Laws are for SissiesHey. You know how the people at the Forbidden Island of Booneville Avenue slapped up some signs and declared the Island, and the waters around it, “Private Property”, without actually owning or paying taxes on any of it? Well, as fate would have it, we just got our hands on another tasty tidbit of information regarding more public property being converted to private use.
The public streets near the river and Schlitterbahn have been, for years, designated as permit parking zones. That is, one must have a special pass to park on them and those passes are only provided to homeowners in the area. As with most things in this city that have to do with special privileges, there were some shortcuts taken in that whole process, shortcuts that might make this summer real interesting for Kathleen Krueger and Ken Valentine. Allow me to explain.
The folks that live over near the Faust Street Bridge want to get in on some of that public-to-private property conversion that the Islanders and Guada-Coma/Lincoln Street residents have been enjoying forever, so they went to the City and requested that parking on nearby city streets be closed to the public as well. So far, so good. We even have a law on the books to facilitate just such a seizure. You can look it up in our municipal code under Section 126-354 – Parking by Permit Only. The requirements are under Section (d), items 1, 2, and 3.
At Monday’s City Council meeting, Garry Ford, (our future former Assistant City Engineer – Transportation), told Council that items 1 and 3 were all in order, reading through 1 and mentioning 3. Oddly, he didn’t mention Item 2 at all. Hmm.
District Two Councilwoman and TX Citizen landlady Aja Edwards directly asked Ford about rules about percentages of non-residents parking on the streets in question, because she had, apparently, read Item 2. Much like St Peter before him, Ford three times
denied there were any such rules. Edwards pressed Ford to read the text he had skipped over the first time he read the ordinance aloud. When he did, he clearly exposed his effort to mislead
Council. That text follows:Item 2: The city engineer will
review all applications submitted for a proposed designated parking permit area and determine the following:
a. No less than 75 percent of all available on-street parking spaces within the designated area are occupied and remain occupied for a minimum of two hours;
b. No less than 25 percent of all available on-street parking spaces within the designated area are occupied and remain occupied by non-neighborhood vehicles; and
c. The proposed designated parking area is a contiguous commercial or residential use and consists of a minimum of ten commercial or residential lots, except where there are less than ten commercial or single family lots on the entire length of the street, then the entire length of the street may be considered.
Oops. Items (a) and (b) are complete unknowns. Looks like a study by the City Engineer is in order. But here’s where it gets good. Planning Manager Shannon Mattingly got up before Council and told them she didn’t think these studies had been done for any of the streets that have been declared permit only. Uh-oh. That would mean that the signs are unenforceable. Oh dear. Oh dearie dear. Oh my goodness. Katie, bar the door.
But wait, it gets even better. The Mayor flat out asked City Attorney Val Acevado if it was legal for Council to vote to approve something that had not met the minimum legal standard as set out in the municipal code. Acevado, after her usual shuck-and-jive, replied with the same answer she always gives Council when passing an illegal ordinance: “It’s up to you”. This is the same advice a gangster’s moll would provide, by the way. “You know best, honey (pops gum, files nails).”
Let’s be clear: Both City Attorney Val Acevedo and, later in the meeting, City Manager Robert Camareno, told the Mayor that Council absolutely had the right to pass the ordinance, despite the legal standard

not being met. Both Acevedo and Camareno advised Council to disregard the law. This should not surprise anyone, as “The Law is Optional” is philosophical par for the course in Texas’ Most Corrupt City™. It’s why the City finds itself on the losing end of court judgments time and time again. (See Nick Rogers’ Due Process column in this issue for an update on the City’s tow truck company fiasco, which is now winding it’s way through the courts. Acevedo’s advice got them into that one, too.)
The first reading of the ordinance passed 5-2, with District One’s George Green and District Two’s Aja Edwards against.
So here’s the deal. We put in an open records request to find out exactly which zones had the proper studies done. If City Planning Director Shannon Mattingly is correct in her belief that they do not exist, we’ve got another Island situation on our hands, and you may park in any neighborhood you’d like. When the tickets are issued and the towing is done, you’ll have yourself an open and shut case against the City for all manner of grievances, as does anyone who ever got a ticket or was towed for parking without
a permit in those neighborhoods. This one could be a barn burner. I’ll give this to the members of City Council – they sure are comfortable with risk. Perhaps they should send a team to the X Games.
As for us, we abhor risk, so don’t park
out there now. Wait until we publish the results of our records request verifying Mattingly’s comments. But for those of you reading from Lincoln Street, you may want to brace yourselves for on onslaught of common people parking where you’ll have to, you know… endure them.

