The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of Environmental Clearance for Expansion of redevelopment on plot bearing CTS No. 833 (pt), Hissa No. 141(A) at Mudran Kamgar Nagar (Printing Press), village Ambivali, Andheri West, Mumbai, Maharashtra for PWD (GoM) by M/ s Hubtown Ltd. The proposal was considered by the EAC in its meetings held on 29 th September, 2014 - 1 st October, 2014 and 27th - 29 th October, 2014. The proponent has informed that: 1. The project accorded Environmental Clearance from SEIAA, Maharashtra vide No. SEAC-2011/CR-39/TC-2 dated 30.07.2013. 11. According to EC No. SEAC-2011/CR-39/TC-2 dated 30.07.2013, total construction area is 1,00,806.58 Sq. m and it includes Udyog Bhavan (2B + G + 15 Floors) and Sale Building of 3 Wings (3B + G + 2P + 15 Floors). iii. Sir,

This has reference to your application No. HTL/60545/E-6(ARCH)/ APP-Corres/42/2014 dated 25.08.2014 and subsequent letters dated 07.10.2014and 29.01.2015 seeking prior Environmental Clearance on the above-mentioned project.

2. The Ministry of Environment, Forests & Climate Change has consideredthe application. It is noted that the proposal is for grant of EnvironmentalClearance for Expansion of redevelopment on plot bearing CTS No. 833(pt), Hissa No. 141(A) at Mudran Kamgar Nagar (Printing Press), villageAmbivali, Andheri West, Mumbai, Maharashtra for PWD (GoM) by M/sHubtown Ltd. The proposal was considered by the EAC in its meetings heldon 29th September, 2014 - 1st October, 2014 and 27th - 29th October, 2014.The proponent has informed that:

1. The project accorded Environmental Clearance from SEIAA,Maharashtra vide No. SEAC-2011/CR-39/TC-2 dated 30.07.2013.

11. According to EC No. SEAC-2011/CR-39/TC-2 dated 30.07.2013, totalconstruction area is 1,00,806.58 Sq. m and it includes Udyog Bhavan(2B + G + 15 Floors) and Sale Building of 3 Wings (3B + G + 2P + 15Floors).

iii. The present proposal involves marginal expansion of PWD (Govt. ofMaharashtra) project for redevelopment on plot bearing CTS No. 833 (pt),Hissa No. 141(A) at Mudran Kamgar Nagar (Printing Press), villageAmbivali, Andheri West, Mumbai, Maharashtra.

iv. The total construction area after expansion is 1,04,944.38Sq.m.v. Project includes construction of Government Office Building known as

Udyog Bhavan (UB) (3B + G + 15 Floors) and Residential Sale Building(SB)of 3 Wings (WingA - 2B + G + 4P + 27 Floors, Wing B- 2B + G + 4P+ 23 Floors And Wing C- 2B + G + 4P + 2 Floors) with shop-line.

vi. The total municipal solid waste (UB-0.53 TDP and SB-0.75 TDP) will becollected and segregated. The waste water (UB-76 KLDand SB-162 KLD)generated from the domestic uses will be treated in STP (UB-90 KLDandSB-250 KLD)and utilized for landscaping and flushing. Sewage sludgeabout 30 KGD generated from STP will be used as manure.

vii.The total water requirement is 312 KLD (UB-95 KLDand SB-217 KLD)and will be met from MCGMjRecycled water.

viii.The power requirement is 100 KVA in construction phase and inoperation phase, the connected load is 5467 KW and demand load is2733 KWand will be sourced from Reliance Energy.

ix.4 nos. of D.G. set of capacity 350 KVAeach for back up to emergencyfacility.

x. Parking facility for 320 ECS in Udyog Bhawan and 911 ECS in SaleBuilding is proposed to be provided.

