1. Minimum Rental: 5 days in NZ and in AU minimum rental period is 5 days for 2 berths and 7 days for 4 & 6 berths and all one way rentals. Minimum rental period subject to change during peak periods.

2. One-way Rentals a. One-way Rentals (NZ): One-way rentals are

available between all branch locations. A one-way fee of NZ$250 is charged for rentals between the North and South Island (and vice-versa), where pick-up is between 01 October 2010 and 31 March 2011.

b. One-way rentals are available between all Maui branch locations the exception is one-way rentals into or out of Tasmania for 4WD vehicles, these are on request and where the vehicle is the Spirit 6 Platinum. The Spirit 6 Platinum is available between Melbourne, Sydney and Brisbane only.Minimum rental period for one-way hires is 7 days. Shorter hires may be available on application only. A one-way fee of $250 applies where pick up originates from Cairns, Brisbane, Sydney, Melbourne, Hobart or Adelaide, and returns to these locations. Should the hire originate or return to or from Darwin, Broome, Alice Springs or Perth, the one-way fee will be $350.E.g., a Cairns to Darwin one-way rental would incur a one-way fee of $350, where a one-way rental from Cairns to Brisbane will incur a one-way fee of $250. The one-way fee if applicable is charged per hire. The one-way fee is included in the Premium Package.

3. Rentals in Broome (AU): An additional remote location fee of AU$650 applies to all rentals picking up or dropping off (or both) in Broome. Only one remote location fee is charged per vehicle. This is in addition to the one-way fee if applicable.

4. Wellington and Queenstown branches (NZ): Vehicle collections and returns in Wellington incur a NZ$200 location fee (same city collection and return, one fee applies), and in Queenstown a NZ$200 location fee (same city collection and return, one fee applies). This is in addition to the one-way fee if applicable.

5. Diesel Tax Recovery Fee (NZ): The Diesel Tax Recovery fee will be calculated and collected on return of your vehicle based on the kilometers traveled during your hire. The vehicle rates per 100km are as follows (rates are subject to Government changes):

2 Berth (2BMA Petrol) = NZ$4.45. 2 Berth (2BTSMTV) = NZ$4.70. 4 Berth (4BM)= NZ$4.70. 6 Berth (6BM) = NZ$4.87

6. For your protection: Personal injury is covered through the Accident Compensation Commission (NZ) and Registration Third Party Insurance (AU) in most cases, however, Maui strongly recommends that all clients take out Personal Injury Travel Insurance. All vehicles are insured for the damage to the vehicle and to the

property of the Third Party. This hirer is responsible for the first NZ$/AU$7,500 (‘the excess’) of the cost of damage to Third Party property or to the rented vehicle, including single vehicle accident, windscreen and tyre damage, towing and recovery costs. The Excess applies in respect of each claim, not rental. This NZ$/AU$7,500 excess can be reduced, in most circumstances, by the purchase of Excess Reduction Option 1 or Option 2.

a. Excess Reduction Option 1: Excess Reduction 1 at NZ$25 or AU$25 per day (max charge NZ$1,250 or AU$2,500) will reduce the excess for Third Party property or to the rented vehicle, including single vehicle accident, windscreen and tyre damage to NZ$2,500 or AU$2,500.

b. Excess Reduction Option 2: Excess Reduction 2 at NZ$42 or AU$42 per day (max charge NZ$2,100 or AU$2,000) will reduce the excess for Third Party property or to the rented vehicle, including single vehicle accident, windscreen and tyre damage to NZ$0 or AU$0 (nil).

7. Vehicle Security Deposit: On collection of the vehicle, a Vehicle Security Deposit is payable. If you do not take Excess Reduction Option 1 or Option 2, the Security Deposit is NZ$7,500 or AU$7,500. If Excess Reduction Option 1 is taken the Security Deposit is NZ$2500 or AU$2500 and is debited from the hirer’s credit card. If Excess Reduction Option 2 is taken The Security Deposit of NZD$220 or AU$220 is taken as an imprint of the hirer’s credit card. The Vehicle Security Deposit is fully refundable provided the vehicle is returned on time, undamaged, with a clean interior and with full fuel tanks.

8. A non-refundable 2% (Mastercard/Visa) and 4.5% (American Express) surcharge will apply to all credit card transactions. Credit card surcharges also apply to debited security bonds. In this instance, the surcharge is refunded when the bond is refunded. If a bond is retained, the surcharge is retained.

