    403.851 Declaration of policy; intent

    It is the policy of the state that the citizens of Florida shall be assured of the availability of safe drinking water. Recognizing that this policy encompasses both environmental and public health aspects, it is the intent of the Legislature to provide a water supply programoperated jointly by the department, in a lead-agency role of primary responsibility for the program, and by the Department of Health and its units, including county health departments, in a supportive role with specific duties and responsibilities of its own. Without any relinquishment of Floridas sovereign powers and responsibilities to provide for the public health, public safety, and public welfare of the people of Florida, the Legislature intends:(1) To give effect to Pub. L. No. 93-523 promulgated under the commerce clause of the United States Constitution, to the extent that interstate commerce is directly affected.(2) To encourage cooperation between federal, state, and local agencies, not only in their enforcement role, but also in their service and assistance roles to city and county elected bodies.

    (3) To provide for safe drinking water at all times throughout the state, with due regard for economic factors and efficiency in government.

    HaveCommitted The Following

    403.859 Prohibited acts.The following acts and the causing thereof are prohibited and are violations of this act:

    (1) Failure by a supplier of water to comply with the requirements of s. 403.857 or dissemination by such supplier of any false or misleading information with respect to

    notices required pursuant to s. 403.857 or with respect to remedial actions being undertaken to achieve compliance with state primary and secondary drinking water regulations-Violated the statutes by falsifying and labeling the water supplied to resident's as drinking water. Also Claiming the WELLS are for irrigation purpose's. While if anyone takes a good look around the property they will see that the irrigation system is completely dismantled and

    broken.(2) Failure by a supplier of water to comply with regulations adopted pursuant to s.

    403.853, with any rule adopted by the department pursuant to this act, or with conditions for variances or exemptions authorized under s. 403.854.-The Water being Provided to the

    Development, The Villages of Bloomingdale is coming from a Cross Connection by way of WELLS that are not and will not be permitted. The area stricken by a constant flow of toxic waste that has been bleeding into the heavy marsh filled pocket's of wetland for 8 decades, thus

    labeling the land Delineated by Toxic Substance

  • (3) Failure by any person to comply with any order issued by the department pursuant to this act.- Every County Official that I have contacted, having gave them viable information that proved there was a problem with the drinking water and yet they chose to ignore/deny

    the fact's/information.(4) Failure by a supplier of water to allow any duly authorized representative of the department or of the Department of Health to conduct inspections pursuant to s.

    403.858.-As of right now I have been informed that Therese LaDouceur denied a request by the Tallahassee DOH official's asking to come perform an inspection of the water at VOB. The request came after they received FAKE Permit #'s given by an official at

    SWFWMD and the location of the WELLS did not match.(5) Submission by any person of any false statement or representation in any application

    , record, report, plan, or other document filed, or required to be filed by this act or rules adopted by the department pursuant to its lawful authority.-Therese LaDouceur

    falsified her report by providing untrue fact's surrounding the WELLS and the action's that she actually took during her visit at the development The Villages of Bloomingdale. 6) Failure by a supplier of water to comply with the requirements of a permit issued under s. 403.861(7).-The County of Hillsborough has FAILED to provide proper/safe drinking water

    to the citizens/resident's living at The Villages of Bloomingdale.

    403.862 Department of Health; public water supply duties and responsibilities; coordinated budget requests with department:

    (d) Require those county health departments designated by the Department of Health as having the capability of performing bacteriological analyses, in addition to the duties prescribed in paragraph (b), to:The County Health Dept. Denied me and my son an Appt. to

    receive Treatment for the problem's we have been facing. I called Several times after Tampa General Denied us treatment and reffered us to the Health Dept. I then called the Health Dept. Attending to the area we lived and they left me on hold. I left a message to get an Appt. But a call was never returned. This is the same office that Therese LaDouceur and

    Daniel Peterson are out of.1.Perform bacteriological analyses of water samples submitted for analysis.-Therese

    LaDouceur did NOT Perform any test or have any test performed on water from the Villages of Bloomingdale.

