TIME AND TIDE WAIT FOR NONE

Time is tickling fast. My team has to be on the toes to render the best for you and our association. January sparkled with Pre Hospital Trauma Care training for Police officials. February brought recognition from Government of Tamilnadu with the function of Best Doctors Award to our medical fraternity for the first time. March ran fast with the conduction of National and our three Unit Workshops with excellent active participation by good number of local branch office bearers. Our thanks to host branches (Nilgiris, Vellore and Coutralam) and unit coordinators and technical consultants. We have accepted the challenge of motivating all our members to notify every newly detected TB patient and create many Peripheral Health Institutes to diagnose and treat TB patients with free medicine from RNTCP Programme.

CAPTAIN OF A SHIP MUST HAVE A LIKING FOR SEA FIRST

The captain of a ship must have a passion for the sea and learn all about the sea first before learning about the ship and other crew. Similarly we the doctors must be well versed with the current mindset of our patients and the society we serve first before we initiate the treatment. Bridging the widening gap by narrowing the mistrust can be done by the association only with co-operation from all of you. Our first job is to explain that we are not responsible for the health care becoming costlier in India and one third of it go to the Government in some form or other. Taking part in National health programmes like RNTCP and Community health camps like AAO GAON CHALEN (Let us go to villages) are bound to build up our image and reputation.

Concessional IMA registration tariff will last only for two more months. Motivate and enroll your professional colleagues and relatives by explaining our excellent PPLSSS and FSS schemes. Clinical Establishment Act will be enforced in few months in our Tamil Nadu, when every clinic and hospitals have to compulsorily registered with the Joint Director of Health Services and IMA will figure in the both State and District level committees. REVISED NATIONAL TUBERCULOSIS PROGRAMME

The National level RNTCP workshop was successfully conducted at Mahabalipuram on 8th and 9th March 2014. The RNTCP Unit I workshop was conducted on 23rd March 2014 at Yelagiri, Unit II on 16th March 2014 at Ooty, Unit III on 30th March 2014 at Courtallam with good participation by the Presidents and Secretaries of the branches of our IMA. Dr. Arivozhi, Dr.Murugesan (In-charge)The State Tuberculosis officers, District Tuberculosis officers and Deputy Directors extended their fullest cooperation for the success of these workshops.

100TH NURSING HOME BOARD MEET

We also had the land mark 100th Nursing Home Board meet on 9th March 2014 at Mahabalipuram wherein our Health Secretary Dr.J.Radhakrishnan IAS was the chief guest, National President Dr.Jitendrakumar Patel, Secretary General Dr.Narendra Saini were the Guest of Honour and Mr.Ramanujam from IRDA along with officials from the Star Health, Widal(ttk) participated, with very good attendance from the members of North Zone. It was a very useful Zonal meet. I congratulate Dr. C.Anbarasu Nursing Home Board Chairman and Dr.B.Sridhar Nursing Home Board Secretary for their commitment in making it a grand function, with able guidance of our State president Dr. M. Balasubramanian

MOTHER AND BABY FRIENDLY HEALTH SERVICE

On 19th March, We also had a panel discussion on Mother and Baby health service along with Mithra Foundation and UNICEF which is going to be implemented throughout our state along with the participation of our members. Also we are going to have school health programme especially insisting on cough etiquette and Hand washing.

BLOOD DONATION CAMPS

In the Month of June we are going to have Blood Donation Camps, It is a National programme, I request every one of you to actively participate and make Tamil Nadu number one in this programme.

The month of March saw our association activities in full flow. The centennial NHB meet at chennai was very productive , Insurance related problems were very well addressed. The fight against Tuberculosis ,RNTCP project took off majestically From mahabalipuram and then we had very interactive sessions at Ooty, Yelagiri , and Kutralam .

Greetings ! We had 9th zonal meet and work shop of IMATNSB PARAMEDICAL WING at Chennai on 8th march. Thanks to IMA Thambaram for making elaborate arrangement and hospitality. Nearly 250delegates, paramedical students and staffs from various institutions and hospitals attended.