9. Licence: A full resident country drivers’ licence, held for at least one year, is to be presented at the time of rental. If the licence is not in English format, an international drivers’ licence is also required.

10. Minimum Age Limit is 21 years. A medical certificate is required for drivers over the age of 75 years.

11. Multiple rentals can be combined to qualify the renter for our long term rate. Rentals in New Zealand and Australia can be combined to qualify.

12. Change of Vehicle: Should the vehicle booked be unavailable through unforeseen circumstances, Maui reserves the right to substitute an alternative vehicle without prior notification and at no extra cost. This shall not constitute a breach of contract and does not entitle the hirer to a refund.

GENERAL TERMS, CONDITIONS AND IMPORTANT INFORMATION

RESERVATIONS & PAYMENTNames advised for airlines tickets must match you passport! A service fee of $100 per person plus any airline charges will be levied to reissue tickets as a result of incorrect information pro-vided. A non-refundable deposit of $250.00 per person is required at the time of booking. This will be deducted from balance, which is due no later than 60 days prior to departure. However, the policy may vary with resorts/hotels/lodges/cruises that require higher deposits and different payments. Any amendments after the booking has been made will incur a $35 per person per change fee.

RATES AND FARES.All rates quoted are based on current tariffs and international rates of currency exchange and are, therefore, subject to change. Prices quoted include charges for our expertise, research, itiner-ary planning & preparation, bank wire transfers, booking procedures & the service of the tour operators representing Destination World. Each booking represents a complete package. An itemized costing breakdown will not be given.

CANCELLATIONS.If you cancel for any reason, the following cancellation fees apply:- More than 45 days before first service: $250 per person 30-44 days prior first service: 25% per person 14-29 days prior first service: 50% per person 0-13 days prior first service: 100% per personThese cancellation fees are apart from any charges levied by resorts, cruise or the airlines on can-celled or amended airline tickets.

REFUNDS. Refunds are not available on unused accommodation vouchers or services.

INSURANCE. Due to the extraordinary savings being offered on airline tickets and some land packages, if you cancel your bookings, various penalties will apply. They will depend on the length of time remaining before departure; in addition to services already provided. Although every effort is made to ensure the safety of all participants, Destination World, its employees or Agents cannot accept responsibility for sickness or accident of any kind. We urge you to take out personal travel insurance to cover loss of deposit, any airfare cancellation service fee, baggage loss or damage and medical fees.

A recommended travel insurance company is Access America. You need to purchase this directly with them.

YOUR TRAVEL DOCUMENTS. Each traveler must have a valid passport. It is solely the passenger’s responsibility to ensure that all documentation/visas necessary for travel are complete and current. Passports must be valid for at least three months beyond intended stay. 31 day entry visas are granted to North Americans on arrival in Fiji.

RESPONSIBILITIES. Destination World, its agents, officers and affiliates and/or suppliers of services pursuant to or in connection with these itineraries shall act only as agents for the passenger in making arrange-ments for accommodation, transportation, restaurants, or any other service and do not assume any liability whatsoever for any injury, damage, death, loss, accident or delay to person or property due to an act of negligence of or default of any hotel or other accommodation, carrier, restaurant, company or person rendering any of the services included in the tour, or by act of God. Further no responsibilities are accepted for any damage or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or other causes beyond their personal control. No responsibility is accepted for any additional expense, omissions, delays, re-routing, or acts of any government or authority. The airlines concerned are not to be held respon-sible for any act, omission or event during the time passengers are not on board their planes or conveyance. The passage contract in use by the airlines concerned, when issued, shall constitute the sole contract between the airlines and purchases of these tours and/or passenger. The right is reserved to withdraw any departure in this program and/or make such changes in the program(s) and may be found desirable for the convenience of the parties and the proper carrying out of tour(s).

This Agreement shall be governed by and construed in accordance with the law of the Republic of the Fiji Islands and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the Courts of the Republic of the Fiji Islands in relation to any dispute, actions, suits or proceed-ings arising out of or in connection with this Agreement. The parties unconditionally and irrevo-cably waive and agree not to raise, plead, or make any objection to proceedings arising out of or in connection with this Agreement in the Courts of the Republic of the Fiji Islands on the grounds that those Courts are not the forum in which the dispute, action, suit or proceedings can be most suitably tried for the interests of all the parties and for the ends of justice.
