President Gerry Keen called the meeting to order.

I. APPROVAL OF MINUTES

Carl Griffin moved to approve the minutes from the April 5, 2017 Executive Committee public hearing assubmitted. Jerry Reynolds seconded and the motion carried by voice vote.

II. NEW BUSINESS

FINAL DETAILED PLANS

1. RESOLUTION PD 17-03--JERRY M. WEIDA AND PATTI A. WEIDA (302 Vine Street PD) Z-2641:Final Detailed Plans for the 302 Vine Street Planned Development: theapproved preliminary plans allow for the construction of a 5-story, mixed-use building that contains a maximum of 73 units with 117 bedrooms,12,580 square feet of ground floor retail, and a 74-space parkingstructure. The property is bounded by North Street, Vine Street, WigginsAvenue and Northwestern Avenue, West Lafayette, Wabash 19 (NE) 23-4.

Carl Griffin moved to hear and approve RESOLUTION PD 17-03—JERRY M. WEIDA AND PATTI A.WEIDA (302 Vine Street PD) Z-2641. Tom Murtaugh seconded.

Gary Schroeder joined the meeting in progress.

Ryan O’Gara presented the zoning map and site plan. He said this site was rezoned by the City of WestLafayette in July 2016 after a unanimous recommendation of approval from APC. The Final DetailedPlans consist of the Construction Plans and Final Plat and meet all conditions required at this stage of

development. If these plans are approved and recorded the owner will be able to apply for permits andbegin construction.

Roger Fine, 625 South Earl Avenue, Lafayette, IN 47904, surveyor representing the petitioners, said heand the petitioner are present tonight to answer any questions. He requested approval.

The Committee voted by ballot 5 yes to 0 no to approve RESOLUTION PD 17-03—JERRY M. WEIDAAND PATTI A. WEIDA (302 Vine Street PD) Z-2641.

2. RESOLUTION PD-17-04--538, LLC (Historic Peirce House PD) Z-2677Final Detailed Plans for the Historic Peirce House Planned Development:the approved preliminary plans allow for the conversion of an existingsingle-family building into a multi-family building with a maximum of 6units. The property is located at 538 S. 7th Street, Lafayette, Fairfield 23(NW) 23-4.

Gary Schroeder moved to hear and approve RESOLUTION PD 17-04—538, LLC (Historic PierceHouse PD) Z-2677. Carl Griffin seconded.

Ryan O’Gara presented the site plan and said the entire PD is within the existing mansion. There is anoption for the owner to add additional garage spaces at a later date. He said the City of Lafayette rezonedthis site in February 2017. These Final Detailed Plans meet all conditions required at this stage. Oncethese Final Detailed Plans are approved and recorded the owner will be clear to apply for permits andbegin construction.

Glen Vick, 538 South 7th Street, Lafayette, IN 47905, petitioner, said he is available to answer anyquestions and requested approval.

The Committee voted by ballot 5 yes to 0 no to approve RESOLUTION PD 17-04—538, LLC (HistoricPierce House PD) Z-2677.

3. RESOLUTION PD 17-05--INDIANA DISTRICT OF THE LUTHERANCHURCH, MISSOURI SYNOD, INC. (460 Northwestern PD) Z-2675Final Detailed Plans for 460 Northwestern Planned Development: theapproved preliminary plans allow for the conversion of the existingExponent building for a church use, office use and limited commercialretail use. The property is located at 460 Northwestern Ave., WestLafayette, Wabash 19 (NE) 23-4.

Gary Schroeder moved to hear and approve RESOLUTION PD 17-05—INDIANA DISTRICT OF THELUTHERAN CHURCH, MISSOURI SYNOD, INC. (460 NORTHWESTERN PD) Z-2675. Carl Griffinseconded.

Ryan O’Gara presented the site plan and said this PD is another adaptive reuse of an existing building.He said the replatting will clean up the 1987 Exponent PD. The City of West Lafayette voted to rezonethis site in February 2017. These Final Detailed Plans, consisting of the construction plans and final platmeet all conditions required at this stage. Once these Final Detailed Plans are approved and recorded theowner will be able to apply for permits and begin construction.

