Executive Summary

Part IV of the Environment Act 1995 places a statutory duty on local authorities to review and assess the air quality within their area and take account of Government Guidance when undertaking such work. This Progress Report is a requirement of the Fourth Round of Review and Assessment and is a requirement for all local authorities. The Report has been undertaken in accordance with the Technical Guidance LAQM.TG (09) and associated tools (as updated in 2010).

This Progress Report considers all new monitoring data and assesses the data against the Air Quality Objectives. It also considers any development changes that may have an impact on air quality as well as updating on any relevant strategy and policy changes.

Having considered the latest monitoring data and development updated, it is concluded that the air quality objectives for benzene, 1, 3-butadiene, carbon monoxide, lead, PM10 and sulphur dioxide will be met. There is no requirement to undertake a Detailed Assessment for these pollutants. However, there are exceedences of the annual mean nitrogen dioxide objective identified through monitoring data outside of the declared Air Quality Management Areas, and where there is relevant exposure. Therefore Tonbridge and Malling Borough Council will proceed to a Detailed Assessment, for the area around Sevenoaks Road, Borough Green.

Proposed actions from the Annual Progress Report are as follows:

� Continue the current monitoring programme. � Complete a Detailed Assessment for the Sevenoaks Road, Borough Green area.

� Consider the installation of a continuous monitor within the Wateringbury AQMA to

provide more robust data prior to amending the existing AQMA declaration to include declaration for the hourly mean NO2 objective in Wateringbury.

� Investigate the possibility of re- locating tube site TN12 closer to relevant receptors. � Proceed to an Updating and Screening Assessment in 2012.

1 Introduction

1.1 Description of Local Authority Area

The borough of Tonbridge and Malling lies in the heart of Kent and is an area of variety and historical interest. The borough is dotted with numerous picturesque villages including West Malling, East Malling, Ightham, Offham, Trottiscliffe, Aylesford and Shipbourne. The River Medway flows in a north easterly direction through Tonbridge and the Medway Gap in the North Downs.

Industry and commerce are concentrated around Tonbridge, Aylesford, Ditton, Larkfield and Snodland. Mineral extraction has been carried out in the area for many years. Paper and packaging mills, distribution, general and light industry and many small businesses make up the industrial scene. The borough is a popular area for office location and high tech development, particularly at Kings Hill business and residential community.

The borough is well served with roads and there are two main railway lines to London and the Channel ports.

The main source of air pollution in the borough is road traffic emissions from major roads, notably the M20, M26, M2, A20, A21, A25, A26, A227, A228 and A229. The Council has declared six Air Quality Management Areas (AQMAs) in relation to road traffic emissions of nitrogen dioxide (NO2) and, in addition one area (M20 corridor) for particulates (PM10). Other pollution sources, including commercial, industrial and domestic sources, also make a contribution to background pollution concentrations.

1.2 Purpose of Progress Report

Progress Reports are required in the intervening years between the three-yearly Updating and Screening Assessment reports. Their purpose is to maintain continuity in the Local Air Quality Management (LAQM) process.

They are not intended to be as detailed as Updating and Screening Assessment Reports, or to require as much effort. However, if the Progress Report identifies the risk of exceedence of an Air Quality Strategy objective, the Local Authority (LA) should undertake a Detailed Assessment immediately, and not wait until the next round of Review and Assessment.

1.3 Air Quality Objectives

The air quality objectives applicable to Local Air Quality Management (LAQM) in England are set out in the Air Quality (England) Regulations 2000 (SI 928), and the Air Quality (England) (Amendment) Regulations 2002 (SI 3043). They are shown in Table 1. This table shows the objectives in units of microgrammes per cubic metre (µg/m3). For carbon monoxide the units used are milligrammes per cubic metre (mg/m3). Table 1 includes the number of permitted exceedences in any given year (where applicable).

1.4 Summary of Previous Review and Assessments

Tonbridge and Malling Borough Council undertook the first round of Review and Assessment between 1998 and 2001. The first round was a three-stage process, which assessed the sources of seven air pollutants of concern to health: benzene, 1,3 butadiene, carbon monoxide (CO), lead, nitrogen dioxide (NO2), fine particulates (PM10) and sulphur dioxide (SO2). The first round concluded that it was necessary to declare an Air Quality Management Area (AQMA) for nitrogen dioxide (NO2) and fine particulates (PM10) along the M20 corridor at Larkfield, Ditton and Aylesford due to road traffic emissions. An Air Quality Action Plan is in place to improve air quality within the M20 AQMA, in partnership with the Highways Agency.

