October 5, 2016, 6:00 p.m.
The Work Session/Business Meeting of the West New York Board of Education was held in the Auditorium of the West
New York Middle School, 201 – 57th Street, West New York, New Jersey. The order of business and agenda for the meeting
was:
I. CALL TO ORDER At 6:17 P.M. the meeting was called to order.

IV. OPEN PUBLIC MEETING STATEMENT
The New Jersey Open Public Meetings Law was enacted to ensure the right of the Public to have advance notice of and to attend the meetings of any public bodies at which any business affecting their interest is discussed and acted upon. In accordance with the provisions of the act, the School Business Administrator/Board Secretary has caused notice of this meeting to be sent to the following, announcing time and place thereof, agenda, etc.

Board President Parkinson shared with the Board that the Chief WNYEA Union Contract Negotiator for the Board, Mr. Lester Taylor, had an update for the Board on recent discussions with the Union and advised that now would be a good time to discuss the update in an executive session with Board Members. He stated further that the executive session will be brief, approximately 15 minutes, following which the agenda will resume with the public comments section.

The public portion of the meeting is now concluded. The Board will now recess into Executive Session to discuss items which fall within an exception of our open meetings policy and permits board to have private discussion since it deals with specific exceptions contained in N.J.S.A. 10:4-12:
Matters of Personnel – WNYEA Union Contract Discussions and update from Chief Negotiator
BE IT RESOLVED, that the Board of Education will recess into Executive Session to discuss the aforementioned matters. Any discussion held by the Board which need not remain confidential will be made public as soon as practical.
Minutes of the Executive Session will not be disclosed until the need for confidentiality no longer exists.
The Board may take action on these items following executive session.

Board Attorney explained to the public that whereas quorum of Board Members was present when the body voted to recess to executive session. Given that Trustees Cheng and Portillo left the meeting following the vote to recess to Executive Session, the Board was waiting to have a quorum of members present in order to officially adjourn the Executive session. Now that Board Vice President Gonzalez has arrived, Board has quorum and the meeting can proceed officially and legall y. Board President Parkinson shared with the public the Board Attorney, in his role as Chief Negotiator representing the Board in the WNYEA negotiations, has updated the Board members at the Executive session. He further stated that he would approve the MOU and Agreement which would come out of the process in which the Fact Finder was engaged. Board President Parkinson opened the Floor to Public Comments and the Board Secretary read the Open Public Meetings Act Notice:

VI. PUBLIC COMMENTS ON MATTERS OF GENERAL CONCERN
In accordance with West New York Board of Education Bylaw #0167 (Public participation in board meetings – Adopted November 14, 2012) each participant shall be limited to three minutes’ duration.
Meeting proceeded with public commentaries of general nature At the end for the Public Comments Section, Board President Parkinson noted that the Board’s Facilities Committee has met with the Administration prior to the Board Meeting and discussed the test results and next steps going forward and that a presentation on water quality and testing will be presented at the current meeting, following the Superintendent’s Report.

VI. SUPERINTENDENT’S REPORT Superintendent Herrera invited the Board to step down from the stage and to join the public for Assistant Superintendent’s Robert Sanchez’ Water Testing and Violence & Vandalism presentations
1. Water Testing: Assistant Superintendent Robert Sanchez went through the Water Testing Presentation, outlining the background for and results of the test results which were posted on the district’s website. He also covered some clerical items, including post testing updates. Mr. Klein, representing the laboratory which conducted the water testing at the district corroborated facts presented by Mr. Sanchez and joined the former in answering questions from the public. Following Presentation, Mr. Sanchez noted that the Administration met with Director of the Health Department of the Town of West New York who shared with the Administration that: – over last 6 months no cases or test results that indicated there is lead poisoning Superintendent Herrera shared that the Director of the Health Administration offered to coordinate scheduling and hosting a town h meeting with the School District at the Superintendent’s discretion. Board President Parkinson noted that the district’s proposed water testing policy is more stringent than that required by law, mandating testing to occur every 2 years as opposed to the state’s 6 year requirement. 2. Violence & Vandalism Report Assistant Superintendent Sanchez presented the Vandalism & Violence report

