Fiscal Management Policy and Procurement Policy

PROCUREMENT POLICY On motion of Supervisor Tucker seconded by Councilman Scott the following

resolution ADOPTED ROLL CALL VOTE-AYES 5 (Card, Fitzsimmons, Scott, Michaloski, Tucker) NAYS 0-RESOLVED to approve the Fiscal Management Policy and the Procurement Policy as follows:

WHEREAS, Section 104-b of the General Municipal Law (GML) REQUIRES every town to adopt internal policies and procedures governing all procurement of goods and services not subject to the bidding requirements of GML 103 or any other law, WHEREAS, comments have been solicited from those officers of the town involved with procurement; NOW, THERE, be it

RESOLVED: that the Town of Caton does hereby adopt the following procurement policies and procedures:

Guideline 1. Every prospective purchase of goods or service shall be evaluated to determine the applicability of GML 103. Every town officer, board, department head or other personnel with the requisite purchasing authority (hereinafter Purchaser) shall estimate the cumulative amount of the items of supply or equipment needed in a given fiscal year. That estimate shall include the canvass of other town departments and past history to determine the likely yearly value of the commodity to be acquired. The information gathered and conclusions reached shall be documented and kept with the file or other documentation supporting the purchase activity.

Guideline 2. All purchases of a) supplies or equipment that will exceed $10,000 in the fiscal year or b) public works contracts over $20,000 shall be formally bid pursuant to GML 103. Guideline 3. All estimated purchases of: - Less than $10,000 but greater than $3,000 require a written request for a proposal (RFP)

and written/fax quotes from three vendors. - Less than $3,000 but greater. than $1,000 requires an oral request for the goods and

oral/fax quotes from two vendors. - Less than $1,000 is left to the discretion of the Purchaser. - All purchases must be accompanied by a NYS Tax Exempt Certificate. Reimbursement will

not be made for taxes paid.

All estimated public works contracts of: - Less than $20,000 but greater than $10,000 requires a written RFP and fax/proposals

from three contractors. - Less than $10,000 but greater than $3,000 requires a written RFP and fax/proposals from

two contractors. - Less than $3,000 is left to the discretion of the Purchaser.

Any written RFP shall describe the desired goods, quantity, and particulars of delivery. The Purchaser shall compile a list of all vendors from whom written/fax/oral quotes have been requested and written/fax/oral quotes offered.

All information gathered in complying with the procedures of this Guideline shall be preserved and filed with the documentation supporting the subsequent purchase or public works contract.

Guideline 4. The lowest responsible proposal or quote shall be awarded the purchase or public works contract unless the Purchaser prepares a written justification stating reasons why it is in the best interest of the town and its taxpayers to make an award to other than the low bidder. If a bidder is not deemed responsible, facts supporting hat judgement shall also be documented and filed with the record supporting the procurement.

Guideline 5. A good faith effort shall be made to obtain the required number of proposals or quotations. If the Purchaser is unable to obtain the required number of proposals or quotations, the Purchaser shall document the attempt made at obtaining the proposals. In no event shall the inability to obtain the proposals or quotes be a bar to the procurement.

Guideline 6. Except when directed by the Caton Town Board, no solicitation of written proposals or quotations shall be required under the following circumstances:

A) Acquisition of professional services; B) Emergencies; C) Sole source situations; D) Goods purchased from agencies for the blind or severely handicapped; E) Goods purchased from correctional facilities; F) Goods purchased from another governmental agency; G) Goods purchased at auction; H) Goods purchased for less than $1,000; I) Public works contracts for less than $3,000;

Guideline 7. This policy shall be revised annually by the Caton Town Board at the annual reorganization meeting or as soon thereafter as is reasonably practicable.

INVESTMENT POLICY A. The Caton Town Board would like to maximize interest income on all funds not immediately needed for payment of obligations.

