2. Opening order $350. Minimum re-order $250. Special requests for re-orders below minimum are subject to a $15 service fee. Orders must meet item minimums and case pack quantities.

3. Terms: Credit Card Only. Visa, MasterCard, or American Express must be provided at time of order. Toss Designs does not grant NET terms for any opening orders. Existing net accounts with balances over 60 days will convert to prepaid, COD or credit card accounts. COD shipments are subject to a $20 service fee. A late fee of 1.5% per month will be added to all outstanding, unpaid invoice balances. Late invoices paid with credit card after terms are expired will be charged 3%. Toss Designs reserves the right to hold future or backorder shipments until account is paid in full. Customers who pay within terms will be given priority in order handling. Returned checks are subject to a $30 service fee. Collection proceedings begin automatically at 90 days. Customers are liable for all associated collection fees.

4. Backorders: Toss Designs will automatically ship all backorders once merchandise becomes available and will use the original payment method, including COD. If you wish to cancel your backorder, please contact Customer Service at 415.721.1036.

5. Shipments are made via UPS or Fed Ex Ground Service, FOB Northern California.

6. Shipping charges include freight and handling. Expedited shipping costs are at the customers’ expense. Every effort will be made to accommodate the timing of special shipment requests. Orders received for same day, overnight processing will be subject to a $25 service fee. Refused orders will be charged a 25% service fee.

7. Returns: Please examine your order upon receipt. Claims for damages or mis-shipments must be made within 3 days of receipt of goods. All returns require a written return authorization from Toss Customer Service. No returns will be accepted without a Return Authorization Number clearly noted on the return carton. For goods damaged in transit, packaging must be kept to substantiate any claims made against carrier. Returns will be charged a 25% restocking fee.

8. Minimum Advertised Pricing: Toss Designs products can only be advertised and offered to the public at a cost that is equal to or exceeds the currently managed per unit pricing structure set forth on the Toss Designs Wholesale Catalog, multiplied by a minimum factor of two (commonly referred to as ‘keystone’ pricing). For acceptable standard retail pricing, you may view online at www.tossdesigns.com. This includes print ads, direct mail or e-mail, brochures, flyers, television, cable, or radio broadcasts, as well as, any depictions or listings on any internet or website accessible by the public.

9. E-Commerce: Customers must be pre-approved by Toss Designs. We do not offer drop shipments. Opening order is $1,000.00, re-order minimum $500.00. Sales via internet auction and/or third party websites are prohibited. Toss Designs reserves the right to approve or decline any website distribution at any time.

10. Distribution: For the protection of our customers and our brand, Toss Designs reserves the right to limit distribution.

11. Canadian Customers: Please note all prices are in US Dollars. Toss Designs pays all duties and clears merchandise through customs before delivery to customer. 20% surcharge added to invoice to cover brokerage, handling, and international ground shipping.
