Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 18th day of June, 2019 at 9:00 AM. The meeting was called to order by Chairperson Kneisl. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Kircher and second by Becker, the following motion was introduced and adopted by unanimous vote: To approve the agenda as presented with the addition of a new consent agenda item 4.6 Nutrient Management Specialist.

Consent Agenda

On motion by Neumann and second by Erickson, the following motions were introduced and adopted by unanimous vote:

To approve the Commissioner’s Meeting Minutes for June 4th, 2019 as presented. To approve a 1-Day Temporary On Sale Liquor License for the American Legion #417 Jacobson Post (Little Sauk Legion) for July 13th, 2019 at 16268 County 50, Long Prairie, MN. On motion by Kircher and second by Neumann, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Commissioner Warrants number (ACH) 400252 through 400262 in the amount of $15,394.39 and (Regular) 51660 through 51758 in the amount of $135,657.20 for a total of $151,051.59. On motion by Erickson and second by Becker, the following motion was introduced and adopted by unanimous rollcall vote: To approve the Health & Human Services Warrants number 515155 through 515205 in the amount of $96,944.72 and warrants number 705159 through 705288 in the amount of $81,113.73.

County Extension

On motion by Becker and second by Erickson, the following resolution was introduced and adopted by unanimous vote:

COUNTY EXTENSION COMMITTEE PER DIEM RATE AMENDMENT WHEREAS, per Minnesota Statute 38.36 Subdivision 1, a county must have an extension committee consisting of particular and at-large members, and; WHEREAS, members of the County Extension Committee are provided a per diem rate for their service, and; WHEREAS, Minnesota Statute 375.47 deems that the per diem rate be set by resolution to be a reasonable allowance in lieu of expenses and also a mileage allowance, and;

WHEREAS, the most recent resolution setting the per diem rate for the County Extension Committee members was approved on December 18, 1984 at $25.00 per meeting and mileage at the federal reimbursement rate, and; WHEREAS, the per diem rates for Committees of comparable commitments have increased their per diem rate over time while the County Extension Committee has remained constant. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioner approve setting the per diem rate for County Extension Committee members at $35.00 and mileage reimbursements be provided at the current time federal reimbursement rate effective June 1, 2019 until otherwise revoked or amended by the County Board.

Lutheran Social Services

On motion by Neumann and second by Erickson, the following resolution was introduced and adopted by unanimous vote: RESOLUTION AUTHORIZING APPLICATION FOR MINNESOTA HOUSING AND FINANCE

AGENCY FAMILY HOMELESSNESS PREVENTION AND ASSISTANCE PROGRAM

WHEREAS, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized to undertake a program to provide funds for Family Homeless Prevention & Assistance Projects, and; WHEREAS, the Lutheran Social Service has developed an application for the Minnesota Housing Finance Agency Homelessness Prevention and Assistance Program, and; WHEREAS, Lutheran Social Service has demonstrated the ability to perform the required activities of the Minnesota Housing Finance Agency Family Homelessness Prevention and Assistance Program. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby authorizes Lutheran Social Services as an entity to be charged with the administration of funds made available through the Minnesota Housing Finance Agency Family Homelessness Prevention and Assistance Program in the County of Todd, Minnesota and approves the attached resolution document.

Public Works

On motion by Becker and second by Erickson, the following resolution was introduced and adopted by unanimous vote:

AWARD OF CONSTRUCTION CONTRACT FOR 2019 BRIDGE REPLACEMENT PROJECT ON CSAH 26

WHEREAS, sealed bids were received on June 11th, 2019 by the Todd County Public Works Director for SAP 077-626-008, said project for bridge construction work on County State Aid Highway #26 over the Long Prairie River, and; WHEREAS, the following sealed bids were received: Redstone Construction, LLC Mora, Minnesota $1,2 22,228.50 Structural Specialties, Inc. Hutchinson, Minnesota $1,222,804.57 NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners does hereby accept and award the contract for the above said construction project to Redstone Construction, LLC of Mora, Minnesota based on their low bid of $1,222,228.50.

County Sheriff

On motion by Kircher and second by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the purchase of 4 new squads from Tenvorde Ford at a total cost of $133,796.00.