Investment of excess funds shall be governed by the regulations contained in Town Law, General Municipal Law, and Local Finance Law. The priorities for investment of funds shall be:

1. Safety 2. Liquidity 3. Yield

B. INVESTMENT REGULATIONS

1.0 AUTHORIZED COMMERCIAL BANKS

The Caton Town Board authorizes the use of commercial banks or trust companies (not savings banks or associations) located and licensed to do business in New York State. The use of private brokerage or investment firms is not authorized by this policy (General Municipal Law 11, local Finance Law 165.00 (b).)

2.0 AUTHORIZED INVESTMENT INSTRUMENTS

The Caton Town Board authorizes the following types of investment instruments for investing Town of Caton monies:

2.2 Money Market Deposit Accounts

2.3 N.O.W. Accounts

2.4 Super N.O.W. Accounts

2.5 Time Deposit Accounts

2.6 Seven to thirty-one-day Accounts

2.7 Certificates of Deposit

2.8 Repurchase Agreements involving the purchase and sale of direct obligations of the United States.

AUTHORIZED INVESTMENT INSTRUMENTS – Continued

2.9 Obligations of the United States and of the State of New York, which include Treasury Bills (T-bills) and Treasury Bonds and Notes.

3.0 DELEGATION OF AUTHORITY FOR INVESTING TOWN MONEY

The Caton Town Board delegates the authority to make the day-to-day investment decisions within the guidelines and limitations of this policy to the:

3.1 Caton Town Supervisor, as Chief Financial Officer, and/or

3.2 Caton Town Deputy Supervisor

The above persons are hereby authorized to utilize the advisory services of municipal consulting firms in planning the timing, amount, maturity, bidding, placement and reporting on any investments made.

3.3 Caton Town Bookkeeper at the direction of either above officer.

4.0 F. D. I. C. INSURANCE AND COLLATERALIZATON

The primary objective of this policy is to enhance the safety and availability of any Town of Caton funds invested.

Regulations of the Federal Deposit Insurance Corporation state that each official custodian of funds of any county, municipality or political subdivision depositing such funds in an insured bank located in the same state shall be insured up to $100,000 for time and savings accounts per bank and up to $100,000 for demand deposits per bank (12 Code Federal Regulations Section 330.8).

For amounts in excess of F. D. I. C. coverage, a pledge of obligations as collateral is required to secure the investment. The obligations that may be pledged are:

(1) Obligations of the United States; (2) Obligations of agencies of the United States if the payment of principal and

interest is guaranteed by the federal government; (3) Obligations of New York State; (4) Obligations of any municipality, school district or district corporation in the

State; (5) Obligations of a public authority (Public Authorities Law, various sections); and

obligations of a public housing authority (Public Housing Law Section 49).

With respect to obligations pledged to secure deposits and investments, whenever possible such obligations should by delivered to a bank or trust company other than the institution with which the investment is made If a third party bank is to serve as custodian, the fiscal officer of the local government should require that the bank execute a written custodial agreement which provides, among other things, that any rights of the custodial bank with respect to the collateral are subordinate to the local government’s interest. The fiscal officer should also determine on a regular basis whether written confirmation of all collateral has been received from all institutions, in which the Town of Caton has invested funds. This confirmation should be received within five (5) business days of any investment. Any substitution of collateral must have Town of Caton approval.

The Caton Town Board authorizes the designated officials the authority to allow for the physical custody of Certificates of Deposit and other evidences of investments for “safekeeping” possession to the winning bank, as provided in Section 11(3) of the General Municipal Law.

5.0 TRANSFER FUNDS

The Caton Town Board authorizes the designated officials the authority to use electronic transfer of funds, among the approved banking institutions to assist in the movement of monies. Each such transfer shall be specifically identified in the original journal entry as a “wire transfer” and subsequently supported by the bank confirmation notice to provide an audit trail.

6.0 WRITTEN REPORTS

All investments shall be documented in written reports to the Caton Town Board outlining the details of each investment and the bids received thereon. Monthly reporting of investments should be made to the Caton Town Board.