    2.Submit copies of the reports of such analyses to the appropriate department district or sub district office.- I have never heard of any of the report's I had taken that failed the EPA regulations being recognized or submitted to the any other entity or sub district office

    for additional analyses.(e) Make available to the central and branch laboratories funds sufficient, to the maximum

    extent possible, to carry out the public water supply functions and responsibilities required of such laboratories as provided in this section.-Therese LaDouceur Denied and Dismissed there is a problem even after being contacted by a Hillsborough County EPA LAB Biologist that contacted Therese after being contacted by a former colleague there was

    eminent concern of a problem with the water supply and the cost for proper testing should be had by the county health dept..

    (f) Have general supervision and control over all private water systems and all public water systems not otherwise covered or included in this part. This shall include the

    authority to adopt and enforce rules, including definitions of terms, to protect the health, safety, or welfare of persons being served by all private water systems and all public water systems not otherwise covered by this part.-FAILED TO PROTECT THE RESIDENT'S living in the Development The Villages of Bloomingdale/Has Abused the power of being/having Supervision

    and Control. (g) Assist state and local agencies in the determination and investigation of suspected waterborne disease outbreaks, including diseases associated with chemical contaminants.-Denied the Possibility of Illness Even after more then 3 resident's contacted Therese

    LaDouceur giving the fact's of Dirty water and sick family member's

  • (h) Upon request, consult with and advise any county or municipal authority as to water supply activities.- I believe the probability /that it is a likely reality,that Hillsborough County official's made contact with local municipalities advising about the circumstances,

    surrounding the water and illness effecting resident's.

  • Where I began was with an email to the Backflow Systems of Hillsborough County when searching for answer's as to why the water stunk, tasted horrible, and was then turning a gray green. So on 5/27/2012

    That email was asking for help because the water was smelling like a sewer and my

    when I touched the water it was burning my skin.

    At the time I had purchased a filter system and thought that maybe the filter was making a difference but that I had an inside source telling me that there was a problem possibly with the backflow system not being cleaned.

    That following Tuesday I received a phone call from a Michelle Vandyke, the call came very early in the morning and she went ahead and asked me some question's pertaining to the water. I gave her information and she said that she would have a tech come out to look into it.

    This is when John Walsh came out and met with me. He went over some thing's and he seemed to me a bit out of sync. He continued by testing the water with a simple test strip and some liquid. This was to test the PH of the water. Which wasn't turning out well because the water stayed in the red zone. His answer was Tampa water is hard. We went over some other details and he gave his business card and left.

    I was not happy with the outcome of the visit I continued to speak to my neigh-bors asking about the problems they seemed to be encountering. I also spoke to someone who worked for the community. This person was helping me understand that my suspicion about the problem with the water was very real. And while this person did not tell me or give me direct information. The confirmation's made towards what I was or was not right about is what got me to take further steps.

    So the next day I took a walk around the grounds of the property. And I discovered the first WELL. I was in shock. I called john Walsh. He asked for photo's of the WELL to be sent to his email.

    Later that day I got a call from Michelle Vandyke she was asking me about the con-tact I had with Mr. Walsh she was basically trying to talk me away from the thought that WELLS were supplying water and said the Backflow system was being checked out. She too said that Tampa water is just hard.

    These answer's were not right. I was becoming very aware that something was not right. The answer's were not sufficient and my response was apparently causing a rise in emotion with this official.

  • I was the one suffering that water and I was not going to be told thing's were not wrong.

    So I continued to try and get answer's. Michelle's attitude bothered me. I had been researching the area and I was discovering that the area was NO WHERE that WELL water should be taken from. I was also discovering that if the water was from the re-claimed water line that the ground water from this area was extremely dan-gerous. Reclaimed Water Michelle claimed can be used for bathing and cooking.

    So I called the EPA and from there the chain of command about who to contact was given to me.

