FOR THE SPECIAL ATTENTION OF THE BIDDERS

1. Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by

the Government.

2 . Even though the bidders meet the above qualifying criteria, they are subject to be disqualified if they

have:

. Made misleading or false representations in the forms, statements and attachments submitted

in proof of the qualificaticn requirements; and/or

Record of poor performance such as abandoning the works, not properly completing the

contract, inordinate delays in completion, litigation history, or financial failures etc.; and/or

The videographers to be hired shall be screened thoroughly as their professional competence,

track record, financial viability and other related factors.

. The Videographers should not belong to any political and should not be known sympathizers or

supporters or close relatives of any of the contesting candidates or any of the leaders of any

political party or should not have been hired by any political party or contesting candidate.

The Videographers do not accept the hospitality from any contesting candidates or political or

their workers.

They should be under the personal supervision and guidance of a senior election related officer.

As and when required the video teams may be aslted to accompany the General/Election

expenditure observers so that all critical events observed by them may also be videotaped.

The Videographer shall be impressed that the principle behind the scheme is t o record and

video tape critical event only which are liltely to vitiate the poll and not t o just videotape all

events in routine manner in order t o fill the cassette.

3. Any addendurn thus issued shall be added on the website namely www.tenders.tn.gov.in

4. The contract shall be for the whole worlts based on the priced Bill of Quantities submitted by the

Bidder.

5. The bidder shall fill in rates and prices and line item total (both in figures and words) for all the items

of the Worlts described in the Bill of Quantities along with total bid price (both in figures and words).

Items for which no rate or price is entered by the bidder will not be paid for by the Employer when

executed and shall be deemed covered by the other rates and prices in the Bill of Quantities

6. All duties, taxes, and other levies payable by the contractor under .the contract, or for any other cause

shall be included in the rates, prices and total Bid Price submitted by the Bidder.

7. The Bid Security may be forfeited

( a ) if the Bidder withdraws the Bid after Bid opening during the period of Bid validity.

(b) if the Bidder does not accept the correction, if any of the Bid Price, pointed out by the tender

calling authority

(c) in the case of a successful Bidder, if the Bidder fails within the specified time limit t o

1. SECURITY DEPOSIT:

execute the contract (i.e. sign the agreement) within the aforesaid 15 days time from the date of

letter of acceptance, the Earnest Money Deposit amount remitted with the Technical Bid (Pre-

Qualification) will be forfeited.

2. LANGUAGE OF TENDER SYSTEM: Bids shall be offered only in the prescribed forms in "ENGLISH" only.

3. VALIDITY OF PRICE TENDER: The Price Bid shall be valid for a period of at least 30 days (Thirty Days)

from the date notified for opening of Price Bid.

5. LATE BIDS: The Tendering system would not allow any late submission of bids after due date & time

6. NEGOTIATIONS: Negotiation of rates will be made only with the lowest Bidder for reducing the

y uoted rates.

7. MODIFICATION AND WITHDRAWAL OF BID: No bid shall be modified or withdrawn after the deadline of submission of bids a) BID OPENING: The Employer inviting bids or its authorized representatives will open the bids. In

the event of the specified date for the opening of bids being declared a holiday for the Employer,

the bids will be opened at the appointed time on the next working day.

b) In all cases, the amount of EMD and validity of the bid shall be scrutinized. Thereafter, the bidders'

name and such other details as the Employer may consider appropriate, will be notified as bid

opening summary by the authority inviting bids.

c) Evaluation of bids with respect t o bid security, qualification information and other information

furnished shall be taken up and completed within five working days of the date of bid opening,

and a list will be drawn up c f the qualified bidders whose price bids will be eligible for opening.

d) The Employer shall inform, the bidders, who have qualified during evaluation of bids, of the date,

time of opening of price bid. The bidders' names, the Bid prices, the total amount o f each bid, and

such other details as the Employer may consider appropriate will be notified by the Employer at

the time of bid opening. Any Bid price, which is not declared and recorded, will not be taken into

account in Bid Evaluation

e) Process t o be Confidential : Information relating to the examinat~on, clar~fication, evaluation,

and comparison of bids and recommendations for the award of a contract shall not be disclosed to

bidders or any other persons not officially concerned with such process until the award to the

successful Bidder has been announced. Any effort by a Bidder t o influence the Employer's

processing of bids or award decisions may result in the rejection of his Bid.

f) Clarification of Bids and Contacting the Employer: No Bidder shall contact the Employer on any

matter relating to its bid from the time of the bid opening to the time the contract is awarded. If

the bidder wishes to bring additional information to the notice of the Employer, i t should do so in

writing.

g) Evaluation and Comparison of Bid: The Employer will evaluate and compare only the bids

determined to be substantially responsive. In evaluating the bids, the Employer will determine for

each bid the evaluated bid price by adjusting the bid price through making an appropriate

adjustment for any other acceptable variation, deviations or price modifications offered. The

Employer reserves the right t o accept or reject any variation, deviation, or alternative offer.

