Important Notice OklahomalawoutlinestwoprocessesforthefilingofTitle42possessoryliensonvehicles,manufacturedhomes,commercialtrailers,boatsandoutboardmotors.Whiletheprocessesaresimilaroverall,importantdistinctionsremain.Asa result, the two processes are addressed separately within this information packet, as outlined below. Section I - Part 1 Procedural Instructions

Process 1 PursuanttoTitle42Section91oftheOklahomaStatutes

Process 1 Applicabletovehicles,manufacturedhomes,commercialtrailers,boatsandoutboardmotorstitledinthestateof

Oklahoma,orwithafederallyrecognizedtribe,andonwhichanactivelien(notover15yearsold–seepage1)isrecordedandforwhichthelienclaimantsarenoteitherlicensedClassAAwreckerservices,exceptwhenperformingconsensualtows,orsalvagepools,asdefinedinTitle47Section591.2oftheOklahomaStatutes.

Title42requestsareprocessedintheordertheyarereceived.Processingtimedependsonthevolumeofrequests. ThefollowinginformationistoserveasanoutlineofthegeneralTitle42possessorylienfilingprocedures,hereindesignatedasProcess1.OklahomastatutorylanguageapplicabletoProcess1isreproducedinSectionI-Part2.

Refertothenoticeonpage1ofthisinformationpacketforanexplanationregardingthedistinctionbetweenProcess1and Process 2.

Itisthelienfiler’sresponsibilitytoreviewandensurepropercompliancewithallapplicablestatutoryrequirements.Failure to comply with any statutory requirement shall result in denial of the title application and cause the special lien to be subordinate to any perfected lien. Upon such denial, the applicant shall be entitled to one resubmission of the title applicationwithin15businessdaysofthereceiptofthedenial.

Upon receipt of notice of legal proceedings, the OTC shall cause the sale process to be put on hold until a notice of resolutionsofcourtproceedingsisreceivedfromthecourt. 42 OS § 90 A person or persons charging a fee for the preparation or assistance in preparation of notices required by Chapter 2 of

Title 42 of the Oklahoma Statutes, other than a person licensed under Title 5 of the Oklahoma Statutes, shall register withandsubmitafifty-dollarannualfeetotheOklahomaTaxCommission;provided,however,suchrequirementsshall not apply to a lawful possessor or employee of a lawful possessor of the property for which such notices are issued. All documentation related to notices prepared by a person required to register pursuant to this section shall includethenameoftheperson.ApenaltyofOneHundredDollars($100.00)shallbeimposeduponapersonwhopreparesorassistsinthepreparationofnoticesinviolationoftherequirementsofthissection.TheOklahomaTaxCommission shall promulgate rules to effectuate the requirements of this section

42 OS § 91(A) states, in pertinent part (Refer to Section I - Part 2 for complete language): Anypersonwho,whilelawfullyinpossessionofanarticleofSection91PersonalProperty,rendersanyservicetothe

ownerthereofbyfurnishingstorage,rentalspace,material,labororskillfortheprotection,improvement,safekeeping,towing, right to occupy space, storage or carriage thereof, has a special lien thereon, dependent on possession, for thecompensation,ifany,whichisduetosuchpersonfromtheownerforsuchservice.

This special lien shall be subordinate to any perfected security interest unless the claimant complies with the requirements of this section.

Theintentofthisinformationpacketistoprovideproceduralguidanceinapplyingtheabovereferenced,andaccompanying,statutoryprovisions.

Ownership - Lienholder Determination Process 1

Record ownership and the existence of any lienholders may be established as follows: Oklahoma Registered Property • IfthepropertyhasanOklahomalicenseplate,registrationdecal,boatregistrationnumberorisotherwisebelieved

tohavebeenregisteredinthisstate,contactanyOklahomatagagencyforownershiporlienholderinformation.Providedtheinformationisavailableinthecomputerfile,youwillbeaskedtocompleteaVehicleInformationRequestForm769(availableatthetagagencyorontheOTCwebsite)andpaytheapplicablefeeof$1.00plusmail fee.

• Ifthereisnocurrentownershiporlienholderrecordonfile,asconfirmedbythetagagency,completeaVehicle

InformationRequestForm769($1.00plusmailfee)requestingasearchforthelastrecordownertobelocatedand the computer record restored and submit to the OTC Motor Vehicle Title Research Section. On the request form,makeanotationthatyouarerequestingrestorationofarecordpursuanttoaTitle42possessorylienfiling.

Please allow 10 business days from the date the request is received for research and return mail time. If you do notreceiveanynotificationfromtheResearchSectionbythattime,youmaytelephone405.521.3120toinquireastothestatus of your request. Indian Tribal Registration Contactthemotorvehicledepartment,orequivalent,ofthattribeforownershipandlienholderinformation.Onceobtained,thosepartiesaretobenotifiedofthependingsale. • Theownershipandlienholderdocumentationprovided(i.e.letterorcomputerfileprintout)bythetribeisrequired

tobesubmittedtotheOTCMotorVehicleDivisionforreviewandapprovalaspartofthecompletefilingpacket.Ifthetriberefusestoprovidesuchinformation,thatrejectiondocumentationmustbesubmitted.

The Title 42 Process May Not be Used on an Assembled Vehicle

Anassembledvehicleisanyvehicleinwhichanyofthefourmajorcomponentshavebeenreplaced.Thefourmajorcomponents are:

1. BodyorCab 2. Frame 3. FrontClip(fromthefirewallforward,fenders,hood,grill,bumper,etc.) 4. Rear Clip (for the rear window back, fenders, trunk lid, bumper, etc.)

Note:Engineandtransmissioncanbereplacedwithoutaffectingthefourmajorcomponents.

ContacttheOTCMotorVehicleTitleSectionforinstructiononassembledvehiclesortopetitionthecourtsforownershipofthevehicle.

ItisunlawfultousetheTitle42processonavehiclethatwaspurchased.

ThevehiclemustbeinthepossessionoftheTitle42filerforafull30daysandthevehicle’sphysicallocationmustbeinthe state of Oklahoma before the Title 42 process can be submitted.