    This began with Hillsborough County Drinking Water division the DOH District 4 of-fice. And I was given the number for Daniel Peterson. I contacted Daniel and ex-plained the circumstances, he seemed to understand that I was in no way going to take the answer, Tampa Water Is Hard so he put his senior official Therese LaDouceur on the phone with me.

    Therese and I spoke for close to a good 30 minutes the whole time Therese coming up with answer's to the water issue's I was expressing. I asked her to come and check the water and she at that time told me she had already checked the water about 2 weeks prior at another home in the community, It Was Fine. I was still persistent in trying to get her out there. And this conversation too ended with some heated attitude and no guarantee that she would be out.

    I was very bothered by the outcome and attitude of this conversation and continued to make phone calls that day. One that was back up to the EPA Region 4 office. And one was to the drinking water division for the FDEP out of Tallahassee. Roger Martin is who I then spoke to.

    After that I made a phone call to SWFWMD and I inquired about WELLS. Asking if someone in Hillsborough County would have to have a permit to have a WELL. I was told Yes Absolutely they would. And I was transferred over to Billy Permenter's office. He spoke to me and he asked the address location for the WELLS and said he would call me back shortly.

    Well 15 minutes later the phone call came, Billy, sounding a bit winded told me that there in fact was not any permits for WELLS in this area. He then asked if he could send out a tech first thing the next morning and would I show the tech around. I agreed to do so.

    This is when Ms. Beth Edwards came out. And while I was out on the property with Beth I ran into some other official's that were being shown around by the mainten-ance man. He came up and spoke to me telling me who that was that he had to show them around. And I of course was very upset towards Therese Ladouceur so I did not attempt to speak with her because I did not want conflict. This would of come be-cause at that moment I found out that she went to the CDD/HOA office and gave them my name. This is a violation to my privacy as a citizen to report possible harm being done.

    At the end when Beth was going to leave as I was thanking her for her time. Mr. Daniel Peterson walked up to us. I tried to ignore him but he introduced himself and I too introduced myself.(not happily)

    I went back to my home and later that day I received an email from Therese LaDouceur. I Was SHOCKED, I thought to myself how did she get my email address?

    She sent an email to myself and to Mr. Larry Meyer, Brian Miller, Van Hoofnagle informing with a falsified report:

    Our department investigated your water quality complaint this morning concerning a cross connection with the irrigation wells located at Villages of Bloomingdale and the potable water that you receive from the Hillsborough County Water Department. We inspected all three wells on site and the three interconnections to the county. The meters at each interconnection were functioning and recording water usage.

    None of the three irrigation wells are connected to any potable water supply. The well located on Newdale has no connection to any piping. The well located at Carlsbad has a bladder

    tank, spigot and pressure vacuum breaker but is valved off from any on-site piping. We recommend physically cutting the galvanized pipe after the pressure vacuum breaker so no one would be able to turn on the valves. You would still be able

    to use the outside spigot for watering from the irrigation well The well located at the front of the complex off Progress Boulevard had the 2 inch galvanized piping and

    atmospheric breaker like the Carlsbad well and it was valved off. There are two small 1 inch PVC lines prior to the pressure vacuum breaker, with one valve on and one valved off. You will need to verify that these two

    pipes go only to irrigation lines and sprinklers so they can continue to be used for irrigation. Physically disconnect the galvanized metal 2 inch line after the pressure vacuum breaker.

    We tested the water for a chlorine residual and sampled for total/fecal coliform. Florida Administrative Code, Chapter 62-550 requires a minimum of 0.2 ppm throughout the distribution system with a maximum limit of 4.0 ppm. The chlorine residual

    was 3.9 parts per million (ppm). The results for the total/fecal coliform test will be available tomorrow.

    Discolored or smelly water may occur when main distribution lines have been flushed, or if there are galvanized pipes within the home that may be beginning to deteriorate. Flushing the water taps for 2-3 minutes after the water has not been used for several hours will help eliminate the discoloration. If the water heater has not drained recently, it may also contribute to the

    discoloration and odor.

