B. Sheet No. 70 – BRIDGE TYPICAL SECTIONS: The Engineer believes the joints and bolt

pockets between the nine (9) existing rigid frame units are not grouted. Upon discovery, if existing joints and bolt pockets are found to be sufficiently grouted, replacement of hardware and regrouting of existing joints will not be required.

ARTICLE 1 – BID RECIPIENT

1.01 This Bid is submitted to:

Mr. David Stack, Town Manager, 10 Grandview Road, Bow, NH 03304

1.02 The undersigned Bidder proposes and agrees, if this Bid is accepted, to enter into anAgreement with Owner in the form included in the Bidding Documents to perform all Workas specified or indicated in the Bidding Documents for the prices and within the timesindicated in this Bid and in accordance with the other terms and conditions of the BiddingDocuments.

ARTICLE 2 – BIDDER’S ACKNOWLEDGEMENTS

2.01 Bidder accepts all of the terms and conditions of the Instructions to Bidders, includingwithout limitation those dealing with the disposition of Bid security. This Bid will remainsubject to acceptance for 60 days after the Bid opening, or for such longer period of timethat Bidder may agree to in writing upon request of Owner.

ARTICLE 3 – BIDDER’S REPRESENTATIONS

3.01 In submitting this Bid, Bidder represents that:

A. Bidder has examined and carefully studied the Bidding Documents, and any data andreference items identified in the Bidding Documents, and hereby acknowledges receipt ofthe following Addenda posted on the Engineer’s website:

B. Bidder has visited the Site, conducted a thorough, alert visual examination of the Site andadjacent areas, and become familiar with and satisfied itself as to the general, local, andSite conditions that may affect cost, progress, and performance of the Work.

C. Bidder is familiar with and has satisfied itself as to all Laws and Regulations that may affectcost, progress, and performance of the Work.

D. Bidder has carefully studied all: (1) reports of explorations and tests of subsurfaceconditions at or adjacent to the Site and all drawings of physical conditions relating toexisting surface or subsurface structures at the Site that have been identified in theSupplementary Conditions, especially with respect to Technical Data in such reports anddrawings, and (2) reports and drawings relating to Hazardous Environmental Conditions, ifany, at or adjacent to the Site that have been identified in the Supplementary Conditions,especially with respect to Technical Data in such reports and drawings.

E. Bidder has considered the information known to Bidder itself; information commonlyknown to contractors doing business in the locality of the Site; information andobservations obtained from visits to the Site; the Bidding Documents; and any Site-relatedreports and drawings identified in the Bidding Documents, with respect to the effect ofsuch information, observations, and documents on (1) the cost, progress, and performance

of the Work; (2) the means, methods, techniques, sequences, and procedures ofconstruction to be employed by Bidder; and (3) Bidder’s safety precautions and programs.

F. Bidder agrees, based on the information and observations referred to in the precedingparagraph, that no further examinations, investigations, explorations, tests, studies, or dataare necessary for the determination of this Bid for performance of the Work at the price bidand within the times required, and in accordance with the other terms and conditions ofthe Bidding Documents.

G. Bidder is aware of the general nature of work to be performed by Owner and others at theSite that relates to the Work as indicated in the Bidding Documents.

H. Bidder has given Engineer written notice of all conflicts, errors, ambiguities, ordiscrepancies that Bidder has discovered in the Bidding Documents, and confirms that thewritten resolution thereof by Engineer is acceptable to Bidder.

I. The Bidding Documents are generally sufficient to indicate and convey understanding of allterms and conditions for the performance and furnishing of the Work.

J. The submission of this Bid constitutes an incontrovertible representation by Bidder thatBidder has complied with every requirement of this Article, and that without exception theBid and all prices in the Bid are premised upon performing and furnishing the Workrequired by the Bidding Documents.

ARTICLE 4 – BIDDER’S CERTIFICATION

4.01 Bidder certifies that:

A. This Bid is genuine and not made in the interest of or on behalf of any undisclosedindividual or entity and is not submitted in conformity with any collusive agreement orrules of any group, association, organization, or corporation;

B. Bidder has not directly or indirectly induced or solicited any other Bidder to submit a falseor sham Bid;

C. Bidder has not solicited or induced any individual or entity to refrain from bidding; and

D. Bidder has not engaged in corrupt, fraudulent, collusive, or coercive practices in competingfor the Contract. For the purposes of this Paragraph 4.01.D:

1. “corrupt practice” means the offering, giving, receiving, or soliciting of any thing ofvalue likely to influence the action of a public official in the bidding process;

2. “fraudulent practice” means an intentional misrepresentation of facts made (a) toinfluence the bidding process to the detriment of Owner, (b) to establish bid prices atartificial non-competitive levels, or (c) to deprive Owner of the benefits of free andopen competition;

3. “collusive practice” means a scheme or arrangement between two or more Bidders,with or without the knowledge of Owner, a purpose of which is to establish bid pricesat artificial, non-competitive levels; and

4. “coercive practice” means harming or threatening to harm, directly or indirectly,persons or their property to influence their participation in the bidding process oraffect the e execution of the Contract.