xi. Energy conservation measures are proposed to save over 21% of energy.xii.Existing 13 staff quarter buildings of GoM are proposed to be

demolished. Substitute accommodation to the existing occupants onGovt. plot is planned on the other plot of GOM at Chunnabhatti, whichis also being developed by the Proponent, under the said agreement.

xiii.This is a proposal for the Government of Maharashtra (GOM) forredevelopment of plot under Public Private Participation (PPP), whereinthe Proponent is the Concessionaire. The plot is in ownership of theState Government. The project is located in a Residential Zone-(R2) insanctioned Development Plan of Mumbai.

xiv.Wildlife issues: There are no National Parks, Wildlife Sanctuary,Biosphere Reserves found in the 10 km buffer zone.

xv. Forest land: No forest land involved in the project.xvi.There is no court cases/violation pending with the project proponent.

xvii.The Project Proponent vide letter no. Nil dated 29.01.2014 has givenundertaking that he is in possession of the said land and all necessaryand valid building and town planning permissions shall be obtained forthe entire project before commencing the work on site.

3. The proposal was examined by the EAC for Infrastructure Development,Coastal Regulation Zone, Building/ Construction and Miscellaneous projects inits meeting held in September, 2014 and EAC sought additional informationviz. details of prescribed minimum area for fire, recreation, common area,parking lift etc under the local regulations along with their compliance,measures to enhance the energy conservation from 13.30 to about 20%,parking requirement according to NBC vs local norms and a confirmation thatauditorium shall be for official use of Industries Department. The PP submittedthe letter from SE, PWD, Thane dated 21.10.2014 which conveyed that theiragreement with Hubtown is in force. PP also submitted letter from PWD,Andheri Circle which confirmed that the auditorium will be only for official useof Industries Department. PP informed that energy saving measures will beenhanced to save about 21 % of the energy.

4. The proposal was considered by the Expert Appraisal Committee (EAC)and recommended in its 140th EAC meeting held on 27th - 29th October, 2014for granting Environmental Clearance. The Ministry of Environment, Forests &Climate Change hereby accords Environmental Clearance for the above-mentioned Expansion ~redevelopment on plot bearing CTS No. 833 (pt),EC_Hubt own, Ltd. ~ Page 2 of8

Hissa No. 141(A) at Mudran Kamgar Nagar (Printing Press), villageAmbivali, Andheri West, Mumbai, Maharashtra for PWD (GoM) by M/ sHubtown Ltd. under the provisions of the Environment Impact AssessmentNotification, 2006 and amendments thereto and Circulars issued thereon andsubject to the compliance of the following specific conditions, in addition to thegeneral conditions mentioned below:

PARTA - SPECIFIC CONDITIONS

I. Construction Phase

(i) The Project Proponent shall obtain all necessary clearance/permission from all relevant agencies including town planningauthority before commencement of work.

(ii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act,1981 and Water (Prevention and Control of Pollution) Act, 1974.

(iii) The total construction area after expansion shall be 1,04,944.38sqm. Project will comprise Government Office Building known asUdyog Bhavan (UB) (3B + G + 15 Floors) and Residential SaleBuilding (SB) of 3 Wings (WingA - 2B + G + 4P + 27 Floors, WingB- 2B + G + 4P + 23 Floors and Wing C- 2B + G + 4P + 2 Floors)with shop-line.

(iv) The total municipal solid waste (UB-0.53 TDP and SB-0.75 TDP)shall be collected and segregated. The waste water (UB-76 KLDand SB-162 KLD) generated from the domestic uses shall betreated in STP (UB-90 KLD and SB-250 KLD) and utilized forlandscaping and flushing. Sewage sludge about 30 KGD generatedfrom STP shall be used as manure.

(v) The total water requirement is 312 KLD (UB-95 KLD and SB-217KLD)which shall be met from MCGM/Recycled water.

(viii) Parking facility for 320 ECS in Udyog Bhawan and 911 ECS inSale Building shall be provided.

(ix) Project Proponent shall comply with the conditions of NOC/Clearance obtained from fire department.

