NOTE BY THE SECRETARIAT
Under Article 102 of the Charter of the United Nations every treaty and every international agreement en-tered into by any Member of the United Nations after the coming into force of the Charter shall, as soon as possi-ble, be registered with the Secretariat and published by it. Furthermore, no party to a treaty or internationalagreement subject to registration which has not been registered may invoke that treaty or agreement before anyorgan of the United Nations. The General Assembly, by resolution 97 (1), established regulations to give effect toArticle 102 of the Charter (see text of the regulations, vol. 859, p.,VIII).
The terms "treaty" and "international agreement" have not been defined either in the Charter or in the regu-lations, and the Secretariat follows the principle that it acts in accordance with the position of the Member Statesubmitting an instrument for registration that so far as that party is concerned the instrument is a treaty or an in-ternational agreement within the meaning of Article 102. Registration of an instrument submitted by a MemberState, therefore, does not imply ajudgement by the Secretariat on the nature of the instrument, the status of a partyor any similar question. It is the understanding of the Secretariat that its action does not confer on the instrumentthe status of a treaty or an international agreement if it does not already have that status and does not confer on aparty a status which it would not otherwise have.
Unless otherwise indicated, the translations of the original texts of treaties, etc., published in this Series havebeen made by the Secretariat of the United Nations.

Le Secretariat consid~re donc queles actes qu'il pourrait &tre amend A accomplir ne conf~rent pas A un instrument la qualit& de «< traitd > ou d'(< accordinternational >> si cet instrument n'a pas ddjA cette qualitd, et qu'ils ne conferent pas A une partie un statut que, parailleurs, elle ne possdderait pas.

AMENDED TEXT OF ANNEX XII TO THE CONVENTION ON THE PRIVI-LEGES AND IMMUNITIES OF THE SPECIALIZED AGENCIES
Annex XII
1. The privileges and immunities, exemptions and facilities referred to in article VI,section 21 of the standard clauses shall be accorded to the Secretary-General of the Orga-nization, to the Deputy-Secretary-General and to the Secretary of the Maritime SafetyCommittee and to the Directors of the Administrative Division, the Technical Co-operationDivision, the Legal Affairs and External Relations Division, the Conference Division andthe Marine Environment Division, provided that the provisions of this paragraph shall notrequire the Member in whose territory the Organization has its Headquarters to apply arti-cle VI, section 21 of the standard clauses to any person who is its national. If the Organi-zation changes the titles of any of the Director posts at any time, the holders for the timebeing of such posts shall continue to be accorded the privileges and immunities, exemptionsand facilities referred to in this paragraph.