7.0 BONDING POLICY

All Town of Caton employees who are involved with the transaction of Town of Caton funds are bonded through the Town’s insurance program. This program should be reviewed and updated annually.

Library Visits Corning Library is reaching out to the Town to provide seasonal activities for Caton children residents of all ages. Dates and time are: February 12, May 14, August 13 and November 12 from 3 to 5 pm at the Caton Town Hall.

On motion of Supervisor Tucker seconded by Councilwoman Fitzsimmons the following resolution ADOPTED VOICE VOTE-AYES 5 (Card, Fitzsimmons, Scott, Michaloski, Tucker) NAYS 0-RESOLVED to approve the above dates for the Corning Library visits, subject to not being a conflict with any other Town activity.

Fire Department Ben Crowl from the Caton Fire Department provided Supervisor Tucker with a December 2017 monthly report.

NYS Association of Towns Data material from NYS for training sessions in NY City.

Old Business New highway building is beginning to look like a building. Metal siding and insulation will be coming next week. The Town will have to borrow money to finish paying for the building and Supervisor Tucker is looking for a lower interest than the 3.6 percent that CCTC has offered.

Court Room Grant Several years ago, the Court was issued a NYS grant for renovations for purchasing a judge’s bench. The bench never got built or purchased and the money was put into the General Fund. Being that the grant money was not ever used, NYS is now asking for the Town of Caton to return the money or use it as what it was specified for.

New Business National Fuel & Gas Company is proposing to install a natural gas pipeline pumping station near Buckwheat Hollow Road and the Pennsylvania border.

CHIPS Town of Caton recently received approximately $108k from NYS and is expecting to receive about $110k in additional CHIPS money for the highway building.

Year End Budget Adjustment On motion of Councilwoman Fitzsimmons seconded by Councilman Michaloski the following RESOLUTION ADOPTED ROLL CALL VOTE-AYES 5 (Card, Fitzsimmons, Scott, Michaloski, Tucker) NAYS 0-RESOLVED to approve a $10,500 modification to the 2017 Budget by appropriating the $10,500 into account DA5130.2.

Town Board Present- Supervisor Lynn Tucker, Council members Michelle Fitzsimmons, Jaime Card, Paul Michaloski and Timothy Scott.

Others Present- Legislator Carol Ferratella, Highway Superintendent David Card, Attorney Stephen Maio, Clerk Avonne Dickerson and several attendees.

Supervisor Tucker brought the meeting to order with the pledge to the flag. He stated that we are here for the Town Board meeting only and no discussion of any outside matters will take place.

Public Hearing for Time Warner Cable franchise agreement- Supervisor Tucker opened the Public Hearing at 6:03 pm.

WHEREAS, the Town of Caton highway garage is in a state of disrepair and inadequate to the purpose for which it is needed, namely the housing of equipment for the highway department and space to make repairs to the same, as well as other general highway department purposes, and

WHEREAS, the Town has already undertaken construction of a new highway garage by using surplus funds of the Town, and

WHEREAS, said surplus funds are not sufficient to cover the entire cost of the building of the new highway garage, and

WHEREAS, the construction of a new highway garage is authorized by Section 220 (2) of the Town Law; and

WHEREAS, the Town Board has determined that it will be most beneficial to the fiscal health of the Town to finance the remainder of the garage through a serial bond in the amount not to exceed $350,000 and for a term of 8 years, it is hereby;

RESOLVED, that the Town is hereby authorized to borrow a sum not to exceed $350,000 for the purpose of constructing a new highway garage and the repayment of said bond shall not extend more than a term of 8 years, and it is further;

ORDERED, that this resolution is subject to a permissive referendum.

Old Business Short discussion on a possible electric service contract with Eligol Energy Company. Court Audit has been completed and needs to be sent in to the State.

