NEW YORK -- Exxon Mobil Corp. says income jumped 55 percent in the third quarter on higher oil prices and increased production. The world's largest publicly traded oil company on Thursday reported earnings of $7.35 billion for the third quarter. That compares with $4.73 billion in the year-ago period. Revenue increased 15.8 percent to $95.3 billion.Shell Q3 profit rises on higher oil priceAMSTERDAM - Royal Dutch Shell PLC, Europe's largest oil company, reported third quarter net profit rose 6.5 percent as increased production and higher oil prices more than offset a billion dollar charge on the value of oil sand assets in Canada.Net profit of $3.46 billion was up from $3.25 billion in the third quarter of 2009. Revenues rose to $90.7 billion from $75 billion, the company said Thursday.ConocoPhillips Doubles Q3 EarningsMeets expectations, doubles earnings due to higher oil prices, better refining marginsHOUSTON -- ConocoPhillips reported third-quarter earnings of $3.1 billion, compared with third-quarter 2009 earnings of $1.5 billion. Excluding gains from asset dispositions and other items, third-quarter 2010 adjusted earnings were $2.2 billion.Valero Energy Reports 3Q Income IncreaseSAN ANTONIO TX-- Valero Energy Corp. reported income from continuing operations of $292 million for the third quarter of 2010, compared to a loss from continuing operations of $343 million for the third quarter of 2009.The oil company's refining and retail segments did particularly well as income from continuing operations was $721 million for the nine months ended Sept. 30, compared to a loss from continuing operations of $170 million for the comparable period the year before.

West Coast refiners caught deliberately keeping supply tight!!! Tesoro itself admitted in a slide presentation to investors that it keeps supply deliberately tight on the west coast to support higher prices and to keep profits at the company healthy. In a press release, Consumer Watchdog hounds Tesoro and Valero, owners of several west coast refineries that process crude oil into gasoline, for keeping supplies deliberately tight to keep pressure on prices. West coast refineries have commonly had the lowest production rates out of any region in the nation. This summer (June 4-Sept. 3), West coast refiners used just 80.5% of their capacity. This compares with other regions: Midwest averaged 93.1% of capacityEast Coast averaged 87.6% of capacityGulf Coast averaged 90.9% of capacityRockies averaged 89.6% of capacityAccording to the release, "Consumer advocates revealed an investor slide presentation by Texas-based oil company Tesoro explaining that oil refiners keep gasoline supplies especially tight on the West coast to keep profits high through higher pump prices."The Tesoro slides, from a 2009 investor presentation, highlight the "West Coast Premium" gained by refiners, which are able to earn substantially more on each barrel of refined oil on the West Coast than other regions because of the considerably higher price paid by consumers at the pump. According to the presentation, West coast refineries have an average margin that is $8.50 per barrel higher than those operating on the Gulf Coast.Consumer Watchdog also published a report showing that since 2002 Valero Energy's net refining margins in California have been 37% higher per barrel than the company's margins in other parts of the country. During that period, Valero reported $4.5 billion in operating profits from its California refineries. Deliberate control and manipulation of west coast motorists should be taken very seriously and oil companies found guilty should pay a heavy price.

Likely Approval of E15 Raises Retail QuestionsDES MOINES -- With federal regulators expected to approve E15 motor fuels this month, retailers are expressing uncertainty about offering the new gasoline.Environmental Protection Agency approval of the 15-percent ethanol blend may be limited to 2007 model-year cars or newer, according to a report by The Des Moines Register, leaving the majority of the nation's 270 million cars restricted to the current 10-percent ethanol blend.Gas station and convenience store operators, then, must decide if they want to invest up to $25,000 for new tank and gasoline dispensing systems to accommodate the new fuel, according to the report. While the E15 fuel dispensers have Underwriters Laboratories approval, other parts of the system, such as the hoses, tanks and compressors, do not.Roz Jalali, owner of a Conoco-branded station in West Des Moines told the newspaper: "I'm not going to put in an E15 pump even if they legalize it. It's too expensive. I'll just keep selling the 10 percent blend."Others are worried someone would need to monitor E15 pumps to determine if the gasoline is going into the right cars. "We might have to go back to full-service," said Dawn Carlson, president of the Iowa Association of the Petroleum Marketers & Convenience Stores of Iowa, told the newspaper.Various interest groups, including automobile manufacturers and outboard-motor, lawn-mower and chainsaw makers, have raised concerns the expansion of E15. Carlson said the petroleum dealers aren't opposed in principle. "But there are so many unanswered questions that right now we cannot recommend to our members that they begin selling E15 if it is

