Only by cooperating with each other can the men now comprising this industry assure themselves of better conditions today and finer business standards for the post-war era. r Those men who will pledge themselves to give complete, true and full information regarding the equipment they intend to sell, will certainly find that all others will cooperate with them. Those who do not care to pledge themselves to cleaner business practise, are probably the same men who will ship anything they can get their hands on, regardless of condition and without mechanics going over the machines, or e^en without seeing the machines themselves in many instances, simply to grab what money they can at this time because of the unusual market condition that prevails. It is far better for the members of this industry to willingly enter into a pledge to work with each other honestly in these tragic times than for anyone to pub- lcly hold a firm up to scorn. In short order, those firms that are shipping merchan- dise of poor character will be called to the attention of the trade anyway by their own actions. They will suffer severely in the long run. As yet returns continue to arrive daily* These will take a few weeks to compile,

classify and clarify* Many have given personal opinions in addition to answering the

questions that appeared* Some failed to answer a few questions* Some misunderstood a

question or two* In general, tho, almost everyone carefully answered each and every-

question appearing in this survey.

No individual opinions will be given in the final report of this survey* The

complete survey will be treated as a collective opinion in every regard* This will be

the trade*s opinion as to what the trade itself believes should be considered as a basis

for jobber and distributor recognition* This will also be the very first time in the

history of this industry that any publication has undertaken so gigantic a task* It

again proves the need for some bureau in this industry which will be prepared to fur-

ther the interests of this business by continued effort of this kind*

A recognition bureau becomes a greater necessity each day* The Cash Box believes

that by presenting the collective results of this survey before the trade the industryitself will be able to judge as to just what should be done in this regard* There is

no doubt that when completed the results of this survey will prove startling to all

in this industry, and may even prove to be the wedge that will open the path to great-

er achievement and finer business standards*

WILL NEW MACHINES DROP PRICES?Tho The Cash Box considers this extremely premature, yet it is already the subjeet ofmany conversations among leading coinmen. These men are holding back from purchasingany large quantities of equipment on the theory that when the new merchandise is an-nounced by the manufacturers, even tho such announcement does not mean immediate de-

liveries of the machines that prices of all present equipment they have in stock or ontheir routes will fall to such low points as to be considered practically worthless.In fact, some of these men believe that machines at present considered among the best

in the industry will lose as much as from 75% to 95% of their value.

These coinmen admit that in the beginning, after the first announcements, deliver-ies at best will be very slow. Most attribute this to the fact that raw materials willnot be obtained in sufficient quantities for mass production. The factories themselveswill need some time to get back into the swing of coin machines manufacture, aftertheir complete concentration in war work* There is also the belief that some of the

manufacturers will be sure to be caught short and will need a little time to test -what-

ever products they first produce, even if these are probably the last machines theymade prior to being forced out of domestic production.

It is also considered certain that the manufacturers will require some time to

get their new employees into the swing of coin machines manufacture* Production linechanges and other factors will also hold down any quantity production for the time be-ing, In fact, to be perfectly frank, most of the men are agreed that it will take any-where from 6 to 18 months after the first announcements of new machines manufacture be-ing allowed prior to seeing production somewhat on the scale it was last known, beforethe war.

That being the case. The Cash Box does not agree that there will be such tremen-dous drops as from 75% to 90% in the value of the average present used machines. Per-haps some of the oldest type of machines will drop as much as 50% in price, but sincenothing will actually be prsented to take their place. The Cash Box is of the beliefthat there may be no serious drop in the price of even such used merchandise. The mo-ment the war is over and the manufacturers do hastily announce their re-entrance intothe field, there may be a somewhat hysterical drop in the prices of all types of usedmerchandise. But as the weeks go by and the production of the factories does not showa tremendous spurt, there is no doubt that the price of used machines will go up onceagain.

One big reasoh will be the return to the trade of many men who have just beenwaiting for the war to finish* They will be willing to purchase any t ype of equipment,regardless of price, to obtain locations and thereby insure those locations remainingtheirs when the new machines are ready* In short, they will be willing to buy anytype of used machine and figure the cost of the machine as the cost of helping to ob-tain a location* At the same time there is no doubt that the used equipment will payfor itself even before the new machine gets into the spot.