New Business Discussion on whether ZBA member Olan Rose is residing in Caton. Town needs to verify

before appointing another resident. Town Clerk’s 2017 books will be audited on Monday, 03/05/2018 @ 4 pm.

Open to the Public Would like a tractor sign put on the Thurber Road. Pleased that Hwy. Superintendent replaced his truck. Hurd Cross Road also needs a sign. Peggy MacNaughton volunteered for a Park Committee position and has others that are

interested. Pleased with construction of the new highway building. Top on East Hill Road is not in good shape.

2017 Bookkeeper Audit

Supervisor Tucker set the audit of the Supervisor’s 2017 books for March 21, 2018 @ 10:00 am.

Discussion from Supervisor Tucker

Supervisor and Comprehensive Planning Committee had a difference of opinion about which

survey was presented and approved by the Town Board at the November 8, 2017 Town Board

meeting and also, which survey was actually mailed out to Caton residents.

He then talked about a petition that was presented to Town Clerk Dickerson on March 12,

2018, requesting a permissive referendum (town vote) for borrowing money to complete the

new highway garage. He advised the Board that if the voters disagree to borrow money for the

building, the Town will run out of money to continue the project and possibly the contractors

may put a contractor’s lien on the building, disallowing the Town to use the partially built

garage.

At the current meeting of March 14, 2018 Town Clerk Dickerson presented the petition to the

Caton Town Board, written as follows:

and an elector of the Town of Caton, County of Steuben, State of New York qualified to vote

upon a proposition to raise and expend money in the Town of Caton, County of Chemung, State

of New York; that my place of residence is truly stated opposite my signature hereto; that on

February 14, 2018, the Town Board of the Town of Caton approved and adopted Resolution No.

001 authorizing and agreeing to seek a loan of $350,000 to finance the completion of a new

Town garage, as per the said resolution; and I do hereby protest against the adoption by act or

resolution of Resolution No. 001 and the said authorization to seek said financing I further

request that it be submitted to the qualified electors of the town affected, that is the Town of

Caton, for their approval or disapproval pursuant to Article Seven of the New York State Town

Law.”

At 6:30 pm, Supervisor Tucker opened the floor for discussion of the new highway building.

Attorney Maio stated that if there are enough signatures on the petition to not borrow money

needed to compete the garage project, the voters have the right to vote on borrowing the

money. To verify validation of the petition, the Town would need to contact the Board of

Elections at the County, as the law states there needs to be 5 % of residents that signed the

petition and voted at the last gubernatorial election. Once petition is validated, the vote would

be held within 60-75 days.

On the other hand, the petition may be rescinded which would make the petition request

mute, as the item requested to vote on is no longer being requested.

On motion of Councilwoman Fitzsimmons seconded by Councilman Scott the following

resolution adopted ROLL CALL VOTE-AYES 5 (Fitzsimmons, Card, Michaloski, Scott, Tucker)

NAYS-0 to acknowledge that a petition has been presented to the Caton Town Board and also,

to rescind Resolution # 001 on that petition, which was received by Town Clerk on March 12,

2018.

Met with the Senior Citizens and brought extra pamphlets from the Office of the Aging

pertaining to Seniors that may need help with most anything.

Also, there are 683 miles of roads in Steuben County. The cost to maintain those roads for this

year is $5.5 million dollars.

Network Capability for the Town

Bob Lord and Councilman Michaloski met with Steve Manning regarding adding more network

to Caton. No direct hope at this time only searching for State or Federal grants, etc.

Meeting open to the Public

• Bidding for the new highway building should have been done differently.

• Steuben County will be doing West Caton Road and Marsh Road this year.

• Frustration with residents is not the highway workers, but the condition of the roads.

• There are several towns that have poor road conditions.

Comprehensive surveys are all in. Councilman Michaloski stated that it would likely be 3 to 4 months to complete the analysis. Supervisor Tucker would like the surveys turned in to the Town Board when Committee is finished with them.

Highway Building is coming along good. Shell Company has donated a desk and filing cabinet. Also, Corning Inc. may have some furniture to donate to highway department.

