No one interested in human rights?

WILLIAM HEUVA

lLENlKELAO Lalvio from the Africa Human Rights and Justice Protection Network believes there is a campaign against human rights in Na· mibia after a planned workshop on minority r ights had 10 be cancelled when all the invited guests fruled to turn up.

Latvio, also the coordinator of the Minor· ity Rights Group International, said the Na· mibilJl Government had so far failed to make a finll commitment to human rights issues. She said it had not provided " proper representation" at a number of interna· tional forums on tfIese issues. According 10 Latvio, the United Na· tions bad expressed its disappointment with the Namibian Government aI the Vjel)fi3 conference in November last year over women's rights.

She added that she was very disappointed at the failure of the worksbop as sessions of this sort encouragedpeopleto sit

down and discuss issues and to reach mulual understanding.

Invited guests who failed toallend included the CO!, Department of Women Affairs, Slate House, Ministries of Home Affairs, Education and Justice, the office of SA Representative, the office of the ANC, Cultura 2000, Nordic Embassies, Brit· ish High Commission, American Embassy, Legal Assislance Cenlre. (CDM, MUN talks deadlock] Mine's top brass to meet with Government today

THE PRESIDENT of the Mineworkers' Union of Namibia (MUN), John Shaetonhodi, yesterday confirmed Ihat talks between the union and CDM about the retrenchment of I 100 workers fronllhe mine reached a deadlock last ..... riday.

Negotiations broke could resume talks with down over what MUN CDM. alleges is the continued While the Ministry has employment of aliens by slaled that those with mM while the company pennanent residence are plans 10 retrench Namiti· entitled to work in Nu-'"'S,

Shaetonhodi also dis· closed that CDM Execu· tive Director Abel Gower and odler top CDM man· agers will meet with Namibian Government in Wiodhoek today.

Shaetonhodi said CDM still employed many aliens with either pennanent residence pennits or temporary work]>Crmits.

He explained that MUN was waiting for clarification from Home Affairs on its policy with regard 10 issuing foreigners with residence and work. permits before it

mibia, MUN wanlS to know whelher foreigners are in fact allowed to lake away jobs from Namibians.

Shaetonhodi charged thal foreigners are employed even in unslcilled and semi-skilled jobs at CDM which the union felt should be reserved for Namibians. "The Ministry of Home Affairs is in fact contributing to unemployment in the country by giving out residence and work pennits to foreigners unnecessarily.

"We cannot compromise on the issue of lhe

company e mploying aliens whi le ;lIlhe s ame time retrenching Na· mibians," he said.

However. during last week 's talks MUN and CDM reached agreemenl on several important oUlstanding issues.

Shaelonhodi said the union and CDM agreed on the basic principles under which people would be relrenched, the procedures to be followed and the selection criteria for those to be retrenched.

They also agreed that CDM would Hrst offer e mployees lhe oplions of either taking volunlary retrenchment or early retirement.

CDM further under· look 10 con~ider either transferring employees whose jobs had been made redundant to other positions - possibly lower

paid jobs at a lowe r grade.

In addition, the uni on and CDM agreed on it

retrenchment package and on company " .... Si8-

lance with the relocation expenses of worke",

Shaelonhodi said he could not state the exact amounts that would be paid out to workers a.~ part of the retrenchment package.

In tenns of tile Labour Act an employer is required to pay an employee one week per ~ar of service. but according to Shaetonhodi the deal negotiated by MUN with CDM provided for more than this.

Furthermore, the company agreed that those workers who were relrenched would be giving priority for e mploymenl should any jobs become available in the futu re.

CDM abtJ undertook not 10 hire any nelV e mployec!\ fp'r thc limc being. "

Finall y CDM agrcctl 10 contribute tow:l. rds a retrenchment fund that would be used fortrain ing retrenched workers.

MUN initially asked CDM for R I million for the fund , but CDM indi cated it was not prepared to give more than R500 000.