Form 752-D Notice of Possessory Lien Process 1

Form752-DNoticeofPossessoryLienisanotificationtoallinterestedpartiesofapossessorylien.Itmustbecompletedin its entirety and distributed as outlined below. • InterestedpartiesareoutlinedinTitle42Section91(A)(8)oftheOklahomaStatutes.RefertoSectionI-Part2of

this information packet. • Thenoticemustbesentbyboth1stclassU.S.mailandcertifiedmailwithreturnreceiptrequestedtoall

interested parties who reside at separate locations. • Includeaphotograph,ifthepropertyisSection91PersonalProperty. • Includeanitemizedstatementdescribingthedateordatesthelabororserviceswereperformedandmaterial

furnished, and the charges claimed for each item, the totals of which shall equal the total compensation claimed. • Includewrittenproofofauthoritytoperformthework,labororservice,orthatthepropertywasabandonedbythe

owneriftheclaimantdidnotrenderanyotherservice. • If the claimant is a business then the name of the contact person representing the business must be shown. • Noticemustbesentnolaterthan60daysafterthefirstservicesarerendered. • Nostoragechargesmaybeassesseduntilnoticeisproperlygiventoallinterestedparties,unlessstorageor

spacerentalwasagreedtobycontractaspartofanoverallagreementpertainingprimarilytostorageorspacerentalagreement,inwhichcasethechargesmaybeginupto60dayspriortothedatetheNoticeismailed.[Title42Section91(A)(5)oftheOklahomaStatutes].

• Intheeventofadenial,theNoticeofPossessoryLienandtheNoticeofSalemaybemailedonthesamedayin

separateenvelopesandstoragechargesshallonlybechargedfromthedateofresubmission.

Form 752-A Notice of Sale Process 1

Form 752-A Notice of Sale must be completed in its entirety, including all statutorily required information. • NoticeofSalerequiredinformationforProcess1isoutlinedinTitle42Section91(A)(6)oftheOklahomaStatutes.

Refer to Section I - Part 2 of this information packet. Distribution of Notice A copy of the Notice of Sale must be posted in two public places within the county in which the property is to be sold at least10dayspriortothesaledate. AcopyoftheNoticeofSalemustalsobemailedbycertifiedmailwithreturnreceiptrequestedand1stclassUSmailtoeachinterestedparty,asdefinedbystatute,atleastten(10)dayspriortothesaledate. The Notice of Sale shall include:

1. AphotographofthepropertyifthepropertyisSection91PersonalPropertyandiftheconditionofsuchpropertyhas materially changed since the mailing of the Notice of Possessory Lien form.

2. Writtenproofofauthoritytoperformthework,labororservice,orthatthepropertywasabandonediftheclaimantdidnotrenderanyotherservice.

3. Thename,completephysicaladdress,mailingaddressandtelephonenumberofthepartyforeclosingsuchlienshall be listed. If the claimant is a business, then the name of the contact person representing the business must be shown.

4. Itemized charges which equal the total compensation claimed.

Proceedingsforforeclosureunderthisactshallbecommencednosoonerthan10daysandnolaterthan30daysaftertheNoticeofPossessoryLienhasbeenmailed,asevidencedbycertifiedmail. • InterestedpartiesforProcess1areoutlinedinTitle42Section91(A)(8)oftheOklahomaStatutes.Referto

Section I - Part 2 of this information packet. • Ifamanufacturedhome,noticebycertifiedmailshallalsobesenttothecountytreasurerandcountyassessorof

the county in which the manufactured home is located. Thewhitecertifiedmailreceipt(s)must list the name and address indicating where the Notice of Sale was sent and must bepostmarkedbythepostoffice.Thispostmarkdatewillbeusedtoconfirmthedatemailedinestablishingtherequired10dayperiodbetweenthemailingdateandthepropertysaledate.TheUSPostalServiceapprovedelectronicequivalentofproofofreturnreceiptrequested.PSForm3811DomesticReturnReceiptshallsatisfydocumentationrequirements. • Failuretoproperlycompletethemailreceiptwillresultinrejectionoftheapplication Please note the following: • ThelienholdershallbeallowedtoretrievetheSection91PersonalPropertywithoutbeingrequiredtobringthe

titleintothelienholder’snameifthelienholderprovidesproofitisalienholderandanypaymentduetheclaimantfor lawful charges where the claimant has complied with the statutory requirements.

• Uponreleaseofpersonalpropertytoaninsurerorrepresentativeoftheinsurer,wreckeroperatorsshallbe

exempt from all liability and shall be held harmless for any losses or claims of loss. • No possessory lien sale may be held on a Sunday. • Afull10daysmustpassbetweennotificationandsale.Thesalemaybenosoonerthanthe11thdayfollowingthe

postofficedatestampedonthecertifiedmailreceipt(s).

Example:CertifiedmailreceiptsaredatedJuly3,2015.TheearliestallowedsaledatewouldbeJuly14,2015(11daysplus3=14).ThesaledateshouldbeplacedonbothForm752-ANoticeofSaleandForm752-CReturnofSale. All forms must list the same public sale date.Ifthesedatesdonotmatch,theTitle42willberejected.

Form 752-B Proof of Posting and Mailing

Process 1 Form752-BProofofPostingandMailingistobecompletedinitsentirety,listingacompletevehicledescription,thelocationswheretheNoticeofSalewaspostedandallinterestedpartiesthatwerenotifiedbycertifiedmailwithreturnreceiptrequestedand1stclassUSmail.

Form 752-C Return of Sale (Assignment of Ownership)Process 1

Form 752-C Return of Sale is to be completed upon sale of the property, recording the date of sale, purchase price, the newowner(buyer)andtheodometerdisclosureinformation(requiredonlyonmotorvehicles20yearsoldandnewer).

Requirements Following Public Sale of the Property Process 1

Following the sale of the property, the following properly completed and notarized (if applicable) photo copies must be submittedtotheOTCMotorVehicleDivision: 1. Form752-ANoticeofSale 2. Form 752-B Proof of Posting and Mailing 3. Whitepostmarkedcertifiedmailingreceipt(s)withreturnreceiptrequestedtoallinterestedparties 4. Form 752-C Return of Sale 5. Vehiclerecorddocumentationorrejectiondocumentationfromthetitlingjurisdiction’smotorvehicledepartmentor

equivalent(whenapplicable) 6. Form 752-D Possessory Lien Notice Note:Toavoidtheassessmentofdelinquentpenalties,alldocumentsmustbesubmittedwithin30daysfollowingthesaleof the property. Pleasereviewthedocumentsbeforesubmitting,bearingthefollowinginmind: • Alterations of any kind are not acceptable (i.e. erasures, white-out, etc.). • Seller or DBA is the person or company claiming the Title 42 Lien. Submission of the completed Title 42 lien paperwork to the OTC does notguaranteeapprovalofownershiptransfer.AllsuchtransfersofownershipmustbereviewedandapprovedbytheOTC.

Notice Vehicles,boatsandoutboardmotorsacquiredthroughtheTitle42lienprocessmaybesubjecttodelinquentfeesand taxes due the state of Oklahoma.

Section I Part 2 Statutory Authority

Process 1 Process 1

Applicabletovehicles,manufacturedhomes,commercialtrailers,boatsandoutboardmotorstitledinthestateofOklahoma,orwithafederallyrecognizedtribe,andonwhichanactivelien(notover15yearsold–seepage1)isrecordedandforwhichthelienclaimantsarenoteitherlicensedClassAAwreckerservices,exceptwhenperformingconsensualtows,orsalvagepools,asdefinedinTitle47Section591.2oftheOklahomaStatutes.