    I do not know HOW you got my e-mail address!! first and second you are a LIAR!!! you are a LIAR! and the line IS connected to the potable water system!! time tells all!     I went and dug at the WELL I took photo's and video of the WELL LINES and the breather that shot up higher then the power lines. And I sent this information to the Region 4 offi-cial Mr. Larry Meyer.

    From here I started having water test's taken. I was too sick my skin was driving me crazymy exhaustion was nothing normal. I was feeling so strange all the time. I was loosing hair and feeling AWFUL. My conversation's with other residents I knew something was wrong and I knew it was the water. So now I spent all my time looking into water testing and calling attorney's this was what I did for a long time.

    And Finally I got an attorney that was interested. I spoke with this firm for about 5 weeks I gave them so much information. I gave them copies of my logs.I gave them resident's names and address and phone number's. They spoke to these resident's and documented their statement's. And then one day I get a call that Mr.Tucker is requesting a meeting with me. I had no idea what it was concerning.But this meeting was to let me know that my case has merit. But that his firm was not large enough to handle it. He said he would do what he could to help me find a new lawyer.I was so saddened. Yet I kept searching. Then I got the first water test's back these test's were on my refrigerator water filter from the water line that I had been using for 3 years.Also my bathroom sink aerator.I will add copies of these most important results with some brief information about these results.But before I end this I want to tell you all about the attorney that came along in October of 2012 his name was Frank Pierce IV of Mateer-Harbert.I had sent out so many notes to different firms that I did not remember this firm right off the bat. But never the less I spoke to Mr.Pierce IV and he said he would get back to me. And thru email's and information I had given him he set up a meeting for me to come to the firm and speak to them. After many question's they asked and information they took, that I gave. It seemed things were going well. And they offered me a contract and told me to go home and read it and get back to them.I Naively signed into contract with them. I had no idea or thought that attorney's were not out to help the client.In short it turns out that Mr.Frank Pierce III and the developer's and the hospital networkthat had been denying my son and I proper treatment are all connected.(and a few other's)

  • So here I am today. Trying to bring awareness to this situation hoping that I an some how helping this state to see that this is an epidemic. Even more so the fact's are that word has been sent out to the medical facility's not to address this issue with the water. And this feeling comes not only from me but also from the other resident's that have brought this to the attention of their physician's. Something is going on at level well above anything normal. I promise you everything I am saying is true. I promise you that the water being given to the residents of the community The Villages Of Bloomingdale is not the proper water.I promise you that those water lines were set up from the start of the build for this development. I can tell you this because the amount of violation's that exist do not just happen by accident. Example: This community was built with NO BACK FILL

    NO BACKFILL ON LAND THAT IS I.76 MILES FROM THE GYPSUM STACKS

    DOES THIS RING ANY TYPE OF ALARM TO THE Official's OF THIS COUNTY?OR IS THIS SOME TYPE OF BIO-TERRORISM?

    OR IS IT A FORM OF PREJUDICE TOWARDS THE CONSIDERED LOWER CLASS COMMUNITY?

    There is MERIT in what I am bringing forward.There is a lot more information and proof that I have that

    gives total clarity.There are others that are VERY SICK, There are many that have DIED Suddenly.

    I do not want my son or myself to die at the hands of greedy developer's and dirty county official's

    These county official's are causing this state and it's bureaucrat's a SERIOUS problem that is growing out of control. How can the state lead official's fix something when the local official's are telling lies having affair's with the developer's and hiring attorney's to

    try and shut down the exposure needed.

  • Some Fact's Pertaining to My Water Results

    1.1 What are bromoform and dibromochloromethane?

    Bromoform (also known as tribromomethane) and dibromochloromethane are colorless to yellow, heavy, nonburnable liquids with a sweetish odor. These chemicals are possible contaminants of drinking water that has been chlorinated to kill bacteria and viruses that could cause serious waterborne infectious diseases. Bromoform and dibromochloromethane may form when chlorine reacts with other naturally occurring substances in water, such as decomposing plant material. Plants in the ocean also produce small amounts of these chemicals.

