HOA Management Fulfilling Hidden Agenda?Beautiful, well-maintained

communities benefit us all. However, my first reaction after reading your article [“HOA Violations from Space,” In&Out, Aug. 15] is that of concern. HOA’s action to use unauthenticated aerial imagery to prove a violation is rather unlawful based on my broad experience with code enforcement matters. The community manager’s comments, which appear to discourage proper method of investigation (deeming it insensitive to people’s privacy), are troubling, while the policy which condones tattling on a neighbor, selective enforcement and gaining entry to the backyard without due consent can be deeply damaging for every fabric of our community.

Governance by HOA, while appearing similar to an incorporated town, is handled more like a simple service contract in our state law. Our community manager is an employee of AAM, Inc. We, the homeowners, have been paying abundantly for this uncontested contract for the management of Anthem’s HOA functions since Pulte/Del Webb departed. In fact, AAM, Inc. has managed scores of other communities throughout the state for other homebuilder companies, significantly expanding its market share and legal influences. Our unpaid part-time board members rely heavily on such a contractor in their decision-making.

Luckily for homeowners, in recent years the laws on governance of planned communities have been slowly changing in our favor, especially when it comes to the enforcement of alleged violations. Experience has shown most NOVs issued by HOA have legal deficiencies rendering them unlawful. Using “10-7 Easement to inspect and Right to Correct” document referenced as sole means to gain investigative entry to backyards in person or via satellite, would be an example of such a blatant misinterpretation of this document.

I remain hopeful but demanding of a greater expertise and genuine community investment from our community management and not just a fulfillment of a hidden business agenda.

On Thursday, Aug. 29, Barbara

Ward-Windgassen, founder and president of Anthem Pets, passed away peacefully and surrounded by family after a long battle with cancer.

Windgassen became an icon in Anthem when she rallied fervently for Pulte/Del Webb to retrofit the award-winning community with the one thing she and scores of dog owners felt was missing: A dog park. She founded the non-profit group Anthem Pets in 2006 with its first mission to wrestle the Anthem Community Council for a small piece of land on which to establish a dog park. Anthem Pets, Windgassen said, was prepared to fund, build and maintain the dog park as a third-party contractor. When Council blocked her efforts, Windgassen and her loyal supporters proceeded to build an award-winning dog park on Jackass Acres, a few miles north of Anthem.

Anthem Pets became the go-to group for all things pets: lost and found, litters and fosters needing homes… As the group’s reach grew, so did the need for volunteers. Windgassen was enthusiastic about recruiting volunteers and holding them to their pledge. She arranged periodic low-cost shot clinics and other vet services. She also convinced retailers to regularly donate massive amounts of pet food that she and volunteers then repackaged and left at the doorstep of pet owners in need.

During the real estate bust, Windgassen and her team of volunteers worked overtime rescuing, fostering and placing countless dogs and

cats abandoned by homeowners as they walked out on their mortgage.

Her tireless dedication to animal welfare knew no bounds. She worked through her illness—well beyond her life expectancy—keeping her computer at her

bedside. Countless animals owe their life to her.

She leaves behind her loyal and devoted husband, Tom. Their love for each other and lifetime of work together is a true love story. She is also survived by her daughter, Elizabeth, who shares her mother’s love for animals, as well as scores of healthy, rescued animals and appreciative animal lovers. Barb’s shoes will be impossible to fill. Her mission has made an indelible mark on so many lives. West Side Park at Mercy of Water Company

Anthem Community Council will spend thousands more from the community enhancement fund

on formal plans for a west side park―risking it can come to an acceptable use agreement with EPCOR, who operates a three-acre water recharge facility in the middle of the site.

The 10-acre site north of Opportunity Way and west of 46th Lane presents a lengthy list of challenges with what Council calls fragmented ownership between ACC, Parkside HOA and EPCOR. EPCOR’s recharge facility pumps up to 1 million gallons per day of reclaimed water into an underground aquifer. The park’s design must integrate and buffer EPCOR’s electrical panels and equipment, several above-ground

sounding ports, and significant underground infrastructure—all to EPCOR’s liking. EPCOR would require regular access to monitor and maintain its equipment.

At its Aug. 28 meeting, the ACC board hired Environmental Planning Group (EPG) to develop an initial design, taking EPCOR’s infrastructure requirements into consideration.

The proposed agreement was met with concern from some on the board. “Do we really have to spend $115,000 to get EPCOR to the point where they understand the project for them to say ‘yay’ or ‘nay?’ ” asked board member Tim Fyke.

Board member Ray Norris said, “I don’t trust EPCOR… Let’s not go forward if EPCOR’s going to pull the plug on this.”

But, Community Operations Officer Neal Shearer said moving to the initial design with EPG was critical, adding that talks and a preliminary agreement with EPCOR had already taken place. Worst case, Shearer said the ACC could run into some serious issues [with EPCOR] that would create the need to look for alternatives. “EPCOR has a need to protect their interest... I think we have to move forward and spend some funding in order to truly understand the proposal,” he said.

In the end, the board agreed to a total amount not to exceed $115,000, but prohibited EPG from moving beyond Task 1 of the project (design development at a cost of roughly $50,000) until after Council arrives at a formal agreement with EPCOR.

Financials have yet to be approved for the estimated $1.7-million project. So far, $265,000 has been allocated to the project, including $150,000 for fill. io

While it wasn’t on my bucket list (because I don’t have one), I

got my first pedicure the other day. It was during a “couple’s getaway” with my wife because that’s what you’re supposed to do on those things, I guess.

It was nice, I guess.

I went in with no expectations, so I was not disappointed. The first thing my pedicurist instructed me to do was pick out my nail polish color. He made a little joke about me considering bright red or purple. This is a fairly common joke when a man comes in for a pedicure, I guess. I chose clear, not wanting to throw off the guy who was about to take sharp instruments to my feet.

I liked the foot bath and the massage part, I guess. To be more precise, I liked MY foot bath and massage alright, but the guy definitely spent more time on my wife’s feet than mine.

I’m not the jealous type, mind you, but my dogs are twice as large, so I’d think there would be some type of minutes-per-inch scale that applies in the mani-pedi world.

I must tell you, the man was quite impressed with my podiatric hygiene. He commented on how nicely clipped my toenails were; (Mama taught me that trimmed toesies make the socks last longer). And, while he needed to take a cheese grater and belt sander to Dianne’s feet (the curse of the short woman and high-heel shoes), he found mine were quite smooth and silky, relatively speaking. That was a compliment, I guess.

With the education of my inaugural visit behind me, I’ll probably do it again, but I’ll let my nails get a little shaggy before I head in (gotta get my money’s worth), pick a more adventurous color, and even go stag so all the attention will be on me and my size 14s… I guess. io