42 O.S. § 91 (A) (SelectedProvisions) 1.a.Thissectionappliestoeveryvehicle,all-terrainvehicle,utilityvehicle,manufacturedhome,motorcycle,boat,

outboardmotor,ortrailerthathasacertificateoftitleissuedbytheOklahomaTaxCommissionorbyafederallyrecognizedIndiantribeintheStateofOklahoma,exceptasotherwiseprovidedinsubsectionDofthissection.ThissectiondoesnotapplytofarmequipmentasdefinedinSection91.2ofthistitle.Theitemsofpersonalpropertytowhichthissectionappliesarecollectivelyreferredtoas“Section91PersonalProperty”.IfpersonalpropertyisapparentlycoveredbothbythissectionandbySections191through200ofthistitle,theproceduressetoutinthissectionshallapplyinsteadofSections191through200ofthistitle.

b.SalvagepoolsasdefinedinSection591.2ofTitle47oftheOklahomaStatutesandclassAAlicensedwrecker

servicestakingpossessionofavehiclepursuanttoanagreementwithoratthedirectionof,ordispatchedby,astateorlocallawenforcementorgovernmentagency,orpursuanttotheabandonedvehicleremovalprovisionsofSection954AofTitle47oftheOklahomaStatutes,shallnotbesubjecttotheprovisionsofthissection,butshallbesubjecttotheprovisionsofSection91Aofthistitle.Unlessotherwiseprovidedbythissubparagraph,classAAlicensedwreckerservicesperformingconsensualtowsshallbesubjecttotheprovisionsofthissection.

2. Anypersonwho,whilelawfullyinpossessionofanarticleofSection91PersonalProperty,rendersanyservice

totheownerthereofbyfurnishingstorage,rentalspace,material,labororskillfortheprotection,improvement,safekeeping, towing, right to occupy space, storage or carriage thereof, has a special lien thereon, dependent on possession,forthecompensation,ifany,whichisduetosuchpersonfromtheownerforsuchservice.

3. Thisspeciallienshallbesubordinatetoanyperfectedsecurityinterestunlesstheclaimantcomplieswiththe

requirements of this section. Failure to comply with any requirements of this section shall result in denial of any title application and cause the special lien to be subordinate to any perfected lien. Upon such denial, the applicantshallbeentitledtooneresubmissionofthetitleapplicationwithinfifteen(15)businessdaysofreceiptofthedenial,andproceedtocomplywiththerequirementsofthissection.Intheeventofadenial,theNoticeofPossessoryLienandtheNoticeofSalemaybemailedonthesamedayinseparateenvelopesandstoragechargesshallonlybechargedfromthedateofresubmission.“Failuretocomply”includes,butisnotlimitedto:

a. failuretotimelyprovideadditionaldocumentationsupportingorverifyinganyentryonsubmittedformsas

requestedbytheTaxCommission,includingbutnotlimitedtoUnitedStatesPostalServiceproofofreturnreceiptrequestedsuchasForm3811orUnitedStatesPostalServiceelectronicequivalent,

b. failuretoprovidethedocumentationsupportinglawfulpossessionasdefinedinparagraph3ofsubsectionHof

this section, c. claimantortheagentbeingotherthantheindividualwhoprovidedtheservicegivingrisetothespeciallien,asin

paragraph 2 of this subsection, d. claimantnotbeinginpossessionofthevehicle, e. noticeofliennotfiledinaccordancewithparagraph4ofthissubsection,or f. foreclosurenotificationandproceedingsnotaccomplishedinaccordancewithparagraph6ofthissection.

4. Anypersonclaimingthespeciallienprovidedinparagraph2ofthissubsectionshallmailanoticeofsuchlien,nolaterthansixty(60)daysafterthefirstservicesarerendered,byregular,firstclassUnitedStatesmail,andbycertifiedmail,returnreceiptrequested,toallinterestedpartieswhoresideatseparatelocations.Ifservicesprovidedarepursuanttoacontractprimarilyforthepurposeofstorageorrentalofspace,thebeginningdateofthesixty-dayperiodprovidedintheprevioussentenceshallbethefirstdayofthefirstperiodorpartialperiodforwhich rental or storage charges remain unpaid. The notice shall be in writing and shall contain, but not be limited to, the following:

a. a statement that the notice is a Notice of Possessory Lien, b. the complete legal name, physical and mailing address, and telephone number of the claimant, c. the complete legal name, physical and mailing address of the person who requested that the claimant render

servicetotheownerbyfurnishingmaterial,labororskill,storage,orrentalspace,orthedatethepropertywasabandonediftheclaimantdidnotrenderanyotherservice,

d. adescriptionofthearticleofpersonalproperty,includingaphotographifthepropertyisSection91Personal

Property, and the complete physical and mailing address of the location of the article of personal property, e. anitemizedstatementdescribingthedateordatesthelabororserviceswereperformedandmaterialfurnished,

and the charges claimed for each item, the totals of which shall equal the total compensation claimed, f. a statement by the claimant that the materials, labor or skill furnished, or arrangement for storage or rental of

space,wasauthorizedbytheownerofthepersonalpropertyandwasinfactprovidedorperformed,andwrittenproofofauthoritytoperformthework,labororservice,orthatthepropertywasabandonedbytheowneriftheclaimantdidnotrenderanyotherservice,andthatstorageorrentalfeeswillaccrueasallowedbylaw,and

g. the signature of the claimant which shall be notarized and, if applicable, the signature of the claimant’s attorney.

If the claimant is a business, then the name of the contact person representing the business must be shown. In place of an original signature and notary seal, a digital or electronic signature or seal shall be accepted.

5. ForservicesrenderedorvehiclesabandonedonorafterNovember1,2005,storagechargesorchargesforrental

ofspace,unlessagreedtobycontractaspartofanoveralltransactionorarrangementthatwasprimarilyforthepurposeofstorageoftheSection91PersonalPropertyorrentalofspace,mayonlybeassessedbeginningwiththedaythattheNoticeofPossessoryLienismailedasevidencedbycertifiedmail.Provided,however,inthecaseofcontractualchargesincurredforstorageorrentalofspaceinanoveralltransactionprimarilyforthepurposeofstorageorrental,chargessubjecttothespeciallienmayonlybeassessedbeginningwithadatenotmorethansixty(60)dayspriortothedaythattheNoticeofPossessoryLienismailed,andshallaccrueonlyattheregularperiodicrateforstorageorrentalasprovidedinthecontract,adjustedforpartialperiodsofstorage or rental. The maximum allowable compensation for storage shall not exceed the fees established by the Corporation Commission for nonconsensual tows.

