    BCS conservation areas identified in Plan 3 must be distinguished from each other based on the conservation category. As is currently demonstrated in Plan 3, the conservation areas should be titled BCS conservation area (conservation category). The conservation categories area: ‘Growling Grass Frog conservation area’ and ‘Nature conservation area.’

    The future urban structure shows an arterial road within the eastern boundary of the conservation area. Under the BCS all urban development is required to be excluded from the conservation area

    DELWP has placed consideration of boundary change proposal on hold until VPA provides advice on merit of application. PSP should not outline proposed changes.

    Update the future urban structure plan to identify the conservation area categories.

    Remove the arterial road from the conservation area on all plans within the PSP document.

    Remove reference to realignment proposal.

    Visit https://services.land.vic.gov.au/SpatialDatamart/ and download the current scattered tree layer. This was updated in Jan 2019.

    Update map so ‘scattered tree’ layer has a status of either retained or removed (DELWP suggested referring to Wollert Plan 7b)

    Drainage from stormwater infrastructure is to be designed to minimise impacts on biodiversity values, particularly habitat for matters of national environmental significance located within conservation areas.

    Requirement 48 is covered by 52.17 changes and can be removed.

    Include the following requirements:

    · “Drainage from stormwater infrastructure must be designed to minimise impacts on biodiversity values, particularly habitat for matters of national environmental significance located within conservation areas”.

    DELWP undertook recent surveys within Conservation Area 28. These differ from the extent of native vegetation shown in timestamping. However, for the CACP our preference is for up to date native vegetation information to be used for the CACP so that future planning can reflect on site values (timestamping was based on modelled data for this area).

    Native vegetation layers for Conservation Area 28 to reflect recent surveys (previously sent through to Dann Briggs on 26.6.19 – DELWP to send through again). The below note to be added to Plan 9a & 9b:

    Existing note ‘proposals are subject to future funding and detail design by land manager as determined by DELWP’ to be changed to ‘Proposals subject to future planning and DELWP approval’.

    Drainage & Integrated Water Management

    The intent of the guideline is to capture the potential impacts of

    storm water assets occurring outside of the conservation area as well.

    Native vegetation along the Curly Sedge Creek within Conservation Area 28 is susceptible to changes in hydrology. Work done by Alluvium identified that without mitigation measures urban development would result in the loss of the nationally threatened Natural Temperate Grassland vegetation community.

    Include the following guideline:

    · “Enable supply of gravity fed treated stormwater for existing and future GGF wetlands”.

    Include the following requirements:

    · “Stormwater conveyance and treatment must be designed to maintain predevelopment hydrology within Conservation Area 28 to DELWPs satisfaction”.

    Precinct Infrastructure Plan & Staging

    The need for multiple utility crossings through conservation areas should be avoided and managed through development staging, and consolidation into service corridors.

    Delete R88.

    Include the following requirement for Conservation Area 34

    · “Where there are no alternative options other than passing through Conservation Area 34, subdivisional development must consolidate utilities into dedicated service corridors.”

    · “Utilities and other infrastructure must avoid traversing patches of native vegetation and habitat for matters of national environmental significance.”

    Include the following requirement for Conservation Area 28:

    · “Utilities and other infrastructure must avoid traversing through Conservation Area 28”

    Conservation Interface Plan (CIP)

    Each BCS conservation area type (e.g. Nature conservation, GGF) should be represented by a separate CIP which follows the CIP requirements of the MSA Guidance Note.

    State requirements at the bottom of the plan, or alternatively add annotation pointing to visual diagram.

    The requirements of the notes should be demonstrated visually or via text on the relevant CIP. Where demonstrated via text, the CIP requirements should be stated at the bottom of the plan, or added as annotations, pointing to the visual diagram. The CIP must demonstrate

    the following:

    Street and path lighting adjacent BCS conservation areas must be indicated as baffled to cast light away from the conservation area

    Development must face the BCS conservation area. A frontage road must be provided between the BCS conservation area and adjacent development. In cases where road frontage is not possible, the development must face the BCS conservation area (i.e. no side or back fences should face the BCS conservation area) with a paper road provided between the BCS conservation area and the development

    All necessary fire breaks are located outside of the BCS conservation area.

    There should be a minimum 20m buffer around all BCS conservation areas except BCS GGF conservation areas. The buffer must exclude buildings but may include roads, paths, open space and drainage infrastructure.

    The BCS conservation area must be protected by an appropriate traffic barrier which should be detailed on the CIP.

    Fencing constructed to the boundary of BCS conservation areas is to restrict vehicle access and direct pedestrian movement towards specified access points

    Diagrams to be labelled Conservation Interface Plan.

    The location of street plantings must ensure there is no tree shading of native grasslands or wetlands within conservation areas. Where shading is likely to occur, trees should not be planted within 10m of a conservation area boundary.

    Create CIP for both Conservation are types.

    Rename Conservation Interface – Cross Section to:

    · Conservation Interface Plan- Nature Conservation

    · Conservation Interface Plan- Growling Grass Frog

    Add note to Nature Conservation CIP stating:

    “All trees located within 10m of the conservation area boundary must be of a local provenance.”

    · Pays the reasonable costs of the Secretary to DELWP in the preparation, execution and registration of the agreement.