Towing Case UpdateIn its motion for appeal in a lawsuit over non-consent towing contracts, the City of New Braunfels argues that it is immune from the suit because there is no ordinance to sue over.
In December, 2012, City Council awarded contracts to four companies for all non-consent towing operations in New Braunfels. Part of the agreement with the companies allows the City 10 free tows per month and free storage of towed vehicles for 15 days. The City had passed an ordinance that would contract only one company for all non-consent towing, but changed its mind and awarded the contracts to four operators. In previous years, there were 17 towing companies on the rotation list, a number the City said was unwieldy.
When the City was considering the use of only one towing firm, it had asked companies to submit a Request for Proposal (RFP), with a deadline set for Nov. 21, 2012. In an RFP, a company makes a claim as to why its services should be considered for contract. In its RFP request, New Braunfels made a list of requirements that any towing company selected must be able to meet, such as having the proper equipment to right an overturned 18-wheeler and the ability to tow heavy equipment, as well as have enough space to store 100 vehicles.
Garrison Maurer, of Comal Towing, brought suit against the City claiming the four companies chosen could not meet the RFP requirements, while his company did. In fact, Maurer stated that the companies eventually chosen actually call him to perform those more difficult services. The City has not disputed Maurer’s comments.
Jeramie Hernandez, of JJ Towing, and Robert Fleming, of Pro Care Wrecker Service, also sued, stating that they did not submit bids because they believed being the only company to handle all of the non-consent towing would have been too difficult. Hernandez and Fleming said that Council, with no public notice, changed the rules to allow four companies to handle the work well after the Nov. 21, 2012, deadline for proposals had passed. Both men say that had they known of the rule changes, they would have pursued the contracts.
In February, Judge Dib Waldrip ruled that the City is not immune from suit in this issue and the court does have proper jurisdiction. The City appealed Waldrip’s decision to the Third Court of Appeals.
The main thrust of the City’s argument in its appeal on jurisdiction is that after Council rescinded the one-company ordinance, it did not issue another ordinance when it chose four companies for the rotation list. Since there is no ordinance, not suit can be brought.
“The City, and the public officials acting in their official capacities, retains immunity from all declaratory judgment actions which do not seek to invalidate an ordinance,” New Braunfels argues in its motion. “Since no ordinance exists in this case (in fact, one was repealed in this process), no declaratory judgment action can be maintained.”
The City also argues that it is not legally required to make a list for towing rotations or to even have a towing ordinance.
“This is a case about a list,” the appeal motion states. “A non-binding discretionary referral list at that.”
The City thus argues that any contracts made with towing companies were simply to be put on the list, not to actually provide services, since New Braunfels can use any towing company it wants and doesn’t have to abide by its own list. Even though it asked towing companies to submit RFPs, the City argues that the requests were “substantively closer” to Request for Quotations (RFQ), which is a request for a product rather than a service.
“The City is not legally required to have a list, but if it does, it decides who to put on and who not to put on,” the motion states. “That is the contract at issue. Under this contract, the City retains immunity from having its decisions challenged in court.”
To choose the four companies, City personnel developed a scoring system and applied it to those companies that previously submitted bids to become the single non-consent towing company. The four who had the highest scores were chosen for the rotation list. However, the City also argues in its motion that when it rejected the one-company towing option, all bids for that contract were rejected.
In his February order, Waldrip ruled that the scoring system was arbitrary and unrealistic, noting that Maurer scored lower than companies that did not meet the City’s own criteria.
Maurer, Hernandez and Fleming, who brought the suit, have until May 5 to file their response.