6. The lien may be foreclosed by a sale of such personal property upon the notice and in the manner following: The

Notice of Sale shall be in writing and shall contain, but not be limited to: a. a statement that the notice is a Notice of Sale, b. the names of all interested parties known to the claimant, c. adescriptionofthepropertytobesold,includingaphotographifthepropertyisSection91PersonalPropertyand

if the condition of such property has materially changed since the mailing of Notice of Possessory Lien required pursuant to paragraph 4 of this subsection,

d. anotarizedstatementofthenatureofthework,labororserviceperformed,materialfurnished,orstorageorrental

ofspace,andthedatethereof,andthenameofthepersonwhoauthorizedthework,labororserviceperformed,orthestorageorrentalarrangement,andwrittenproofofauthoritytoperformthework,labororservice,orthatthepropertywasabandonediftheclaimantdidnotrenderanyotherservice,

e. the date, time and exact physical location of sale,

f. the name, complete physical address, mailing address and telephone number of the party foreclosing such lien. If the claimant is a business, then the name of the contact person representing the business must be shown. In place of an original signature and notary seal, a digital or electronic signature or seal shall be accepted, and

g. itemized charges which shall equal the total compensation claimed. 7. Such Notice of Sale shall be posted in two public places in the county where the property is to be sold at least ten

(10)daysbeforethetimethereinspecifiedforsuchsale,andacopyofthenoticeshallbemailedtoallinterestedpartiesattheirlast-knownpostofficeaddress,byregular,firstclassUnitedStatesmailandbycertifiedmailreturnreceiptrequested,atleastten(10)daysbeforethedateofthesale.Iftheitemofpersonalpropertyisamanufacturedhome,noticeshallalsobesentbycertifiedmailtothecountytreasurerandtothecountyassessorof the county where the manufactured home is located.

8. Interestedpartiesshallincludeallownersofthearticleofpersonalpropertyasindicatedbythecertificateoftitle

issuedbytheTaxCommissionorbyafederallyrecognizedIndiantribeintheStateofOklahoma;liendebtors,ifany,otherthantheowners;anylienholderwhoselienisnotedonthefaceofthecertificateoftitle;andanyotherpersonhavinganyinterestinthearticleofpersonalpropertyofwhomtheclaimanthasactualnotice.

9. Anyinterestedpartyshallbepermittedtoinspectandverifytheservicesrenderedbytheclaimantpriorto

the sale of the article of personal property during normal business hours. The lienholder shall be allowed to retrievetheSection91PersonalPropertywithoutbeingrequiredtobringthetitleintothelienholder’sname,ifthelienholderprovidesproofitisalienholderandanypaymentduetheclaimantforlawfulchargeswheretheclaimant has complied with the requirements of this section. Upon the release of personal property to an insurer orrepresentativeoftheinsurer,wreckeroperatorsshallbeexemptfromallliabilityandshallbeheldharmlessforany losses or claims of loss.

10.Theclaimantoranyotherpersonmayingoodfaithbecomeapurchaserofthepropertysold. 11. Proceedingsforforeclosureunderthisactshallbecommencednosoonerthanten(10)daysandnolaterthan

thirty(30)daysaftertheNoticeofPossessoryLienhasbeenmailedasevidencedbycertifiedmail.Thedateactuallysoldshallbewithinsixty(60)daysfromthedateoftheNoticeofSaleasevidencedbycertifiedmail.

42 O.S. § 91D 1. Ifavehicle,all-terrainvehicle,utilityvehicle,manufacturedhome,motorcycle,boat,outboardmotor,ortrailer

hasacertificateoftitleissuedbytheTaxCommissionorbyafederallyrecognizedIndiantribeintheStateofOklahoma,butthereisnoactivelienrecordedonthecertificateoftitle,Section91Aofthistitlewillapplyinsteadofthissection.Likewise,ifthereisanactivelienrecordedonthecertificateoftitlebutthelienisoverfifteen(15)yearsoldandthepropertyisnotamanufacturedhome,Section91Aofthistitlewillapplyinsteadofthissection.

2. IfpersonalpropertythatotherwisewouldbecoveredbythissectionhasbeenregisteredbytheTaxCommission

orbyafederallyrecognizedIndiantribeintheStateofOklahoma,andthereisalienofrecordbutnocertificateoftitlehasbeenissued,Section91Aofthistitlewillapplyinsteadofthissection.

3. Ifpersonalpropertyotherwisewouldbecoveredbythissection,buttheserviceswererenderedortheproperty

wasabandonedpriortoNovember1,2005,Section91Aofthistitlewillapplyinsteadofthissection. 42 O.S. § 91 E. A person who knowingly makes a false statement of a material fact regarding the furnishing of storage, rental

space,material,labororskillfortheprotection,improvement,safekeeping,towing,righttooccupyspace,storageorcarriagethereofinaproceedingunderthissection,orattemptstouseorusestheprovisionsofthissectiontoforecloseanownerorlienholder’sinterestinavehicleknowingthatanyofthestatementsmadeintheproceedingarefalse,uponconviction,shallbeguiltyofafelony.

F. Upon receipt of notice of legal proceedings, the Tax Commission shall cause the sale process to be put on hold

untilnoticeofresolutionofcourtproceedingsisreceivedfromthecourt.IfsuchnoticeofcommencementofcourtproceedingsisnotfiledwiththeTaxCommission,thepossessoryliensaleprocessmaycontinue.

G. No possessory lien sale shall be held on a Sunday.

H. For purposes of this section:

1. “Possession”includesactualpossessionandconstructivepossession; 2. “Constructivepossession”meanspossessionbyapersonwho,althoughnotinactualpossession,doesnothave

anintentiontoabandonproperty,knowinglyhasbothpowerandtheintentionatagiventimetoexercisedominionorcontrolovertheproperty,andwhoholdsclaimtosuchthingbyvirtueofsomelegalright;

3. “Lawfullyinpossession”meansapersonhasdocumentationfromtheownerorowner’sauthorizedagent,oran

insurance company or its authorized agent, authorizing the furnishing of material, labor or storage, or that the property was authorized to be towed to a repair facility. If the person lacks such documentation, he or she shall notbelawfullyinpossessionoftheSection91PersonalPropertyandshallnotbeentitledtoaspeciallienassetforthinthissection;and

4. “Itemizedcharges”meanstotalparts,totallabor,totaltowingfees,totalstoragefees,totalprocessingfeesand

totals of any other fee groups, the sum total of which shall equal the compensation claimed. I. Forpurposesofthissection,theUnitedStatesPostalServiceapprovedelectronicequivalentofproofofreturn

receiptrequestedForm3811shallsatisfyreturnreceiptrequesteddocumentationrequirements. J. Ifapersonclaimingaspeciallienpursuanttothissectionfailstocomplywithanyoftherequirementsofthis

section, any interested party may proceed against the person claiming such lien for all damages arising therefrom, includingconversion,ifthearticleofpersonalpropertyhasbeensold.Ifthenoticeornoticesrequiredbythissection shall be shown to be knowingly false or fraudulent, the interested party shall be entitled to treble damages. Theprevailingpartyshallbeentitledtoallcosts,includingreasonableattorneyfees.