Variations, deviations and alternative offers and other factors which are in excess of the

requirements of the bidding document or otherwise result in unsolicited benefits for the Employer

shall not be taken into account.

h) The entire process of calling for tenders, opening of tenders, processing of tenders and award of

contract will be done in accordance with the provisions contained in the Tamil Nadu Transparency

in Tender Act, 1998 and the Rules framed thereon.

i) Award of Contract : The Employer will award the Contract t o the Bidder whose Bid has been

deterr-nined:

a ) t o be substantially responsive to the bidding documents and who has offered the lowest

evaluated Bid price, provided that such Bidder has been determined to be eligible in

accordance with the provisions

b) to be w~ th in the available bid capacity adjusted to account for his bid price which is evaluated

the lowest.

c) The Employer reserves the right to accept or reject any bid, and to annul the bidding process

and reject all bids at any time prior to contract award, without thereby incurring any liability to

Bidders, In case of annulment, all bids submitted and specifically, bid securities, shall be

promptly returned to the Bidders

8. EXECUTION OF AGREEMENT:

a. The successful Bidder 1s required to execute an agreement between The District Election

OQtk,:, & lf istrict C~ l l ec ta r Salem for fulfillment of the contract in Rs. 201- judicial stamp

paper within a period of 15 days from the letter of Acceptance. It will be signed by the The

Dlstrlct Electlon Offlcer & District Collector, Salem after the security deposit is furnished by

successful Bidder. For failure to sign within 15 days, the District Election Officer & District

Collector, Salem shall have an option either t o extend this period for signing the contract or

talten any other action as deemed necessary, including calling for re-tenders.

b. The Successful Bidder shall not assign or make over the contract, the benefit or burden thereof

to any other person or persons or body corporate for the execution of the contract or any part

thereof.

9. WORK ORDER:

After successful execution of the Agreement and payment of Security Deposit, "Work Order" for the

INVITATION FOR BIDS (IFB)

1. The District Election Officer & District Collector, Salem on behalf of the Governor of

Tamil Nadu invites the item rate bids, in open tendering system, for VIDEOGRAPHY OF

CRITICAL EVENTS DURING TAMILNADU LEGISLATIVE ASSEMBLY GENERAL ELECTIONS 2016

from the eligible and approved contractors / Companies / Firms / Studios registered with

any of Tamil Nadu State Government Departments/undertaltings etc.

2. Date of release of Invitation for Bids through open Tender: 10.02.2016

3 . Availability of Bid Document and mode of submission: The bid document is available online

from .10.02.2016 to 26.02.2016 at 13.00 hrs and bid should be submitted in Tender Box

provided @ Election section, Collectorate, Salem. The bidder would be required to register

in the web-site which is free of cost.

4. Submission of Original Documents: The bidders are required to submit (a) original EMD in

approved form and (b) original affidavit regarding correctness of information furnished with

bid document to Tender Box provided at the office The Additional District Election Officer &

District Collector, Salem on the same day of opening of Bid, either by registered post or by

hand, failing which the bids will be declared as non-responsive.

5. Last Date/ Time for submission of bids through open tendering 29.02.2016, upto 15.00 hrs.

6 . Bids submitted either in tender Box or registered Post is permitted. The qualification part of

the bids will be opened at 16.00 hrs on 29.02.2016 by the authorized officers. If the office

happens to be closed on the date of opening of the bids as specified, the bids will be opened

on the next worlting day at the same time and venue.

7 . Other details can be seen in the bidding documents. The Employer shall not be held liable

for any delays due to system failure beyond its control. Even though the system will attempt

t o notify the bidders of any bid updates, the Employer shall not be liable for any information

not received by the bidder. It is the bidders' responsibility to verify the website for the latest