All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessaryclearances.

(x)

(xi) Suitable toilet fixtures for water conservation shall be provided.

(xii) Proponent shall obtain permission for ground water withdrawalfrom State Ground Water Authority.

(xiii) The rainwater harvesting plan should be incorporated by theCGWA.

(xiv) Provision shall be made for the housing of construction labourwithin the site with all necessary infrastructure and facilities suchas fuel for cooking, mobile toilets, mobile STP, safe drinking water,medical health care, creche etc. The housing may be in the form oftemporary structures to be removed after the completion of theproject.

(xv) A First Aid Room will be provided in the project both duringconstruction and operation of the project.

(xvi) All the topsoil excavated during construction activities should bestored for use in horticulture/landscape development within theproject site.

(xvii) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposedtaking the necessary precautions for general safety and healthaspects of people, only in approved sites with the approval ofcompetent authority.

(xviii)Soil and ground water samples will be tested to ascertain that thereis no threat to ground water quality by leaching of heavy metalsand other toxic contaminants.

(xix) Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminatewatercourses and the dump sites for such material must besecured so that they should not leach into the ground water.

(xx) Any hazardous waste generated during construction phase, shouldbe disposed off as per applicable rules and norms with necessaryapprovals of the State Pollution Control Board.

(xxi) The diesel generator sets to be used during construction phaseshould be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noiseemission standards.

(xxii) The diesel required for operating DG sets shall be stored inunderground tanks and clearance from Chief Controller ofExplosives shall be taken, as applicable.

(xxiii)Vehicles hired for bringing construction material to the site shouldbe in good condition and should have a pollution check certificateand should conform to applicable air and noise emission standardsand should be operated only during non-peak hours.

(xxiv)Ambient noise levels should conform to residential standards bothduring day and night as per Noise Pollution (Control and

Regulation) Rules, 2000. Incremental pollution loads on theambient air and noise quality should be closely monitored duringconstruction phase. Adequate measures should be made to reduceambient air and noise level during construction phase, so as toconform to the stipulated standards by CPCB/ SPCB.

(xxv) Fly ash should be used as building material in the construction asper the provisions of Fly Ash Notification of September, 1999 andamended as on 27th August, 2003.

(xxvi)Ready mixed concrete must be used in building construction.

(xxvii)Storm water control and its re-use as per CGWB and BISstandards for various applications.

(xxviii) Water demand during construction should be reduced by use ofpre-mixed concrete, cunng agents and other best practicesreferred.

(xxix) Permission to draw ground water shall be obtained from thecompetent Authority prior to construction/ operation of the project.

(xxx) Separation of grey and black water should be done by the use ofdual plumbing line for separation of grey and black water.

(xxxi)Fixtures for showers, toilet flushing and drinking should be of lowflow either by use of aerators or pressure reducing devices orsensor based control.

(xxxii)Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use highquality double glass with special reflective coating in windows.

(xxxiii) Regular supervision of the above and other measures formonitoring should be in place all through the construction phase,so as to avoid disturbance to the surroundings.

(xxxiv) Under the provisions of Environment (Protection) Act, 1986, legalaction shall be initiated against the project proponent if it wasfound that construction of the project has been started withoutobtaining environmental clearance.

II. Operation Phase

(i) The treated wastewater shall be recycled and reused for flushing oftoilets, horticulture and HVAC to reduce the demand of freshwater as committed.

(ii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management &Handling) Rules, 2000. No municipal waste should be disposed offoutside the premises.

(iii) The Operation and Maintenance of STP shall be made in the MoUwith STP supplier. Project Proponent shall ensure regularoperatio,haanncdmaintenance of the STP.

(iv) Parking facility with 9 m driveway shall be provided as committed.I..