Dr.Senthamil Pari Vice President (North Zone) was the chief guest .Dr. Muthurajan joint sec was

the guest of honor.

Dr A.K. Ravikumar Dr. Karthick Prabhu Dr. Binulal, Dr Venkatesh Babu Dr.Amudha karunanidhi, Dr.Yesodha Dr Karunanidhi were Faculties. Various topics like Dress code, Communication Skills, Inter Personal Relationship, Infection control, Role of Paramedics in CRISIS, Parenteral Drug Administration, How to be an ideal nurse were taught to them.

For the first time we had workshop on handling instruments and dressing, emergency management and CPR, Bladder Catheterization, IV line management, Electronic Record keeping and it was well appreciated and It was well accepted by the delegates.

Let me at the outset thank you all for making the CENTENARY MEET a grand success. The National leaders Dr.Jitendra Patel, Dr.Narender Saini , Dr.Arulrhaj , Dr.Vi jayakumar and Dr.Apparoa participated. Health Secretaty Dr.Radhakrishnan gave a wonderful speech,

expressing the willingness to co-operate with IMA in all the activities and welfare measures of the government. He was pleasantly surprised that, our NHB is 3600 strong and was celebrating its 100th meet. He also released souvenir commemorating the event. The Hallmark of the event was the release of postage stamp to mark the 100th Meet. The most important discussion was about insurance-PPN rates and was attended by Mr.Ramprasad from IRDA, Dr.Prakash from Star health and Dr.Gunasekaran from TTK. Mr.Ramprasad mentioned that he never knew that such a organized service provider forum was available in Tamilnadu to discuss various issues and promised in future he would consult us. It was agreed to have a workshop on health insurance and cover all points so that both the insurance companies and service providers are mutually benefited. The meet was attended by over 252 participants and senior leaders. We NHB will be very happy if the same response continues from our members and we become a strong and united forum.

The next meeting will be in East zone and venue is Cuddalore. The date shall be informed later. We take this opportunity to thank our president Dr.M.Balasubramanian and Secretary Dr.C.N.Raja for all the help they gave us with regards to the 100th meet.

Dear Colleagues, Greetings. “Progress is impossible without change and those who cannot change their minds,cannot change anything”.NEGLIGENCE ALLEGED - IN CORONARY BY-PASS SYRGERY::FACTS OF THE CASE: The patient died due to brain-stem heamorrhage a few days after undergoing a successful coronary by Pass operation.THE ALLEGATIONS: That the hospital had negligently, wrongfully and prematurely discharged the patient. That the patient contracted an infected wound above the knee, from the hospital. That the hospital failed to advice microbiological investigation like culture and sensitivity tests for determination and treatment of the above infected knee, resulting in thromboembolism which resulted in the death of the patient.THE FINDINGS:1. That there was no fever and the TLC and DLC was normal.2. That the discharge was not premature; the post operative recovery was smooth and uneventful, the condition of the patient did not necessitate or justify continued hospitalization; the infection in the wound above the knee was superficial and mild; there was no fever, no discharge ; rather the antibiotics were withdrawn. 3. The cause of the death was found to be brainstem heamorrhage followed by renal failure and cardiac arrest. 4. That the hospital also place on record the diagnosis and notes on the case sheet of the patient made by four different neurologists of the hospital after examination of the patient two neurologists summoned by the relatives of the patient after examining him opined that the condition of the patient was either due to embolic phenomenon or cerebral heamorrhage.THE DECISION: THE NATIONAL CONSUMER COMMISSION HELD THAT; 1. There was no evidence of deficiency in service and consequent negligence in the diagnosis and treatment of the patient in the hospital . 2. That, at the conclusion of the hearing the hospital, purely on compassionate considerations, agreed to refund exgratia amount of Rs.20000/- deposited at the time of re-admission. 3. The above case was dismissed and it was made clear that there had been no deficiency in diagnosis and treatment of the patient in the hospital, and therefore, the refund could not be interpreted, directly or indirectly, as admission of any lapse.

