The Parliament of Queensland enacts—

Part 1 Preliminary

1 Short title

This Act may be cited as the Trade Measurement LegislationRepeal Act 2009.

2 Commencement

This Act, other than section 16, commences on a day to befixed by proclamation.

3 Definitions

In this Act—

commencement means the commencement of this Act.

Commonwealth law means the National Measurement Act1960 (Cwlth).

continuing matter means—

(a) proceedings mentioned in section 8; or

(b) an infringement notice offence mentioned in section 9;or

(c) a disciplinary action mentioned in section 10; or

(d) a review mentioned in section 11; or

(e) a seized measuring instrument, record, article or otherthing mentioned in section 12; or

(f) an unpaid fee mentioned in section 13; or

(g) anything done or not done under the repealed Acts inrelation to a matter mentioned in paragraph (a), (b), (c),(d), (e) or (f).

information includes document.

National Measurement Institute means the NationalMeasurement Institute established under the Commonwealthlaw, section 17.

repealed Acts means the repealed TMA and the repealedTMAA.

repealed TMA means the Trade Measurement Act 1990 as inforce from time to time before its repeal.

repealed TMAA means the Trade MeasurementAdministration Act 1990 as in force from time to time beforeits repeal.

4 Words have meanings given by repealed Acts

Words defined under the repealed Acts and used in this Acthave the same meanings in this Act as they had under therepealed Acts.

5 Acts Interpretation Act, s 20 not limited

This Act does not limit, and is not limited by, the ActsInterpretation Act 1954, section 20.

Part 2 Repeals

6 Repeal of Trade Measurement Act 1990 and Trade Measurement Administration Act 1990

The following Acts are repealed—

• Trade Measurement Act 1990, No. 68

• Trade Measurement Administration Act 1990, No. 70.

Part 3 Transitional provisions

7 Application of repealed Acts to continuing matters

(1) For the purpose of the administration and enforcement of therepealed Acts in relation to continuing matters, the repealedActs and the legislation mentioned in part 5 continue to applyas if this Act had not commenced.

(2) Without limiting subsection (1)—

(a) a chief inspector of trade measurement or a staffmember may be employed under the repealed TMAA,section 5(1); and

(b) the employment of a chief inspector of trademeasurement or a staff member under the repealedTMAA, section 5(1), in force immediately before thecommencement, continues in force from thecommencement until it ends; and

(c) the chief inspector may authorise a person to takeproceedings for offences as mentioned in the repealedTMAA, section 13(1); and

(d) an authorisation under the repealed TMAA, section13(1), in force immediately before the commencement,continues in force from the commencement until it ends;and

(e) the chief inspector may delegate the chief inspector’spowers as mentioned in the repealed TMAA, section 21;and

(f) a delegation under the repealed TMAA, section 21, inforce immediately before the commencement, continuesin force from the commencement until it ends.

(3) In this section—

staff member means a person, other than a chief inspector oftrade measurement, mentioned in the repealed TMAA, section5(1).

8 Offences

(1) This section applies if a person is alleged to have committedan offence against either of the repealed Acts before thecommencement.

(2) Despite the Criminal Code, section 11, proceedings for theoffence may be started or continued, and the court may hearand decide the proceedings, as if this Act had not commenced.

9 Infringement notices

(1) This section applies if—

(a) a person is alleged to have committed an infringementnotice offence before the commencement; and

(b) at the commencement, an infringement notice for theoffence had not been served on the person.

(2) Despite the Criminal Code, section 11, an infringement noticefor the offence may be served on the person and the StatePenalties Enforcement Act 1999 applies as if this Act had notcommenced.

(3) In this section—

infringement notice means an infringement notice under theState Penalties Enforcement Act 1999, section 15.

infringement notice offence means an offence mentioned inthe State Penalties Enforcement Regulation 2000, schedule 1,as in force before the commencement, entry for TradeMeasurement Act 1990, Trade Measurement (MeasuringInstruments) Regulation 1991, Trade Measurement(Miscellaneous) Regulation 1991 or Trade Measurement(Weighbridges) Regulation 1991.

10 Disciplinary actions

(1) This section applies if—

(a) the licensing authority had served a written notice on alicensee under the repealed TMA, section 57 before thecommencement; and

(b) at the commencement, the licensing authority had nottaken disciplinary action under the repealed TMA,section 58 against the licensee.

(2) The licensing authority may take disciplinary action under therepealed TMA, section 58 against the licensee as if this Acthad not commenced.

11 Reviews

(1) Subsection (2) applies if—

(a) immediately before the commencement a person couldhave applied to QCAT under the repealed TMA, section59 for the review of a decision of the licensing authority;and

(b) the person has not made the application before thecommencement.

(2) The person may apply to QCAT for the review, and QCATmay review the decision under the repealed TMA, as if thisAct had not commenced.

(3) Subsection (4) applies if—

(a) a person has applied to QCAT under the repealed TMA,section 59 before the commencement for the review of adecision of the licensing authority; and

(b) the review has not been finally decided before thecommencement.

(4) QCAT may review, or continue to review, the decision underthe repealed TMA as if this Act had not commenced.

12 Seized measuring instruments and other things

(1) This section applies if, before the commencement, aninspector seized—

(a) a measuring instrument, or records concerning ameasuring instrument or its use, under the repealedTMA, section 61(1); or

(b) an article or other thing under the repealed TMA,section 62(2).

(2) The inspector may retain, return, or dispose of the instrument,records, article or other thing under the repealed TMA as ifthis Act had not commenced.

(3) Subsection (2) is subject to section 14(3).

13 Unpaid fees

(1) This section applies if, immediately before thecommencement, a fee payable under either of the repealedActs has not been paid within the period prescribed undereither of the repealed Acts for payment of the fee.

(2) The fee may be recovered by the State as a debt.

(3) In this section—

fee includes charge or expense.

14 Disclosure of information about continuing matters

(1) This section applies to information obtained by the chiefinspector about a continuing matter.

(2) The chief inspector may disclose the information to theNational Measurement Institute for the purpose of theadministration or enforcement of the Commonwealth law.

(3) If the information relates to a seized thing mentioned insection 12, the chief inspector may allow the NationalMeasurement Institute to inspect the thing for the purpose ofthe administration or enforcement of the Commonwealth law.

(4) This section applies despite any other Act.

15 Reference to a repealed Act

A reference in another Act or document to either of therepealed Acts may, if the context permits, be taken as areference to the Commonwealth law.

Part 4 Miscellaneous

16 Transfer of registers and other information

(1) This section applies to—

(a) the register of the prescribed particulars relating tolicences mentioned in the Trade Measurement Act 1990,section 47; and

(b) information obtained by the chief inspector as theadministering authority or licensing authority.

(2) The chief inspector may transfer the register and theinformation to the National Measurement Institute for thepurpose of the administration or enforcement of theCommonwealth law.

(3) This section applies despite any other Act.

17 Expiry of Act

This Act expires on 1 July 2011.