K. Thissectionshallapplytoallactionsorproceedingsthatcommenceonoraftertheeffectivedateofthisact.

Process 2: Applicabletovehicles,manufacturedhomes,commercialtrailers,boatsandoutboardmotorstitledinanotherstate

orwhichdonothaveacertificateoftitle,orhaveacertificateoftitleonwhichanactivelienisnotrecorded,orareexcludedfromProcess1byTitle42Section91(D)oftheOklahomaStatutes,oronwhichthelienclaimantiseitheralicensedClassAAwreckerservice,exceptwhenperformingconsensualtows,orsalvagepool,asdefinedinTitle47Section591.2oftheOklahomaStatutes.SectionII-Part1ofthisinformationpacketcontainsproceduralinstructionsrelating to Process 2. Section II - Part 2 contains selected portions of applicable Oklahoma statutory text relating to Process 2.

Title42requestsareprocessedintheordertheyarereceived.Processingtimedependsonthevolumeofrequests. ThefollowinginformationistoserveasanoutlineofthegeneralTitle42possessorylienfilingprocedures,hereindesigned as Process 2. Oklahoma statutory language applicable to Process 2 is reproduced in Section 2 - Part 2.

Itisthelienfiler’sresponsibilitytoreviewandensurepropercompliancewithallapplicablestatutoryrequirements.Failuretocomplywithanystatutoryrequirementshallresultindenialofthetitleapplicationand,withthespecificexceptionsofClassAAwreckertowingchargesandliensclaimedbysalvagepoolsdefinedunderTitle47Section591.2oftheOklahoma Statutes, cause the special lien to be subordinate to any perfected lien. Upon such denial, the applicant shall beentitledto1resubmissionofthetitleapplicationwithin30businessdaysofreceiptofthedenial.

Upon request of notice of legal proceedings, the OTC shall cause the sale process to be put on hold until a notice of resolutionofcourtproceedingsisreceivedfromthecourt.

42 OS § 90A person or persons charging a fee for the preparation or assistance in preparation of notices required by Chapter 2 of Title 42 of the Oklahoma Statutes, other than a person licensed under Title 5 of the Oklahoma Statutes, shall register withandsubmitafifty-dollarannualfeetotheOklahomaTaxCommission;provided,however,suchrequirementsshall not apply to a lawful possessor or employee of a lawful possessor of the property for which such notices are issued. All documentation related to notices prepared by a person required to register pursuant to this section shall includethenameoftheperson.ApenaltyofOneHundredDollars($100.00)shallbeimposeduponapersonwhopreparesorassistsinthepreparationofnoticesinviolationoftherequirementsofthissection.TheOklahomaTaxCommission shall promulgate rules to effectuate the requirements of this section.

42 OS § 91A, states, in pertinent part (Refer to Section II - Part 2 for complete language): Any person who, while lawfully in possession of an article of personal property to which this section applies, renders anyservicetotheownerthereofbyfurnishingstorage,rentalspace,material,labororskillfortheprotection,improvement,safekeeping,towing,righttooccupyspace,storageorcarriagethereof,hasaspeciallienthereon,dependentonpossession,forthecompensation,ifany,whichisduetosuchpersonfromtheownerforsuchservice.Charges owed under a contract primarily for the purpose of storage or rental of space shall be accrued only at the regularperiodicrateforstorageorrentalasprovidedinthecontract,adjustedforpartialperiodsofstorageorrental. This special lien shall be subordinate to any perfected security interest unless the claimant complies with the requirements of this section.

Theintentofthisinformationpacketistoprovideproceduralguidanceinapplyingtheabovereferencedandaccompanyingstatutoryprovisions.

• Ifthereisnocurrentownership/lienholderrecordonfile,asconfirmedbythetagagency,orthereisnolicenseplateorregistrationdecalaffixedtotheproperty(i.e.stateofregistrationunknown),completeForm769VehicleInformation Request, requesting a search for the last record owner to be located and the computer record restored($1.00plusmailfee)andsubmittotheOTCMotorVehicleTitleResearchSection.Ontherequestform,makeanotationthatyouarerequestingrestorationofarecordpursuanttoaTitle42possessorylienfiling.

Note: If a record is found, it will be restored and a printout returned to the requestor. If no Oklahoma record is found, a responsewillbereturnedstatingthatfact.Inthatevent,theTitlingJurisdictionUnknownprocedurewillapply.

Thewhitecertifiedmailreceipt(s)must list the name and address indicating where the Notice of Sale was sent and must bepostmarkedbythepostoffice.Thispostmarkdatewillbeusedtoconfirmthedatemailedinestablishingtherequiredten(10)dayperiodbetweenthemailingdateandthepropertysaledate.TheUSPostalServiceapprovedelectronicequivalentofproofofreturnreceiptrequested.PSForm3811DomesticReturnReceiptshallsatisfydocumentationrequirements.

• FailuretoproperlycompletethemailreceiptwillresultintheTitle42beingrejected.

Afull10daysmustpassbetweennotificationandsale.Thesalemaybenosoonerthanthe11thdayfollowingthepostofficedatestampedonthecertifiedmailreceipt(s).

Example:CertifiedmailreceiptsaredatedJuly3,2015.TheearliestallowedsaledatewouldbeJuly14,2015(11daysplus3=14).ThesaledateshouldbeplacedonbothForm752-ANoticeofSaleandForm752-CReturnofSale. All forms must list the same public sale date.Ifthesedatesdonotmatch,theTitle42willberejected.

Newspaper Notice Instructions Process 2

Intheeventallapplicableownershipandlienholderdeterminationprocedureshavebeenfollowedandresultedinnorecordfound,theownershipnotificationrequirementmaybesatisfiedbyplacinganewspapernoticestatingthepropertyis to be sold at public auction. The following guidelines apply:

• ThenewspapermustbeauthorizedtopublishlegalnoticespursuanttotheprovisionsofTitle25Section106oftheOklahomaStatutesandmustbepublishedinthecountyinwhichthevehicle,boatormotorislocated.Ifnonewspaper authorized by law to publish legal notices is published in that county, the notice is to be published in somesuchnewspaperofgeneralcirculationwhichispublishedinanadjoiningcounty.TheeligibilityofaspecificnewspapermaybeverifiedbycontactingtheOTCMotorVehicleTitle42Section.

• Thenewspapernoticemustidentifythepropertybyidentificationnumber,yearandmake.