Judge Lahoti's pronouncement of inclusion of word 'gross' in I.P.C.304 A, in assessing degree of negligence in respect of doctors has saved the Doctors of Kolkatta from punishment under sec.304 A of I.P.C. in Kunal Saha Vs Kolkatta doctors i.e. D-1, D-2, D-3, D-5,D-6SHORT HISTORY OF THE CASE1. 1.4.98 - Dr.Kunal Saha (K.S.)(Indian Doctor settled in U.S. and engaged in research on H.I.V in U.S.A.,) and his wife Mrs.Anuradha –a child psychologist, arrived in Calcutta, for vacation.2. 25.4.98 - Anuradha developed fever along with skin rash. She 'supposedly after eating some Chinese food in some restaurant developed fever and skin rash on or about 25.4.1998- Para 98'. In para 106 –“Mrs.Anuradha has been admitted to Beach Candy Hospital, (Bombay) on 17.5.98 at night 9.30 PM. Her condition on admission is serious. She has been accompanied by her husband Dr.Saha, who has given the history of antibiotic injection for respiratory infection –Rovamycin, Ampicillin and ampiclox and Nimuslide followed by development of Toxic Epidermal Necrolysis” 3. 26.4.98 - D-1, attended her at her parental residence. Advised rest; said quick recovery; No medicines. 4. 07.5.98 - Skin rash reappeared more aggressively. Went to D-1. He prescribed Inj.Depomedrol 80 mgm b.i.d. X 3 days. 5. 11.5.98 - Condition worsened. Anuradha was admitted in Resp.No.4- AMRI hospital, under D-1. D-1 prescribed Inj.Depomedrol 80 mgm b.i.d. – And left India. 6. 12.5.98 - D-2 and D-3 saw the patient and diagnosed correctly as TEN. D-2 prescribed Tab.Prednisolone 40 mgm t.i.d. Inj.Depomedrol stopped. D-1 & D-2 controlled treatment. D-5 (equally qualified, but junior) was in charge of the patient.7. 17.5.98 - Patient condition worsened – transferred to Breach Candy Hospital, Mumbai.8. 28 5.98 - Patient Anuradha died. Death due to Septicemia shock with multi-organ failure leading to cardio- respiratory arrest. No Post Mortem Examination done.

LITIGATION HISTORY –under I.P.C. 304 A1. 19.11.1998 - M.K.Ganguly -K.S.'s relative, filed a criminal case under 304-A of I.P.C. against Kolkatta doctors - D-1, D-2, D-3, in the Court of CJM, Alipore,for commission of offence under Section 304 A of the Indian Penal Code. On 29.05 2002, the leaned Chief Judicial Magistrate found D-1, D-2, guilty of commission of offence under 304 A and sentenced them to under go simple imprisonment for 3 months and to pay a fine of Rs.3,000/- each. D-3 was acquitted. Against this M.K.Ganguly -K.S.'s relative appealed for enhancement of punishment and D-1 and D-2 filed appeal for dismissal of the case.2. 19.03.2004 - Calcutta High Court which heard all the appeals, dismissed the appeal by M.K.Ganguly -K.S.'s relative and allowed the appeal by D-1and D-2 Against this M.K.Ganguly-K.S.'s relative, appealed to the Supreme Court. (In 2005, came the Hon.Judge Lahoti's Judgment setting the law on Negligence by medical professional.) 07.08.2009 The Supreme Court heard the appeal and dismissed it. “To prosecute a medical professional for negligence under criminal law, it must be shown that the accused did something or failed to do something which in the given facts and circumstances no medical professional in his ordinary senses and prudence would have done or failed to do.” “For an act to amount to criminal negligence, the degree of negligence should be high degree. A negligence which is not of such high degree may provide a ground for action in civil law, but cannot form the basis for prosecution.” So unless the negligence is proved “gross”, medical professional can not be prosecuted under IPC 304A.