The average coinman will agree that there are a tremendous nunber of locationsavailable everywhere in the nation* This is due to the numbers of men who have soldout entire routes to enter into the armed forces and into war work* This is also dueto the fact that many machines have already worn and are wearing out and have to bepulled, and there is nothing with which to replace them* It is also a fact that whenthe war is over a great many new locations will be ready to accept coin operated equip-ment.

Therefore regardless of how old the machine, as long as it is rushed into the

spot - just to hold this location - the newcomer or the returned coinman has a chance

when the new machines arrive. From this standpoint alone The Cash Box believes that

prices of present used machines will zoom immediately after a hesitant drop on the

first announcements by the manufacturers of new equipment.

Coinmen will need used equipment to grab the largest possible number of locations

for themselves* Even those at present engaged in the industry, since the greater ma-

jority have cut down on the size of their routes, will also start out grabbing for

used equipment of practically any type to insure holding the right spots for themselves

when the new machines begin to arrive,

Tho The Cash Box is in agreement that prices will drop somewhat on first announce-ments of new machines manufacture it is not in agreement that this will be a long andsevere drop. Instead, it will be a psychological price drop, which will come back

with plenty of vigor as the trade realizes that the new equipment will not come inspeedily enough, nor in sufficient quantity, to take care of the tremendous backlogdemand which easily, at this time, exceeds 1,000,000 machines of all types#

The trade can look ahead for many months after the first announcements of new ma-chines manufacture to continuing its present business methods. There is also no doubt

that when new machines are announced, that a great many nefarious practises will change

with exceeding rapidity for these men will not at such time wish to offend possiblecustomers nor win bad names with the manufacturers who will naturally hear of their ac-

tions.The Cash Box is in agreement that prices on present equipment will probably be

completely wiped out about 18 months after manufacture has started, Tho most firms be-

lieve that they will be able to export a large amount of this equipment at good prices,this, too, is doubtful. The average British, Canadian and other foreign coinman, is

today as well acquainted with the industry as is the .American coin machines man.

BRINGING 'EM BACKReports received from thruout the country verify the fact that machines are growingscarcer and more difficult to obtain each day® There are many machines as yet to be

dug out of cellars and attics end barns thruout the country which would prove oftremendous value to the trade at this time® If the more progressive men in this indus-try will get into action in this direction they are sure to find many machines rightin their own territory which they never before suspected existed* This has been proventime and time again by agressive coinmen.

Many coinmen, to obtain equipment, have used advertising in local newspapers inthe hope that by so doing they would reach smaller operators who had stored theirequipment and were now war workers or away to the armed forces. Many report that theywere successful in obtaining some equipment in this fashion. Others have simplycombed over their old lists and have written letters advising that they would pay goodprices for coin operated equipment and have also been able to dig up some machines inthis fashion® Generally it has been the direct visitor, the salesman, who travelsabout thruout the hinterland, who has been able to bring much equipment to marketwhich was formerly hidden away in dark basements or attics, garages and barns.

SEASONAL ARCADESThe time grows shorter each day to when the seasonal arcades will be opening for their’44 season® This is the time for those arcade owners to meet and arrange to speed theaction for a better understanding as well as a definite decision regarding their taxa-tion problem® They will thereby assure themselves more profitable operation.

There is no doubt that all seasonal arcade men are in agreement that somethingmust be done and done quickly so that they again won*t have to purchase full year li-censes to operate for just about three months this summer season,

A national meet of arcade owners is necessary. At such a meeting, featuring na-tional representation of the arcade field, agreements can be reached on the methods ofprocedure® A meeting of all the arcade owners to appoint a committee to act for themwill tremendously impress the Ways & Means Committee in Washington and any others withwhom the committee will have to make contact®

A petition should be started now to obtain the signatures of all arcade ownersthruout the country in an effort to help change this ruling. The arcade owner shouldbe allowed to purchase his licenses on a quarter-yearly basis. This is one field thatis assured a glowing future if its members will work together.