Gallagher SpeaksEarly voting started this week, which means
we’re about to get this whole Mayoral thing
over with. This has been a tough race to cover,
as candidate Barron Casteel has flatly ignored
every request we’ve made to his campaign
for comment, assuming that the TX Citizen
reader either doesn’t vote, (which is a risky
premise to work from), or won’t vote for an
establishment, machine candidate (which is
probably a safe bet). Either way, he’s devoted
his time and attention to the listeners of KGNB
and the readers of the Houston-owned Herald-
Zeitung, leaving us with extra space to fill with
the words of his opponent, Greg Gallagher.
As we pulled into the home stretch of this
race, we sat down with Gallagher and gave
him a chance to speak freely about his vision
for the city at large, and City Hall specifically.
We put a nickel in him and asked him about
what he’d go to work on immediately, should
he win the May 10 election:
The Big Picture“First and foremost, as I’ve been saying, is
growth. With growth comes problems, in any
community. When a high number of people
are assembling in one area, that causes a
problem, and that problem is crime. We
are very ill-prepared to handle anything that
happens in this town. We’re 30 officers short.
Chief Wibert is asking for 8 officers a year
for five years. And that doesn’t even get us to
where we need to be.
“We’re at 1.6 officers per 1000
residents, when we should be at 2.2. Right
now, they’re reacting to events, not preventing
crimes. It’s too little, too late most of the time.
I have noticed over the last couple of weeks,
probably because it’s close to summer, that
there are a lot more patrols. They’re running
radar on the highway, and I see a better
presence out there. That’s good. The Chief of
Police is an important position, and he has a
task, and I don’t think the City is responding to
his requests appropriately.
“Then there are the rivers. My proposal
is, as I’ve said many times, is to get out of
the river ordinance business and focus
on other needs. Specifically, the outlying
neighborhoods. The one thing I’ve seen and
learned while going out and talking to people,
is that these neighborhoods feel neglected and
forgotten. Their requests fall on deaf ears. The
council is there until 11 at night sometimes,
arguing river issues. We’ve got to resolve this,
move on, and get into the business of serving
communities, not just catering to a certain
group of people that live by the rivers, and
will always have complaints about trash and
noise and crowds. My proposal is to leave the
issues on the rivers to those who know best,
and that’s the outfitters. Empower them. Make
them responsible for a clean, safe river. Get
back into the business of running a town, and
not running a river.
“The third issue, back to growth, is
jobs. Stop giving the farm away when a
company wants to come to town, or is here
and threatens to leave if they don’t get some
big tax break. I scratch my head on some
of the things the city does. You saw what
happened with the Scooter Store. Back when
they were threatening to leave, the city gave
them a sweetheart deal with the additional
call centers. It was basically blackmail. They
weren’t going anywhere. And as it turns out,
they were an unethical corporation and got
shut down. That put all those people on the
street without a job.
“They’re not being good trustees of the
taxpayers’ money. We’ve got to make better
decisions when companies are trying to come
here, promote the jobs. And what I propose
would be to, immediately upon taking office,
do an audit. I want to know how much money
is going to the CVB, the Chamber, 4B, and
what that money is being used for. Every
dollar they get should be somehow used to
bring a company here, or expand an existing
company, and create more jobs. I would even
be open to bringing in a third party forensic
accounting team to do an audit. Where is
all this money going, and how is it being
used? It’s not the city’s money, it’s the people’s
money, and they need to know where their
hard earned tax money is going.”
On City Hall Culture“From what I understand, there is a lot of
in-fighting in City Hall, as well as some
disgruntled staff. I’ve talked to some folks in the
Street Department that don’t feel (management)
has good ideas. I know there are opportunities
for better communication between council and
staff. I think the City Manager is doing a good
job. I think the City Attorney could definitely
use some more experience, and counsel
the Council better. The mayor is basically
the CEO of a very large corporation. And
that mayor, whomever it might be, needs to
be a good manager. They need to facilitate
communications between council and staff
members to get the job done.”
On Transparency“We see on the front page of the papers
how much money the City is bringing in. We
all talk about how great that is, but nothing
is being disclosed on where that money is
going. There should be justification of where
every dollar coming in is going. The HOT
should be used for promoting our amenities,
and enhancing them. Hotels are paying that
tax, understanding that it will be used to bring
in more overnight guests. I think it’s going to
some places that don’t make much sense.”

Dear Uncle Esel: I recently took my
family to a big zoo near New Braunfels.
While we did enjoy looking at all the
various animals, I couldn’t help but
feel sorry for them behind all of those
cages. I understand that many of these
species need protecting, but do you
think there could be a better, more
humane way to do so without placing
them behind cages?

