    TRICKLE IN Water Project Terms and Conditions

    Ebenezer A IDP Camp

    Kikopey, Kenya

    Project Summary

    The Trickle In Water Project was initiated on March 1, 2010. The project provides a

    point of access to water for the Ebenezer A and Ebenezer IDP Camps and thesurrounding Kikopey area. Water will be sold at a fair price from a kiosk erected on the

    Ebenezer Camps common grounds. Proceeds from the sale of water will trickle in to

    the Ebenezer A Camp Development Fund for the use in the betterment of the campcommunities.

    Project Specifications

    The project connects the main Kikopey water line to a water access point at the Ebenezer

    IDP Camp common grounds. No obstructions, disturbances, or diversions will be

    permitted unless jointly agreed upon by the Ebenezer A Camp Officials and KikopeyWater and Sanitation Services Provider.

    Proprietorship

    Ebenezer A Camp retains proprietorship of the pipes, fixtures, and kiosk used in thediscussed water project.

    By retaining proprietorship, Ebenezer A Camp agrees to maintenance and service theproject.

    Provision of Water

    The Gilgil Town Council in conjunction with the Kikopey Water and Sanitation Services

    Provider agrees to provide water to the Ebenezer water kiosk based on the same rights

    and regulations designated for domestic/commercial/kiosk use (_______ initials.)

    The Kikopey Water and Sanitation Services Provider certifies the Ebenezer water project

    and kiosk.

    Water will be provided to the kiosk at a rate of 3 shillings per 20 litres, and 4 shillings per

    30 litres.

    Water usage will be tracked by a meter. Payment of water is based upon the above stated

    rate by the usage as indicated on the meter. Payment will be collected by the Kikopey

    Water and Sanitation Services Provider on a ___________ basis (_______ initials).

    Trickle In Water Sales Stipulation

    Water will be sold from a registered kiosk at a rate of 1 KSH per 20 litres above the

    required rate of payment for water per 20 litres to the Gilgil City Council. Proceeds fromthe sale of water will be deposited into the Ebenezer A Community Fund designated for

    community development projects. The use of the funds will be managed by the Ebenezer

    A Camp Committee per the guidelines that govern the Community Fund.

    Kiosk Operation

    Management and operation of the water kiosk and water sales will be overseen by the

    Ebenezer A Camp Officials.

    Management and operation of the water kiosk and water sales will be guaranteed to a

    member of the Ebenezer A Camp unconditionally. No outside member will be granted

    the position of management and/or operation.

    The Gilgil Town Council will provide the salary for operation the water kiosk at the rate

    provided to similar positions. The salary will be divided amongst the kiosk operators

    proportionate to each operators work hours.

    The operators of the water kiosk and water sales will be the elected Ebenezer A Camp

    Officials. Any changes or additions to the designated operators will be agreed upon bythe Ebenezer A Camp Officials.

    Operation Requirements

    Hours of operation of the water kiosk and water sales will be determined by the Ebenezer

    A Camp Officials, the above stated designated management and operators of the kioskand sales. Hours of operation will be determined according to the hours of provision ofwater and to the need of the community members.

    Daily Requirements

    1. Upon opening the kiosk for operation, the meter will be read and recorded, alongwith the time of the reading.

    2. Upon closing the kiosk for operation, the meter will be read and recorded, along

    with the time of the reading.3. The amount of fees collected during operation will be recorded along with the

    closing meter reading.

    4. The operator will sign his or her name indicating the operators work hours.

    If a change in the operator occurs within the same day, opening and closing requirements

    will be repeated for each respective operator.

    If a closing and reopening of the kiosk occurs within the same day, opening and closing

    requirements will be repeated for the respective hours of operation.

    Phase II forecasting

    The discussed water project is the first stage to the development of larger water

    infrastructure project. The status of the larger water infrastructure is in its initial

    surveying stage. Ebenezer A Camp (the above stated proprietors of the pipes, fixtures,and kiosk) agrees that upon development of the larger water infrastructure, the pipes and

    kiosk used in the first stage water project will be incorporated into the larger

    infrastructure while retaining proprietorship of the original stated materials.

    TRICKLE IN WATER PROJECT BY-LAWS

    1. Members of the Ebenezer Camps and surrounding area are entitled to buy water.

    2. Every member is required to pay unconditionally the advertised price per litre.

    3. Sale of water is on cash basis at the time of purchase. No exceptions will beallowed.

    4. The management, e.g. the Ebenezer A Camp Committee, will ensure, fair,

    adequate, and timely supply of water to every stakeholder.5. Any aggression, incitement, or disagreement in contraversion water supply is

    strictly prohibited.

    The Trickle In Water Project is a joint effort of the Ebenezer A Camp Officials,Chairman Samuel Muhia Kihuga and Secretary John Mwangi Kimani, Kikopey Water

    and Sanitation Services Provider, Chairman John Waweru Macharia and Secretary

    Francis Maina Mwangi, and the Waldroup Family Giving Group as represented byRobin C Waldroup. Special thanks is given to all who have contributed their efforts to

    this project.
