has requested that the facilities at Marina Parkway be relocated under the terms of the current franchise agreement. RPA requested that Legal analyze the City’s request.

• Reconductoring of TL 603 SDG&E will be reconductoring TL 603 through much of National City. RPA is identifying how the community will be impacted.

• Utility Box Painting Program in Chula Vista's Redevelopment Area The City’s Community Development Office contacted RPA to establish a public art program on SDG&E’s utility boxes in the City’s redevelopment area. RPA worked to establish the parameters of the program and identify which boxes could be used in the program.

• IDEC Pharmaceutical 6" HP Gas Extension After Oceanside City staff delays for the permits for this "time-sensitive" project, RPA intervened via the Mayor and City Manager to gain release of the job. Successful negotiations resulted in more favorable working hours on busy streets plus the waiver of $45,000 in the initial fees quoted by staff, the bulk of which was for an on-site inspector. RPA established a toll-free hot line for area residents to voice concerns throughout the project and provide written notification along the route to some 850 residences.

SDG&E RESPONSE Legal 25. Please provide a copy of the settlement agreement approved by the Court in Colo v. SDG&E,

SDG&E Response: There were a multitude of plaintiffs in the Colo v. SDGE (aka Guejito Fire cases) lawsuit(s). There were various settlements in this matter. The court approved none of the settlement agreements. After the settlement agreements were signed, each plaintiff dismissed, with prejudice, San Diego Gas & Electric from their lawsuit. San Diego Gas & Electric was insured through AEGIS and had a self-insured retention of $250,000. Other than this deductible, insurance covered the settlement payments.
