    VICTORIAN HOSPITAL

    The Interior Health Authoritys decision to reduce emergency

    services to Kaslo will only result in hardship to the members of that

    community, and those members who live in outlying communities

    which are serviced by Kaslo.

    Contrary to The Ministry of Healths strategic goal #3, which

    speaks to accessibility of timely, safe, and appropriate hospital

    services that support the needs of the patients and their families,

    he IHAs decision to reduce services at the Victorian Hospital in

    Kaslo will do exactly the opposite.

    Losing the emergency services in Kaslo will reduce the ability to

    riage and stabilize patients with medical emergencies. The loss of

    hese services will result in patients having to travel to Nelson, by

    either private vehicle or the provincial ambulance service. Those

    patients may then require more critical intervention and the delay

    n providing service may result in increased complications and

    deaths.In light of the negative impact to our families and communities, I

    urge the IHA to look at all models of care, including the use of

    Nurse Practitioners, promotion of Nurse First Call and Remote

    Nursing Practice Certification for RNs, in order to maintain 24/7

    services in Kaslo.

    New law turns shacked-up lovers into married

    Law Actcame into force March 18, 2013.

    These days, many more couples choose to live

    together for the long term than get married.

    The need to better deal with this new reality,

    and the fallout when some of these common-

    law relationships inevitably end, is one reason

    for the new law.

    Also, family law disputes often took up heapsof court time. The new law recognizes that the

    bitter Ill see you in court! approach is often

    not the best way to go.

    If you have children, its particularly impor-

    tant that you have a civil relationship with

    your ex-partner long after you separate. The

    QHZODZUHHFWVWKDWLWPD\EHEHWWHUWRWU\

    to work through family break-up issues. It

    encourages mediation, getting the help of a

    parenting co-ordinator and negotiated agree-

    ments instead of going to court.

    But the biggest change and the one that

    prompted the dramatic headlines has to do

    with the splitting of assets and debts after a

    break-up.

    Before, if you lived in a marriage-like rela-

    tionship for two years or more, you could

    But when it came to property like the fam-

    ily home, the situation was different. Marriedcouples generally got one-half of the family

    assets, no matter which spouse owned them

    (though the court could order a different

    split). Common- law partners, though, even

    LIWKH\FRQWULEXWHGWRWKHUHODWLRQVKLSQDQ -

    cially or by looking after the children, faced

    an uphill court battle to try and get a share in

    property owned by the other.

    Now, if youve been living common-law for

    two or more years, the law treats you the

    same as a married person for dividing up your

    property and debts. Family property is now

    GLYLGHGHTXDOO\XQOHVVWKDWZRXOGEHVLJQL -

    cantly unfair. You have up to two years after

    breaking up to make a claim.

    But for both married and common-law cou-

    ples, the new law excludes certain property

    from being split equally. Basically, you get tokeep whats yours if you owned the property

    beforehand. Also, a gift or inheritance (or

    things bought with that money), or insurance

    money or personal injury compensation spe-

    ship generally stays with you and isnt carved

    up between you and your ex-partner only

    its increase in value during the relationship

    is shared.

    If you dont want the new laws property rulesto apply, you can agree with your partner to

    opt out (by a written agreement) and divide

    a break-up.

    It may make a lot of sense, well before the

    two-year common-law milestone is reached,

    and debts in case you separate.

    The new law deals with many other thingslike giving notice if you want to move with

    your kids, parenting arrangements, family law

    protective orders and more. Seek good legal