Planning & Zoning

On motion by Neumann and second by Kircher, the following motion was introduced and adopted by unanimous vote: To grant the Conditional Use Permit with the conditions developed by the Planning Commission for Camphill Village’s request for one additional living unit attached to ‘Aurora House’. On motion by Erickson and second by Kircher, the following motion was introduced and adopted by unanimous vote: To grant the Conditional Use Permit with the conditions developed by the Planning Commission for Paul Johnson on parcel 12-0020600 & 12-0020700 to store and sell steel and plastic barrels and IBC totes. On motion by Becker and second by Kircher, the following motion was introduced and adopted by unanimous vote: To extend the time needed to complete the final plat for the Aldrich Amish Cemetery until October 17th, 2019. On motion by Becker and second by Kircher, the following motion was introduced and adopted by unanimous vote: To grant the conditional use permit for temporary family housing on parcel 25-0034600 with the conditions recommended by the Planning Commission.

Solid Waste

On motion by Erickson and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the proposed change of winter weekend hours of operation for the Solid Waste/Transfer Station facility to be the 3rd Saturday of the month 8:00 am to 12:00 pm November through March beginning in November 2019. On motion by Kircher and second by Becker, the following motion was introduced and adopted by unanimous vote: To approve signing the contract with Alex Rubbish for Ag Bag recycling.

Health & Human Services

On motion by Kircher and second by Neumann, the following motion was introduced and adopted by unanimous vote: To accept the Mardag Foundation grant.

MIS

On motion by Erickson and second by Becker, the following motion was introduced and adopted by unanimous vote: To approve Pictometry Contract and complete flyover in 2020, with optional 2023 flight. Administration

On motion by Erickson and second by Neumann, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION TO APPOINT DEPUTY DIRECTOR FOR EMERGENCY MANAGEMENT WHEREAS, it is the responsibility of the county board to appoint one or more deputy director/s of emergency management, and; WHEREAS, Minnesota State Statute 12.25 §2.a, states “Each county emergency management organization must have a director and one or more deputy directors. They must be appointed by the county board.” and; WHEREAS, David Determan would be an ideal fit to this role, and; WHEREAS, David Determan has a lot of the necessary training and works closely with emergency management director in his role as Public Health Emergency Preparedness Coordinator. NOW, THEREFORE BE IT RESOLVED, David Determan to be appointed as deputy director of emergency management. On motion by Kircher and second by Neumann, the following motion was introduced and adopted by unanimous vote: To change the job grade for the Facilities Supervisor to a Grade 11, Step 5 effective June 19th, 2019.

The Chief Deputy Recorder position was established on August 1, 2002 with its own job description and Hay Study wage valuation to which Linda Daoust was promoted to. Linda has been in that position up until Jan. 8, 2019 when she became an elected official which has left the Chief Deputy Recorder position vacant. This position was included in the Springsted study with its own job description/duties and grade placement assigned. The Chief Deputy Recorder position, besides being determined as statutorily necessary, is a vital role in the County Recorder's office primarily to assist in the recording of documents, day-to-day management of office workload and support in the case of vacancy of the County Recorder position. Internal advertisement has been fulfilled and Douglas Johnson was the only applicant that applied for the position. I met with the Personnel Committee on June 24, 2019 and it was concluded that the interview process was not necessary since only one applicant had applied and the applicant was a qualified candidate to fill this vacant position.Options: Recommendation: The Todd County Board of Commissioners approves the following by Motion: to approve promoting Douglas Johnson to Chief Deputy Recorder at Grade 10, step 1, $24.94 per hour effective July 3, 2019.

ADOPTING THE TODD COUNTY GOVERNMENT CENTER CAMPUS PARKING POLICY

WHEREAS, the Todd County Board of Commissioners desire to ensure County customers have reasonable access to the Todd County Government Center and;

WHEREAS, the Todd County Board of Commissioners desire to ensure County employees have reasonable access to the Todd County Government Center, and;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners establishes the following policy related to employee and customer parking around the Todd County Government Center;

Purpose:

The purpose of this policy is to establish parking protocol for employees and customers parking near the Todd County Government Center.

Article I. Historic Courthouse Hill Parking Lot The Historic Courthouse Hill parking lot is designated as a co-mingled parking lot for County employees and County customers. The seven parking spaces next to the Historic Court House, as well as seven spaces marked as “Public Parking” by signs shall be used by County customers only. All other spaces may be used by County employees. In addition there are two parking spaces marked as, “Reserved.” These two parking spaces are reserved for County employees who are loading and unloading vehicles.