Justice Grant-still nothing. On motion of Supervisor Tucker seconded by Councilwoman Card the following Resolution ADOPTED VOICE VOTE-AYES 5 (Michaloski, Card, Fitzsimons, Scott, Tucker) NAYS-0 RESOLVED to draft a letter to the Court, requesting Justice Divens-Bruffey to attend a meeting with the Town Board to discuss options for the previously received grant.

New Business At last month’s meeting, the Town had moved $20k from the $25k Capital Reserve

Retirement Fund into Buildings Capital Reserve Fund, while leaving the remaining $5k in the account. On an advisory opinion of CPA Carol Golden, the Board may consider closing out the Retirement Capital Reserve Fund and move the balance of it into the General Buildings Capital Reserve Fund.

Highway Building is coming along good and is about 95% finished and should be completed within a few weeks.

New Business Budget Resolutions # 1-Whereas, the Town Board has indicated its intent to use resources available in the Building Reserve to partially finance the construction of a new highway garage, and

Whereas, there was $54,879.84 available in the Building Reserve for this purpose,

Therefore, on motion of Councilwoman Fitzsimmons seconded by Councilwoman Card the following Resolution ADOPTED ROLL CALL VOTE-AYES 3 (Fitzsimmons, Card, Tucker) NAYS 0-RESOLVED for the Town Board to amend the 2018 General Fund Budget by appropriating $54,879.84 from the Building Reserve as an interfund transfer to the Highway Capital Projects Fund.

Supervisor Tucker stated that the loan for the Highway Project was advertised. The amount needed to finish paying for the Highway Project bills is $265,000 while $115,000 of that will go to the General Fund to payback what was used to pay for the Project bills. Due to the fact that getting the loan was delayed it cost the Town almost 1% more in interest or about $10,000. This will be a 9-year loan with an annual payment of $34,303.

New Business o Supervisor Tucker received a notice from the U S Board on Geographic Names for the

Town Board to comment on. This is a proposal to apply the new name of “Berry Creek” to a 3.7-mile long unnamed tributary of Mudlick Creek in Steuben and Chemung County’s. The name refers to the many wild bushes that the proponent, Jonathan Conklin, from Pine City, reports are found along the creek. This creek flows from the Town of Caton, Southport and then enters Mudlick Creek.

Park Program for 2018- o Program will run from July 30th to August 17th. On motion of Supervisor Tucker seconded

Councilman Michaloski received information that this spring, a grant had went out to under-served areas of NYS such as the Southern Adirondack region. Another round of grants will be coming around at the end of July.

Stop sign on Kelly Hill Road needs to be on Birch Creek Road.

Motorcycle rally will be going through Caton Center this weekend.

Park looks good, but still need mulch for playground and basketball hoops.

Park bench in memory of Bob Richards is almost ready to go. Still need some kind of plaque to put on the bench. Will get in touch with family members for suggestions.

Area grants for Parks and Recreation rehab are available.

Supervisor Tucker read aloud a letter that he received from a resident concerning the upkeep of another resident located on the Ginnan Road. This letter is now a part of these minutes and is available to view, as per Supervisor Tucker.

Cold War Exemption 2018 marks the statutory end to the 10-year availability of the Cold War Veterans Exemption that our Town adopted in June of 2008. A bill has been signed by Governor Cuomo for new legislation to remove the ten-year limitation and make it a permanent exemption. In order to continue with this exemption, a local law must be adopted at the municipality level.

On motion of Supervisor Tucker seconded by Councilwoman Card the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Fitzsimmons, Card, Michaloski, Scott, Tucker)-0 NAYS RESOLVED to schedule and hold a Public Hearing on September 12, 2018, at 6 pm prior to the regular monthly Town Board Meeting, to consider adopting the Cold War Exemption Law with no expiration date.

