Commission Regulation (EC) No 669/2009 on increased level of official controls on imports of certain feed and food of non-animal origin
Background: E U Commission Regulation 669/2009 sets out the specific rules goveming the importation, into the E U , of certain food and feed products, classified as presenting additional risks to the food chain, and lists the particular food and feed products involved. These controls came into effect on 25* January 2010.
The list of products (Annex I to the Regulation) can be added to or deleted from on a quarterly basis by the European Commission. The product currently in Annex I that is of relevance to animal feed is groundnuts for feed imported from Argentina, Brazil, Ghana, India and South Afi ica - Regulation (EU) No. 433/2011. With effect fi-om 01 October 2011 feed additives and premixtures from India will be added to Annex I - Regulation (EU) No 799/2011.
Procedure As an importer of feed you are advised that if you propose to import any of the listed products from the countries of origin stated you must comply with the following procedures:
(i) . import the products via Dublin seaport, which is the designated point of entry (DPE) for the import of feed products listed in Annex 1;
(ii) . submit a prior notification of the importation (copy enclosed) to the Department of Agriculture, Fisheries and Food (DAFF), along the lines of the form currentiy being used by importers of feed materials, at least 5 days prior to the arrival of the consignment;
(iii) . complete a Common Entry Document form (CED) for each consignment being imported and submit it at least 1 day prior to the arrival of the consignment; (the form is attached to the above Regulation);
(iv) . refrain from splitting the consignments until all of the official controls have been carried out at the port of entry and the C E D form has been endorsed by D A F F ; and
(v) . arrange sufficient human resources and logistics to facilitate the unloading of the consignment in order for the official controls to be carried out. This wi l l only be necessary i f the consignment has been selected by D A F F for physical checks and sampling.
A l l consignments of the listed feed products will be detained by Custom officials at Dublin seaport until DAFF officials have carried out the required checks. A documentary check will be carried out on all consignments and an identity and physical check (including sampling and analysis) will be carried out on a certain percentage of the consignments at the frequency specitled in /\nnex I. In the case of consignments selected for documentary check only, these consignments can be released into free circulation once D.4FF confirm to the Revenue's Customs Service that the documentary checks are in order. However, consignments selected for physical checks cannot be released into free circulation until the analysis results indicate the sample is in compliance with the reievant thresholds.
Fee: The Commission Regulation allows Member States to recoup any additional costs incurred in the carrying out of the controls.
Failure to comply with the requirements set out above wil! be regarded as a breach of European Communities Food and Feed Hygiene Regulations 2009 (SI 432 of 2009).

THE COMMISSION OF THE ELtROPEAN COMMUNITItS,
Having regard to the Treaty establishing the European
Communi ty ,
Having regard to Regulation (EC) N o 882/2004 o f t h e European
Parliament and of the Counci l of 29 A p r i l 2004 on official
controls performed to ensure the verification of compliance
wi th feed and food law, animal health and animal welfare
rule,'; ("'), and in particular Article 15(5) and .Article 6.1(1)
thereof,
Having regard to i^eguiation (EC) N o 178/2002 o f t h e European
Parliament and of the Counci l of 2$ January 2002 laying down
the general principles and requiretitents of food law, establishing
the European Food Safety Autho i i ty and laying down
procedures in matters of food safety ('), and in particular
Article 53(1),
Whereas:
(1) Regulation (EC) No 882 /2004 establishes a hamionised
frainework of general rules for the organisation of official
controls at Communi ty level, including official controls
on the intri)duction of food and feed f rom third coun
tries. In ,tddition, it provides for a list to be drawn up of
feed and food of non-animal origin that is on the basis
o f a knowm or emerging risk to be subject to an
increased level of off ic ia l controls at the point o f etitry
into the territories referred to in Atmex I thereto (the
list). .Such an increased level of control should allow,
on the one hand, the known or emerging risk to be
countered more effectively, and, on the other hand, the
collection of accurate monitoring data on the occurrence
and prevalence o i unfavourable results f rom laboratory
analysis.

f4) Rcgtilation (EC) N o 882/2004 provides that Member
States are, tor the organisation of the increased level of
controls, to designate particular points of entry which
have access to the appropriate control facilities for the
different types of feed and food. Accordingly, it is appro-
piiate to set out in the present Regulation min imutn
requirements for designated points of entry in order to
ensure a degree of ui i i fonr i i ty in the effectiveness o f the
controls.
(5) Regulation (EC) N o 882 /2004 prowdes that Member
States are, for the organisation of the increased level o f
controls, to require .feed and food business operators,
responsible for consigmnents, to give prior notification
of the arrival and nature o f such consignments. Accord
ingly, a model fo rm t)f c o m m o n entry- document (CED)
should be laid down tor impotts of feed and food of
non-animal origin covered by this Regulation, in order
to ensure a un i fo rm approach throughout the
Community , The CED should be made available to the
custotns authorities when consignments are declared fo r
the release for free circtdation.
((5) In addition, in order to ensure a certain level of
uniformity at Communi ty level wi th regard to the
increased level of official controls, it is appropriate to
lay down in this Regulation that those controls should
cover documentary, identity and physical checks.
(7) Adequate financial resources should be made available
for organising the increased levels of official controls.