(1) farmequipmentasdefinedinSection91.2ofthistitle,and

(2) “Section91PersonalProperty”asdefinedinSection91ofthistitle.

b. Thissectionappliestoanyvehicle,all-terrainvehicle,utilityvehicle,manufacturedhome,motorcycle,boat,outboardmotor,ortrailerthatisexcludedfromcoverageundersubsectionAofSection91ofthistitlebecausethepersonal property:

(1) doesnothaveacertificateoftitle,or

(2) hasacertificateoftitlebutdoesnothaveanactivelienrecordedonthecertificateoftitle,or

(3) hasacertificateoftitlethatisnotissuedbytheOklahomaTaxCommissionorbyafederallyrecognizedIndian tribe in the State of Oklahoma, or

(4) isotherwiseexcludedbysubparagraphbofparagraph1ofsubsectionAofSection91ofthistitleorsubsectionDofSection91ofthistitle.

c. Ifpersonalpropertyhasacertificateoftitle,orwouldberequiredtohaveacertificateoftitleunderOklahomalaw,andisapparentlycoveredbothbythissectionandbySections191through200ofthistitle,theproceduressetoutinthissectionshallapplyinsteadofSections191through200ofthistitle.IfpersonalpropertywithoutacertificateoftitleandnotrequiredtobetitledunderOklahomalawiscoveredbothbythissectionandSections191through200ofthistitle,theproceduressetoutinSections191through200ofthistitleshallapplyinsteadofthis section.

2. a. Any person who, while lawfully in possession of an article of personal property to which this section applies, rendersanyservicetotheownerthereofbyfurnishingstorage,rentalspace,material,labororskillfortheprotection,improvement,safekeeping,towing,righttooccupyspace,storageorcarriagethereof,hasaspeciallien thereon, dependent on possession, for the compensation, if any, which is due to such person from the owner forsuchservice.Chargesowedunderacontractprimarilyforthepurposeofstorageorrentalofspaceshallbeaccruedonlyattheregularperiodicrateforstorageorrentalasprovidedinthecontract,adjustedforpartialperiods of storage or rental.

b. Except for Class AA licensed wrecker towing charges, the special lien shall be subordinate to any perfected security interest unless the claimant complies with the requirements of this section. Failure to comply with any requirements of this section shall result in denial of any title application and cause the special lien to be subordinate to any perfected lien. Upon such denial, the applicant shall be entitled to one resubmission of the title applicationwithinthirty(30)businessdaysofreceiptofthedenial,andproceedtocomplywiththerequirementsofthissection.“Failuretocomply”includes,butisnotlimitedto:

1. failuretotimelyprovideadditionaldocumentationsupportingorverifyinganyentryonsubmittedformsasrequested by the Tax Commission,

2. failuretoprovidethedocumentationsupportinglawfulpossessionasoutlinedinparagraph3ofsubsection H of this section,

3. claimantbeingotherthantheindividualwhoprovidedtheservicegivingrisetothespeciallien,asinsubparagraph a of this paragraph,

4. claimantnotbeinginpossessionofthevehicle,or 5. notificationandproceedingsnotaccomplishedinaccordancewithsubparagraphCofthisparagraph,and

paragraph3ofthissubsection. C. Anypersonclaimingalienunderthissectionshallrequest,withinfive(5)businessdaysofperforminganyservice

or work on the property, the Tax Commission or other appropriate license agency to furnish the name and address ofthecurrentownerofandanylienholderupontheproperty.TheMotorVehicleDivisionoftheTaxCommissionorappropriatelicenseagencyshallrespondinpersonorbymailtothelienclaimantwithinten(10)businessdays of the receipt of the request for information. The Tax Commission shall render assistance to ascertain ownership,ifneeded.Thelienclaimantshallsend,withinseven(7)businessdaysofreceiptoftherequestedinformation from the Oklahoma Tax Commission or other licensed agency, a notice of the location of the property bycertifiedmailwithreturnreceiptrequested,postageprepaidtotheownerandanylienholderofthevehicleattheaddressesfurnished.Thelienclaimantmaychargetwentydollars($20.00)forprocessingplusthecostofpostage if the notice is timely sent pursuant to the requirements of this subparagraph in addition to fees regulated by the Oklahoma Corporation Commission for licensed wreckers. If the lien claimant is unable to meet the time requirementsduetothelackoforanalteredvehicleidentificationnumberontheproperty,thelienclaimantshallproceeddiligentlytoobtainthepropervehicleidentificationnumberandshallmeetthetimerequirementsonthenoticeoncethevehicleidentificationnumberisknown.Ifthelienclaimantisrequiredtosendadditionalnotices because of change of ownership or lienholder after it has timely complied with the requirements of this subparagraph, the lien claimant shall remain in compliance if such additional notices are sent within the required timeperiodsfromthedateofdiscoveryofthenewownersorlienholders.Thenoticeshallbeinwritingandshallcontain, but not be limited to, the following:

1astatementthatthenoticeisaNoticeofPossessoryLien, 2. the complete legal name, physical and mailing address, and telephone number of the claimant, 3. thecompletelegalname,physicalandmailingaddressofthepersonwhorequestedthattheclaimantrender

servicetotheownerbyfurnishingmaterial,labororskill,storage,orrentalspace,orthedatethepropertywasabandonediftheclaimantdidnotrenderanyotherservice,

4. a description of the article of personal property, and the complete physical and mailing address of the location

of the article of personal property, 5. thenatureofthework,labororserviceperformed,materialfurnished,orthestorageorrentalarrangement,

andthedatethereof,andwrittenproofofauthoritytoperformthework,labororserviceprovidedthat,inthecase of a law enforcement directed tow, the logbook entry prescribed in OAC 595:25-5-5 or the tow ticket as definedbytheCorporationCommissionshallserveaswrittenproofofauthority,

6. the signature of the claimant which shall be notarized and, if applicable, the signature of the claimant’s

attorney. If the claimant is a business, the name of the contact person representing the business shall be shown. In place of an original signature and notary seal, a digital or electronic signature or seal shall be accepted, and

7. anitemizedstatementdescribingthedateordatesthelabororserviceswereperformedandthematerial

furnished and the charges claimed for each item, the totals of which shall equal the total compensation claimed.

The lien claimant shall not be required to send the notice required in this subparagraph if the property is

released to an interested party before the notice is mailed and no additional charges or fees continue to accrue. If a law enforcement agency has the property towed to a law enforcement facility, the person claiming a lien under this section shall not be required to send notice until the property is released by law enforcement to the claimant or the date which claimantstartschargingstorage,whicheverisearlier.Alienclaimantshallhaveanextensionoften(10)businessdaysto send the notice required in this subparagraph if a state of emergency has been declared in the county in which the property is located.

d.SubparagraphsbandcofthisparagraphshallnotapplytosalvagepoolsasdefinedinSection591.2ofTitle47of the Oklahoma Statutes.

