Sir, This has reference to your application 25.02.2015, submitting the above mentioned proposal to this Ministry for grant of Environmental Clearance (EC) in terms of the provisions of the Environment Impact Assessment Notification (EIA), 2006 under the Environment (Protection), Act, 1986. 2. The proposal for capacity enhancement of 'Treatment and disposal of Common Effluent and Hazardous Solid Waste facilities' at KIADB Industrial Area, Sompura, 1 st Stage Dobaspet, Nelamangala Taluk, Bangalore Rural District (Karnataka) by MIs Bangalore Eco Park Pvt Ltd, was considered by the Expert Appraisal Committee (EAC) in the Ministry for Infrastructure Development, Coastal Regulation Zone, Buildingj Construction and Miscellaneous projects, in its 147thmeeting held on 23 rd - 24th April, 2015. 3. The details of the project, as per the documents submitted by the Project Proponents (PP), and also as informed during the above said EAC meeting, are reported to be as under:- (i) Environmental Clearance has been obtained from MoEF for Incinerator capacity 200kgjhr vide letter F.No.10-2j2010-IA.III dated 25.10.2010. (ii) The project was accorded TOR for capacity enhancement of 'Treatment and disposal of Common Effluent and Hazardous Solid Waste facilities' at KIADB Industrial Area, Sompura, 1st Stage Dobaspet, Nelamangala Taluk, Bangalore Rural District (Karnataka) vide letter no. F.No.10-2j2010-IA.III dated 21.08.2013. (iii) The present proposal is for enhancement of capacity for treatment and disposal of common effluent and hazardous solid waste facilities in terms of Incinerator capacity from 200 to 500 Kgjhr & to Evaporate 100 KLD through Forced Evaporation . .~ (iv) The area for proposed incinerator is located at Plot no. 296B, Karnataka ~ industrial Area (KIADB),Sompura (V)1 st stage, Dabaspet (T),Bangalore (D). ~ (v) The total land allotted by Karnataka Industrial Area Development Board . Sir,

This has reference to your application 25.02.2015, submitting the abovementioned proposal to this Ministry for grant of Environmental Clearance (EC) interms of the provisions of the Environment Impact Assessment Notification (EIA),2006 under the Environment (Protection), Act, 1986.

2. The proposal for capacity enhancement of 'Treatment and disposal ofCommon Effluent and Hazardous Solid Waste facilities' at KIADB IndustrialArea, Sompura, 1st Stage Dobaspet, Nelamangala Taluk, Bangalore RuralDistrict (Karnataka) by MIs Bangalore Eco Park Pvt Ltd, was considered by theExpert Appraisal Committee (EAC)in the Ministry for Infrastructure Development,Coastal Regulation Zone, Buildingj Construction and Miscellaneous projects, in its147thmeeting held on 23rd - 24th April, 2015.

3. The details of the project, as per the documents submitted by the ProjectProponents (PP), and also as informed during the above said EAC meeting, arereported to be as under:-

dispose of the hazardous solid waste. The nearest highway is Tumkur, Bangalore NH4 West from the site and Dobaspet to Doddaballapur SH-207 is adjacent to the sitein South. Nearest railway station is Dobaspet Railway Station about 5 Km SouthEast.(vi) The project components involved are Incinerator, Compressors, Process LogicControl, MCCroom and Tank Farms.(vii) The total water requirement for the facility is 60 KLD and will be supplied byKIADB.It is estimated that the wastewater generation will be 20 KLD, from variousstages of the operation and most of the wastewater is treated and recycled. Theindustrial effluent of about 20 KLD from Scrubber bleed will be generated and thesame will be recycled to spray drier and there will be no discharge of processeffluent. Zero discharge will be maintained.(viii) The ash generated in the incinerator is considered as a hazardous solid waste.The incinerator ash will be collected in specified containers and stored in the pre-designated totally enclosed storage yards lined with HDPE and sent to KSPCBauthorized agency for disposal. The unit shall comply with the Hazardous WasteManagement rules 2008, the procedures for handling hazardous waste.(ix) Energy conservation measures such as use of CFLjLED lights, solar panels forstreet lighting are proposed.(x) A greenbelt of 15 m wide will is provided along the boundary of the project.Overall 33 % of the total area will be developed as greenbelt (open areas, along theroads, road junctions).(xi) Parking facility will be provided for employees near the main entrance.During construction around 40 Nos. and during operation around 50 nos.(xii) The total cost of the project includes machinery and land is Rs 4.9 Crores.(xiii) The project site is not situated in any Critically Polluted Area.(xiv) Public Hearing is waived off for this proposed project, because the unit isestablished in notified industrial area. There is no CRZ Area falling under projectcover area.(xv) Forest land: No issue of diversion of forest land is involved in the project. Thisproject does not involve tree cutting as this is open dry land.(xvi) Wildlife issues: No Eco-Sensitive Zone falls within 10 Km boundary of theproject.(xvii) Employment will be given to the local youth based on the qualification andexperrerice.(xviii)Project benefit: From the proposed project the major benefits, includeimproving the degraded environment by establishing an incinerator facility toenhance;

