That the minutes of the Regular Council Meeting held on October 2, 2017 and the minutes of the two Special Council Meetings held on October 5, 2017 be approved and adopted as presented.

Public Meeting for Zoning By-law Amendments:

Mayor Gerow introduced the Township’s Planning Consultant, Darryl Tighe from Landmark Associates Limited, to the Public Meeting. Zoning By-law Amendment – Holly Richards-Conley (Applicant)

Mark Landry (Owner) The Township of Havelock-Belmont-Methuen is in receipt of an application for a Zoning By-law Amendment to change the zoning of certain lands being described as Part Lot 23, Concession 3, being Lot 48 and Part of Block N of Registered Plan No.35 – in the Methuen Ward (Methuen Lake), identified by Roll No. 1531-010-007-09700 and having municipal address of 69 Fire Route 83c Upper.

The purpose of this application is to rezone the subject property while also introducing certain site specific regulations to permit the redevelopment of the lot. As proposed the redevelopment will consist of the replacement of an existing cottage with a new single detached vacation dwelling together with attached decks/porches, and construction of a new detached garage.

Mr. Tighe presented the planning report to the meeting. Mr. Tighe advised that this Public Meeting was held under Section 34 of the Planning Act. A notice of the public meeting was given by prepaid first class mail to every owner of land within 120 metres of the area to which the application applies. A notice was also clearly posted on the property to which the application applies. Notice was also provided to the prescribed ministries and agencies. Comments regarding the proposed zoning by-law amendment were received. Peterborough Public Health (October 2, 2017) provided written comments and expressed no objection to the application, provided that the owners are approved for an existing sewage system application prior to issuance of a building permit. Crowe Valley Conservation Authority (CVCA) provided written comments on October 3, 2017 expressing no concern with the application. It was also noted by CVCA that a new permit will need to be issued by their office in order to proceed with the proposed development associated with this zoning by-law amendment. Enbridge provided written comments on October 2, 2017 expressing no concern with the application. Written comments were also received from Donald A. Reid in support of the zoning by-law amendment. Mr. Tighe reviewed the planning report regarding the application.

Mr. Tighe summarized that the subject application conforms to the Growth Plan, County of Peterborough Official Plan, Township of Havelock-Belmont- Methuen Official Plan and is consistent with the Provincial Policy Statement. Mr. Tighe recommended that the draft by-law be passed by Council. It was noted for the record that the applicant, Holly Richards-Conley, was in attendance. Mayor Gerow invited comments in favour of the application. Dave Retzer, the immediate neighbour to the applicant, rose in favour of the application. Mayor Gerow invited comments in opposition of the application three times with no response. Mayor Gerow invited questions and comments from Council with no response. Zoning By-law Amendment – William and Robin Pepper (Owner and Applicant) The Township of Havelock-Belmont-Methuen is in receipt of an application for a Zoning By-law Amendment to change the zoning of certain lands being described as Part Lot 26, Concession 10, being Part Lot 16 of Registered Plan 12 – in the Methuen Ward (Jack Lake, Sharpe Bay), identified by Roll Numbers 1531-010-007-61000 and 1531-010-007-61100 and having municipal addresses of 260 and 268 Fire Route 89C. Consent applications B-13-17 and B-22-17 were recommended for approval by Council on April 18, 2017 and were subsequently approved by the Peterborough County Land Division Committee. The purpose of application B-13-17 was to sever a parcel of land from 260 FR 89C to serve as a lot addition to 268 FR 89C. The purpose of application B-22-17 was to request that a right-of-way be granted over 268 FR 89C, to be accessed by 260 FR 89C. A condition of consent application B-13-17 was that each of the severed and retained parcels be rezoned. No new development is proposed on either the severed or retained lands, however each require a rezoning in order to recognize changes to lot area and lot frontage; as well as to maintain a uniform zoning on the lands benefiting from the lot addition. The purpose of this application to amend the zoning by-law, will serve to satisfy the condition of consent for application B-13-17 as previously approved. Mr. Tighe presented the planning report to the meeting. Mr. Tighe advised that this Public Meeting was held under Section 34 of the Planning Act. A notice of the public meeting was given by prepaid first class mail to every owner of land within 120 metres of the area to which the application applies. A notice was also clearly posted on the property to which the application applies. Notice was also provided to the prescribed ministries and agencies.