    The requirement for a Land Management Co-operative Agreement in this condition does not apply to land of any lot or part of a lot within the conservation area shown on Plan 9 of Precinct Structure Plan as conservation area 28 or 34 that:

    · is identified in a Precinct Structure Plan as public open space and is vested, or will be vested, in the council as a reserve for the purposes of public open space; or

    · is identified in a Precinct Structure Plan as a drainage reserve and is vested, or will be vested, in Melbourne Water Corporation or the council as a drainage reserve; or

    · is the subject of an agreement with the Secretary to the DELWP to transfer or gift that land to:

    · the Secretary to DELWP;

    · the Minister for Environment and Climate Change; or

    · another statutory authority.

    to the satisfaction of the Secretary to DELWP.

    Salvage and translocation

    The Salvage and Translocation Protocol for Melbourne’s Growth Corridors (Department of Environment, Land, Water and Planning, 2017) must be implemented in the carrying out of development to the satisfaction of the secretary to the Department of Environment, Land, Water and Planning.

  • It is unclear on the Plan 15 where the 590m measurement is measured from andwhat it is measuring? It also seems there are two 590m measurement. Why was 590metres arrived at?

    2.                   Permit conditions for “section 2-permit required” are unclear. Please see examplebelow:

    It is unclear what the condition for sensitive uses in Philip quarry sensitive use buffer.For example, this read as Accommodation must be on land identified as ‘futureresidential area’ and within the ‘Phillips Quarry sensitive use buffer’ – don’t believethis is the intent. If the intent to trigger a permit for accommodation within thequarry buffer, then perhaps this use should just be prohibited? The Intention of thecondition needs to be more clearly articulated.

    3.                   In Table 1: Applied zone provisions, local convenient centre (east) and localconvenient centre (west) should be more clearly identified / differentiated on thePlan 3.

    4.                   Quarry access: Also query the existing quarry access point – how is the

    management of truck movements to and from the quarry considered in the PSP.     3.5 27 Drainage from stormwater infrastructure is to be designed to minimise impacts on biodiversity values, particularly habitat for matters of national environmental significance located within conservation areas. Requirement 48 is covered by 52.17 changes and can be removed.

    Include the following requirements:

    - “Drainage from stormwater infrastructure must be designed to minimise impacts on biodiversity values, particularly habitat for matters of national environmental significance located within conservation areas”.

    3.5 28 DELWP undertook recent surveys within Conservation Area 28. These differ from the extent of native vegetation shown in timestamping. However, for the CACP our preference is for up to date native vegetation information to be used for the CACP so that future planning can reflect on site values (timestamping was based on modelled data for this area).

    Native vegetation layers for Conservation Area 28 to reflect recent surveys (previously sent through to Dann Briggs on 26.6.19 – DELWP to send through again). The below note to be added to Plan 9a & 9b:

    Drainage & Integrated Water Management

    3.7 37 The intent of the guideline is to capture the potential impacts of storm water assets occurring outside of the conservation area as well. Native vegetation along the Curly Sedge Creek within Conservation Area 28 is susceptible to changes in hydrology. Work done by Alluvium identified that without mitigation measures urban development would result in the loss of the nationally threatened Natural Temperate Grassland vegetation community.

    Include the following guideline: - “Enable supply of gravity fed treated stormwater for existing and future

    GGF wetlands”. Include the following requirements:

    - “Stormwater conveyance and treatment must be designed to maintain predevelopment hydrology within Conservation Area 28 to DELWPs satisfaction”.

    Precinct Infrastructure Plan & Staging

    3.8 42 The need for multiple utility crossings through conservation areas should be avoided and managed through development staging, and consolidation into service corridors.

    Include the following requirement for Conservation Area 34

    - “Where there are no alternative options other than passing through Conservation Area 34, subdivisional development must consolidate utilities into dedicated service corridors.”

    Conservation Interface Plan (CIP)

    69 Each BCS conservation area type (e.g. Nature conservation, GGF) should be represented by a separate CIP which follows the CIP requirements of the MSA Guidance Note. State requirements at the bottom of the plan, or alternatively add annotation pointing to visual diagram. The requirements of the notes should be demonstrated visually or via text on the relevant CIP. Where demonstrated via text, the CIP requirements should be stated at the bottom of the plan, or added as annotations, pointing to the visual diagram. The CIP must demonstrate the following: Street and path lighting adjacent BCS conservation areas must be indicated as baffled to cast light away from the conservation area Development must face the BCS conservation area. A frontage road must be provided between the BCS conservation area and adjacent development. In cases where road frontage is not possible, the development must face the BCS conservation area (i.e. no side or back fences should face the BCS conservation area) with a paper road provided between the BCS conservation area and the development All necessary fire breaks are located outside of the BCS conservation area.

    There should be a minimum 20m buffer around all BCS conservation areas except BCS GGF conservation areas. The buffer must exclude buildings but may include roads, paths, open space and drainage infrastructure. The BCS conservation area must be protected by an appropriate traffic barrier which should be detailed on the CIP. Fencing constructed to the boundary of BCS conservation areas is to restrict vehicle access and direct pedestrian movement towards specified access points Diagrams to be labelled Conservation Interface Plan. The location of street plantings must ensure there is no tree shading of native grasslands or wetlands within conservation areas. Where shading is likely to occur, trees should not be planted within 10m of a conservation area boundary.