(v) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

(vi) The installation of the Sewage Treatment Plant (STP) should becertified by an independent expert and a report in this regardshould be submitted to the Ministry before the project iscommissioned for operation. Treated affluent emanating from STPshall be recycled/ reused to the maximum extent possible.Treatment of 100% grey water by decentralized treatment shouldbe done. Discharge of unused treated affluent shall conform to thenorms and standards of the State Pollution Control Board.Necessary measures should be made to mitigate the odourproblem from STP.

(vii) The solid waste generated should be properly collected andsegregated. Wet garbage should be composted and dry/inert solidwaste should be disposed off to the approved sites for land fillingafter recovering recyclable material.

(viii) Diesel power generating sets proposed as source of back-up powerfor elevators and common area illumination during operationphase should be of enclosed type and conform to rules madeunder the Environment (Protection) Act, 1986. The height of stackof DG sets should be equal to the height needed for the combinedcapacity of all proposed DG sets. Use low sulphur diesel. Thelocation of the DG sets may be decided with in consultation withState Pollution Control Board.

(ix) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measuredat the boundary of the building shall be restricted to thepermissible levels to comply with the prevalent regulations.

The green belt of the adequate width and density preferably withlocal species along the periphery of the plot shall be raised so as toprovide protection against particulates and noise.

Rain water harvesting for roof run-off and surface run-off, asplan submitted should be implemented. Before recharging thesurface run off, pre-treatment must be done to remove suspendedmatter, oil and grease. The borewell for rainwater rechargingshould be kept at least 5 mts. above the highest ground watertable.

Energy conservation measures like installation of CFLs/TFLs forthe lighting the areas outside the building should be integral partof the project design and should be in place before projectcommissioning. Use CFLs and TFLs should be properly collectedand disposed off/ sent for recycling as per the prevailingguidelines/rules of the regulatory authority to avoid mercurycontamination. Use of solar panels may be done to the extentpossible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayedon the website of the concerned State Pollution Control Board. TheEC letter shall also be displayed at the Regional Office, DistrictIndustries centre and Collector's Office/ Tehsildar's office for 30days.

(ii) The funds earmarked for environmental protection measures shallbe kept in separate account and shall not be diverted for otherpurpose. Year-wise expenditure shall be reported to this Ministryand its concerned Regional Office.

5. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be givenfull cooperation, facilities and documents/data by the project proponentsduring their inspection. A complete set of all the documents submitted toMoEF&CC should be forwarded to the CCF, Regional office of MoEF&CC,Nagpur.

6. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

7. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection)Act, 1986, to ensure effective implementation of the suggested safeguardmeasures in a time bound and satisfactory manner.

8. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil AviationDepartment, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972etc. shall be obtained, as applicable by project proponents from the respectivecompetent authorities.

9. These stipulations would be enforced among others under the provisionsof Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, thePublic Liability (Insurance) Act, 1991 and EIANotification, 2006.

10. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance andcopies of clearance letters are available with the State Pollution Control Boardand may also be seen on the website of the Ministry of Environment, Forests &Climate Change at http://www.envfor.nic.in. The advertisement should bemade within Seven days from the date of receipt of the Clearance letter and acopy of the same should be forwarded to the Regional Office of this Ministry at

. Nagpur.

11. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to this project.

12. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section16 of the National Green Tribunal Act, 2010.

13. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and theLocal NGO, if any, from whom suggestions/ representations, if any, werereceived while processing the proposal. The clearance letter shall also be put onthe website of the company by the proponent.

14. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shallupdate the same periodically. It shall simultaneously be sent to the RegionalOffice of MoEF&CC, the respective Zonal Office of CPCB and the SPCB. Thecriteria pollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as wellas stack emissions) or critical sectoral parameters, indicated for the projectshall be monitored and displayed at a convenient location near the main gate ofthe company in the public domain.

15. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to theconcerned State Pollution Control Board as prescribed under the Environment(Protection) Rules, 1986, as amended subsequently, shall also be put on thewebsite of the company along with the status of compliance of EC conditionsand shall also be sent to the respective Regional Offices of MoEF&CC bye-mail.