Article II. Todd County Government Center Parking Lot The Todd County Government Center Parking lot is designated as a co-mingled parking lot for County employees and County customers. The County vehicle fleet shall also be parked in this area.

Article III. Street Parking The Todd County Board of Commissioners directs that Employees of Todd County shall not park during the regular work day, except for periods of loading and unloading or as otherwise signed (i.e. Sheriff parking) as follows:

(a) 1st Avenue between 2nd and 3rd Street. (b) 2nd Avenue between 2nd and 3rd Street. (c) 3rd Street between 1st and 2nd Avenue.

Article IV. Medical Parking Passes Employees with medical issues needing access to closer parking spaces may contact Todd County Human Resources to request a temporary employee medical parking pass. This parking pass will allow them closer access to parking for the building of their employment. This parking pass allows the employee to park in customer parking if needed, in order to have better access to their building of employment.

Article V. Other Resolutions It is understood that this Resolution replaces and supersedes all prior County Board actions, oral or written, relating to the subject matter hereof.

GRANT AGREEMENT TO STATE TRANSPORTATION FUND FOR SAP 077-626-008

LOCAL BRIDGE REPLACEMENT PROGRAM (GRANT TERMS & CONDITIONS)

WHEREAS, Todd County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Bridge No. 77538, and;

WHEREAS, the Commissioner of Transportation has given notice that funding for this project is available, and;

WHEREAS, the amount of the grant has been determined to be $444,205.63 by the reason of the lowest responsible bid.

NOW, THEREFORE BE IT RESOLVED, be it resolved Todd County does hereby agree to the terms and conditions of the grant consistent with Minnesota Statutes, section 174.50, and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for the bridge but not required. The Todd County Board Chairman and the Todd County Auditor/Treasurer are authorized to execute a grant agreement and any amendments thereto with the Commissioner of Transportation concerning the above-referenced grant.

LOCAL BRIDGE REPLACEMENT PROGRAM GRANT AGREEMENT

This agreement is between the State of Minnesota, acting through its Commissioner of Transportation ("State"), and ("Grantee"):

Grantee has been awarded Local Bridge Replacement Program funds under Minn. Stat. § 174.50, subd. 6-7. 3. Grantee represents that it is duly qualified and agrees to perform all services described in this agreement to the

satisfaction of the State. Pursuant to Minn.Stat.§16B.98, Subd.1, Grantee agrees to minimize administrative costs as a condition of this agreement.

AGREEMENT TERMS 1 Term of Agreement, Survival of Terms, and Incorporation of Exhibits

Effective Date. This agreement will be effective on the date the State obtains all required signatures under Minn. Stat.§16B.98, Subd. 5, whichever is later. As required by Minn.Stat.§16B.98 Subd. 7, no payments will be made to Grantee until this agreement is fully executed. Grantee must not begin work under this agreement until this agreement is fully executed and Grantee has been notified by the State’s Authorized Representative to begin the work.

Expiration Date. This agreement will expire on November 1, 2021, or when all obligations have been satisfactorily fulfilled, whichever occurs first.

Survival of Terms. All clauses which impose obligations continuing in their nature and which must survive in order to give effect to their meaning will survive the expiration or termination of this agreement, including, without limitation, the following clauses: 8. Liability; 9. State Audits; 10. Government Data Practices and Intellectual Property; 11. Workers Compensation; 12. Governing Law, Jurisdiction, and Venue; and 14. Data Disclosure.

Exhibits. Exhibit A: Sources and Uses of Funds Schedule; Exhibit B: Grant Application; and Exhibit C: Grantee Resolution Approving Grant Agreement are attached and incorporated into this agreement.

2 Grantee’s Duties

Grantee will conduct one of more of the following activities in accordance with its grant application, which is attached to this Agreement as Exhibit B: (i) constructing or reconstructing a bridge, (ii) preliminary engineering and environmental studies authorized under Minn. Stat. Sec. 174.50, subdiv. 6a, (iii) abandoning an existing bridge that is deficient and in need of replacement, but where no replacement will be made, or (iv) constructing a road to facilitate the abandonment or removal of an existing bridge determined to be deficient.