Ul (CAS number 85-86-9) or Sudan IV (85-8 3-6), Since
the adoption of those measures, the frequency of the
notifications to the RASFF has decreased, which
indicates a signii'icant improvement in the situation a.s
regai-ds the presence of Sudan dyes in relevant
products. It is therefore appropriate to discontinue the
retiuirement to provide the analytical report for each
consignment ot imported products laid down io
Decision 2005 /402fEC and to establish instead a
imi form, increased level of controls on those
consignments at the point of entry into the Communi ty .
Decision 2005 /402 /EC should therefore be repealed.
(9) Commiss ion Decision 200t)/504;EC of 12 juiy 2006 on
special conditions goveming certain foodstuffs imponed
f rom certain third countries due to contamination risks
of these products by aflatoxins ('), provides tor an
increased frequency o f controls (50 % of all consign
ments) to be carried for the presence of atlatcmns in
peanuts oiiginating f rom Brazil . Since the adoption o f
those measures, the frequency of the notifications to
the RASFF i n relation to arlatctins in peanuts f rom
Brazil has decreased. It is therefore appropriate to
discontinue the measures provided for in Decisictn
2006/504 as regards such commodities, which should
instead be subject to a uni form, increased level of
controls at the point o f entr>' into the Communiry.
Decision 2006 /504 /EC should be amended accordingly.
(10) The application of the m i n i m u m requirements for
designated points o f entry may present practical
difficulties for the Member States. Therefore, this Regu
lation should provide for a transitional period during
which those requirements may be progressively imple
mented. .Accordingly, the competent authorities in the
K'fember States should be allowed, during that transi
tional period, to carry out the required identity and
physical checks at control points other than the
designated point o f entry. In those cases, such control
points should comply with the m i n i m u m requirements
for designated points o f entry set out in this Regulation.
(11) The measures provided for in this Regulation are in
accordance with the opin ion of the Standing
Committee on the Food Chain and Animal Health,
HAS ADOPTED THIS REGULATiON:

Subjec t mat ter
This Regulation lays down rules concerning the increased level
o i ofticial controls to be carried out pursuant to Articie 1 5(5) of
Regulation (EC) No SS2/2004 at the piMiits of entry into die
territones referred to Annex { thereto, on imports of the feed
and food of non-animal origin listed in Arjnex I to this Regu
lation.
Article 2
Updates t o A n n e x I
In order to set up and regularly amend the list in .Annex I, at
least the fo l lowing sotirces of information shall be taken into
account:
(a) data resuking f r o m notifications received through the
RASFF:
(b) reports and information resulting f rom the activities of the
Food and Veterinary Office;
(c) reports and information received f rom third countries;
(d) intTirmation exchanged between the Commiss ion and
Member States, and the European Food Safety .Authority;
(e) scientific assessments, where appropriate.
The list in Anne.x 1 shall be reviewed on a regular basis, and at
least quarterly.
Articfe 3
Definitions
For the purposes of this Regulation, the fo l lowing definitions
shall apply:
(a) ' common entry document (CED)' means the document to be
coinpleted by the feed and food business operator or its
representative as provided for in .Article 6, a model of
which is set out in Annex 11, and by the competent
atithority conf i rming complet ion of official controls;
(b) 'designated point of entry (DPE)' means tbe point of entry
provided for in the first indent o f .Article 17(1) of Regu
lation (EC) N o 882/2004, into one o f the territories referred
to in .Annex 1 thereto; in cases of consignments arriving by
sea, which are unloaded for the purposes of being loaded on
another vessel for onwards transportation to a port in
another Member State, the tiesignated point of entry shall
be the latter port;
(c) •consignment" means a quantity of any of the feed or f ood
of non-animal origin listed in Annex; I tit this Regulatio.n of
the same class or description, covered by the same doci i -

coming f rom the same third country or part of such
Counrry.