3. Thelienmaybeforeclosedbyasaleofsuchpersonalpropertyuponthenoticeandinthemannerfollowing:The

notice shall be in writing and shall contain, but not be limited to: a. the names of the owner and any other known party or parties who may claim any interest in the property, b. adescriptionofthepropertytobesold,includingavisualinspectionoraphotographifthepropertyisamotor

vehicle,andthephysicallocationoftheproperty, c. thenatureofthework,labororserviceperformed,materialfurnished,orthestorageorrentalarrangement,

andthedatethereof,andwrittenproofofauthoritytoperformthework,labororserviceprovided.Inthecase of a law enforcement directed tow, the logbook entry prescribed in OAC 595:25-5-5 or the tow ticket as definedbytheCorporationCommission,shallserveaswrittenproofofauthority,

d. the time and place of sale, e. the name, telephone number, physical address and mailing address of the claimant, and agent or attorney, if

any, foreclosing such lien. If the claimant is a business, then the name of the contact person representing the business must be shown. In place of an original signature and notary seal, a digital or electronic signature or seal shall be accepted, and

f. itemized charges which shall equal the total compensation claimed. 4.a. Such Notice of Sale shall be posted in two public places in the county where the property is to be sold at least

ten(10)daysbeforethetimethereinspecifiedforsuchsale,andacopyofthenoticeshallbemailedtotheownerandanyotherpartyclaiminganyinterestinthepropertyifknown,attheirlast-knownpostofficeaddress,bycertifiedmail,returnreceiptrequested,atleastten(10)daysbeforethetimethereinspecifiedforsuchsale.Iftheitemofpersonalpropertyisamanufacturedhome,noticeshallalsobesentbycertifiedmailtothecountytreasurer and to the county assessor of the county where the manufactured home is located.

b. Inthecaseofanyitemofpersonalpropertywithoutacertificateoftitleandnotrequiredtobetitledunder

Oklahomalaw,apartywhoclaimsanyinterestinthepropertyshallincludeallownersoftheproperty;anysecuredpartywhohasanactivefinancingstatementonfilewiththecountyclerkofOklahomaCountylistingone or more owners of the property by legal name as debtors and indicating a collateral description that would includetheproperty;andanyotherpersonhavinganyinterestinthepersonalproperty,ofwhomtheclaimanthas actual notice.

c. Inthecaseofpersonalpropertysubjecttothissectionforwhichacertificateoftitlehasbeenissuedbyany

jurisdiction,apartywhoclaimsanyinterestinthepropertyshallincludeallownersofthearticleofpersonalpropertyasindicatedbythecertificateoftitle;liendebtors,ifany,otherthantheowners;anylienholderwhoselienisnotedonthefaceofthecertificateoftitle;andanyotherpersonhavinganyinterestinthearticleofpersonal property, of whom the claimant has actual notice.

d. Whenthejurisdictionoftitlingforavehicle,all-terrainvehicle,utilityvehicle,motorcycle,boat,outboardmotor,

ortrailerthatisfive(5)modelyearsoldornewer,oramanufacturedhomethatisfifteen(15)modelyearsoldor newer, cannot be determined by ordinary means, the claimant, the agent of the claimant, or the attorney of theclaimant,shallrequest,inwriting,thattheOklahomaTaxCommissionMotorVehicleDivisionascertainthejurisdictionwherethevehicleormanufacturedhomeistitled.TheOklahomaTaxCommissionMotorVehicleDivisionshall,withinfourteen(14)daysfromthedatetherequestisreceived,provideinformationastothejurisdictionwherethepersonalpropertyistitled.IftheOklahomaTaxCommissionMotorVehicleDivisionisunabletoprovidetheinformation,itshallprovidenoticethattherecordisnotavailable.

e. When personal property is of a type that Oklahoma law requires to be titled, the owner of record of that propertyisunknown,andthejurisdictionoftitlingandownerofrecordcannotbedeterminedbyordinarymeans and also, if applicable, cannot be determined in accordance with the preceding subparagraph, then the special lien may be foreclosed by publication of a legal notice in a legal newspaper in the county where thepersonalpropertyislocated,asdefinedinSection106ofTitle25oftheOklahomaStatutes.Suchnoticeshallincludethedescriptionofthepropertybyyear,make,vehicleidentificationnumberifavailablefromtheproperty,thenameoftheindividualwhomaybecontactedforinformation,andthetelephonenumberofthatpersonortheaddresswherethevehicleislocated.Thelegalnoticeshallbepublishedonceperweekforthree(3)consecutiveweeks.Assoonascircumstancesexistasdescribedinthefirstsentenceofthissubparagraph,thefirstdateofpublicationmayoccur,evenifthespeciallienhasnotaccruedforoverthirty(30)days.Thefirstdateavailableforpublicsaleofthevehicleisthedayfollowingpublicationofthefinalnotice,butnofewerthanthirty(30)daysafterthelienhasaccrued.Whentheownerofrecordisunknown,theNoticeofSaleneverthelessmustbecompletedandmailedtoanyknowninterestedpartybycertifiedmail.For purposes of this paragraph, interested parties shall include all persons described in subparagraph b or subparagraphcofthisparagraph,whicheverisapplicable,withtheexceptionofanyownerwhoisunknown.Exceptincircumstancesdescribedinparagraph7ofthissubsectionthatprovideforashortertimeperiod,theNotice of Sale shall be posted in two public places in the county where the property is to be sold at least ten (10)daysbeforethetimethereinspecifiedforsuchsale,andtheNoticeofSaleshallnotbemaileduntilatleastthirty(30)daysafterthelienhasaccrued.

5. The lienor or any other person may in good faith become a purchaser of the property sold. 6. Proceedingsforforeclosureunderthisactshallnotbecommenceduntilthirty(30)daysafterthelienhasaccrued,

exceptasprovidedelsewhereinOklahomalaw. 7. Notwithstandinganyotherprovisionoflaw,proceedingsforforeclosuresforthestorageofjunkvehiclestowed

and stored pursuant to Section 955 of Title 47 of the Oklahoma Statutes by Class AA wreckers listed with the MotorVehicleDivisionoftheDepartmentofPublicSafety,maybecommencedfive(5)daysafterthelienhasaccrued.Forpurposesofthisparagraph,“junkvehicles”meansanyvehiclethatismorethanten(10)yearsoldifthecostofacomparablevehiclewouldbelessthanThreeHundredDollars($300.00)asquotedinthelatesteditionoftheNationalAutomobileDealersAssociationOfficialUsedCarGuideorlatestmonthlyeditionofanyothernationallyrecognizedpublishedguidebook,adjustingtotheconditionofthevehicle.

42 O.S. § 91A D.1.Thissectionappliesifavehicle,all-terrainvehicle,utilityvehicle,manufacturedhome,motorcycle,boat,outboard

motor,ortrailerhasacertificateoftitleissuedbytheTaxCommissionorbyafederallyrecognizedIndiantribeinOklahoma,butthereisnoactivelienrecordedonthecertificateoftitle.