ARTICLE 6 – TIME OF COMPLETION

6.01 Bidder agrees that the Work will be substantially complete and will be completed and readyfor final payment in accordance with Paragraph 15.06 of the General Conditions on orbefore the dates or within the number of calendar days indicated in the Agreement.

6.02 Bidder accepts the provisions of the Agreement as to liquidated damages.

SECTION 00850SPECIAL CONDITIONS

The following Special Conditions apply and are hereby made part of the Agreement andContract Documents.

1.01 PERMITS

A. Permit applied for or obtained by the OWNER, if any, are indicated in paragraphSC-7.08 of the Supplementary Conditions.

1.02 CONSTRUCTION SCHEDULE

A. The OWNER anticipates issuing a Notice to Proceed on this project by May 1,2020 to July 1, 2020, subject to the successful bidder satisfying the requirementsindicated in the Notice of Award.

1. Contractor may propose an earlier/later Notice to Proceed date(earlier/later than 7/1/20) to Owner that accommodates a Fall/Winter2020 schedule and/or a spring/summer 2021 schedule.

B. A winter shutdown (suspension of work) will be permitted (approved), uponrequest by the contractor. Suggested shutdown period is starting on or about5:00 PM November 25, 2020 and ending at 12:00 Midnight May 2, 2021. Noconstruction work shall be permitted during this time frame and all shutdownconditions, as described below shall be met:

For a shutdown to be utilized, the following conditions must be met:

· NH Route 3A and Dunklee Road, open to all lanes of traffic in their existingand/or new configuration.

· Pavement in place on all roads (existing wearing course or new binder courseas minimum).

· All erosion control measures must be checked periodically and maintainedduring the shutdown.

· All traffic control measures (signage, signals, barricades, barrels, guardrail,pavement markings, etc.) shall be checked periodically and maintainedduring the shutdown.

C. The CONTRACTOR may request a winter shutdown for the project if desired.This request must be submitted in writing to the ENGINEER at least fourteen (14)days prior to the proposed start of the shutdown. The total length of the

D. Contract times (calendar days) will be suspended for approved periods ofshutdown (suspension of work).

1.03 RESIDENT PROJECT REPRESENTATIVE

A. The OWNER will provide a part-time Resident Project Representative at no costto the CONTRACTOR. The Resident Project Representative is being provided forthe benefit of the OWNER, not the CONTRACTOR. Duties and responsibilities ofthe Resident Project Representative are indicated in paragraph 10.03 and 10.08of the General Conditions, and SC-10.03 of the Supplementary Conditions.

1.04 CONTRACTOR NOTIFICATIONS

A. The CONTRACTOR shall notify the Engineer a minimum of forty-eight (48) hoursin advance of key construction activities in order to have the Resident ProjectRepresentative present on-site and observe the work. The CONTRACTOR shallprovide this advance notice for the following construction activities:

1. Rehabilitation of existing precast concrete section operations(realignment of units, hardware replacement, and joint installation).

2. Installation of water diversion structures and devices.

3. Installation of traffic control devices and signage for alternating trafficand for detour route.

4. Construction of bridge and wingwall footings.

5. Fabrication and casting of all precast concrete elements at the fabricationplant.

6. Placement/erection of all precast units (bridge units, modular blockwingwall units, and retaining wall units).

7. Completion of constructing concrete framework and placing reinforcingsteel.

8. All cast-in-place concrete placement operations.

9. Installation of membranes.

10. Backfill placement and compaction in, around, behind and over bridgeand wingwall units.

11. Installation of geogrid and backfill placement and compaction in, around,and behind Redi-Rock mechanically stabilized Earth retaining wall orModular Block retaining wall.

12. Roadway subgrade placement and compaction.

13. All paving operations.

14. Signal foundation borings.

15. Drilling of signal foundations.

16. Changes to traffic configurations.

17. Installation or relocation of hydrants, water and sewer lines.

B. Failure of the CONTRACTOR to provide the proper advanced notice ofconstruction activities as indicated in paragraph 1.04-A may be cause forrejection of the work. Any work rejected shall be removed and replaced by theCONTRACTOR at not additional cost to the OWNER.

C. The CONTRACTOR shall notify the water & sewer utility (WhiteWater, Inc.) aminimum of forty-eight (48) hours in advance of any key construction activitiesrelated to hydrants, water and sewer lines and manholes.