Councilman Michaloski would like to have a full documentation report of the Park Program. He also would like the Assessor to complete a report similar to the report he has prepared. He will put a copy of his request in Assessor Deal’s mailbox.

Councilwoman Card would like to start a face-book page for the Town of Caton. No negativity will be allowed on the website.

MEETING OPEN TO THE PUBLIC Pennsylvania is still receiving gas money. County records storage facility is 99% completed. New downtown County office building is completed and they will be moving in soon. Highway County bids for a new highway shed came in to high. SCDPW is also thinking of closing the Caton highway shop and consolidate to Curtis Some municipalities use ARC to purchase highway workers clothing.

On motion of Supervisor Tucker seconded by Councilwoman Fitzsimmons the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Michaloski, Scott, Tucker) NAYS 0-for Supervisor Tucker to contact the Greene County Bank to receive the names of their bank attorney’s that will complete the loan transaction. He also mentioned that the Board needs to re-evaluate our Town Attorney.

New Business- o Resolution-on motion of Supervisor Tucker seconded by Councilman Michaloski the

following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Michaloski, Scott, Tucker) NAYS 0-to approve a transfer of $33,616.03 from General Fund to Loan Capital Project to cover the retainer for the new highway building.

o Status of possible Dollar General-an investment firm for Dollar General is interested in purchasing property in Caton to construct a new Dollar General. They have looked at a few properties, but are most interested in the Caton Grange building and the house between the Town Hall and the old Grange. Supervisor Tucker, Bob Lord and reps from STCRPDB have recently met with the investment firm and are hoping to meet again with the property owners.

o County Update-Carol Ferratella talked to the Board about the danger of the hog weed plant. Also, in the near future, the County will be updating their pictometry.

o Councilman Michaloski-commented that by December of 2019, Verizon will have gotten rid of all their flip phones.

o Local Law # 1 of 2018-to amend Local Law No. 2 of 2008, entitled: “A local law providing for the Real Property Tax Exemption of Cold War Veterans pursuant to Real Property Tax Law Section 458-b” by adding subparagraph “(a)” as follows: Pursuant to subsection 2 ( c ) (iii) of §458-of the NYS Real Property Tax Law, the exemption authorized shall apply to qualifying owners of real property for as long as they remain qualifying owners, without regard to such ten year limitation.

On motion of Supervisor Tucker seconded by Councilman Scott the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Michaloski, Scott, Tucker) NAYS 0-to accept the presentation from the Caton Town Clerk of proposed Local Law No. 1 of 2018 that will amend Local Law No. 2 of 2008. Councilwoman Fitzsimmons- She would like the section of Caton Bypass Road, from the four-corners to the stop sign on Caton Bypass Road, reverted back to the Telephone Road. Steuben County 911 will be contacted to see how this can be achieved.

At 6 pm, Supervisor Tucker opened the meeting with the pledge to the flag and opened the Public Hearing for Local Law # 1 of 2018.

Supervisor Tucker stated that the local law pertains to the amendment of Local Law # 2 of 2008 which is; providing for the Real Property Tax Exemption for Cold War Veterans, to allow qualified owners to continue with the exemption, without regard to the previous 10-year limitation.

At 6:03 pm, and after hearing no adverse comments, Supervisor Tucker made a motion seconded by Councilman Michaloski to close the Public Hearing. VOICE VOTE-AYES 5-(Fitzsimmons, Card, Michaloski, Scott, Tucker)-NAYS-0. Motion carried.

At 6:05 pm Supervisor Tucker opened the Regular Monthly Town Board Meeting.

Carol Ferratella & Scott VanEtten, County Update Scott stated that the Legislature is currently working on the 2019 budget. There are several NYS mandates coming down that will most likely cost the County more money.

NYS is expecting each county to come up with a dwelling to house the 16-17-year aged youths that have committed a crime and cannot be put in an adult jail due to their age. Scott mentioned that the County may be able to use Camp Monterey.

Cornell Co-operative Extension’s 100th anniversary.