• The proposed project facilitates better management of the industrial wastes.It will be the showcase for other states for management of hazardous wastewith additional benefit of green and clean Environment.It minimizes the pollution load on environment from industrial hazardouswaste.Compliance with prescribed regulatory norms which in turn avert the risk ofclosure on account of violation of rules.It reduces the number of hazardous waste dump sites in the area and alsoeliminates the pollution potential.The management of wastes is relatively easier & economically viable atcommon facility.Cost of environmental monitoring is less at common facility.

\ • Reduced environmental liability due to captive storage of hazardous waste inthe premises of industries.

• Better occupational health and safety at individual industry level• Prevention of natural resource contamination thereby improving overall

environmental status.

4. The proposed project falls in project activity 7(d) - Category 'A', Commonhazardous waste treatment, storage and disposal facilities (TSDFs).

5. The proposal was considered by the Expert Appraisal Committee (EAC)in its147th meeting held on 23rd - 24th April, 2015 for grant of Environmental Clearance.As per recommendations of the EAC, the Ministry of Environment, Forest & ClimateChange hereby accords Environmental Clearance for capacity enhancement of theabove-mentioned project 'Treatment and disposal of Common Effluent andHazardous Solid Waste facilities' at KIADBIndustrial Area, Sompura, Dobaspet,Nelamangala Taluk, Bangalore Rural District (Karnataka) by Mis Bangalore EcoPark Pvt Ltd, under the provisions of the Environment Impact AssessmentNotification, 2006 and amendments thereto and Circulars issued thereon andsubject to the compliance of the following specific conditions, in addition to thegeneral conditions mentio~ed below:-

A. Specific Conditions:

(i) 'Consent to Establish' and Authorisation shall be obtained from State PollutionControl Board under the Air (Prevention and Control of Pollution) Act, 1981and the Water (Prevention and Control of Pollution) Act, 1974.

(ii) Transportation and handling of Hazardous Wastes shall be as per theHazardous Wastes (Management, Handling and Trans-boundary Movement)Rules, 2008 including the section 129 to 137 of Central Motor Vehicle Rules,1989.

(iii) Guidelines of CPCB for Common Hazardous Wastes Incinerators shall befollowed.

(iv) Incinerated ash shall be disposed at approved TSDF and MoD made in thisregard shall be submitted to the Ministry prior to the commencement.

(v) Periodical air quality monitoring in and around the site shall be carried out.The parameters shall include Dioxin and furan.

(vi) Use only low sulphur diesel. No other oil shall be used.

(vii) The proponent shall comply with the Environmental standards notified byMinistry of Environment & Forest for incinerators along with thetechnology / guidelines.

(viii) Necessary provision shall be made for firefighting facilities within the complex.

(ix) Project proponent should carryout periodical air quality monitoring in andaround the site including VOC, HC.

,(xi) Treated flue gas emissions discharge through stack to atmosphere shall always

be less than or equal to the parameter-specific emission standards notified bythe CPCB.

(xii) All the facilities shall be designed to achieve a minimum temperature of1100°C in secondary combustion chamber and with a gas residence time III

secondary combustion chamber not less than 2 (two) seconds.

(xiii) Incineration plants shall be operated (combustion chambers) with suchtemperature, retention time and turbulence, so as to achieve Total OrganicCarbon (TOC)content in the slag and bottom ashes less than 3%, or their losson ignition is less than 5% of the dry weight of the material.

(xiv) Guidelines published by the Central Board from time to time for commonincineration facilities shall be referred for implementation.

(xv) Transportation and handling of Bio-medical Wastes shall be as per the Bio-medical Wastes (Management and Handling) Rules, 2000 including the section129 to 137 of Central Motor Vehicle Rules, 1989.

(xvi) The proponent should ensure that the project fulfills all the provisions ofHazardous Wastes (Management, Handling and Transboundary Movement)Rules, 2008 including collection and transportation design etc and alsoguidelines for Common Hazardous Waste Incineration - 2005, issued by CPCB.