The second round commenced in 2003 with the Updating and Screening Assessment (USA). Similar to stage one of the first round, there was consideration of the seven pollutants of concern to health and an assessment was made as to whether Air Quality Strategy (AQS) objectives for these pollutants would be met. The second round of Review and Assessment (2003 – 2004) concluded that there was a risk of exceedences of the NO2 annual mean objective at the nearest receptors to the:

� Tonbridge High Street (southern end),

� A26 Tonbridge Road/Red Hill junction (Wateringbury), and

� London Road/Station Road junction (Ditton).

Tonbridge and Malling Borough Council declared three further AQMAs at these locations on 1st June 2005. Road traffic emissions have been identified as the major contributor to exceedences of the annual mean NO2 objective in these three AQMAs. Tonbridge and Malling Borough Council are working in partnership with Kent County Council to implement actions to improve air quality through the Local Transport Plan and ‘Growth without Gridlock’.

The third round of Review and Assessment, following the same stages as the second round, beginning with a USA which Tonbridge and Malling Borough Council completed in June 2006, with the conclusion that a Detailed Assessment was required for NO2 due to emissions from road traffic outside the declared AQMAs along London Road in Larkfield, Ditton and Aylesford outside the declared AQMAs. Recommendations were also made for relocation of kerbside diffusion tube sites at Castle Way, Leybourne and London Road, Aylesford to more appropriate sites near to relevant exposure. In addition, monitoring was recommended at the nearest receptors to Hadlow Road/Cannon Lane, Tonbridge and A20 Hall Road/Mills Road, Aylesford junctions, to check compliance with the annual mean objective. The Detailed Assessment, which was informed by the additional monitoring, confirmed the need for two additional AQMAs along London Road at Larkfield/Ditton and Aylesford, which were declared in 2008. The Further Assessment was completed in 2009, which recommended continuance of the two AQMAs, along London Road at Aylesford and Larkfield, although the Larkfield AQMA was predicted to be marginally below the objective and may be revoked in future should monitoring continue to show compliance with the annual mean objective.

The 2009 Updating Screening and Assessment concluded that additional monitoring be undertaken for NO2 at Borough Green at the junction of the A25 Sevenoaks Road/ High Street as predicted annual mean NO2 concentrations were within 10% (36µgm3) of the air quality objective.

The 2010 Annual Progress report concluded that site TN70, Sevenoaks Road, Borough Green which is located outside the declared AQMAs, was showing an exceedence of the annual mean NO2 objective. However only 4 months of data was available, thus continuation of monitoring was recommended. In accordance with Defra’s feedback further monitoring is being undertaken and the results will be presented as a Detailed Assessment Report in 2011.

The AQMAs declared in the borough are illustrated in Figure 1 to Figure 6.

2 New Monitoring Data

2.1 Summary of Monitoring Undertaken

This section provides details of monitoring carried out in 2010, the year covered by this report.

Several changes were made to passive monitoring locations following the completion of the 2010 APR. Nine sites were removed and nine new sites were added during the year. No changes were made to the continuous monitoring site within the Tonbridge High Street AQMA.

Sites that were removed in 2010 were:

� TN28 – Bell Lane Ditton

� TN46 – 3 Station Road Ditton

� TN50 – 64 High Street Tonbridge

� TN67 – 17 McKenzie Close, Aylesford

� TN69 – 3 High Street Borough Green

� TN71 – 2 Maidstone Road Borough Green

� TN65\ TN66 – London Road Larkfield (part of a triplicate)

New sites added in 2010 were:

� TN72\ TN73 – 55 Sevenoaks Road Borough Green (part of a triplicate)

2.1.1 Automatic Monitoring Sites

Tonbridge and Malling Borough Council continue to monitor nitrogen dioxide using an continuous chemilumescence analyser at one location within the borough (Figure 9). The analyser, ‘Tonbridge Roadside 2’, is located within the Tonbridge High Street Air Quality Management Area (AQMA 3).