approved," she told The Des Moines Register.Kum & Go, operator of 435 gas/c-stores in 11 states, has promoted E85 for flex-fuel vehicles. Randy Meyer, vice president of fuels for the West Des Moines company, told the newspaper he expects relatively little to happen at the pumps until the legal and technical issues over E15 are sorted out."We want to offer fuel choices to our customers," Meyer said. "But a lot of decisions would have to be made if the federal decision is bifurcated among different vehicle groups."Iowa is home to 40 ethanol plants and producer of one-quarter of the U.S. supply of ethanol, according to the report.WASHINGTON –The EPA authorized the use of E15 in vehicles manufactured in model year 2007 and later.

USDA to Fund Blender PumpsWill help pay for 10,000 ethanol dispensers at gasoline stations, c-stores nationwideWASHINGTON -- To boost demand for ethanol, the U.S. Department of Agriculture (USDA) will help deploy 10,000 blending pumps at convenience stores and gas stations around the country, Agriculture Secretary Tom Vilsack said in a speech at the National Press Club. Each of those pumps cost $25,000, which would put the total cost of the expansion at $250 million, reported Bloomberg."Over time, a key missing link in the effort to meet the [Renewable Fuels Standard] goal has been and will continue to be the lack of convenient locations to obtain higher blends of biofuels. Convenient store operators and gasoline marketers remain reluctant to incur the cost of new pumps and tanks. USDA and other federal departments can and should offer help," he said. "I have instructed Rural Development officials to provide financial assistance, using existing RD programs and resources, to provide matching funds to help install 10,000 blender pumps and storage systems over the next five years. Work will commence immediately on putting that program together."U.S. drivers will use about 138 billion gallons of gasoline this year, and ethanol facilities are expected to produce 12.8 billion gallons of the additive, according to the Renewable Fuels Association."That's why USDA is working to assist in developing a biofuels industry in every corner of the nation." Vilsack said he is directing the agency to plan within 60 days and help fund construction of five refineries spread across the country to process biomass into fuels. Higher costs for refiners related to use of the new feedstocks will be paid from up to $281.5 million that remains from the 2008 Farm Act, he said.The Environmental Protection Agency (EPA) approved increasing concentrations of ethanol blended with gasoline for U.S. vehicles made in 2007 and later to 15% from 10%. A decision on whether to extend that ruling to cars built from 2001 to 2006 will come next month after more testing."The recent EPA announcement authorizing E15 for late-model vehicles will help boost demand. It already convinced NASCAR to use E15. If it is good enough for Jimmy Johnson to remain hopeful, it will also be good enough for earlier vehicles from 2001 to 2006," Vilsack said.

Ethanol, EPA fuel anger among local boatersWINTER HAVEN FL- The U.S. Environmental Protection Agency (EPA) is expected to announce soon a decision on whether to boost from the current 10 percent to 15 percent the amount of ethanol in the nation's gasoline supply.The EPA's decision on E10 versus E15 and a national boating organization and many local boat retailers are not supporting it. "We are very aware of the effects of ethanol fuel. Just the current 10 percent is wreaking havoc on the boat motors," said Tricia Gurr, co-owner of Marine Supply-The Boating Center in Winter Haven. "We service and sell non-ethanol gas at our 717 Sixth St., S.W., location. We recommend 100 percent non-ethanol fuel."Gurr said that with ethanol being a cleaning agent, fuel bi-products that have attached themselves to the walls of fuel tanks get dispersed throughout the engine, causing failure."The manufacturers like Yamaha, Mercury and Evinrude don't want to pay for engine repairs because it's not their fault. It has nothing to do with them," said Gurr "It's a fuel issue. The customer doesn't want to pay for it because they just put gas in it. Then we are in the middle breaking the bad news to them."The Marine Supply-The Boating Center in Winter Haven does sell non-ethanol fuel for $3.85 per gallon. Although it is not the cheapest alternative, Gurr said it is better than paying for engine repairs. As long as they are allowed to still purchase non-ethanol fuel, we'll be fine, but if they do away with non-ethanol fuel, we're in trouble," she said.The nation's largest boat owners group, Boat Owners Association of the United States, (BoatUS) is urging recreational boaters to speak out now that scientific testing on E15 must precede EPA's decision and not come at a later date.Terence McElroy, press secretary for the Florida Department of Agriculture and Consumer Services, said the department has responsibility for the quality of the fuel supply in Florida."The EPA has been petitioned by ethanol producers who are advocating an increase in ethanol to visit this issue and consider it," McElroy said. "The commissioner of agriculture is closely monitoring this situation."