(xvii) The gas generated from the Landfill facility shall be collected and disposed asper rules.

(xviii)The Leachate from the facility shall be collected and treated to meet theprescribed standards before disposal.

(xix) The proponent should obtained necessary clearance from the Ground WaterAuthority.

(xx) The depth of the land fill should be decided based on the ground water level atthe site.

(xxi) Project proponent should prepare and implement an On Site EmergencyManagement Plan.

(xxii) Project proponent should carryout periodical ground water/soil monitoring inand around the site to check the contamination.

J (xxiii)Project proponent should carryout periodical ground water/soil monitoring inand around the site to check the contamination including TCLP test for heavy

(xxiv)The project should be operational with 24x7 monitoring devices for CETP andair quality, wherever necessary.

B. General Conditions:

(i) The project proponent should set up necessary facility for on site testing ofwastes to decide the requirement of treatment if any, before disposal.

(ii) The project proponent should set up separate environmental management cellfor effective implementation of the stipulated environmental safeguards underthe supervision of a Senior Executive.

,(iii) The project proponent should extend full support to the officers of this

Ministry /Regional Office during inspection of the project for monitoringpurposes by furnishing full details and action plan including action takenreports in respect of mitigation measures and other environmental protectionactivities.

(iv) A six-Monthly monitoring report shall need to be submitted by the projectproponents to the Regional Office of this Ministry at Bangalore regarding theimplementation of the stipulated conditions.

(v) The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection)Act, 1986, to ensure effective implementation of the suggested safeguardmeasures in a time bound and satisfactory manner.

(vi) In the event of a change in project profile or change in the implementationagency, a fresh clearance shall be obtained from the Ministry of Environment,Forest & Climate Change.

(vii) A copy of the clearance letter will be marked to concerned Panchayaty localNGO, if any, from whom any suggestion/ representation has been madereceived while processing the proposal.

(viii) The environmental safeguards contained III the EIA Report should beimplemented in letter and spirit.

(ix) The funds earmarked for environmental protection measures shall be kept inseparate account and shall not be diverted for other purpose. Year-wiseexpenditure shall be reported to this Ministry and its concerned RegionalOffice.

(x) A copy of the environmental clearance letter shall also be displayed on thewebsite of the concerned State Pollution Control Board. The EC letter shallalso be displayed at the Regional Office, District Industries centre andCollector's Office / Tehsildar's office for 30 days.

6. These stipulations would be enforced among others under the provisions ofWater (Prevention and Control of Pollution) Act 1974, the Air (Prevention and Controlof Pollution) Act 1981, the Environment (Protection) Act, 1986, the P.ublic Liability(Insurance) Act, 1991 and EIA Notification 1994, including the amendments andrules made thereafter.

7. All other statutory clearances such as the approvals for storage of diesel fromChief Controller of Explosives, Fire Department, Civil Aviation Department, ForestConservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, asapplicable by project proponents from the respective competent authorities.

8. The project proponent shall advertise in at least two local Newspapers widelycirculated in the region, one of which shall be in the vernacular language informingthat the project has been accorded Environmental Clearance and copies of clearanceletters are available with the State Pollution Control Board and may also be seen onthe website of the Ministry of Environment, Forest & Climate Change athtt: www.envfor.nic.in. The advertisement should be made within Seven days

from the date of receipt of the Clearance letter and a copy of the same should be ,forwarded to the Regional office of this Ministry at Bangalore.

9. This Clearance is subject to final order of the Hon'ble Supreme Court of Indiain the matter of Goa Foundation Vs Union of India in Writ Petition (Civil)No.460 of2004 as may be applicable to this project.

10. Any appeal against this clearance shall lie with the National Green Tribunal, ifpreferred, within a period of 30 days as prescribed under Section 16 of the NationalGreen Tribunal Act, 2010.

11. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisady Municipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestions/ representations, if any, were received whileprocessing the proposal. The clearance letter shall also be put on the website of thecompany by the proponent.

12. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall update thesame periodically. It shall simultaneously be sent to the Regional Office of MoEFCC,the respective Zonal Office of CPCB and the SPCB.

13. The project proponent shall also submit six monthly reports on the status ofcompliance of the stipulated EC conditions including results of monitored data (bothin hard copies as well as bye-mail) to the respective Regional Office of MoEF&CC,the respective Zonal Office of CPCB and the SPCB.

14. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of EC conditions and shall also be sentto the respective Regional Offices of MoEF&CCbye-mail.