Grantee will comply with all required grants management policies and procedures set forth through Minn.Stat.§16B.97, Subd. 4 (a) (1).

Asset Monitoring. If Grantee uses funds obtained by this agreement to acquire a capital asset, the Grantee is required to use that asset for a public purpose for the normal useful life of the asset. Grantee may not sell or change the purpose of use for the capital asset(s) obtained with grant funds under this agreement without the prior written consent of the State and an agreement executed and approved by the same parties who executed and approved this agreement, or their successors in office.

3 Time

Grantee must comply with all the time requirements described in this agreement. In the performance of this grant agreement, time is of the essence.

Grantee represents to State that the Sources and Uses of Funds Schedule attached as Exhibit A accurately shows the total cost of the project and all of the funds that are available for the completion of the project. Grantee agrees that it will pay for any costs that are ineligible for reimbursement and for any amount by which the costs exceed State’s total obligation in section 4.1.3. Grantee will return to State any amount appropriated but not required.

4.1.3 Total Obligation. The total obligation of the State for all compensation and reimbursements to Grantee under this agreement will not exceed $444,205.63.

Payment 4.2.1 Invoices. Grantee will submit state aid pay requests for reimbursements requested under this grant agreement.

The State will promptly pay Grantee after Grantee presents an itemized invoice for the services actually performed and the State's Authorized Representative accepts the invoiced services.

4.2.2 All Invoices Subject to Audit. All invoices are subject to audit, at State’s discretion. 4.2.3 State’s Payment Requirements. State will promptly pay all valid obligations under this agreement as

required by Minnesota Statutes §16A.124. State will make undisputed payments no later than 30 days after receiving Grantee’s invoices and progress reports for services performed. If an invoice is incorrect, defective or otherwise improper, State will notify Grantee within ten days of discovering the error. After State receives the corrected invoice, State will pay Grantee within 30 days of receipt of such invoice.

4.2.4 Grant Monitoring Visit and Financial Reconciliation. During the period of performance, the State will make at least annual monitoring visits and conduct annual financial reconciliations of Grantee’s expenditures. 4.2.4.1 The State’s Authorized Representative will notify Grantee’s Authorized Representative where and

when any monitoring visit and financial reconciliation will take place, which State employees and/or contractors will participate, and which Grantee staff members should be present. Grantee will be provided with at least seven calendar days of notice prior to any monitoring visit or financial reconciliation.

4.2.4.2 Following a monitoring visit or financial reconciliation, Grantee will take timely and appropriate action on all deficiencies identified by State.

4.2.4.3 At least one monitoring visit and one financial reconciliation must be completed prior to final payment being made to Grantee.

4.2.5 Unexpended Funds. The Grantee must promptly return to the State at grant closeout any unexpended funds that have not been accounted for in a financial report submitted to the State.

4.2.6 Closeout. The State will determine, at its sole discretion, whether a closeout audit is required prior to final payment approval. If a closeout audit is required, final payment will be held until the audit has been completed. Monitoring of any capital assets acquired with grant funds will continue following grant closeout.

Contracting and Bidding Requirements. If Grantee is a municipality as defined by Minn. Stat. § 471.345, subdivision 1, then Grantee shall comply with the requirements of Minn. Stat. § 471.345 for all procurement under this Agreement.

5 Conditions of Payment

All services provided by Grantee under this agreement must be performed to the State’s satisfaction, as determined at the sole discretion of the State’s Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules, and regulations. The Grantee will not receive payment for work found by the State to be unsatisfactory or performed in violation of federal, state, or local law.

7 Assignment Amendments, Waiver, and Grant Agreement Complete

Assignment. The Grantee may neither assign nor transfer any rights or obligations under this agreement without the prior written consent of the State and a fully executed Assignment Agreement, executed and approved by the same parties who executed and approved this agreement, or their successors in office.

Amendments. Any amendments to this agreement must be in writing and will not be effective until it has been executed and approved by the same parties who executed and approved the original agreement, or their successors in office.

Waiver. If the State fails to enforce any provision of this agreement, that failure does not waive the provision or the State’s right to subsequently enforce it.

Grant Agreement Complete. This grant agreement contains all negotiations and agreements between the State and Grantee. No other understanding regarding this agreement, whether written or oral, may be used to bind either party.