Dear Lover:
A few years ago, the Uncle was
watching a nature show on television. The
show explored an extended family group of
chimpanzees. During the filming, a rogue
gang of chimpanzees (Group A) invaded
the peaceful chimpanzee family (Group B)
and laid waste to them. One member of
Group B was killed after members of Group
A threw it against a tree several times.
Group A then ate it.
At his point, I realized that nature is
messed up and needed to be dealt with.
An important function of zoos not many
people realize is that they are actually prisons
for criminally insane animals. The protection
that you speak of is to protect the rest of the
animal populace from these vicious thugs.
I spoke with Dan Johansen, owner and
operator of Safari Dan’s Zoo and Jerky Haus
in nearby Canyon Lake.
“I hate animals,” Dan told me. “They’re
thugs, the whole lot of them.”
Dan mentioned Steve the Gorilla as case
and point. “He would fling his own leavin’s at
people,” Dan said. “I mean, who does that?
They’re like… animals.”
To stop this nasty habit, the zoo strapped
big diapers to Steve. Deprived of his preferred
weapon, the gorilla started carrying guns.
“We think he got them from gun shows,”
Dan said. “Naturally, we took them away,
but we now have reason to believe he has
acquired a 3D printer.
“We’re screwed,” the zookeeper said.
Another example Dan gave me is an
alpaca known as El Muerte. El Muerte once
ran a vicious drug cartel in Monterrey that
even frightened the other cartels.
“The way he looks at me sends chills
down my spine,” Safari Dan admitted. “I just
know that he’s waiting for his chance to kill
me. And, he’s made friends with the gorilla.”
I asked Dan what the most difficult animal
to work with is.
“Dolphins,” he said without hesitation.
“They are so damn arrogant. They try and
make you look stupid around your girlfriends
and talk smack about you behind your back.”
So, dear Lover, don’t feel sorry for the
animals, they deserve to be there. Also,
remember to thank your lucky stars that there
are people out there like Safari Dan who help
keep these monsters off the streets.

When I have a new lover, I wrap her feet
up in jewelry and ask her to place them
on a special altar I made. The trouble is,
I have been kicked out of all the bars,
shoe stores and pedicure salons in town.

or the near the rivers. Where can I go
now to gander at the feminine foot?

Get a job with a podiatrist, which puts a
high premium on people who love feet.
If you already have a steady job, though,
another option is to become a licensed foot
masseuse and do that in your spare time.
However, I must warn against you moaning or
using the altar, which could cause suspicion.

Uncle does not judge. So, you just keep being

Summer is coming and it’s time to make sure you are ready for any invitation to a party or
backyard BBQ that may come your way. You also need to make sure you are swimsuit ready!
Here is a light, refreshing side dish that can be made a day early. This fresh and colorful pasta
salad is a blast of garden vegetables and is low calorie too. The pepperoni can be eliminated
if you want to go vegetarian. This recipe is very versatile and can be doubled up if you are
cooking for a larger crowd. Either way, this pasta salad is guaranteed to disappear when
placed on the picnic table!
Light Summer Pasta Salad
• 12oz.bagofgardenstyletri-color
spiral pasta
• 16oz.bottleoflite-lowcalorie
Italian dressing
• Italianseasoningtotaste
• 15oz.canofblackbeans,drained
• 4oz.canofslicedblackolives,drained
• 6oz.bagofturkeypepperoni,
cut into quarters
• ½yellowonion,sliced
• ½purpleonion,sliced
• ½greenbellpepper,sliced
• ½yellowbellpepper,sliced
• ½redbellpepper,sliced
• ½orangebellpepper,sliced
• 2cupsskimmilkshreddedmozzarellaorItalianblendcheese
Bring water with a pinch of salt to a boil in a medium pot. Add pasta and cook per
directions on the bag until tender; about 7 minutes. Drain pasta. Place in a large serving bowl
and coat with a few squirts of Italian dressing to keep the pasta moist. Sprinkle on some Italian
seasoning and mix. Allow pasta to cool. Once cool, add your drained black beans and black
olives. Add you quartered pepperoni. Cut all your vegetables into 1 inch bite size slices and
add to the pasta and blend. Add the remaining Italian dressing as you continue to mix the
ingredients in the bowl with a large spoon. Taste to determine if you need additional Italian
seasoning. Add shredded cheese a few small handfuls at a time while continuing to toss the
pasta salad. Less cheese can be used to reduce calories further. Once thoroughly mixed, cover
with clear plastic wrap and refrigerate for several hours. Serve cold.