SEVVICE STATION DEALERS OF AMERICA (SSDA) NOTICE“The Association is extremely disappointed in the EPA decision to allow an E15 waiver for 2007 and newer cars and light trucks. The waiver creates so many liability issues for our members that it simply astounds us that the EPA actually

granted the waiver. The belief that consumers will be protected by a label and that the EPA will police the labeling is a fantasy that only an isolated policymaker with no real world experience would concoct. The label does nothing to protect dealers from liability for misfueling incidences and there are the unanswered questions about long-term effects on tanks and lines. The majority of our members don’t even have control over what products they sell. If their supplier decides to sell E15 it certainly isn’t clear who has legal responsibility for any malfunctions attributable to the E15. The EPA has submitted to the will of the corn/ethanol lobby to the detriment of the citizens and the environment. This is one more sad commentary on the ways of Washington.”

Menthol Cigarettes Ban Could Fuel Black MarketThe FDA need only look to Canada where 48% of cigarettes are sold through underground channels, to know how a ban on menthol cigarettes could create unintended consequences and drive criminal behavior.The FDA is considering a ban on menthol cigarettes in the U.S., a move some fear could have unintended consequences, such as a skyrocketing black market for the products. We're currently facing in the U.S. is the (potential) banning of a currently legal product that would create an immediate black market for menthol products and all the problems associated with a contraband market. Menthol cigarettes currently account for 30% of the tobacco market. If the product were banned some fear it could lead much of that 30% of consumers to seek out alternate venues for buying the products.A panel appointed by the FDA's Center for Tobacco Products is meeting to discuss the public health impacts of menthol cigarettes and how to regulate them. It is required to make recommendations to the federal agency by March.Canada is the leader in the sale of contraband tobacco throughout the world with more than 48% of cigarettes in some provinces being sold illegally, providing youth with easy access to cigarettes. Canada's black market plight could teach the FDA and the Tobacco Products Scientific Advisory Committee what might happen if the U.S. follows the same path. Taxes were intended to discourage people from smoking, customers just found different avenues to obtain their tobacco products. The federal government in Canada has lost over $2 billion a year just in tax collection due to the black market, and high school kids are easily gaining access to cigarettes. While convenience stores are often blamed for youth access to cigarettes, NACS noted, "Convenience stores are the first line of defense against underage smoking because we card customers to ensure minors do not have access to tobacco products."  Criminals selling black market cigarettes are not going to card teenagers looking for smokes, adding to the public health problem. NACS hopes the FDA will look to the problems in Canada when deciding whether or not to ban menthol. The big concern is that banning menthol in the U.S. could mimic what happened in the era of prohibition in the U.S. where the alcohol industry was just pushed underground and customers continued to purchase alcohol from underground channels.

Roll-Your-Own Cigarette Machines Require PermitWASHINGTON, D.C. – The U.S. Treasury's Alcohol and Tobacco Tax and Trade Bureau ruled last week that retailers selling cartons of cigarettes produced by rolling machines in stores must obtain manufacturing permits and pay applicable federal taxes, the Wall Street Journal reported."We do not believe that Congress intended for a consumer to be able to purchase at retail commercially manufactured cigarettes upon which tax has not been appropriately paid," the bureau said in its ruling, which was cited by the Wall Street Journal.The ruling deals a blow to tobacco stores that sell deeply discounted cigarettes, and addresses a practice where some stores have sold "roll-your-own" cigarettes for as little as $16 a carton, according to the report.Approximately 150 tobacco outlets in some 20 states have engaged in the activity, using high-speed rolling machines that yield a carton of cigarettes in eight minutes, according to an estimate by one maker of the devices cited by the newspaper.Cigarette manufacturers must obtain permits from the bureau, comply with recordkeeping rules and pay $10.07 in federal excise taxes for each carton of cigarettes made, according to the report, which noted the ruling suggests that many retailers may find it cost-prohibitive to own or lease such machines.RYO Machine Rental LLC, an Ohio manufacturer that has sold or leased about 200 of the machines to retailers, didn't respond to requests for comment by the newspaper.

