1. Chillers arrived at site on 26th July 11.
2. Shifting and Placing at the foundation and further installation work is in M/s Service First Aircon scope which was started on 26th July 11.

1. They have not yet submit extension request for commissioning. 2. We have informed them by official letter dtd. 09.06.2012 that there is missing of “Relieve Valve” & no person
present at site from their end. 3. They submit a reply letter on 18.12.2012 informing their responsibility is over for safe custody as commissioning
date is not informed to them. 4. A legitimate reply from MMC given on 23.06.2012 referring contractual clauses. 5. Official mail serve to them for necessary extension of BG. 6. They reply their inability 7. 2nd reminder also send to them for the same, no feedback came.

1. LOA dated 14th Dec 2010 (Ref: TRIFAMPPL/Trane/Chillers/02) Clause no. 10 Performance Bank Guarantee which clearly states that “Nominated Supplier shall continue to extend the validity of the Performance Security until the issuance of Performance Certificate”
2. LOA dated 15th Dec 2010 (Ref: TRIFAMPPL/Service First Aircon/Chillers/01) Clause No. 3.3 Performance Bank Guarantee which states that the PBG should be valid through the defects notification period of 1 year with claim period of 21 days.
Based on the above references and conditions of contract, you are requested to kindly extend the PBG accordingly. Hope this is in line with your requirement.