BUSINESS and FINANCE 1.1 Treasurer of School Monies Report
On motion made and passed, the Board of Education accepted the report of the School Business Administrator/School Board Secretary (148) as certified in keeping with N.J.A.C. 6:20-2.2.13(d) and the report of the Treasurer of School Monies (A149) for the month of March 2016, as presented by the Superintendent of Schools, and found them in agreement and upon review certified them to the best of their knowledge and no major account or fund had been over expended in violation of N.J.A.C. 6:20-2.14(b) and that sufficient funds were available to meet the District’s financial obligations set for the remainder of the Fiscal Year N.J.A.C. 6:20-2.13(e) and on this basis ordered them as part of the minutes of the Board of Education. In keeping with the aforementioned approval, this Board does hereby also approve the submission of the March 2016, Secretary and Treasurer Reports to the N.J. Department of Education, Division of Finance, Office of Budget Review and Fiscal Monitors.

1.4 Transfers
BE IT RESOLVED, that this Board of Education, upon the recommendation of the Superintendent of Schools, authorizes the following line item transfers and certifies that the proposed transfer(s) will not affect implementation of any approved programs and/or services:
1.5 Jugando Aprendemo - OFAC Audit CAP
WHEREAS, N.J.A.C. 6A:23A-5.6 requires a school district to discuss the findings of an Office of Fiscal Accountability and Compliance (OFAC) audit at a public meeting of the district board of education no later than 30 days after receipt of the findings, and
WHEREAS, the West New York Board of Education Early Childhood Education Provider, Jugando Aprendemo, underwent such an audit for the 2014-2015 school year, and
WHEREAS, the New Jersey Department of Education Office of Fiscal Accountability and Compliance letter of Report of Examination dated August 26, 2016 was received by the District on August 28, 2016, and
WHEREAS, at the September 6 10, 2016 Board Meeting, this Board of Education adopted a resolution discussing the Report of Examination from the New Jersey Department of Education Office of Fiscal Accountability and Compliance, and
WHEREAS, the Office of Fiscal Accountability and Compliance, based upon their limited review, revealed areas of concern requiring additional monitoring and follow-up in order to enhance compliance with the contractual requirements of the educational components in the Early Childhood Preschool Education Program, and
WHEREAS, N.J.A.C. 6A:23A-5.6(b) requires a school district approve the corrective action plan to address the issues raised in the findings and that the resolution be submitted to the Office of Fiscal Accountability within 10 days of adoption by the Board of Education, so
NOW THEREFORE, BE IT RESOLVED, the West New York Board of Education approve the Corrective Action Plan for Jugando Aprendemo for the 2014-2015 audit and authorize the Board Secretary to submit the resolution to the Office of Fiscal Accountability.
1.6 Labor Relations Consulting Services - Extend Expenditure Cap
WHEREAS, at its November 24, 2015 meeting, the West New York Board of Education, resolved to appoint Mr. Raymond Cassetta to serve as a labor relations/salary guide consultant for labor relations/salary guide analysis and preparation in connection with negotiations with the WNYEA at a rate of $160.00 per hour for an amount not to exceed $10,000.00, and
WHEREAS, the District's negotiations with WNYEA are still on-going and Mr. Raymond Cassetta is continuing to provide services, the aggregate cost of which is anticipated to exceed the $10,000.00 cap, so
NOW THEREFORE BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent, resolves to award an extension of the cap on Mr. Raymond Cassetta's remuneration from the current $10,000 cap to an aggregate $20,000 cap, while maintaining an hourly service rate of $160.00 per hour.
1.7 MHS Annex B Pool Contract with North Bergen Board of Education (2016-17)
WHEREAS, on an annual basis, the West New York Board of Education enters into a contract with the North Bergen Board of Education for the latter's use of the swimming pool in Memorial High School Annex B Building, and
WHEREAS, the West New York Board of Education's contract for North Bergen Board of Education's use of MHS Annex B Pool in 2016 is subject to the approval of both boards, and
WHEREAS, and the anticipated start of North Bergen Board of Education's usage of the MHS Annex B Pool scheduled for first week of November, 2016, with approval of both Boards possible by October 19, 2016, prior to the contract start

