TRATON HEADLINE: Traton Homes Covenants

Worthless to Protect Homeowners

In a case that was decided by the Georgia Court of Appeals, the

attorneys for Traton Homes successfully argued that a homeowner had

no right to prevent others from damaging the right-of-way that is

adjacent to the home. Even though, as the picture below shows, the

right-of-way is a non-trivial, 13-foot-wide perimeter of the yard.

In considering the issue, Traton Corp. argued that its own covenants

could not require the homeowner to maintain that large right-of-way,

even though the right-of-way forms a part of the yard. The Court of

Appeals agreed, stating:

The covenants merely require Moses and other Lotowners to maintain their Lots, and neither Moses'sLot nor any other owner's Lot includes the rightof way.

According to the Appellant in the action:

This decision affects every homeowner in a covenantedneighborhood, and not only those in Traton Homesdevelopments. Traton's attorneys stated, in no uncertainterms, that a homeowner need not maintain that 13-foot-

wide portion of the yard, and the Court surprisinglyagreed. So, any renegade homeowner can leave the right-of-way portion of his yard in disarray, and thehomeowners' association can't do a thing about it. Evenif it detrimentally affects the value of their homes.

I am puzzled whyTraton Homes would want to devaluetheir property by arguing that their covenants are

worthless. I mean, this affects all of Traton Homes' newdevelopments as well as their established developments.

I'm curious to see how they're going to sell houses,especially when potential buyers find out that they arepurchasing a home with a worthless covenant.

While this particular case involved a home in the Lakefield Manorsubdivision, the