The Quality Assurance/Quality Control (QA/QC) procedures for the Kent and Medway Air Quality Monitoring Network (KMAQMN) are equivalent to the UK Automatic Urban and Rural Network (AURN) procedures with the exception of the following:

� Calibration of NOX analysers with NO gas (AURN also use NO2)

� Data checks are done once daily and downloads are done twice daily (AURN are hourly)

� Independent audits of the stations are undertaken annually (AURN are 6 monthly).

AEA operate as site managers for ‘Tonbridge Roadside 2’ and ratify the data on behalf of the Kent and Medway Air Quality Monitoring Network.(KMAQMN.)

2.1.2 Non-Automatic Monitoring

During 2010, the Council monitored NO2 using diffusion tubes at 30 sites, including 6 triplicates. As stated before, nine sites were closed in the first part of the year, with nine new sites being installed for the second half of the year.

The Council has provided nitrogen dioxide diffusion tube data to the Kent and Medway Air Quality Monitoring Network since 1993. The diffusion tubes are supplied and analysed by Scientifics (part of ESG and previously known as Harwell Scientifics) utilising the 50% Triethanolamine (TEA) in acetone preparation method. Scientifics participate in the Workplace Analysis Scheme for Proficiency (WASP) for NO2 diffusion tube analysis and the Annual Field Inter-Comparison Exercise. These provide strict performance criteria for participating laboratories to meet, thereby ensuring NO2 concentrations reported are of a high calibre. The lab follows the procedures set out in the Harmonisation Practical Guidance.

With regard to the application of a bias adjustment factor for the diffusion tubes, the technical guidance LAQM.TG (09) and LAQM Support website1.recommend use of a local bias adjustment factor where available and relevant to diffusion tube sites. Tonbridge and Malling Borough Council do not currently have a local co-location study, so the relevant bias adjustment factor for 2010 has been taken from the National Bias Adjustment spreadsheet. For 2010, the bias adjustment factor is 0.85 for this laboratory and preparation method (based on 18 studies; spreadsheet version 04/11). For 2008 - 2009 data, the bias corrected results have been taken from the Council’s 2010 LAQM Progress Report, to put the 2010 results into context.

2.2.1.2 Diffusion Tube Monitoring Data

The monitoring results for the Nitrogen Dioxide diffusion tubes across in Tonbridge and Malling are given in Table 6 below. For those diffusion tubes with less than 75% data capture, results have been annualised (see details in Appendix A).

Additional tubes were collocated during 2010 with single tubes TN42, TN45 and TN70, already installed, leading to these four sites becoming triplicate sites. Conversely, tubes were removed from triplicate site TN64 /65/66, with only tube TN64 remaining. As data capture for these sites varies depending on which set (single or triplicate) is considered, both results are provided in the table below.

2.2.2 Summary of Compliance with AQS Objectives

The 2010 diffusion tube results show that 13 sites exceeded the annual mean NO2 AQS objective of 40µg/m3 in 2010, 12 of which located within the declared AQMAs.

Results from TN12 (London Road, Wrotham Heath) also just meets the annual mean objective (39.9µg/m3). This site is outside the existing AQMAs, however, the nearest relevant receptor is located 26m away. It is therefore unlikely that the NO2 AQS objectives will be

exceeded at nearby properties and it is not necessary to proceed to a Detailed Assessment. Tonbridge and Malling will investigate the relocation of this tube site to be closer to the relevant receptors.

An exceedence was also recorded at TN70 in Borough Green, outside existing AQMAs. The NO2 annual mean at this site have been over 50µg/m3 both in 2009 and 2010. The Council did not proceed to Detailed Assessment for this site in 2009 as there was only four months of available data. Thus it was recommended that monitoring continue at the site till a full years data set was built up.

The Council should therefore progress to a Detailed Assessment as monitoring at TN70 continues to demonstrate a risk of exceedence of the annual mean objective. The additional monitoring at the site (now triplicate) that commenced in 2009 should be continued to aid the robustness of any assessment.

With respect to the hourly NO2 objective, there could be a potential risk of exceedence of this short-term objective, where the annual mean NO2 concentration is >60µg/m3.

TN42 on Tonbridge Road, Wateringbury with an annual mean of 70µg/m3 and TN33 on Tonbridge Road/Red Hill Corner, Wateringbury with an annual mean of 64µg/m3, indicate the risk of exceedence of the short term objective for NO2. Both sites are within the Wateringbury AQMA, which has been declared for the annual mean NO2 objective only; therefore, the Council should consider amending the AQMA order to cover the hourly mean objective as well.