GOOD WORK TRAVELOGUE NEWARK ARCADES“Curley” Robinson of A.O.L.A.C., Los

Angeles, Calif., again sends in a few letters

we are mighty proud to publish. The first

**>ne comes from U. S. Naval Construction

Battalion Number 125, c/o Fleet Post

Office, San Francisco, Calif., and reads as

follows

:

“May I express my thanks and gratitude

for your generous contribution of the three

pinball machines to our recreational gear.

“I am sure that when we reach our

destination, Island X, the machines will aid

greatly in reviving memories of the good

old United States. It will also take up a

considerable amount of the spare time

which in some of the war zones becomes

unbearable for the men.

4' “Thanking you again on behalf of the

Enlisted Men and Officers of our Bat-

talion.”

The second letter is from the Bell

Gardens Hospitality Hut in Bell Gardens,

Calif., and is written to “Curley” by Frank

U. Brown, President of the Board. It

reads

:

“May we express to you the appreciation

of the Board, and the pleasure and grat-

itude of the entire personnel of the Bell

Gardens Hospitality Hut for the gift of

%our marble machine.

On the first day it was installed the Hutentertained more than one hundred service

men. Their delight in its being there wasvery apparent.”

DIRECT SALESBill Gilles of Gilles Candy Co., Osage,

la., who built Tailgunner and received

quite a bit of commendation for this gunrevamp, writes, “Am enclosing check for

renewal of my subscription. Don’t figure

I will be reading The Cash Box much after

a while, as I will be wearing Uncle Sam’s•khaki, but, not for long, as it’s going to be

over pretty damn soon.

“You’re doing a fine job with The CashBox. Why don’t you stress the idea of notselling direct to locations? All jobbers are

guilty of doing it, and after the war believe

that a great many will continue to do so,

to get rid of the many old machines that'frill become antiquated.

“I have a resort town and you would be

surprised at the number of locations that

have their own machines. Take this for

what it’s worth, but I believe a program

should be worked out to tell of the harm’This practise causes operators.”

that Bill Gilles ivill be leaving us. But,

Tom Smallwood of Collette & Small-

wood, Idaho Falls, Idaho, who has just

returned from a two months vacation in

Mexico (pronounced Meh-Hic-Co) was so

enthused over visiting there that he dropped

us a letter which reads like a travelogue.

Tom writes, “Just returned from a twomonths vacation. Spent a month in MexicoCity. Went to Vera Cruz, Acapulco andGuadalajara. Life magazine, February 22

issue, had quite a spread regarding the

above mentioned cities in Mexico.

“Mexico City is a great city. Population

over 2,000,000. Altitude over 7,000 feet.

And in some sections is as modern as NewYork.

“Saw a few phonographs, mostly old

models of various makes, but no slots. Thegovernment takes care of the gamblingsituation with their own lottery. Races

were on and well attended.

“The big attraction is the bull fight on

Sundays. Starts at 4 P.M. and six bulls

are killed during the performance. Thebowl, or ring, holds over 35,000 people andit’s jammed to capacity. Getting tickets

for this is like securing tickets for the

World’s Series in the States.”

( Editors note: Wouldn’t you, too, like

to spend a month in Mexico City, just

looking at bull fights on Sundays andbreathing in the rare and clear air on week-days zvhile troubadors twang on mandolinsin the moonlight and gay senoritas sing

sweet songs in your pearly ears? Wouldn’tyou? Then be a good little operator andoperate like hell so that you, too, will be

able to visit Mexico.)

POST-WARTo get some idea of how big business is

trying with all possible means to offset any

trying period that may follow the end of

the war, the following excerpts from a

letter written by A. D. Whiteside, President

of Dun & Bradstreet, Inc., will possibly

open the eyes and minds of many in this

industry.

Mr. Whiteside writes: “Contract cancel-

lations and renegotiations of profits are

unquestionably the two outstanding fea-

tures of our present war economy, not only

because of their importance in the appraisal

of individual credit risks, but also because

of their vital effect upon the post-warplanning of every commercial and industrial

business enterprise in the country.

“At the end of World War I, cancella-

tions of contracts for war equipment, mate-rials and supplies totalled $7,500,000,000.