Carol stated that NYS has revamped the STAR exemption program. To receive the Enhanced STAR exemption, you must enroll in the NYS Income Verification Program (IVP). The enrollment only needs to be done once and if eligible for the Enhanced Starr exemption you will automatically receive the exemption each year thereafter. Contact Assessor for more information.

Note: Due to the fact that a quorum of Board members was not present, no Town business could be voted on. Carol Ferratella & Scott VanEtten, County Update

CPL 370.15 & CPL 370.25-Scott specified that NYS passed a new section of the law under domestic violence. This means that if a person is found to commit or attempt to commit a domestic crime, which may be determined as a serious offense under the new statue, and is convicted of even a class B misdemeanor under the statue; and is “related enough” under the CPL, the effect of the law is that a person can never purchase a firearm and all possessed firearms will be confiscated by officials. A relative is considered blood relation, a spouse or a relative through marriage.

Scott also stated that a group from NYS will be coming down on October 11th and go through the now closed Monterey Jail facility with a conglomerate from 10 counties to decide if the facility meets the requirements for housing aged 16 and 17-year old prisoners. Otherwise, NYS is mandating that each County is responsible for dealing with the housing of the youth.

Next year, the County will be using Glove House, which already detains troubled youth.

Carol specified that NYS is supposed to reimburse the County with $1.2 million dollars if NYS approves everything.

Councilman Michaloski had recently met with Steve Manning from Southern Tier Network and he may be working with the Town for wireless internet. Possibly may find a location to run the fiber from Empire Access in South Corning and then the wireless repeater will send internet only to homes in Caton.

Town Clerk gave each member a copy of the Local Law #1 of 2018 pertaining to the Cold War Veteran’s Exemption which has been filed with in NYS and is in effect as of 10/26/2018.

New Business CPR-EMT Robert Richards is interested in holding a CPR training session with Town

employees and any others that would like the training. A date and time will be set after checking with the highway workers as to what works best for them.

Caton Fire District #1 has presented their 2019 Budget to the Town Board. Amount requested is $164,903. The Public Hearing for the Fire District Budget will be October 16th, 7 pm, at the Caton Fire Department.

Open to Public Discussion over taxes pertaining to Fire Districts and Fire Departments. Complaint over farm equipment being in the road on Kelly Hill Rd.

Other Business Don Haussener stated that the Town recently received $17,000 in State Aid and that the

2019 tax rate will increase from 2018 rate by $.10 - $.11 per $1,000 of assessed value. Also, $2,200 was put back into the proposed 2019 town budget for Assessor software license and the Contingency Fund was reduced by $1,500.

On Thursday, November 1, 2018, 9:30 am, CPA Carol Golden, Don Haussener and Supervisor Tucker will meet at the Town Hall, to go over the proposed 2019 budget. Board members are welcome to attend.

By the end of 2018, the Town will have approximately $256,000 left over in General IMMA and $86,000 in Highway IMMA. The Town should be receiving $8,000 in mortgage tax and another $25,000 in CHIPS funding. The Town is planning on putting $40,000 in Highway Equipment Reserve Fund for 2019, and possibly replacing the current excavator and / or backhoe.

Old Business Dollar General-Caton is still in the picture.

At 6:10 pm and on motion of Councilman Michaloski seconded by Councilwoman Card the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Card, Michaloski, Scott, Tucker) NAYS-0 to close the Public Hearing and move into the Regular Monthly Town Board Meeting.

2019 Budget- Supervisor Tucker explained that the tax rate for the Town’s portion of the 2019 tax bill will be going up by approximately $.1041 cents per $1,000 of assessed value; thus, the tax bill for a property assessed at $100,000 would be raised by $10.41.

Scott VanEtten, County Update- 2019 County Budget presentation will be Thursday, November 15th. Levy for 2019 is $186 million. This includes the approximate $1.5 million for NYS mandates such as “Raise the Age” program and the requirement for “Public Defenders” at court proceedings. However, NYS is supposed to be reimbursing most of the mandate costs to the County. Basically, the tax rate will be flat from last year due to increasing the sales tax and interest revenue.