8 Liability

Grantee and State agree that each will be responsible for its own acts and the results thereof to the extent authorized by law, and neither shall be responsible for the acts of the other party and the results thereof. The liability of State is governed by the provisions of Minn. Stat. Sec. 3.736. If Grantee is a “municipality” as that term is used in Minn. Stat. Chapter 466, then the liability of Grantee is governed by the provisions of Chapter 466. Grantee’s liability hereunder shall not be limited to the extent of insurance carried by or provided by Grantee, or subject to any exclusion from coverage in any insurance policy.

9 State Audits Under Minn. Stat. § 16B.98, Subd.8, the Grantee’s books, records, documents, and accounting procedures and practices of Grantee, or other party relevant to this grant agreement or transaction, are subject to examination by the State and/or the State Auditor or Legislative Auditor, as appropriate, for a minimum of six years from the end of this agreement, receipt and approval of all final reports, or the required period of time to satisfy all state and program retention requirements, whichever is later. Grantee will take timely and appropriate action on all deficiencies identified by an audit.

10 Government Date Practices and Intellectual Property Rights Government Data Practices. Grantee and State must comply with the Minnesota Government Data Practices

Act, Minn. Stat. Ch. 13, as it applies to all data provided by the State under this grant agreement, and as it applies to all data created, collected, received, stored, used, maintained, or disseminated by the Grantee under this agreement. The civil remedies of Minn. Stat. §13.08 apply to the release of the data referred to in this clause by either Grantee or the State.

11 Workers Compensation

The Grantee certifies that it is in compliance with Minn. Stat. §176.181, Subd. 2, pertaining to workers’ compensation insurance coverage. The Grantee’s employees and agents will not be considered State employees. Any claims that may arise under the Minnesota Workers’ Compensation Act on behalf of these employees and any claims made by any third party as a consequence of any act or omission on the part of these employees are in no way the State’s obligation or responsibility.

12 Governing Law, Jurisdiction, and Venue Minnesota law, without regard to its choice-of-law provisions, governs this agreement. Venue for all legal proceedings out of this agreement, or its breach, must be in the appropriate state or federal court with competent jurisdiction in Ramsey County, Minnesota.

13 Termination; Suspension Termination by the State. The State may terminate this agreement with or without cause, upon 30 days written

notice to the Grantee. Upon termination, the Grantee will be entitled to payment, determined on a pro rata basis, for services satisfactorily performed.

Termination for Cause. The State may immediately terminate this grant agreement if the State finds that there has been a failure to comply with the provisions of this agreement, that reasonable progress has not been made, that fraudulent or wasteful activity has occurred, that Grantee has been convicted of a criminal offense relating to a state grant agreement, or that the purposes for which the funds were granted have not been or will not be fulfilled. The State may take action to protect the interests of the State of Minnesota, including the refusal to disburse additional funds and requiring the return of all or part of the funds already disbursed.

Termination for Insufficient Funding. The State may immediately terminate this agreement if: 13.3.1 It does not obtain funding from the Minnesota Legislature; or 13.3.2 If funding cannot be continued at a level sufficient to allow for the payment of the services covered here.

Termination must be by written or fax notice to the Grantee. The State is not obligated to pay for any services that are provided after notice and effective date of termination. However, the Grantee will be entitled to payment, determined on a pro rata basis, for services satisfactorily performed to the extent that funds are available. The State will not be assessed any penalty if the agreement is terminated because of the decision of the Minnesota Legislature, or other funding source, not to appropriate funds. The State will provide the Grantee notice of the lack of funding within a reasonable time of the State’s receiving that notice.

Suspension. The State may immediately suspend this agreement in the event of a total or partial government shutdown due to the failure to have an approved budget by the legal deadline. Work performed by the Grantee during a period of suspension will be deemed unauthorized and undertaken at risk of non-payment.

14 Data Disclosure

Under Minn. Stat. § 270C.65, Subd. 3, and other applicable law, Grantee consents to disclosure of its social security number, federal employer tax identification number, and/or Minnesota tax identification number, already provided to the State, to federal and state tax agencies and state personnel involved in the payment of state obligations. These identification numbers may be used in the enforcement of federal and state tax laws which could result in action requiring the Grantee to file state tax returns and pay delinquent state tax liabilities, if any.