Comments regarding the proposed zoning by-law amendment were received. Peterborough Public Health, as well as Enbridge, provided written comments dated October 2, 2017; each expressed no objection to the application. Comments from Crowe Valley Conservation Authority (CVCA) are not required due to the properties being located on Jack Lake. Mr. Tighe reviewed the planning report regarding the application. Minor Variance Applications: A-21/17, Minor Variance, Sandra and Randy Dale, Part Lot 15, Concession 8, with municipal address 59 Fire Route 36 – Belmont Ward (Round Lake) The purpose of this minor variance application is to seek relief from Section 4.10 B (a) (ii) in order to permit the construction of a 60 square foot deck addition to the existing front/lakeside deck, which will have the effect of reducing the minimum required water

yard setback from 100 feet as per Section 4.35 to 58.3 feet (58.3 feet existing) and reducing the minimum front yard setback from 70 feet as per Section 11.2.1(c) to 58.3 feet (58.3 feet existing). The Clerk advised that notice of the Public Meeting had been given by prepaid first class mail to every owner of land within 60 metres of the area to which the application applies and a notice was clearly posted on the property. Notice was also provided to the prescribed Ministries and agencies. Crowe Valley Conservation Authority (CVCA) provided written comment expressing no concern with the application. It was also noted by CVCA that an existing permit (No.139/17) issued by their office would need to be amended to reflect the setbacks submitted with the application. Comments were also received by Peterborough Public Health stating no objection to the application. Planning Consultant Darryl Tighe presented the Planning Report to the meeting. The owner/applicant Sandra Dale was in attendance. Deputy Mayor Martin invited anyone present to speak in opposition to the minor variance application three times with no response. Deputy Mayor Martin invited anyone present to speak in favour of the minor variance application. Sandra Dale spoke in favour of the application but requested relief from approval condition number five (survey) as identified in the Planning Report siting the cost. Darryl Tighe noted that this particular condition has been in effect for many applications. Mr. Tighe explained that with past applications a letter from the Ontario Land Surveyor confirming location of the construction and survey markers has been sufficient to meet the requirements of the minor variance. A Land Survey Technician may be dispatched by the Surveyor to measure the location of construction and identify the survey pins. A full or new survey is not required. Deputy Mayor Martin invited questions and comments from the committee members. Councillor Gerow noted that he is moving the motion for approval on condition that the owner/applicant clearly understands that a new survey is not required to satisfy condition number five as written in the report of the Planning Consultant. That a 20-day appeal period lapse prior to the issuance of a building permit;

That a building permit be issued within 12 months of the approval of this application and upon submission to the building department of the appropriate application, fees and supporting information as required by the Chief Building Official;

That the structure and the required setbacks be staked by an Ontario Land Surveyor prior to the commencement of any site alterations or construction; and any requisite measurements from the high water mark or edge of water shall be taken from the same locations relied upon at the time the application was submitted; and

That the balance of the information in the Planning Report be received. Carried

A-22/17, Minor Variance and Application for Permission, William and Lisa Fischer, Part Lot 28, Concession 8, with municipal address 8 Fire Route 85g – Methuen Ward (Jack Lake – Callahan Bay) The purpose of this minor variance application is to seek relief from Section 4.10 A (Legal Non-conforming Buildings, Structures and Uses) and Section 4.10 B (a) (ii), and to seek approval for an application for permission which would permit the following:

1. Construct a 168 ft2 addition to the east side of the existing cottage, having the following effect:

i. reducing the minimum required water and front yard setbacks from 100

feet as per Section 4.35 and 70 feet as per Section 11.2.1(c), respectively to 19 feet (10 feet existing); and

2. Construct a replacement septic system on approximately the same footprint as

the existing septic system, which will have the effect of reducing the minimum required water yard setback from 100 feet as per Section 4.35 to 49.2 feet (approximately 49.2 feet existing).