Cancellations of World War II contracts

exceeded $12,000,000,000 by the close of

1943, and undoubtedly have increased since

then to more than twice the amount of

World War I cancellations.

“In 1943, 23,500 prime contractors andsub-contractors were renegotiated on their

1942 war business.”

SWEET ADELINEJames W. Johnson, Collector of Internal

Revenue for New York City’s third district,

reported today that if the boys at the bar

give out with “Sweet Adeline” slightly off

key, it’s alright. But, if the singers soundprofessional, the 30% cabaret tax may have

to be levied, he said.

One of our Newark, N. J. subscribers,

who forgot to mention his name, sends us a

clipping from the Newark Evening Newsof Monday, April 3, wherein the headlinereads: “It’s Spring in Market St. WhenArcades Flourish.” And the sub-headingreads: “Fun Emporiums with Their Clatterand Color Enjoying War Boom.”

It certainly must have been Spring in thefancy of the reporter who tapped out the

story for it starts, “The most garish of

war-boomed business here are the amuse-ment arcades, the sidewalk fun emporiumswhose wide open doorways are a sure sign

of Spring in Market St. as any calendar.”

Market Street, by the way, is the maindrag in Newark, N. J., and the leadingarcades are practically downstairs of the

offices of the Newark Evening News.Therefore this reporter didn’t have to

travel far to get his story which coversabout two full columns. He does go onto say

:

“Soldiers, sailors, street urchins and otherrestless strollers with a spare nickel or twoand an itch to twang a slot box lever are

crowding the pinball halls these days.

“What the resultant clatter (bells, horns,buzzers, etc.) lacks in tune it doubles in

brass. And just as loud are the crashinggreens, blues, reds and yellows of the

arcade gun ranges and bagatelle lights.

“Servicemen, particlarly, flock to theslot machines urging they ‘learn to shootfor America, 5 cents’ and ‘trap the Jap,2 sents and ‘torpedo the sub, improve youraim, 1 cent.’

“Funny thing about soldiers’, remarkedone arcade host, as he collected precioussteel bb’s from the shooting gallery floor

with a magnet, ‘they’re lousy shots. Theymiss everything but the back wall. Maybethey ain’t used to the guns.’

And the reporter goes on to tell aboutone arcade owner who made 1 1 hits out of12 tries and told him that civilians werebetter shots than service men because the

service men are accustomed to heavier guns.And he also told the reporter that heprobably would have scored 100% but forthe fact that he didn’t have his glasses withhim. Anyway the item winds up with somereally fine description, as follows:

When 20 to 40 bagatelle machines arebeing pumped and the shooting range is in

use, the noise can be heard several hundredyards up and down the street. But themore noise, the more nickels for the arcademen. They love the non-stop raucous sym-phony of clangs, crashes, bongs, toots,cracks, pops, squeeks, howls, yelps, hootsand burps — for then it’s really Spring in

Market Street.”

(And the really funny part of this wholestory is that a terrific snozv stormcovered all Newark, N. J., in fact thewhole Eastern area—the very next day afterthis article appeared. Spring? Phooey !)

slugs to be used to obtain free cigarettes,stamps, admissions or other articles orservices from coin operated machines willhenceforth run the risk of a $3,000 federalfine and year’s imprisonment under theterms of a Bill signed by President Roose-velt on April 3, 1944. FOREWORDMany time*. wide differences appear in the high and low prices of certain equipment. Like any true reporter TheConfidential Price Lists can only feature the market prices as they are quoted. The Confidential Price Lists act exactly

the same as the market quotation board at the Stock Exchange—posting the prices exactly as they are quoted for

each week, regardless of how much they may seem to be out of line. Some machine prices do not change for

months. The Confidential Price Lists, rather than show no price for the week, retain the last known quotations lor

such equipment so that the subscriber at least has the last known quoted prices as a basis to work with. Prices

continue to be very widely divergent these days. Someone on the West Coast may feel a certain machine worth$150.00 whereas someone on the East Coast may think it worth but $75.00. Of course, condition, serial, appearance,demand, territory, quantity, etc., must all be taken into consideration. The Confidential Price Lists report eachquotation exactly as it is made and depend on the subscriber to make average price adjustment to fit the peculiarities

of his own territory.