consignment) in appropriate conditions during the period
of detention, where appropriate, awaiting the results of the
analysis referred to in point (c), and a sufficient number of
storage rooms, including cold stores, in cases where a
controlled temperature is required due to the nature of
the consignment;
However, a Member .State may consent to c o m m o n entry
documents being dr.twn up in another ofi icial language of the
Ciommiiititv.
Article H
Increased level of o f f i c i a l controls at designated points o f
en t ry
1. The competent aulhority at the designated point of entry
shall c a m ' out without undue delay:
(a) documentary checks on all consignments within 2 working
days f rom the time of arrival at the DPE, unless exceptional
and unavoidable circumstances arise;
(e) unloading equipment and appropriate equipment
carrying out sampling for analysis;
for
(f) the possibility to perform the unloading and the sampling
for analysis in a sheltered place, where appropriate;
(g) a designated laboratory which can perform the analysis
referred to in point (c), situated at a place to which the
samples can be transported within a short period of time.
Artide 5
List o f designated points o f e n t r y
Tlie Member States shall maintain and inake publicly available
on the Internet for each of the products listed in .Anne.K 1 an up-
to-date list of the designated points o f entry. The Member Stares
shall communicate the Internet addresses of these lists to the
Commiss ion .
(b) identity and physical checks, including laboraton..' analysis,
at the frequencies set out in Annex [, and in such a way that
it is not possible for feed and food business operators or
their representatives to predict whether any particular
consignment w i l l be subjected to such checks; the results
of physical checks must be available as soon as technically
possible.
2. After complet ion of the checks provided for in paragraph
1, the competent authority shall:
(a) complete the relevant part of Part 11 of the c o m m o n entry
document; and the responsible official of fhe competent
authority shall stamp and sign the original of that
document:
The Commiss ion shall display the national links to those lists
on the Commission's website, for information punposes.
(b) make and retain a copy of the signed and stamped c o m m o n
entrv document.
Article 6
P r i o r n o t i f i c a t i o n o f cons ignments
Feed and food business operato.'-s or their .representatives shall
give adequate prior notification of the estimated date and time
of physical arrival of the consignment at the designated point o f
entry and o f the nature o f the consignment.
For that purpose, they shall complete Part I of the common
entry document and transmit diat documen; to ihe competeni
authority at the designated point of entry, at least one working
day prior to the physical arnval o f the consignment.
The original of the c o m m o n entry document shall accompany
the consignment on its onward transport until it reaches its
destination as indicated in the C E D .

Article 9
Spec ia l c i rcumstances
1. O n request of the Member State concerned, the
Commiss ion may authorise the competent authorities of
certain designated points of entiy operating under specific
geographical constraints to carrv out physical checks at the
premises of a feed and food business operator, provided that
the fo l lowing conditions are .met:
(a) the ctficiency ot controls canied out at the DPE is not
adversely affected;
entry document or its electronic equivalent duly completed by
the competent authority once all controls required in
accordance with Article S(l) have been carried out and
tavourable results (mm physical checks, whe.'-e such checks
are .•"equired, are known.

O b l i g a t i o n s o f feed a n d f o o d business opera tors
In cases where the special characteristics o f the consignment so
warrant, feed and food business operator or their representative
shall make available to the competent authority:
(b) the premises fu l f i l the requirements indicated in Article 4, as
relevant, and are approved i'or that purpose by the Member
State;
(c) appropriate arrangements are in place to guarantee that the
consignment remains under the continuous control of the
competent authorities of the DPE as f r o m the moment of its
aiTival at the DPE and cannot be tampered with in any
tnanner throughout all cheeks.
2. By derogation to Article 8(1), under exceptional c i rcum
stances, the decision to list a new product in Annex I may
provide that identity and physical checks on consignments of
that product can be cairied out by the competent authority of
the place of destination as indicated in the CED, i f appropriate
at the premises of the feed and food business operator i f the
conditions laid down in paragraph 1 (b) and (c) are satisfied,
provided that the fo l lowing conditions are met:
(a) the highly perishable nature of the product or the specific
characteristics of the packaging are such that the
performance of sampling operations at the DPE would
inevitably result in a serious risk to food safety or in the
product being damaged to an unacceptable extent;
(b) appropriate cooperation arrangements ,rre put in place by
the competent authorities at the DPE and the co.mpetent
authorities pertbnning the physical checks to ensure that:
(i) the consignment cannot be tarnpe.'ed with in any
manner throughout all checks;
iii) the reporting requirements laid down in Article 15 are
iuilv met.

Release f o r f ree c i r c u l a t i o n
(a) sufficient human resources and logistics to unload the
consignment, in tirder that the official controls may take
place;
(b) the appropriate equipment for sampling for analysis as
regards special transport and/or specific packaging fonns,
insofar as such sampling cannot be representatively
performed with standard sampling equipment.
Article 12
S p l i t t i n g o f cons ignmen t s
Consignments shall not be split unti l the increased level o f
official controls has been completed, and the c o m m o n entry
document has been completed by the competent authority as
provided for in .Article 8.
In the case of subsequent splitting of the consignment, an tiuth-
endcated copy o f the c o m m o n entry document shall
accompany each part o f the consignment until it is released
for free circulation.
Artide 13
N o n - c o m p l i a n c e
If the off icial controls establish non-com.pliance, the responsible
official o f the competent authority shall complete Part HI o f the
common entiiy document and action shall be taken pursuant ro
Articles 19, 20 and 2 i o fRegu la t i on (EC) N o 882/2004.