ExxonMobil Sells 190 Stations in Massachusetts, New Hampshire and Rhode IslandWALTHAM, Mass. -- ExxonMobil sold 190 gas stations, and the supply rights to another 31, in Massachusetts, New Hampshire and Rhode Island to Global Companies based here, according to Telegram.com. Of those, 42 are directly operated by ExxonMobil. The acquisition, completed in stages, according to Edward J. Faneuil, executive vice president of Global, was finalized Oct. 1. The stations were primarily in Massachusetts, with only 22 in Rhode Island and 20 in New Hampshire, according to the report.

"In these states it affords us the ability to continue to operate and supply locations for ExxonMobil because we're a significant terminal owner/operator in New England," Faneuil said in the report. "We view it as an opportunity for Global. This is an introduction for Global to the branded gasoline market, but a compliment to our existing businesses." However, ExxonMobil spokesman Kevin M. Allexon said the company is not planning on getting out of the retail business. "We're changing our business model," Allexon said in the report. Mobil stations are company-owned and operated, leased to operators, or operator-owned under a brand agreement. The division is who owns the property, and we're in the process of selling real estate assets to branded distributors." Global Companies is a wholesale distributor in New England and New York that primarily distributed heating oil for years. Since its shift to a public company, it has moved to fuel that is less weather-dependent, Telegram.com reported.

NRC to Sell 56 Retail Fuel Sites in Florida PanhandleCHICAGO -- NRC Realty & Capital Advisors LLC will coordinate the sale of up to 56 current and former retail petroleum properties located throughout the panhandle of Florida, of which, all are fee properties and most are operating gas stations with convenience stores, while a few are closed gas station/c-store combinations, the company stated.Most of the operating stations are major-branded for gasoline including BP, Shell, Exxon, Chevron and Mobil, but all have unbranded convenience stores, according to NRC. Some of the sites have unbranded gas, and others have on-site carwashes. Sites may be purchased either with or without supply agreements, NRC stated."This sale offers some great opportunities for motor fuel marketers and individual dealers alike," Evan Gladstone, NRC executive managing director, said in a statement. "We expect strategic players will be looking at excellent market concentrations and some larger store formats as well as supply and available financing. Even those not currently operating in these markets may want to look at expansion opportunities."Geographically, the sites are located in the Fort Walton Beach/Destin market area, the Pensacola and Panama City markets, in and around Crestview, and some are in smaller communities eastward toward and beyond Tallahassee, according to the company.The properties will be sold through a sealed bid sale utilizing NRC's "buy one, some or all" format. BP, Arco Stations to Get Electric Car ChargersDETROIT -- The charging company ECOtality, which announced that it plans to add its electric vehicle chargers in a partnership to add the recharging kiosks to BP gas stations and convenience stores, according to a New York Times blog.

"This pilot allows us to test E.V.-charging technology, gather real-world data and learn about how motorists use and charge electric vehicles," Kevin Phelan, vice president for sales and marketing at BP, said in a statement cited by the blog. ECOtality was expected to announce the deal at the Business of Plugging in conference. The agreement covers the installation of its new 480-volt Blink fast charger at approximately 45 BP and Arco gas stations in Arizona, California, Oregon, Washington and Tennessee, according to the report. "This is the first time Big Oil has invited electric vehicles to the table. We're very excited about this program," said Jonathan Read, ECOtality chief executive, in the report, noting the financial benefits would go to the franchise holders who operate the stations. The first stations will be installed in March, and they will reside in and around the cities and states that are part of the federally supported E.V. Project, managed by ECOtality. The costly chargers will be installed in the stations at no cost, in markets where the Nissan Leaf electric car will be initially offered to customers, the report stated. The chargers can recharge a Leaf in 26 minutes, Read said in the report. According to Read, the new Blink-branded fast-charging stations will have a retail price of $25,000 to $40,000. The stations will be set up to use the fast-charging protocol, CHAdeMO, developed by the Tokyo Electric Power Co., which is already in use in Japan. Some 5,700 Nissan Leafs distributed in the E.V. project markets will be equipped with ports to charge using the Japanese standard, according to the report.