Tonbridge and Malling Borough Council has measured concentrations of NO2 above the annual mean objective at relevant locations outside of the AQMAs, and will need to proceed to a Detailed Assessment , for the area around Sevenoaks Road, Borough Green.

4 Local / Regional Air Quality Strategy

Tonbridge and Malling Borough Council does not have a Local Air Quality Strategy, but works in partnership with Kent County Council (KCC) and the Kent and Medway district authorities through the Kent & Medway Air Quality Partnership on air quality issues across Kent.

KCC in partnership with Kent local authorities has produced the “Kent Environment Strategy 2010-13” 2, which considers air quality issues county-wide and includes the following objectives relevant to air quality:

� Meeting National Air Quality Objectives

� Reducing the impact on environmental health

� Planning new development appropriately

� Tackling transboundary pollution

The Kent Environment Strategy Progress Report (2007) provided an update with respect to progress with actions relating to air quality, as shown below:

� Despite reductions in some air pollutants, overall air quality in Kent is showing no clear improvement;

� Long-standing problems have been exacerbated by traffic growth, increased ozone pollution from distant sources and extreme weather such as heat waves which are becoming more likely as a result of global warming;

� The identification of new Air Quality Management Areas (AQMAs) is an indication of the problem – but only a first step in solving it;

� The effort going into ‘monitoring and action planning’ is still not being matched by ‘implementation’ of actual measures to improve air quality;

� Reducing emissions from HGV and car traffic remains the key challenge to improve air quality.

The Environment Strategy has been revised and a final version was to be published at the end of March 2011.

6 Air Quality Planning Policies

Tonbridge and Malling Borough Council produced a Local Development Framework in July 2009, which was formally adopted on April 2010. The Air Quality Policies are detailed in the Managing Development and the Environment Development Plan Document (MDE DPD). including Policy SQ4, which states that:

“Development will only be permitted where all of the following criteria are met:

� the proposed use does not result in a significant deterioration of the air quality of the area, either individually or cumulatively with other proposals or existing uses in the vicinity;

� proposals would not result in the circumstances that would lead to the creation of a new Air Quality Management Area;

� proximity to existing potentially air polluting uses will not have a harmful effect on the proposed use; and

� there is no impact on the air quality of internationally, nationally and locally designated sites of nature conservation interest or appropriate mitigation is proposed to alleviate any such impact.”

7 Local Transport Plans and Strategies

In 2011, KCC adopted its third Local Transport Plan (LTP3) which covers the period from 2011 to 2016. The LTP objectives related to A Safer and Healthier County “Prioritise spending to tackle Countywide problem sites including Air Quality Management Areas, crash cluster sites, and areas with high levels of health deprivation”. The report also states that “KCC will continue to work with the districts to assist in the development of Air Quality Action Plans (AQAPs) and consider appropriate mitigation measures which will then be put forward for inclusion in the annual Integrated Transport Programme”.

The Kent County Transport Strategy “Growth without Gridlock” was published in December 2010. The document provides strategies for the whole of Kent, but also some which are directly aimed at transport improvement within Tonbridge and Malling.

KCC has proposed several improvements to the current bus network in order to improve connectivity and promote the use of public transport. The following improvements have been outlined:

� Improvements in bus interchange;

� Bus Rapid Transport (BRT);

� Inter-urban coach service – to give all towns direct access to public transport;

� Local Bus Services – these will operate into the local communities with links to the inter-urban system; and

� Improvement to the rural bus network through rural interchange system.

8 Climate Change Strategies

The Tonbridge and Malling Borough Council Climate Change Strategy 2008/113, outlined how the Council will adapt and prepare for future changes as well as reducing greenhouse gas emissions. Details of the Strategy are provided in the Progress Report 2010.

Tonbridge and Malling’s Climate Change Strategy 2008-2011 was due to be updated this year, however the decision has been taken not to proceed with the review as KCC are developing a Kent wide Climate Change Adaptation Plan through the Climate Change Network, which if supported by the districts will lead to the partnership working with KCC.. The draft Adaptation Plan does contain a number of actions pertinent to the districts. Tonbridge & Malling B.C are proposing to link in with and actively support the KCC initiative.

9 Implementation of Action Plans

To date Tonbridge and Malling Borough Council have produced one Air Quality Action Plan in respect of the M20 AQMA.