2. Thissectionappliesifavehicle,all-terrainvehicle,utilityvehicle,motorcycle,boat,outboardmotorortrailer

hasacertificateoftitleissuedbytheTaxCommissionorbyafederallyrecognizedIndiantribeinOklahoma,andthereisanactivelienrecordedonthecertificateoftitle,butthelienisoverfifteen(15)yearsold.

3. ThissectionappliesifpersonalpropertytowhichSection91ofthistitleotherwisewouldapplyhasbeen

registered by the Tax Commission or by a federally recognized Indian tribe in the State of Oklahoma, and thereisalienofrecordbutnocertificateoftitlehasbeenissued.

4. ThissectionappliesifpersonalpropertytowhichSection91ofthistitleotherwisewouldapplyhasnotbeen

registered by either the Tax Commission or a federally recognized Indian tribe in the State of Oklahoma, and nocertificateoftitlehasbeenissued,butthereisalienofrecord.

5. ThissectionappliestopersonalpropertythatotherwisewouldbecoveredbySection91ofthistitle,except

thattheserviceswererenderedorthepropertywasabandonedpriortoNovember1,2005. 6. Thissectionappliestoavehicle,all-terrainvehicle,utilityvehicle,manufacturedhome,motorcycle,boat,

outboard motor, or trailer for which ownership cannot be determined by ordinary means or by the Oklahoma TaxCommissionMotorVehicleDivision,asprovidedinsubparagraphsdandeofparagraph4ofsubsectionAof this section, as applicable.

7. This section applies to items of personal property that are not required by Oklahoma law to be titled, and that donothaveacertificateoftitle.

8. ThissectionappliestosalvagepoolsasdefinedinSection591.2ofTitle47oftheOklahomaStatutes. 9. ThissectionappliestoclassAAlicensedwreckerservicestakingpossessionofavehiclepursuanttoan

agreementwith,oratthedirectionof,ordispatchedbyastateorlocallawenforcementorgovernmentagency,orpursuanttotheabandonedvehicleremovalprovisionsofSection954AofTitle47oftheOklahomaStatutes , with respect to all types of personal property, regardless of whether that personal property has a certificateoftitle.

10.Foravehicleabandonedatasalvagepool,ifthecostofrepairingthevehicleforsafeoperationonthe

highwaydoesnotexceedsixtypercent(60%)ofthefairmarketvalueofthevehicleasdefinedinSection1111ofTitle47oftheOklahomaStatutes,asalvagetitleshallnotberequired.

E. A person who knowingly makes a false statement of a material fact regarding the furnishing of storage, rental

space,material,labororskillfortheprotection,improvement,safekeeping,towing,righttooccupyspace,storageorcarriagethereofinaproceedingunderthissection,orattemptstouseorusestheprovisionsofthissectiontoforecloseanownerorlienholder’sinterestinavehicleknowingthatanyofthestatementsmadeintheproceedingarefalse,uponconviction,shallbeguiltyofafelony.

F. Upon receipt of notice of legal proceedings, the Tax Commission shall cause the sale process to be put on hold

untilnoticeofresolutionofcourtproceedingsisreceivedfromthecourt.IfsuchnoticeofcommencementofcourtproceedingsisnotfiledwiththeTaxCommission,thepossessoryliensaleprocessmaycontinue.

G. No possessory lien sale shall be held on a Sunday. 42 O.S. § 91A H. For purposes of this section: 1. “Possession”includesactualpossessionandconstructivepossession;and 2. “Constructivepossession”meanspossessionbyapersonwho,althoughnotinactualpossession,doesnot

haveanintentiontoabandonproperty,knowinglyhasbothpowerandtheintentionatagiventimetoexercisedominionorcontrolovertheproperty,andwhoholdsclaimtosuchthingbyvirtueofsomelegalright.

3. “Lawfullyinpossession”meansapersonhasdocumentationfromtheownerortheowner’sauthorizedagent,

or an insurance company or its authorized agent, authorizing the furnishing of material, labor or storage, or that the property was authorized to be towed to a repair facility.

ClassAAwreckerservicestakingpossessionofavehiclepursuanttoanagreementwith,oratthedirectionof,

ordispatchedby,astateorlocallawenforcementorgovernmentagency,orpursuanttotheabandonedvehicleremovalprovisionsofSection954AofTitle47oftheOklahomaStatutes,shallbeconsideredlawfullyinpossessionofthevehicle.Ifthepersonlackssuchdocumentation,theproceduresestablishedbythissectionshallnotapply;and 4. “Itemizedcharges”meanstotalparts,totallabor,totaltowingfees,totalstoragefees,totalprocessingfees

and totals of any other fee groups, the sum total of which shall equal the compensation claimed. I. Forpurposesofthissection,theUnitedStatesPostalServiceapprovedelectronicequivalentofproofofreturn

receiptrequestedForm3811shallsatisfyreturnreceiptrequesteddocumentationrequirements. J. Ifapersonclaimingaspeciallienpursuanttothissectionfailstocomplywithanyoftherequirementsofthis

section, any interested party may proceed against the person claiming such lien for all damages arising therefrom, includingconversion,ifthearticleofpersonalpropertyhasbeensold,Ifthenoticeornoticesrequiredbythissection shall be shown to be knowingly false or fraudulent, the interested party shall be entitled to treble damages. Theprevailingpartyshallbeentitledtoallcosts,includingreasonableattorneyfees.

K. Anyinterestedpartyshallbepermittedtovisuallyinspectandverifytheservicesrenderedbytheclaimantpriorto the sale of the article of property during normal business hours. If the claimant fails to allow any interested partytoinspecttheproperty,theinterestedpartyshallmailarequestforinspectionbycertifiedmail,returnreceiptrequested,totheclaimant.Withinthree(3)businessdaysofreceiptoftherequestforinspection,theclaimantshallmailaphotographoftheproperty,bycertifiedmail,returnreceiptrequested,andadateofinspectionwithinfive(5)businessdaysfromthedateofthenoticetoinspect.Thelienholdershallbeallowedtoretrievethepropertywithoutbeingrequiredtobringthetitleintothelienholder’sname,ifthelienholderprovidesproofitis a lienholder and any payment due the claimant for lawful charges where the claimant has complied with this section.Uponthereleaseofpersonalpropertytoaninsurerorrepresentativeoftheinsurer,wreckeroperatorsshallbeexemptfromallliabilityandshallbeheldharmlessforanylossesorclaimsofloss.Intheeventanylawenforcement agency places a hold on the property, the party wanting to inspect or photograph the property shall obtain permission from the law enforcement agency that placed the hold on the property before inspecting or photographing.

L. Thissectionshallapplytoallactionsorproceedingsthatcommenceonoraftertheeffectivedateofthisact. Section3.ThisactshallbecomeeffectiveNovember1,2014.