    These chemicals are found mainly in water that originally came from surface sources, such as rivers and lakes. Springs and deep drilled wells usually contain very little of the substances that react with chlorine to form these chemicals; therefore, well and spring water is less likely a source of bromoform and dibromochloromethane than water from a

    reservoir (artificial lake). The amount of bromoform and dibromochloromethane in drinking water can change considerably from

    day to day, depending on the source, temperature, amount of plant material in the water, amount of chlorine added, and a variety of other

    factors.

    Heterotrophic Plate Count: What is HPC and when is the right time to use it?

    Heterotrophs are a group of microorganisms (bacteria, moulds and yeasts) that use organic carbon sources to grow and can be found in all types of water. In fact, the majority of bacteria found in drinking water systems are considered heterotrophs. Heterotrophic plate count (HPC) is a method that measures colonyA group of hyphae (fungal colony) or cells (bacteria colonies) which arise from one spore (or

    hypha) or cell. It's possible to have mixed colonies of different organisms. formation on culture media of heterotrophic bacteria in drinking water. Thus the HPC test (also known as Standard Plate Count) can be used to measure the overall bacteriological quality of

    drinking water in public, semi-public and private water systems.

    The Expected Standard set by the EPA

    As stated by the National Primary Drinking Water Regulations established by the U.S. EPA a lower concentration of heterotrophic bacteria in the drinking water is linked to a better maintenance of the treatment and distribution systems. According to these regulations, treatment techniques should aim to control HPC concentrations in surface waters and groundwaters influenced by surface waters to less than 500 CFU/mL (using standard methods). Note: This is not a health-based standard, but reflects the concern that at concentrations

    above 500 CFU/mL, heterotrophic bacteria can interfere with some total coliform and E. coli recovery methods.

    I questioned this with GREAT SUSPICIONSo It was looked into

    My question:

    Did They(the owner of the wells) Go Thru The Whole ERP Process? And are the WELLS Sufficient

    to the:MEMORANDUM OF AGREEMENT

    Between the: U.S. Environmental Protection Agency, Region 4,

    Superfund Division and The South West Florida Water Management District?

    I was told that the location of the WELLS did not fall inside the Superfund site per the FDEP.

    I then checked this result and have found that this area does in fact fall inside a zone impacted byPromulgated Law applied to zoning with many specific limits.

    Gardinier, Inc.'s East Tampa Chemical Plant Complex encompasses about 2,600 acres of land and is located in

    west-central Hillsborough County, Florida. The facility is located at the mouth of the Alafia River adjacent to

    Hillsborough Bay. The plant began its operations in 1924 and has been expanded several times by various owners. In

    1973, Gardinier, Inc. took over the entire operation. Gardinier, Inc. is owned by Cargill, Inc. of Minneapolis, Minnesota.

    Operations currently include production of phosphoric acid and phosphate and other fertilizers.18,19

    Gardinier's on-site waste management units include two process water ponds (Nos. 1 and 2) and a gypsum

    stack. Process Water Pond No. 1 is an unlined pond that occupies 13 hectares (32 acres) and is 2 meters (6 feet deep);

  • Along with the skin issue's there are many other issues. Such as Extreme Fatigue, Hair Loss,Hair Dry and Brittle.

    Finger Nails becoming dis colored, thin and ridged, Stomach Problems.Teeth Cracking, Gums Swelling, Teeth not growing back in.

    Then Cancer popping up for all ages. Sudden heart Attacks in Healthy people, even young people.And a few that have died, Suddenly. These folks had diabetes's but still fairly young.

    One woman who only lived at VOB for 6 months then fell ill quickly her immune system gave way to an infection of the sinus cavity and they had to remove the center of her face.

    She too only had diabetes's but died in September 2012 after a short harsh battle to her immune system.

    Another lady who is friend's with one of the people in these photo's, is now in hospice on her last leg in a battle

    with cancer. She was 47 when she moved into VOB.
