Subject: DEPARTMENTAL APPEAL AGAINST THE ORDER NO. SO(CE-I)20-2/08 DATED 06-07-2010 UNDER SECTION 16 OF PEEDA ACT, 2006.
Respectfully submitted, That the appellant has been working in Higher Education
Department Since 1987. I was transferred and posted as Deputy Director
(Admn), in Lahore Arts Council on deputation basis. I continued working as
such till 30-11-2008, when my deputation period came to an end and
consequently I submitted my joining report to the defendant No. 1 on 04-12-
2008, I was waiting for my posting order and I visited education department
many times but posting orders were never delivered to me. It is important to
mention here that it was myself who requested the defendant No. 1 on 04-05-
2010, to issue my posting orders. On 10-05-2010 I received the posting orders
from the Education department which were issued on 02-01-2009, and then I
requested the defendant No. 1 on 10-05-2010 to direct the principal Govt.
Degree College, Hafizabad to let me join my services (the application attached
along with other documents). But surprisingly I received a show cause notice
dated 21-05-2010 reflecting me absent from duty since 02-01-2009. I
submitted my written reply to the defendant No.1 by stating that there is no
evidence that the posting orders were delivered to me. The defendant No. 1
did not took to my submission and passed the impugned orders in arbitrary
manner deviating from the principal of natural justice. The impugned order is
based on hypothetical presumption. Service of posting order in Govt. Degree
College, Hafizabad was never affected upon me to the lawful norms in vogue.
Therefore the impugned is not maintain able and is defective in the eyes of
law, not supported by substantial evidence. Thus the impugned orders are
liable to be set aside interalia on following grounds.
I. It is submitted by the defendant No. 1 that I reported to defendant No.1 upon termination of my deputation period. In December 2008. There is no communication on record that the appellant was served with any sort of letter notice / order prior to passing the impugned order. Thus the impugned order is defective to section 9&10 of civil procedure code (case laws referred A 1993 A 165, A 1918 L 59, A 1952 C 781, 1990 MLD 1028).
II. Dispensation of enquiry by the defendant No. 1 I is arbitrary and with malafide intention. Discretion has been exercised without cogent reasoning. Imposition of major penalty of the basis of a hearsay version regarding communication of the impugned order is fatal to my service rights. It also lacks any proportion in the eyes of law and is liable to be dismissed (reliance is based on NLR 1987 civil 341 and PLD 1959. 48; DLR 1958 DAC 481 and AIR 1981 SC 818).
III. The principal of natural justice requires that every person whose civil rights are affected must have a reasonable notice of the case he has to meet. (Reliance his made on P L D 1958 PESH; 1959 (1) 1243.
2. Keeping in view the Foregoing facts it is humbly prayed that as the
impugned order is based on hearsay version regarding the communication
of my posting orders. There is no evidence on record that the posting
orders were delivered to me.
3. I beseech your honor to have mercy upon me and connive at my
mistake if any. I submit my unconditional apology.
4. I therefore, request your benevolent honor to reinstate me in service
and issue my posting orders. I shall be everlastingly grateful to you.