consignment or their representatives shall pay the fees
rel'erred to in paragraph 1.
Arride 15
R e p o r t i n g to the C o m m i s s i o n
1. Member States shall submit to the Commiss ion a report
on consignments, for the purposes o f a continuous assessment
of the feed and food of non-animal origin listed in Annex 1.
That report shall be submitted quarterly by the end o f the
month fo l lowing each quarter.
2. The report shall include the fo l lowing information:
(a) details of each consignment, including:
(i) the size in terms o f net weight of the consignment:
(ii) the country o l origin of each consignment;
(b) the number of consigmnents subjected to sampling im
analysis;
(c) the results of the checks as provided for in .Article 8(1);
3. The Commiss ion shall compile the reports received
pursuant to paragraph 2 and make them available to the
Member States.
Artide 16
Amendment to Decision 2006/504/EC
Decision 2006/504/EC is amended as follows:
1. in Article 1, point (a) (iii), (iv) and (v) are deleted,
2. in Article 5, paragraph 2 (a) is replaced by the fol lowing:
'(a) each consignment of foodstuffs f r o m Brazil ' .
3. in Article 7, paragraph 3 is deleted.
Article 17
Repeal o f Decision 2005/402/EC
Commiss ion Decision 2005/402/EC is repealed.
Artide IS
Applicability
This Regulation shall enter into force on the 20th day fo l lowing
its publication in the Official Joumd oj the European Union.
It shall apply f rom 25 January 2010.
Artide 19
T r a n s i t i o n a l measures
1. For a period of five years f rom the date of entry into force
of this Regulation, where a designated point o f entry is not
equipped with the facilities required to cany out physical
checks as provided for in /Vrticle 8(l)(l5), those cheeks may be
cairied out at another point of control in the same Member
State, tiuthorised for that purjjose by the competent authority,
before the goods are declared for release for free circulation,
provided that such control point complies wi th the min imum
requirements laid down in Article 4.
2. Member States shall tnake publicly available, by electronic
publication on their website, a list of the control points auth
orised in accordance wi th the first paragraph.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

official controls on imports of certain feed and food of non-animal origin

THE EUROPE.\N COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 .April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules ('), and in particular Anicle 15(5) thereof.
Whereas:
(1) Commission Regulation (EC) No 669/2009 (') lays down rules conceming the increased level of official controls to be carried out on imports of feed and food of non-animal origin listed in Annex I thereto ('the list), at the points of entry into the territories referred to in Annex 1 to Regulation (EC) No 882/2004.
il) .\rticle 2 of Regulation (EC) No 669/2009 provides that the list is to be reviewed on a regular basis, and at least quarterly, taking into account at least the sources of information referred to in that Article.
0) The occurrence and relevance of food incidents notified through the Rapid .\lert System for Food and Feed (RASFF), the fmdings of missions to third countries carried out by the Food and Veterinary Office, as well as the quarterly reports on consignments of feed and food of non-animal origin submitted by Member States to the Commission in accordance with Article 15 of Regulation (EC) No 669/2009 indicate that the list should be amended.
(4) In particular, the list should be amended by deleting the
entries for commodities for which those information
sources indicate an overall satisfactory degree o f
compliance with the relevant safety requirements
provided for in Union legislation and for which an
increased ievel of official control is therefore no longer
justified.

with the relevant safety requirements, thereby warranting the introduction of an increased level of official controls, should be included in the list.
(6) The entries in the list for certain imports from Azerbaijan, China, Egypt, India and Pakistan should therefore be amended accordingly.
(7) As regards the entry for imports of fresh peppers from Thailand, a clarification is necessary in the interest of clarity of Union legislation conceming the CN codes affected.
(8) The amendment to the list conceming the deletion of the references to commodities should apply as soon as possible, as the original safety concems have been satisfied. Accordingly, those amendments should apply from the date of entiy into force of this Regulation.
(9) Taking into account the number of amendments that need to be made to Annex I to Regulation (EC) No 669/2009, it is appropriate to replace it by the text in the Annex to this Regulation.
(10) Regulation (EQ No 669/2009 should therefore be amended accordingly.
(11) The measures provided for in this Regulation are in accordance with die opinion of the Standing Committee on the Food Chain and Animal Health,
HAS ADOPTED THIS REGULATION:

Annex I to Regulation (EQ No 669/2009 is replaced by the text in the Annex to this Regulation.

This Regulation shall enter into force on the third day fol lowing
its publication in the O j t d a l journal of the European Union.-

However, the deletion of the entrv' for Pakistan for basmad rice
shall apply f rom rhe date of entry mto force of this Regulation.
