The following employees are exempt: outside sales; teachers working at a private elementary or secondary academic institution (kindergarten through 12th grade) and earning a monthly salary of no less than two times the state minimum wage for full time employment; certified nurse midwives, nurse anesthetists, and nurse practitioners who are primarily engaged in performing duties for which their certification was required; employees engaged in an executive, administrative, or professional capacity, and who earn a monthly salary equivalent of no less than two times the state minimum wage rate for full-time employment; and licensed physicians or surgeons who are primarily engaged in performing duties for which their licenses are required if they are paid at least $84.79 effective 1/1/2020. Employees employed in a medical internship or resident program or physicians covered by a valid collective bargaining agreement are excluded.