15 Fund Use Prohibited. The Grantee will not utilize any funds received pursuant to this Agreement to compensate, either directly or indirectly, any contractor, corporation, partnership, or business, however organized, which is disqualified or debarred from entering into or receiving a State contract. This restriction applies regardless of whether the disqualified or debarred party acts in the capacity of a general contractor, a subcontractor, or as an equipment or material supplier. This restriction does not prevent the Grantee from utilizing these funds to pay any party who might be disqualified or debarred after the Grantee’s contract award on this Project.

16 Discrimination Prohibited by Minnesota Statutes §181.59. Grantee will comply with the provisions of Minnesota

Statutes §181.59 which requires that every contract for or on behalf of the State of Minnesota, or any county, city, town, township, school, school district or any other district in the state, for materials, supplies or construction will contain provisions by which Contractor agrees: 1) That, in the hiring of common or skilled labor for the performance of any work under any contract, or any subcontract, no Contractor, material supplier or vendor, will, by reason of race, creed

or color, discriminate against the person or persons who are citizens of the United States or resident aliens who are qualified and available to perform the work to which the employment relates; 2) That no Contractor, material supplier, or vendor, will, in any manner, discriminate against, or intimidate, or prevent the employment of any person or persons identified in clause 1 of this section, or on being hired, prevent or conspire to prevent, the person or persons from the performance of work under any contract on account of race, creed or color; 3) That a violation of this section is a misdemeanor; and 4) That this contract may be canceled or terminated by the state of Minnesota, or any county, city, town, township, school, school district or any other person authorized to grant contracts for employment, and all money due, or to become due under the contract, may be forfeited for a second or any subsequent violation of the terms or conditions of this Agreement.

17 Limitation. Under this Agreement, the State is only responsible for receiving and disbursing funds. Nothing in this

Agreement will be construed to make the State a principal, co-principal, partner, or joint venturer with respect to the Project(s) covered herein. The State may provide technical advice and assistance as requested by the Grantee, however, the Grantee will remain responsible for providing direction to its contractors and consultants and for administering its contracts with such entities. The Grantee’s consultants and contractors are not intended to be third party beneficiaries of this Agreement.

18 Additional Provisions Prevailing Wages. Grantee agrees to comply with all of the applicable provisions contained in Minnesota Statutes

Chapter 177, and specifically those provisions contained in Minn. Stat.§. 177.41 through 177.435 as they may be amended or replaced from time to time with respect to the project. By agreeing to this provision, Grantee is not acknowledging or agreeing that the cited provisions apply to the project

E-Verification. Grantee agrees and acknowledges that it is aware of Minn.Stat. § 16C.075 regarding e-verification of employment of all newly hired employees to confirm that such employees are legally entitled to work in the United States, and that it will, if and when applicable, fully comply with such order

REQUEST FOR SPEED LIMIT STUDY ON COUNTY ROAD #95

WHEREAS, some Todd County residents have expressed concerns over the appropriateness of the 45 mile per hour speed limit on County Road 95 from County State Aid Highway 11 to just west of 183rd Avenue in Kandota Township, and;

WHEREAS, by Minnesota Statute 169.14, Subdivision 5, local authorities can request the Commissioner of the Department of Transportation to authorize a speed limit on a local (non-trunk highway) roadway.

FINAL PAYMENT AUTHORIZATION – 2019 DUST CONTROL CONSTRUCTION CONTRACT

WHEREAS, the contract with Knife River Corporation for a 2019 Dust Control Construction Contract known as CP 77-19-08 located on various county roads in Todd County in all things been completed, and;

WHEREAS, construction work on this contract was scheduled and completed in 2019 with the value of the total work certified being $94,257.75, and;

WHEREAS, partial payments amounting to $43,899.67 have been previously been made to the contractor as work progressed, and; WHEREAS, it has been determined that $50,358.08 still remains to be paid to Knife River Corporation. NOW, THEREFORE BE IT RESOLVED, that the Board of Commissioners does here accept said completed project for and in behalf of the County of Todd and authorizes final payment as specified.