Shaetonhodi however said it now appeared as though C DM might nOI even be prepared to give the R500 000 it had promised .

With regard to the number of workers th:lI might be retrenched he said the exact number would onl y be known once the process of identifying those wanted voluntary retrenchment, or early ret irement, had been completed .

THE NAMIBIAN Moncfay.Jamj~~ ;'8 19933' ,

Warmbad borders to be redrawn THE borders of Warm bad in the Karas region established by the Delimitation Commission ahead of the regional and local elections are to be redrawn as they exclude most of the town's residents.

Deputy minister of Local Govemment antl Housing, Jetty Ekandjo, told The Namibian that his Ministry had held a meeting to discuss the situation. He said that the *Odendaal delimiw lation exercise had de· dared the locatioD of Warmbad. Namasrus, as part of the Nama tribal

homeland. The Delimitation

Commission sel up by the Namibian Government overlooked this division and simply followed the previous act, Ekandjo said. The new delimitation was then gazetted .and used fo r local election purposes.

According to PJcandjo,

Nolte stops trial TIIE case in which Schalk Nolle, 43, is ac~used of brutally murdering his girlfriend was yesterday postponed to today by the Windboek High Coun.

Nolle is standing trial for the murder of Beatrix Hendrina Swan, who was shot and killed in a municipal bungalow at Swakopmund on April 19 last year.

When the trial started, Nolte ·askedlustice Theo Frank to postpone the case to give him a cbance to get a pro-deo defence counsel, as be was not in a position"to pay for a lawyer.

Nolte told the coun be regarded his case as serious andclaimedtbere were maoyirregularities about his detention. He said his documents to obtain a lawyer bad been torn up aod that there had even been plans to bomb his cell. Noire charged that because of these problems he could not conduct his own defence.

Judge Frank then issued a certificate to the Legal Aid Board requesting them to provide Nolle with a lawyer.

Laler yesterday Gerhard Burger was assigned to the case. which w" postponed to 10h00 today when N oIte will be asked to plead.

'Let's help teachers .. .'

JOSEF MOl1NGA

the Goverrunent had realised too late that the delimitation was incorrect and said it was imperative that the borders of Warmbad be redrawn before village and town councils submitted their budget proposals - 10 be discussed with the national budget in Marcb.

Otherwise, he added, Warmbad could only submit a budget for the

,

40 people living in the 'town ceooe' am the 400 in the location would be denied services.

Ekandjo added that he knew of no other case where re-delimitation was necessary. Towards the end of last year the Community Development Comminee and the Bondelswarts Steering Committee complained about the delimitation.

The Deputy Director of the Wannbad PeriUrban Board, Anie

Snyman, deplored the fact that the majority o f Warmbad 's residents had been excluded from the elections.

Call for Barnard to face trial JOHANNESBURG: There was more than enough evidence (0 justify a rmd ing that fornler Civil Cooperation Bureau agent Ferdi Barnardkilled Dr David Webster, senior counsel argued ill a Johannesburg Supremc Coun inquest yesterday.

Ebcrhard\ Bertelsmann, SC for the Webster Trust, argued there was su fficient evidence 10 establish a prima facie case against Barnard. He also argued that sevcral scn iorofficers of tllC covert organisation were accessories after the 'facI .

The inquest into the May 1, 1989 shotgun slaying of the anti-apanheid activist resumcd yesterday following a six-week adjournment. Bertelsmann submiued in his closing argument that Bamard should be found guilty of firing the shot that killed Or Websler outside his Troyville, Johannesburg home because:

- He had been identified in the courtroom as the murderer by witness Comelius du Plessis.

- Bamard's handler, L."lfras Luitingh, had testified that 8arnard admiued to him he had Idlled DrWebsler in order to inlpress senior CCR officials.

- Evidence by fonner Military Intelligence Chief Gen Witkop BadcnhorSI thal he had been inf(ltmcdof a rumour that Bamard was involved l'orroborated Luilingh's evidence.