Daniel Teder, PO Box 280, Lafayette, IN 47902, said the church sold its previous location on Chaunceyand plans to relocate to this site. The plan is to be ready before the fall semester begins in August.

III. PUBLIC HEARING

Gary Schroeder moved that the Comprehensive Plan for Tippecanoe County, the Unified ZoningOrdinance of Tippecanoe County, and the Unified Subdivision Ordinance for Tippecanoe County, Indianaare hereby entered by reference into the record of each agenda item. Carl Griffin seconded and themotion carried by voice vote.

Gerry Keen read the meeting procedures.

A. SUBDIVISIONS

S-4670--ROHRMAN NORTH SUBDIVISION (minor-sketch):Petitioners are seeking primary approval to replat two Winding Creek lots (Lots297 & 298) into one lot on 1.985 acres, located on the west side of CR 75 E, justsouth of Appaloosa Trail, in Tippecanoe 29 (NE) 24-4.

Gary Schroeder moved to hear and vote on S-4670—ROHRMAN NORTH SUBDIVISION (minor-sketch). Carl Griffin seconded.

Kathy Lind presented the zoning map, aerial photos and sketch plan. She referred to the zoning map tohighlight the R1 and R1B going through both lots. The R1 zone is stricter and its requirements will applyto all of the proposed new lot. She highlighted the area zoning and land use patterns. Both lots havesanitary sewer but no water service and the construction plans for this section of Winding Creek requirethese two lots be serviced by grinder pumps with an individual force main for each lot. The DrainageBoard has already approved drainage for the site. Because the southwesterly lot is within 100’ of theFlood Plain the lowest floor or crawl space must be 2’ higher than the Flood Plain Elevation. Shesummarized the remainder of the staff report and concluded with a recommendation of approval,contingent on the following conditions:

FINAL PLAT – The following items shall be part of the Secondary Application and Final Platapproval:

1. All existing easements, covenants or restrictions shall be shown and referencedwith the corresponding recording information (Document Number and daterecorded).

2. All required building setbacks shall be platted.3. The street addresses and County Auditor's Key Number shall be shown.4. The note on the sketch plan regarding the sanitary sewer requirement shall be

platted.5. The note on the sketch plan regarding the Flood Plain regulations shall be

platted.

Robert Gross, 420 Columbia Street, Suite 100, Lafayette, IN 47901, surveyor representing the petitioner,concurred with the staff report, agreed to the conditions and requested approval.

The Committee voted by ballot 5 yes to 0 no to grant conditional primary approval for S-4670—ROHRMAN NORTH SUBDIVISION (minor-sketch).

Staff Report May 11, 2017

REQUEST MADE, PROPOSED USE, LOCATION: Petitioner Lee Fry, with consent from owner Meijer Stores Limited Partnership, and represented by surveyor Jon Spinazzola, is seeking primary approval for a one lot commercial subdivision on 0.899 acres, located on the south side of SR 26, between Meijer Drive and Veterans Memorial Parkway East, in Lafayette, Fairfield 25 (NE) 23-4. The purpose of the minor subdivision is to create a building site for a proposed Dunkin Donuts. AREA ZONING PATTERNS: The site is zoned GB, General Business as are the two surrounding properties to the east and to the south and west. Land across the highway to the north is zoned R1, Single-family Residential. AREA LAND USE PATTERNS: The site in question is currently undeveloped except for a few paved parking spaces. A small commercial plaza is to the east of the private entrance road; Meijer and its parking lot are to the south and a Meijer gas station is adjacent to the west. Single-family homes are across SR 26 from the site. TRAFFIC AND TRANSPORTATION: SR 26 is a limited access highway classified as a primary arterial in the adopted Thoroughfare Plan. The required half-width right-of-way is already in place so no further dedication is necessary. Also because the highway is limited access, a “no vehicular access” statement is not being required by the city. ENVIRONMENTAL AND UTILITY CONSIDERATIONS: City sewer and water are available to the site without any public improvements. The city will review drainage for the site at the time of building permit issuance. CONFORMANCE WITH UZO REQUIREMENTS: Setbacks shown are correct. There are no lot width or lot area requirements in the GB zone. STAFF RECOMMENDATION: Conditional primary approval, contingent on the following:

REQUEST MADE, PROPOSED USE, LOCATION: Petitioners and owners, James and Kimberly Weston, represented by Robert Gross of R.W. Gross & Associates, are seeking primary approval of a 2 lot subdivision on 10.01 acres located on the west side of CR 500 E, approximately ¼ mile south of CR 300 N, in Fairfield 12 (NE) 23-4. AREA ZONING PATTERNS: The site and all surrounding property is zoned R1, Single-family Residential except for land across the county road to the east which is zoned A, Agricultural. The parent tract is larger than usual: 105.34 acres in area. There has been one parcel created from it (P95-19) as well as several tracts of ten acres or bigger. After the approval of this two-lot minor subdivision, only one division right (creation of a lot or parcel smaller than ten acres in size) will remain within the parent tract. AREA LAND USE PATTERNS: There is an existing house and pole building on proposed Lot 1; Lot 2 is currently unimproved and heavily wooded. The Crist & Fassnaght county regulated drain divides the tract approximately along the proposed lot line between the two new lots. The 150’ wide legal drain easement has been shown on the sketch plan. A certification of any Flood Plain in the area will need to be established and shown on the final plat. TRAFFIC AND TRANSPORTATION: CR 500 E is classified as a rural secondary arterial by the adopted County Thoroughfare Plan. This requires a 40’ wide half-width right-of-way along the frontage. Either a letter from the mortgage holder, a mortgage release, or an affidavit of mortgage will be a required prior to recordation of the final plat. County Highway is not requiring a “no vehicular access” statement. ENVIRONMENTAL AND UTILITY CONSIDERATIONS: The County Surveyor or the Drainage Board will need to approve drainage for the proposed two lots. A letter from the County Health Department states that, “Lot one has an existing single-family dwelling located on it served by an on-site sewage disposal system approved and installed on December 18, 2008. Lot two…can be considered for an elevated sand mound with a perimeter drain to lower seasonal high water table. Information provided…indicates there is adequate elevation to discharge the tile on the

lot for the perimeter drain without need of an easement.” CONFORMANCE WITH UZO REQUIREMENTS: A revised sketch plan shows the required 40’ setback from CR 500 E as well as the 25’ building setback from the Flood Plain elevation (636.4 feet). Any construction between this 25’ building setback and the 100’ mark would require the lowest floor elevation to meet the Flood Protection Grade of 638.4 feet in elevation. STAFF RECOMMENDATION: Conditional primary approval, contingent on the following:

FINAL PLAT – The following items shall be part of the Secondary Application and Final Plat approval:

1. If there is a mortgage on this property, a recorded partial release or written acknowledgment from the mortgage company must be obtained in order to dedicate the necessary right-of-way.

2. All existing easements, covenants or restrictions shall be shown and referenced with the corresponding recording information (Document Number and date recorded).

3. All required building setbacks shall be platted.

4. The Regulatory Flood Elevation and Boundary for the Crist & Fassnaght Regulatory Drain Flood Plain shall be shown. It shall also be described and certified as specified in Unified Zoning Ordinance, Section 2-27-17.

5. The Drainage Board or the County Surveyor shall approve any required drainage plans in compliance with Tippecanoe County Ordinance #2011-27-CM.

CASE #2017-20 BROWNSTONE DEVELOPMENT, LLC: Petitioner is requesting a parking variance to reduce the number of on-site parking spaces to 12 (1 space per unit) from the minimum requirement of 21 spaces (1.75 spaces per unit) to build medium density residential apartments on a property located at 201, 205, and 207 South 4th Street, Lafayette, Fairfield 29 (NE) 23-4. (UZO 4-6-3) A rezone request to CB from the current NBU for these properties received a favorable recommendation at the May APC meeting. The City Council will hear and vote on this CB rezone request at its June 5, 2017 meeting.

RECOMMENDATION: Staff advises that these requests do not constitute use variances.