On a Strength’s Inherent WeaknessMost people that read my column will understand that I am a likely supporter for Rand Paul should he make a run for the presidency. Rand Paul, like his father before him, has been very successful in bringing libertarian ideas into the forefront of Republican Party politics. Make no mistake, Paul will face an uphill battle in any Republican primary. He certainly doesn’t fit the establishment mold; primarily because he is serious about limiting the size and scope of government. He is certain to butt heads with religious conservatives as well. He might side with them on issues where the protection of religious liberties are at stake, but he will fall short in their eyes when it comes to attempts to socially engineer in a conservative fashion. Neither of these problems bother me, but they will make it difficult for him to win wide support with other Republicans.
A few weeks ago, I discussed one area that I felt was a weakness for Paul (or any libertarian): foreign policy. At the time the issue was Russia and its belligerence with Ukraine. The tensions between those two countries continues and has in fact gotten worse. Thus far, the response from the Obama administration has accomplished nothing. It’s actually possible that a libertarian response might have been stronger, but I can’t imagine one that would have kept Russia out of Crimea, nor do I see anything likely to keep Russia from going further. There is no question that what is a weakness in the Obama Administration’s response would be a problem for a candidate like Paul too.
If Paul expects to be nominated to run on the Republican ticket, he really should be expected to speak out on how he might have handled something like this. While he’s at it, he might want to discuss the current tension between China and Japan. (China recently grabbed a Japanese cargo ship in order to collect on disputed debt from World War II.) He should be forced to suggest courses of action that deal with the realities as they stand and don’t involve things that might have been differently beforehand. As President he would be inheriting the legacy of U.S. foreign policy, whether he likes it or not.
What’s good for the goose, though, should be good for the gander. If Paul should be expected to address his weakness, so should other Republican candidates.
Of those polling well, only Mike Huckabee could be said to represent social conservatives. Others may appear over time (Huckabee is always an early favorite), but for now, Huckabee should take up the mantle for the religious right.
Social conservatives need to address what they believe are the responsibilities of the federal government. If they have an area of weakness, this is it. I expect that Democrats will fret over this appropriately, but there are a good number of Republicans who don’t much care for government overreach on social issues.
Huckabee should be expected to answer if there should be a federal restriction on abortion and what that restriction would be. This would force him to openly take a position on a topic that concerns many Americans, but specifically many Republicans. Should the federal government ban abortion outright? Should there be exceptions for incest or safety of the mother? Is there a point at which a fetus should have federal protection?
This should eliminate the states’ rights dodge. To say it is an issue for the states is to say that the federal government has no place in abortion. Any other answer means that the federal government should have some role and require an answer as to what that role would be.
Huckabee should answer a similar question on marriage equality. The question can be very simple, but might require a follow-up or two: should the federal government recognize gay marriages? If the answer is no, the he should be asked to explain why married heterosexual couples should qualify for x,y and z, but gay married couples should not. If the answer is yes, then he should be asked if states have to do the same, and if not, why not? If different states are going to maintain different views on this, you can expect that there will be some conflict as people move from state to state.
Both are difficult political questions, but they are fair and should give Republican voters an idea of what they’re buying into.
Paul Ryan, Jeb Bush, or Chris Christie could fill the role of establishment candidate. I’m sure they would all prefer a different title, and I’m ok with that. I simply see each as a candidate less likely to buck the system. All seem to have a relatively broad view of the role of the federal government, and consequently, all can be expected to spend beyond their means. Hence the question: How do you plan to pay for all this?
Actually, that’s a bit vague to expect any sort of real answer. Instead, they should be asked to lay out a balanced budget based on current incomes and next year’s anticipated spending. Since the income number is a real value it doesn’t allow for fudging. The smartest of candidates will immediately point out that there would need to be some cutting to make that work, and they would be right.
The point, of course is to find out what they would be willing to cut out of the federal budget. This will give Republican voters an idea of their priorities. Would they take an axe to entitlements? (For the sake of this exercise we will assume that they may cut spending, even mandatory spending, at will.) Can the military stand a haircut or not? When you’re done cutting all the things that the entire American public will cheer, what’s next? Because we all know foreign aid just isn’t going to do it. I wonder if any of them would suggest defaulting on the debt and just starting over from scratch (no, I do not endorse this position).
I would hope that all of the candidates would be able to provide answers to all of these questions, but if everyone would address their greatest weakness that would make me happy enough. None of the questions are impossible to answer; it’s just difficult to know the best political answer. Some answers are great for primaries, but kryptonite for a general election. Any candidate that could answer their question truly well, though, would find the answer an asset not just for Republicans, but for the entire electorate.