1.05 MAINTENANCE OF TRAFFIC

A. Contractor is permitted to close Dunklee Road and Bridge and to detour vehicletraffic for a maximum period of one hundred eighty (180) days.

B. Access to driveways shall be maintained at all times, on NH Rte. 3A and DunkleeRoad.

C. At all other times during the duration of the project, the Contractor shallmaintain as a minimum, one way, alternating vehicle traffic on Dunklee Roadthrough the project.

D. Contractor will be assessed liquated damages of $750 for each day the road andbridge are closed beyond the permitted one hundred eight (180) day closure.

ITEM 1008.41 – UTILITY ADJUSTMENTS (WATER & SEWER)ITEM 1008.42 – UTILITY ADJUSTMENTS (GAS)

This special provision provides for supporting underground utilities, or alternativelyremoving and reinstalling underground utilities during construction.

Description

1.1 This work shall consist of designing, furnishing, and installing mechanisms totemporarily support the existing 12” water, 18” sewer, and 6” gas lines in the vicinity of thebridge during construction.

1.1.1 This work shall also consist of installing protective insulation for the existingwater and sewer pipes.

1.1.2 This work shall also consist of temporarily discontinuing water service in thevicinity of the bridge throughout construction.

1.2 This work shall alternatively consist of discontinuing water service andremoving/reinstalling water line and unused (dry) sewer line in the vicinity of the bridge duringconstruction.

1.2.1 this work shall also consist of disinfecting and pressure testing water line afterreinstallation, prior to returning service.

1.3 Contractor Option (means & methods) to temporary support underground water, sewerand gas (Section 1.1 above), or remove and reinstall water and sewer (Section 1.2 above).

Materials

2.1 Support materials shall not cause damage to the bridge or pipes. Materials shall becapable of supporting the water, sewer, and gas lines at full capacity.

2.1.1 Cribbing materials shall be timber, steel, concrete, or masonry or a combinationthereof.

2.1.2 Temporary Bridge materials shall be steel or concrete with hangers.

2.2 Rigid Foam Insulation shall be rigid extruded polystyrene 8 feet long, 4 feet wide and 2inches thick having an R value of 10 and conforming to ASTM C 578, Type VII, and shall beSTYROFOAM HI-60 as manufactured by Dow Corning Chemical Co., or approved equal.

Construction Requirements

3.1 Removal and Reinstallation (Option 1.2)

3.1.1 Temporary Water Shutoff. Water service shall be temporarily shut off (isolated)prior to conducting bridge excavation activities. Water service shall be resumed afterrehabilitation and backfilling activities are complete.

3.1.2 Temporary Sewer. Unused (dry) sewer line shall be removed prior to conductingbridge excavation activities. Sewer line shall be reinstalled after rehabilitation and backfillingactivities are complete.

3.2 Support System (Option 1.1)

3.2.1 Design. The support system shall be designed to adequately support the water,sewer, and gas lines as a single system or individually. Contractor shall submit a sequence andlayout plan for acceptance prior to work. The water and sewer pipes shall be supported at all jointlocations and halfway between joints. Support spacing shall be such that the pipe slope remainssmooth and consistent, matching the existing pipe’s slope and alignment. The maximumunsupported span of each utility shall be as follows:

6” Gas: 6’-0”12” Water: 10’-0”18” Sewer: 10’-0”

3.2.2 Handling. The contractor shall carefully handle the support materials and existingutilities to prevent damages to the utilities or bridge structure within the contractor’s control.Damages caused within the contractor’s control shall be repaired at no cost to the owner. Repairsrequired outside of the contractor’s control, such as an existing condition of the utilities, shall berepaired in accordance with Item 1002.1, Repairs or Replacements as Needed.

3.2.3 Insulation. In locations within the project limits where the water or sewer linesbecome exposed and 4-feet of cover will not be obtained, pipe shall be encased in sand or rigidfoam insulation shall be provided and extend 18” either side of pipe. (Water Line Sta 201 + 50 to202 + 10, 60 L.F. total). In the vicinity of the concrete rigid frame, insulation shall be providedbelow the pipes within 6-feet of either end of the bridge. Insulation shall be placed 6” above orbelow the existing water and sewer pipes and extend 18” either side of pipe, at the requiredlocations.

Method of Measurement

4.1 Utility Adjustments shall be measured as a unit. Any required excavation, backfill, orprotective measures shall be subsidiary.

4.2 Insulation and temporary service shutoff shall be subsidiary.

Basis of Payment

5.1 The accepted quantity of Utility Adjustments (temporary support of existing utilities orremoval and reinstallation of existing utilities) shall be paid for at the contract lump sumcomplete in place.
