Third victory of OIPA in India and PFA Haryana on elephants:
Despite a ban on elephant trading, jumbos can be bought and sold
in Haryana thanks to loopholes in the state's Village Cattle Fair Act
(1970). The act, amended twice, continues to have elephants on its
list of tradable animals at rural cattle fairs. The state act violatesthe Wildlife Protection Act (1972) that puts elephants in the
protected category scheduled one and bars their domestication. The
definition of tradable cattle in Haryana includes buffaloes, camels,
cows, donkeys, elephants, horses and mules.
Elephant became national heritage animal of India, Indian
representative of United Nation affiliated OIPA Naresh Kadyan
approach the Ministry of Environment and Forest to introduce
legislation and then moved public interest litigation before the Delhi
High Court to include elephant in the Emblem and Names(Prevention of improper use) Act, 1950; like wise Abhishek Kadyan,
Hon. Animal Welfare Officer, AWBI taken up this matter with the
Ministry of Home Affairs, where as Miss Sukanya Kadyan moved this
matter before the Election Commission of India to freeze the symbol
of Bahujan Samaj Party.
Miss Sukanya Kadyan, Hon. Animal Welfare Officer, AWBI taken up
the matter of amendment in the Haryana Cattle Fairs Act, 1970
definition because it allow the trade of jumbo in Haryana, which is
illegal, after a long battle of three years, at last Haryana Legislative
Assembly agreed to amend the said legislation, elephant word
deleted approving Haryana Cattle Fair Bill, 2013 on September 10,
2013.
Elephant can not handle with iron ankush now because Naresh
Kadyan, Chairman, People for Animals (PFA) Haryana moved public
interest litigation before the Rajasthan High Court (Jaipur Bench)
and got ban order, like wise elephant ivory products manufacturing
and trading was allowed under the Prime Minister Employment
Generation Programme of Khadi and Village Industries Commission
scheme for financing up to twenty five lacs with margin money
subsidy, this matter was also taken up with the Wildlife Crime
Control Bureau (Ministry of Environment and Forest) by the
Abhishek Kadyan and Miss Sukanya Kadyan jointly, notice was
issued to KVIC by WCCB and at last KVIC was compelled to amend

its negative list, now all ban articles are covered under the negative
list of KVIC.