That notwithstanding the current zoning of the property as ‘Open Space (OS) Zone’, that all provisions as they apply to the ‘Seasonal Residential (SR) Zone’ of By-law No. 1995-42, as amended, shall apply to the subject property identified by property roll number 1531-010-007-40600;

That the proposed addition and septic system be permitted with the setbacks as noted above and be located as illustrated on the drawing as labelled Schedule ‘A’ in the report of the Planning Consultant;

That any requisite approval be received by the applicable approval authorities prior to the building permit being issued;

The Clerk advised that notice of the Public Meeting had been given by prepaid first class mail to every owner of land within 60 metres of the area to which the application applies and a notice was clearly posted on the property. Notice was also provided to the prescribed Ministries and agencies. No comments were received at the time of report preparation. Due to the nature of the proposal comments are not required from Peterborough Public Health. Additionally, comments will not be required from the Crowe Valley Conservation Authority, as the property is located on Jack Lake. That Minor Variance Application A-23/17 for constructing a detached garage being 624 ft2 (190.2 m2) with an increased height of 16.5 feet (5.03 metres) be approved, with the following conditions:

That the proposed detached garage be permitted with a minimum water yard setback of 110 feet and at the location as illustrated on the drawing as attached and labelled Schedule ‘A’ in the report of the Planning Consultant;

That the detached garage is permitted to include a second-storey for the purpose of storage type uses only; and being subordinate and accessory to the main or principle dwelling shall not contain any habitable space, sanitary, plumbing or cooking facilities;

That a 20-day appeal period lapse prior to the issuance of a building permit;

That a building permit be issued within 12 months of the approval of this application and upon submission to the building department of the appropriate application, fees and supporting information as required by the Chief Building Official;

That the detached garage and the required setbacks be staked by an Ontario Land Surveyor prior to the commencement of any site alterations or construction; and

That the balance of the information in the Planning Report be received. Carried

A-24/17, Minor Variance, David and Theresa Ball, Part Lot 15, Concession 6, with municipal address 645 Kasshabog Lake-Island 38 – Methuen Ward (Kasshabog Lake) The purpose of this minor variance application is to seek relief from Section 4.10 B (a) (ii) in order to permit the construct of a 400 square foot addition to the existing cottage, which will have the effect of reducing the minimum required water yard setback from 100 feet as per Section 4.35 to 95.9 feet (81.1 feet existing); together with increasing the maximum allowable lot coverage from 4% as per Section 12.2.1(g) to 4.5% (3.3% existing).

The Clerk advised that notice of the Public Meeting had been given by prepaid first class mail to every owner of land within 60 metres of the area to which the application applies and a notice was clearly posted on the property. Notice was also provided to the prescribed Ministries and agencies. Peterborough Public Health (dated October 2, 2017) provided written comments and expressed no objection to the application,

That the proposed cottage addition be permitted with the setback as noted above and be located as illustrated on the drawing as attached and labelled Schedule ‘A’ in the report of the Planning Consultant;

That any requisite approval be received by the applicable approval authorities prior to the building permit being issued;

o Crowe Valley Conservation Authority o Peterborough Public Health

That a 20-day appeal period lapse prior to the issuance of a building permit;

That a building permit be issued within 12 months of the approval of this application and upon submission to the building department of the appropriate application, fees and supporting information as required by the Chief Building Official;

A-25/17, Minor Variance, Jeffery and Debbie Souter, Part Lot 3, Concession 10, Part 1 of Plan 45R7088 – Long Lake, Methuen The purpose of this application is to seek minor variance approval for relief from Section 4.10 B (a) (ii) as follows:

1. to construct an addition on the footprint of an existing deck, which will have the effect of reducing the minimum required water yard setback from 100 feet as per Section 4.35 to 78.8 feet (78 feet existing);

2. to construct a new deck together with reconstructing a portion of an existing deck

which will have the effect of reducing the minimum required water yard setback from 100 feet as per Section 4.35 to 78 feet (70 feet existing); and

3. to construct an attached waterfront landing and stairs on the footprint of an

The Clerk advised that notice of the Public Meeting had been given by prepaid first class mail to every owner of land within 60 metres of the area to which the application applies and a notice was clearly posted on the property. Notice was also provided to the prescribed Ministries and agencies. No comments were received at the time of report preparation. Peterborough Public Health provided written comments (dated October 2, 2017) and expressed no objection to the application, provided that the owners are approved for an existing sewage system application prior to issuance of a building permit. Crowe Valley Conservation Authority (CVCA) provided written comment on October 3, 2017 expressing no concern with the application. It was also noted by CVCA that a permit will need to be issued by their office in order to proceed with the proposed development. Planning Consultant Darryl Tighe presented the Planning Report to the meeting. The owner and applicant, Debbie Souter was in attendance. Deputy Mayor Martin invited anyone present to speak in opposition to the minor variance application three times with no response.