NEWS FLASHFREE PLAYGAMES RULED“NOT GAMBLING'lNDISTRICT OF COLUMBIA BY U. S. COURT OF APPEALSThe U. S. Court of Appeals of the District of Columbia ruled (April 17, 1944) in thecase of the Washington Coin Machine Association vs Harvey G. Callahan, AssistantSuperintendent of Metropolitan Police, in an appeal taken from the local districtcourt (argued March 14, 1944) Judge Groner giving the following opinion:

"These machines are lacking in the essential elements necessary to make

of them gambling devices or gambling machines. There is no element ofgain or loss, financial or otherwise, involved in the transaction.

"One may not suppose that a person desiring to gamble would put up

money in the hope of obtaining tokens which can be used only to produceinsignificant humorous sayings. The amusement feature of the machinedoes not make the machine a gambling device. It arouses interest and

perhaps attracts customers to the machine in much the same way as ad-vertising would, but this is lawful.

"The only chance connected with the operation of the machine is that

wit or humor may momentarily brighten up the vacuous minds huntingamusement, "

It is also understood that Judge C. J, Groner, who gave this decision which capturedthe fancy of the various presses located in Washington at this time and who rushed itover their wires to the nations* newspapers, will in a few weeks also rule on the

legality of tokens in machines, but not for redemption. Washington coinmen eagerlylook forward to his decision in this regard.

In the meantime the news that Washington, D, C,, is again open to free play games hasflooded this already overcrowded city with operators from as far away as Florida andmany from New York City. Word comes thru that all these are getting ready to set pinsjust as fast as they can obtain them. Such eastern centers as New York, Newark, N.J.,Philadelphia, Pa*, Boston, Mass., and many other cities heard the news first andoperators from these spots rushed to Washington seeking locations. This grand rushto operate in Washington is bringing chuckles to the District of Columbia ops whoknow the ropes as well as the many restrictions and especially the locations thatproved worthwhile when pins ran last.

The entire case goes all the way back to 1936 before Judge Donahue in the Court of

Equity. At that time the judge ruled that pin games were games of chance, and there-fore gambling devices. (He meant the one-balls that were in operation in Washingtonat that time.)

In 1938 when free play pins made their appearance, Washington* s ops placed them outcautiously, expecting this old ruling to apply to them, but the police did not molestthe games. In 1942 the District Attorney came out with an opinion that these freeplay pin games were illegal and ordered the police department to pick them up onsight.

The ops went into city court and obtained a jury trial, after one storekeeper wasarrested, to fight this order. The jury disagreed with the police department at thistrial, but this was only on that one particular game which had been picked up.

Another game was immediately picked up by the police department and the ops then de-manded an injunction restraining the police from molesting their machines. They lostthe suit for this injunction in the District Court.

In 1943 the coin machines association of Washington took an appeal from this loss tothe U.S, Court of Appeals of the District of Columbia on obtaining an injunction.This is the decision which has just been announced.

For a moment the frantic long distance phone calls that came in from everywhere inthe country to The Cash Box were starting something of a rampage. Many misinterpretedthe press release in this case which appeared in their daily newspapers by just read-ing that, "Free Play games have been termed not gambling by the U,S*Court of Appeals".Many coinmen therefore believed that this decision came from a high Federal court andwould affect the entire country.

This is not a Federal decision covering the nation. It is instead a decision for theDistrict of Columbia from the U.S. Court of Appeals for that district only.

A meeting of all coin machines manufacturers and trade press representatives has been

called by the C. M. I. for April 26, 1944. The meeting will be held at Groetchen’s

Restaurant, Madison Street and Crawford Avenue, in Chicago. Dinner will be served

at 6:30 P. M., to be followed by a floor show, after which, the manufacturers will

participate in an open meeting to discuss all ideas pertaining to the future welfare of

the industry. This is not being done because of any rash anticipation that the war

may soon end. Most of the manufacturers are deep in war work and this is their chief

concern until victory is won.