ARCO Sites on BlockBP West Coast Products selling 28 locations in California, Oregon, and WashingtonLA PALMA, Calif. --The sale by BP West Coast Products LLC, La Palma, Calif., of 28 ARCO-branded retail sites is part of the company's "normal portfolio management process," BP spokesperson Scott Dean told CSP Daily News. The portfolio includes eight sites in the Sacramento and San Francisco areas; nine sites in the Los Angeles and San Diego areas; four sites in the Eugene and Portland, Ore., areas; and seven sites in the Seattle area.The sale "involves ARCO-branded sites that will remain in the ARCO network as dealer-owned facilities," Dean added.

Prospective buyers wishing to view property-specific information or receive sale updates may register online at www.nrc.com/1009.Chavez Calls Citgo ‘Bad Business’ Venezuelan President Hugo Chavez stops short of saying the company is for sale.CARACAS – Venezuelan President Hugo Chavez said that Citgo is an undervalued asset that the country is stuck with, according to Reuters."Citgo is bad business. We have not been able to get out of it, we are subject to U.S. law," Chavez said during a television appearance. "That company has eight refineries, I don't know how many tanks, it distributes fuel via 8,000 stations in the United States, yet it makes us no profit," said Chavez, according to Reuters. However, Chavez did stop short of announcing that Citgo, which just celebrated its 100th anniversary, was for sale.The news services noted that Venezuelan oil company PDVSA has been trying to sell some of the some of its perceived less profitable refineries in Europe and elsewhere.

Financial Institutions Eager for Smartphones Payments  The banks and credit card companies are ready to transform plastic payments into mobile ones.RIVERWOODS, Ill. – Widespread use of smartphones for payment in the United States may be three to five years in the future, according to the Federal Reserve Bank of Boston, the Chicago Tribune reports. Last month, Verizon Wireless, T-Mobile and AT&T Inc. announced that they were moving ahead with exploring smartphone contactless payment options. Banks and credit card companies are quickly following suit, not wanting to lose a lucrative income stream. Bank of America has tested mobile-payment technology in Charlotte, N.C., and has started a pilot program in New York City. Discover Financial Services recently indicated its continued optimism about the future of mobile payments. Japanese and Korean consumers regularly use mobile payments, but until more U.S. merchants purchase devices that will be able to accept mobile transactions, mobile payments will not take off. With more companies testing pilot programs, Consumers Union has asked Washington to extend federal protections for lost or stolen credit or debit cards to include new mobile payment transactions as well. Bank of America and Discover have tested stickers embedded into phones to facilitate contactlass payments between the sticker and a retailer’s reader device. Convenience Stores Safe Places  Jackson, Miss., more robberies happen in homes than in convenience stores.JACKSON, Miss. – Convenience store operator’s work hard to ensure a safe environment for employees and customers, and new local data supports their success, the Clarion Ledger reports. In Jackson, Miss., convenience store owner Surinder Singh has been telling people how safe his store is for years. “It’s as safe as being at home,” he said. Actually, his store may be less likely to be robbed than a home. Of the nearly 500 armed robberies that happened in Jackson between April and August, only nine occurred in a gasoline station or convenience store. In contrast, more than 20 times that many robberies happened in homes and more than 30 times that number took place on a public street. Nationwide, the FBI recently reported that convenience stores and gasoline stations saw a huge drop in the number of robberies. Because of a recent shooting death at a convenience store, Councilman Kenneth Stokes has been lobbying for the city to make convenience stores pay private security guards to be on the premises. The Mississippi Business Owners Association strongly opposes the proposal. Former association president Singh agrees that the measure would not be workable. “The problem is the crime. It’s not convenience stores or any particular business,” he said. “All we are saying is the crime has to be dealt with all together.”Stokes amended his proposal by asking for a six-month moratorium on new convenience stores in Jackson for time to look into the issue. But even the police department is against Stokes’ idea to hire security guards, instead preferring to help retailers make their stores less likely to be a robbery target.