NOW, THEREFORE BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools, approves the award of a contract with the North Bergen Board of Education for the use of the swimming pool in Memorial High School Annex B Building in the amount of $13,650.00 (same as last year) for the period of November 1, 2016 through March 15, 2017, and instruct the Business Administrator to enter into the contract with the North Bergen Board of Education subject to the North Bergen Board of Education's approval of the contract at its Board Meeting on October 19, 2016
1.8 NEA BoD Alternate - Reimbursement
WHEREAS, Ms. A. Kober was elected to the New Jersey Education Association's ("NEA") Board of Directors as an Alternate for a one-year term commencing September 1, 2016 and expiring August 31, 2016, and,
WHEREAS, Ms. Kober notified the Superintendent of her election and requested that release time be granted in the event she is called upon to attend various meetings as part of the functions carried out by an Alternate for an NEA State Director, and so
NOW, THEREFORE, BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent, approves the attendance of Anita Kober to various NEA meetings throughout the year as per attached NEA letter of request, and
BE IT FURTHER RESOLVED, that this Board of Education, upon the recommendation of the Superintendent, approves the acceptance of Ms. Kober’s per diem reimbursement by the NEA in the amount of $______.
1.9 Payment Authorization_ H&S Construction (SDA-funded Science Lab Upgrade Project - MHS | Annex B)
WHEREAS, on June 28, 2013, the NJ Schools Development Authority (the “SDA”) has approved the district’s funding for the renovations of the science labs at Memorial High School and Annex B (Capital Maintenance Project), and entered, in accordance N.J.S.A. 18A:7G-13a, into a grant agreement with the Board for the payment of the State’s share of costs (100% of project costs): (DOE Project #: 5670-050-12-0ACM-01; SDA Project#: 5670-050-12-0ACM-01; Grant #: GB-0252), and
WHEREAS, having duly received authorization from the Board to advertise for and receive competitive bids for the Memorial High School / Annex B Laboratory Alterations (Bid No. 05-60), the District’s Central Administration:
1. conducted a public bid opening for the award of the Memorial High School / Annex B Laboratory Alterations (Wednesday, March 30, 2016)
2. awarded the contract for the Memorial High School / Annex B Laboratory Alterations to H & S Construction in the total contract sum of $2,324,00.00 (Base Bid - $2,174,000, plus Contingency allowance - $150,000) as the lowest and responsible bid for the 2015-2016 school year (at the Board’s May 18, 2016 meeting), and
WHEREAS, pursuant to a payment schedule outlined in the New Jersey Schools Development Authority’s “Final Grant Amount and Authorization to Proceed with the Award of Contract Letter”, dated 5/26/2016, and RSC Architect's (Construction Administrator) Certification of Payment No. 4 as submitted by H&S Construction (Contractor), dated 9/23/2016 2016, Contractor is due a payment in the amount $1,071,047.80 (excluding retainage)
THEREFORE, BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools, hereby authorizes the Business Administrator to effect a payment of SDA funds to H & S Construction in the amount of $1,071,047.80
1.10 Donation – MHS Production Props
BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of School and in accordance with West New York Board of Education Policy/Regulation #7230 (Gifts, Grants and Donations), accepts the following donations from the following donors:

1.11 Superintendent Goals for 2016 – 2017 – ADDED BY THE SUPERINTENDENT
WHEREAS, the WNYBOE has entered into an employment contract with Clara Herrera, Superintendent of Schools; and
WHEREAS, said contract allows the Superintendent to earn a bonus for achieving enumerated qualitative and/or quantitative goals,
NOW THEREFORE, be it approved that the WNYBOE approves the qualitative and quantitative goals set forth in Exhibit A and that same are expressly subject to the approval of the Executive County Superintendent of Schools.

2.5 Distribution Master Teacher Additional Hours with PIRT
BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools approves additional hours in payment for Master Teachers as per the Early Childhood Operational Plan. Said hours will not exceed one hundred eighty two hours per Master Teacher, for a total of nine hundred ten hours, payment to be made commensurate with the collective negotiated agreement with the WNYEA.
BE IT ADDITION Y RESOLVED, that a portion of unused Master Teacher hours will be allocated to be used for Social Worker, Speech Therapist, Special Education Resource Personnel, and PIRT members so these professionals may be employed in activities that will further support the Early Childhood Program. The allocated hours will be utilized in services related to professional development for staff and parents/guardians before and/or after school meetings.

BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools approves the collaboration between Beth Baur, MHS Performing Arts Instructor and Charlotte Colavin, Staff at Manhattan Theater Club, to assist in the development of an original script for the Winter Play pending Ms. Colavin’s background check. They will be creating an original play with the working title of “Immigrante”. There is no cost to the district.
2.7 NJ Child Assault Prevention (CAP) Project Grant Acceptance
WHEREAS, The NJ Child Assault Prevention (CAP) Project is a statewide prevention program whose mission is to provide schools and communities with information and resources to reduce children’s vulnerability to assault and bullying. NJCAP, a program of the Educational Information and Resource Center (EIRC) and the NJ Department of Children and Families, has trained over 3 million children and 500,000 parents and teachers since its inception in 1985.
THEREFORE, BE IT RESOLVED, that the Board of Education of West New York, upon recommendation of the Superintendent of Schools, hereby accepts the NJCAP grants for the following schools and will adhere to NJCAP program requirements as identified in the application forms. Workshops will be delivered to students in each classroom during the school day. Teacher workshops will be delivered during one of the pre-scheduled in-service days. Parents will be invited to workshops in collaboration with the appropriate parent-teacher organizations at each participating school.

2.8 Student Transfer Card (Form A41) Revision
BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools, approves the revision of the Student Transfer Card (Form A41) to fit the needs of the West New York School District. According to the New Jersey Administrative Code (N.J.A.C. 6A:32-8) the transferring school must use the “Student Transfer Card (Form A41) provided by the Department of Education or a similar transfer form approved by the local board of education.

BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools, approves the acceptance of the Perkins Grant in the amount of $95,626 for the 2017 fiscal year for the duration of the program starting July 1, 2016 and ending on June 30, 2017.
2.10 Harvest Week
WHEREAS, the West New York School District will continue to put emphasis in wellness and nutrition and has demonstrated leadership in providing healthy environments for students and staff through its work with the alliance for Healthier Generation and other health promotion programs,
THEREFORE, BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools, approves Harvest Week to take place at the West New York Middle School, in conjunction with Nu-Way Concessionaires. Harvest Week will kick off on Monday, October 31st with nutrition and cooking classes, hands-on learning, pumpkin decorating, hay races, and more. The week will come to a close on Friday, November 4th with our Knights of the Farm Table Luncheon. Potential list of speakers below at no cost to the district.

2.11 ECS - Weekly Adult ESL Classes
WHEREAS, this district recognizes the importance of family literacy in the education of its students,
AND WHEREAS, this district supports initiatives designed to improve family literacy,
NOW THEREFORE BE IT RESOLVED, that the West New York Board of Education, upon recommendation of the Superintendent of Schools, authorizes the Early Childhood School to begin weekly Adult ESL classes for the parents/guardians and family of the students in our preschool program. Said training will be delivered by Bilingual Master Teacher, Mary Loredo and CPIS, Maria Rojas. Classes will take place at the Early Childhood School during the school day at no cost to the district.
2.12 Advisory Council Meetings - ECS
BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of Schools, authorizes the Early Childhood Program to have their Advisory Council Meetings as required by the Early Childhood Guidelines. The following are tentative dates for the meetings, November 17, 2016, February 2, 2017 and June 1, 2017. Dates may be rescheduled if need be and meetings will be held at the Early Childhood School after school hours.

NOW THEREFORE, BE IT RESOLVED, this Board upon the recommendation of the Superintendent of Schools, in keeping with Article 10 of the Agreement between the West New York Board of Education and the West New York Education Association and having considered the request of said employee and having reviewed the supporting documentation and by reason of the special circumstances which exist and for good cause shown, hereby grants additional sick leave to Employee ID#2585 commencing September 30, 2016 for a period not to exceed 24 days subject to the following limitations as enumerated below and pursuant to Article 10 of the Agreement:
(a) For each school day of the second week of said period said employee shall be paid a sick day’s salary (defined as 1/200th of the annual salary) less the pay of a substitute or the estimated cost of the employment of a substitute if none is employed.
(b) After the expiration of the above 2 week period and with the concurrence of the Medical Director of the Board of Education on the recommendation from the attending physician of said employee that further absence from service is essential, the Board (having in mind the length of employment of such employee) shall grant further leave to such ill employee.
(c) Upon the exhaustion of the extended sick leave period as herein set forth Employee ID#2585 shall suffer full and complete loss of pay until such time that he is able to return to employment.