• Legal Services- Supervisor Tucker stated that the Town is considering hiring a new Attorney through Coughlin & Gerhart LLP, Binghamton NY. Cheryl Succo is one of the attorneys at this law firm and she will be in attendance at the December 2018 Board Meeting for a presentation of their services.

• JD Backhoe Loader- Supervisor Tucker presented board members with a quote from Five Star Equipment Inc, Rochester NY, for cost of purchasing a 2019 John Deere 310SL Backhoe Loader on NYS bid at a cost of $105,475.99. This price is only good until the end of 2018. If purchase is approved equipment would not be delivered until after the New Year and the first payment would be made sometime in 2019. Current loader would be sold later on at an auction.

• Steuben County DPW Shared Service Contract- Highway Superintendent Card has received, signed and mailed back a DPW 5-year proposal for a Shared Services Contract with SCDPW.

• Maintenance items- Supervisor Tucker announced that the park is winterized and closed until spring.

Also, several outside lights on the Town Hall are not working and some of the street lights in the Lighting District are not working. Clerk to call NYSEG about street lights.

Alyssa Card, Janitor for the Town, may be leaving Caton. Not sure as of yet, but Councilwoman Card will keep us up to date if we have to fill that vacancy.

Supervisor Tucker suggested that employees make a list of items in the Hall that need repair, as currently we do not have a maintenance person.

Councilman Michaloski-

Prepared an update on the lack of internet and cellular services for Caton that he has been working on for quite some time. Document is on file in Clerk’s Office.

Public Comments-

• Glad the 2019 Budget is complete and that the Town is purchasing a new loader on NYS bid.

• Need to install additional security system for the highway building.

• On election day several residents complained about the untidy condition of the big room.

• There are people in town that would like to and are willing to plant flowers in the Caton

Park.

• A new larger sign for the Park would be much more noticeable than the small sign on the corner of the Riff Road.

Supervisor Tucker closed the meeting at 6:45 pm.

At 6 pm Supervisor Tucker called the meeting to order with the pledge to the flag.

Coughlin & Gerhart Supervisor Tucker introduced Cheryl Sacco and Nathan VanWhy, attorneys from Coughlin &

Gerhart LLP, Binghamton NY, law firm is involved only with municipal law. Town of Caton is considering hiring this law firm to continue legal services for us, as Ms. Sacco completed the legal portion of the financing for the new highway building.

After discussion with the Board, Ms. Sacco is to forward a 2019 Retainer Agreement with Coughlin & Gerhart LLP for Supervisor to sign after and if approved by Town Board. This will be to provide general legal services to the Town beginning January 1, 2019 to December 31, 2019 at an hourly rate of $180 per hour for attorneys and $110 per hour for paralegals.

Ms. Sacco suggested the Town come up with a list of employees approved to contact the firm when needed. Supervisor Tucker suggested that will include himself, Bookkeeper, Town Clerk and possibly Planning Board Chair. The Board thanked them for attending our meeting.

County Update Legislator Carol Ferratella Carol reported that the County tax levy has slightly dropped and the 2019 tax rate was also reduced. • Town of Caton is seeking a part-time handy person for maintenance at the Town Hall consisting of small repairs, etc. Clerk will forward an ad for employment to the Corning Leader for resumes to be submitted by January 8, 2019.

Supervisor Tucker also mentioned that in January 2019, an ad for employment needs to be in the paper for Caton Park Custodian/Groundskeeper and resumes to be in by 02/11/2019.

Discovered that there is a group north of here called “Internet Equity” to make sure that everyone across the state has internet access.

Meeting open to the public Sales tax is up by about 7 ½ %.

Is the Fire Department doing the birthday calendars anymore?

What Paul is doing for internet service is good.

New attorneys sound good.