Hold Harmless Agreement – Ditch Maintenance – County Ditch 7

WHEREAS, Steve Gaugert is requesting to maintain approximately 200 feet of CD7 that is located on his parcel 01-0027600. The maintenance will be done at Steve’s own expense. A Hold Harmless Agreement has been signed and submitted to the Ditch Authority, and;

WHEREAS, an onsite inspection has been done; a Wetland Application has been submitted to the TEP, and;

WHEREAS, the sections of the ditch to be excavated are at the inlets and outlets of his two culverts. He will remove the silt and place it back on his cattle crossing paths.

NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Steve Gaugert to maintain approximately 200 feet of CD7 to repair his cattle crossings, on his own property, at his own expense.

The State of MN is offering a security monitoring program which allows the State and local counties to share costs in security hardware and software, along with providing monitoring services. The program requires a four year service agreement to be signed. Todd County MIS has budgeted for replacement of our security appliances in 2019, and would like to participate in the 4 year program. The State will provide the security appliances and years 1 and 2 of software support. Todd County would be responsible for year 3 software support, which is due upon signing agreement, at $6016.00. The breakdown for additional years would be as follows: Year 2 - no additional costs. Year 3 - security monitoring at $1560. Year 4 - security monitoring and software renewal at approximately $5000. After year four, the service can be discontinued if desired. Todd County would keep the hardware and maintain any software maintenance ongoing. 4. Provide security analysis and incident detection of perimeter security events for city and county entities participating in the SSMI. Analysis activities will include monitoring of the entity network traffic traversing the monitoring sensor(s) against various rules and correlation conditions to identify known and/or potential malicious or suspicious network activity;

5. Coordinate the SSMI program, including grant administration in cooperation with the Department of Public Safety Homeland Security and Emergency Management (DPS/HSEM) Division;

6. Design, implement, and maintain the shared infrastructure procured for Counties as part of the DPS/HSEM grant programs;

7. Provide troubleshooting and Provide diagnostics support to the county for issues directly related to the security appliances procured or provided by the SSMI and or DPS/HSEM grant programs;

8. Provide an annual invoice to all participating county partners to recover the costs of the service. Security monitoring, log management services, analysis and incident handling costs as part of participation in the SSMI are charged at a rate of 10% of the City/County entity’s County Collaboration costs from MN.IT Services;

The County is Responsible to: 1. Participate in the SSMI project, grant administration meetings, and user group forums as

needed; 2. Provide technical resources and information to provide the “best fit” design for security

appliances in the County networks to meet the network security needs of the County and the monitoring and analysis goals of the SSMI project;

3. Assist in the design, implementation, and maintenance of any security appliances provided by MN.IT Services as part of the SSMI project and/or the DPS/HSEM Grant programs;

4. Configure all network security and infrastructure related devices to log activity and alert events to the Log Management and SIEM infrastructures;

5. Host discrete and/or virtual server(s) to aid in the collection and transmission of activity and alert events to the Log Management and SIEM infrastructures;

6. Provide timely feedback and information related to network traffic and/or conditions thought to be suspicious or malicious;

7. Provide rack or mounting space, electrical power, and cooling as needed for security appliances;

8. The County agrees to use State network services and security infrastructures in accordance with state and federal regulations;

Billing acceptance criteria for service: The service is billable to the county partners from the date of January 1, 2021 and may be subject to a 3% increase in vendor cost for support and maintenance. The counties agrees to participate in the program for at least 4 years. After 4 years, if the county wants to end the agreement, they must provide a 30 day written notice of cancelation. The vendor will bill directly to the county for the threat and malware licenses and support and maintenance on the equipment. The State will bill for the security monitoring service, which covers the support and maintenance on the shared county equipment. All costs are identified in the table below. The rates are based upon the current cost recovery schedule. The rates are subject to annual and/or periodic rate adjustments as jointly approved by the State Chief Information Officer and the Commissioner of Minnesota Management and Budget as part of the rate change process. WHEREAS, the Minnesota Department of Human Services (DHS) has published a Request For Proposals (RFPs) to provide health care services to recipients of Families and Children and MinnesotaCare in eighty (80) Minnesota counties, including Todd County, and;

WHEREAS, DHS has requested County evaluations and recommendations regarding the RFP proposals from each respective county, and;

WHEREAS, HMO Minnesota d/b/a Blue Plus, Medica and UCare submitted proposals to provide managed health care services in Todd County, and;
