Chapter 1Scope and AdministrationChapter 1 has historically been re-written by Kentucky so as to address Kentucky specific needs and interests regarding building construction and code application.

The 2013 KBC follows the same formatting as the 2012 IBC.

Many of the KY amendments to Chapter 1 is code text carried forward from the previous edition and many you have seen since the1980 edition of the KBC. However, there are a few new sections we will review.

The underscored language is not new to the code but is new to the KBC. The 2013 KBC no longer deletes this text. The new language extends the codes intent beyond that of establishing safeguards for the public and building occupants.

It extends application to the protection of our fire fighters and first responders during any emergency operation and event. 2007 KBC2013 KBC

Section 101.3 PurposeIBC text was deleted as an amendment to create this section in the 2007 edition.New text added via IBCSection 101.3 Intent. The purpose of this code is to establish the minimum/maximum requirements and safety to life and property from fire and other hazards attributed to the built environment and to provide safety to fire fighters and emergency responders during emergency operations. 4

SECTION 106FLOOR AND ROOF DESIGN LOADS

106.1 Live loads posted. Where the live loads for which each floor or portion thereof of a commercial or industrial building is or has been designed to exceed 50 psf (2.40 kN/m2), such design live loads shall be conspicuously posted by the owner in that part of each story in which they apply, using durable signs. It shall be unlawful to remove or deface such notices.

106.2 Issuance of certificate of occupancy. A certificate of occupancy required by Section 111 shall not be issued until the floor load signs, required by Section 106.1, have been installed.

KRS 322ENGINEERS LAW322.360 Public work required to be done under professional engineer or licensed architect.

Neither the state nor any of its political subdivisions shall engage in the construction of any public work involving engineering, unless the plans, specifications, and estimates have been prepared and the construction executed under the direct supervision of a professional engineer or a licensed architect.Subsection (1) of this section shall not apply to any public work, including a highway or capital project under KRS 56.491, that involves only maintenance or repair of the facility. Maintenance or repair shall not include any work which alters, modifies, or changes the original characteristics of the design.

KRS 323ARCHITECTS LAW323.033 Buildings requiring services of licensed architect.

(5) Neither the state nor any of its political subdivisions shall engage in theconstruction of any public work involving the practice of architecture orengineering unless the plans, specifications, and estimates have been prepared and the administration of construction contracts executed under the direct supervision of a licensed architect or a professional engineer. This subsection shall not apply to:

(a) Any public work, including a building or capital project under KRS 56.491, that involves only maintenance or repair of the facility. Maintenance or repair shall not include any work which alters, modifies, or changes the original characteristics of the design; or

(b) Any residential dwelling that falls under the Kentucky Residential Code.

Chapter 3Use and Occupancy ClassificationChapter 3 establishes the occupancy classification, single occupancy or mixed occupancy, which is necessary to apply many of the requirements of the code.

317.2 Rooftop garden or landscaped roof size. shall not exceed 15,625 square feet in size for any single area with a maximum dimension of 125 feet in length or width. A minimum 6-foot-wide clearance consisting of a Class A rated roof system complying with ASTM E 108 or UL 790 shall be provided between adjacent rooftop gardens or landscaped roof areas. 317.3 Rooftop structure and equipment clearance. For all vegetated roofing systems abutting combustible vertical surfaces, a Class A-rated roof system shall be achieved for a minimum 6-foot-wide continuous border placed around rooftop structures and all rooftop equipment 317.4 Vegetation.