Tonbridge and Malling Borough Council are in the process of preparing an Action Plan to address pollution levels in the A26 Wateringbury AQMA, the Tonbridge High Street AQMA and the London Road, Aylesford AQMA. It is intended that the draft Action Plan will be submitted to Defra in May 2011.

Progress on the current Action Plan is detailed in Table 7.

10 Conclusions and Proposed Actions

10.1 Conclusions from New Monitoring Data

The Annual Progress Report has shown that results continue to exceed the annual mean NO2 objective in all six AQMAs declared across the Borough.

Outside the AQMAs, one site, TN12 (London Road, Wrotham Heath) just meets annual mean AQS objective for NO2 (39.9µg/m3). However the nearest relevant receptor is a property located 26m from the monitoring site. It is therefore unlikely that the NO2 AQS objectives will be exceeded at nearby properties and it is not necessary to proceed to a Detailed Assessment. The Council will consider moving the tube closer to relevant receptors.

Another site in Borough Green (TN70) recorded a significant exceedence of the NO2 annual mean AQS objective. The site had been monitored to be over the AQS objective in 2009 however as this was only based on four months of data the Council did not proceed to Detailed Assessment. Data for a full year has now been collected and two more tubes added to the site to give a robust average. As the site is still over the AQS objective Tonbridge and Malling BC will therefore need to proceed to a Detailed Assessment, for the area around Sevenoaks Road, Borough Green.

Two sites were shown to be exceeding 60µgm3 within the Wateringbury AQMA, which indicates that the hourly mean NO2 objective is likely to be exceeded in the area in addition to the annual mean objective. Thus the Council should consider amending the AQMA order to include the hourly mean objective.

10.2 Conclusions relating to New Local Developments

The Annual Progress Report has found no new developments that will require detailed consideration in relation to air quality.

10.3 Proposed Actions

Proposed actions from the Annual Progress Report are as follows:

� Continue the current monitoring programme. � Complete a Detailed Assessment for the Sevenoaks Road, Borough Green area.

� Consider the installation of a continuous monitor within the Wateringbury AQMA to

provide more robust data prior to amending the existing AQMA order to include declaration for the hourly mean NO2 objective in Wateringbury.

� Investigate the possibility of re- locating tube site TN12 closer to relevant receptors. � Proceed to an Updating and Screening Assessment in 2012.

Appendix A: QA:QC Data Diffusion Tube Bias Adjustment Factors

Diffusion tubes are supplied and analysed by Scientifics (part of ESG formerly Harwell Scientifics) utilising the 50% Triethanolamine (TEA) in acetone preparation method. A bias adjustment of 0.85 for year 2010 has been derived from the national bias adjustment calculator (Version 04/11).

Factor from Local Co-location Studies (if available)

Tonbridge and Malling Borough Council did not operate any co-location monitoring sites in 2010.

Discussion of Choice of Factor to Use

As Tonbridge and Malling BC does not have a co-location study, the national bias adjustment calculator has been used for bias adjustment of the 2010 diffusion tube data. This is consistent with previous LAQM reporting.

Short-term to Long-term Data adjustment

A number of the diffusion tubes monitoring locations were installed or discontinued part way through the year. As a consequence the data capture at these sites for 2010 was less than 75%. Average concentrations at these sites were annualised using the method outlined in Tevchnical Guidance LAQM.TG (09), based on results from NOx urban background continuous monitoring analysers installed in Kent. A summary of these reference sites and associated annualisation factors is provided in Table A.1.

QA/QC of diffusion tube monitoring

Tube preparation and analysis follows operating procedure HS/WI/1015 (NO2). Nitrogen dioxide analysis procedures are compliant with the Diffusion Tubes for Ambient NO2 Monitoring: Practical Guidance for users and laboratories (February 2008).

Scientifics participates in the Workplace Analysis Scheme for Proficiency (WASP) for NO2 diffusion tube analysis and the Annual Field Inter-Comparison Exercise. These provide strict performance criteria for participating laboratories to meet, thereby ensuring NO2 concentrations reported are of a high calibre. In 2010 the Inter-Comparison rating for Harwell Scientifics was “good”. The 2010 WASP rounds have not yet been made available. However, for the latest rounds (covering April 2009 to April 2010), Scientifics performance was ”good”.