- Evidence had also been given by wiUlesses th.lt Barnard had access to a Silwn-off dlluh!c-harrelled shotgun.

Bertel.~m3nn said Barnard was also 11 man with it

violent past who had joincd the CCR kM\\,lng flJJ1 well what its aims and objectives were. "I t is oUl" submission that 01 Strong prima facie case has been eSlalllished against Ferdi Barnard."

Benelsnwm said evidence had also provided print..1 facie proof thal several sen ior officers and Ihe CCB attempted in various ways to shield the murderer becausedisclosureofhis identity would h,Jve harmed the South African Defence Force anrlthe CCH.

Earlk.'f YCStCrdllY, State Advocate Jannic van Vuurcn argued that because of the nature of the cvidence. thl! coun was in 110 position to find who was probably responsible for Or Wehster's mU r(tCl .

Rugby tickets THE Namibia Rugby Union (NRU) announced yesterday that unprecedent interest was experienced on the first day for renewal of season tickets for the 1993 season.

The NRU reminded the public that existing tickets can only be renewed-up to February 8. Tickets that are not renewed by this dale will be

I made available to other interested persons from Fl!BIllaY,!'!3. "

The NRU further announced that the rugby programme for tbe year will be presented to the Annual General Meeting on February 20 for discussion and ratification, after which it will be made available to the news media.

"Everything points to a very good programme, should present negotiations be successful," said NRU manager Stoffel RocMr.

THE NAMIBIAN nalional soccer learn played its best inlemational malch allhe In· dependence Stadium in Windhoek on Sunday, when it wenl down 1-0 to a fired·up Madagascar in a crucial World Cup Group H qualifiers.

The resurgence of the Brave Warriors could not have come ata better time as they faced the country which handed them their fmt official international defeat (3-0) in the ftr'St round outing.

Namibia suffered another humiliation against the highly.regarded

'December was seen as the fmal straw for the coaching staff and team manager, Elifas Shipanga.

People had started to talk about replacing the technical staff before the

~ team had even arrived from Tanzania, and a few players were also e~pected to re dropped from !he squad.

But on Sunday tre players proved their critics wrong by holding their own against the Group H. leaders, who had even defeated favourites Zambia 2-0 in Antananarivo.

The Brave Warriors put up a good fight against the visitors on Sunday, and can count themselves unlucky not 10 have achieved a draw.

But despite enjoying territorial advan\:lge for the most part of the second i\3lf, Namibia has o~ again failed to score a single goal in four internationals.

The Namibian squad, despi te many successive breaks into Madagascar's goal area, never really threatened the visitors. Only when striker Kosie Springbok twice attacked the opposition goal and second half substitute Lesley Goagoseb allempted a header from close range

did the homeside teant look sharp.

The combination of midftelders Elifas Shivute and Rudy Pahl also paid off and hopefully these two with Steven 'Madigage' Damaseb, and the agile goalie Ronnie KanaJelo will maintain the same fonn against Zambia and Tanzania.

Namibia is e~pectcd to face Zambia in Lusakaon Sarurday, January 30. before hosting Tanzania on Sunday, February 28. al the Independence Stadium.

Our lasllwomatches in tre World Cup campaign, especially the tie against Zambia will prove wootrer we have learned from previous miSlalreS.

If our squad can maintain fonn and approach the last matches with the

same spirit as it did against Madagascar, then we can look forward 1.0 a brighter furure for Namibian soccer.

In addition, the technical committee should kf:ep an eye open for other promising players in the different regions. There are still players out there who derscrve a chance 10 prove themselves.

And there i~ scope for some posilional changes in our team. What about moving cilptain Tollie van Wyk to the midfield position, Sleven Damaseb 10 the centre forward pOsi. tion (he proved onoe again he is the only striker in this country who is able to face tough opposition) and trying out Puli Subeb or African Stars Nico Hindjou in the sweeper posilion.
